Chairman’s Message

Spring is here and the books are closed on this year's legislative session. As an Association you need to collectively pat yourself on the back - with a special pat for Myron! This was one of our most productive sessions in memory with the following success stories:

• Elimination of the Vehicle Damage Disclosure

• Extending from 30 to 45 days the time period required to provide title work

• Creating a method so electric motorcycles can be taxed and licensed

• Creating processes to allow for the rental of motorcycles

In addition to our successes, the Legislature and the Governor's office came to an agreement allowing for the desperately needed funding to repair our roads and bridges. We didn't survive this completely unscathed as our customers will now pay one percent more in excise tax when they purchase a vehicle and a bit more for the gas going into their new cars. Overall, it was a very good session that will benefit all of us for many years to come. Thanks again to everyone who made it happen!

President’s Message

It is nice to be back in Sioux Falls, nice to be home at night and nice to go to my office every day. Of course I make these statements because I just returned from the State Capitol where I have been representing your interests to the state legislature since the 12th of Janu-ary. As you have heard me say so many times, I look forward to the start of every legislative session, but when it nears the end I am VERY ready to have it end!

If you have been following my weekly legislative reports, you will already know that we had a great legislative year. This association submitted 4 bills for consideration and I am very proud to say that all four have been signed by the Governor.

SB 93 was submitted to create a method for motorcycles to be rented in the same way as cars are rented. We prevailed on this matter, in fact one legisla-tor formally commented that this should have been done many years ago. We agreed!

SB 94 was submitted to create a method to license electric powered motor-cycles. Since current law provides for the licensing of motorcycles based on the cubic centimeters size of the engine, there was no mathematical way to convert that methodology to an electric motor. The successful passing of this bill fixed this issue.

HB 1113 was our flagship piece of legislation for the 2015 Session. This bill finally fixed the issues we have had with our damage disclosure statutes for 25 years. I personally have been working on a resolution to this matter for the 14 years that I have worked for the SDADA. I actually drafted what became HB 1113 this year in the fall of 2012, but could not get all of the players on board until the fall of 2014. This was a total repeal of South Dakota's damage disclosure laws. There will be some administrative challenges in South Dakota dealerships regarding this huge change. For that reason, I will be issuing a guidance memorandum prior to July 1st when the old damage disclosure law finally goes away. Watch your mail for that memorandum and if you have ques-tions in the interim, please call me.

HB 1132 is another game changer for South Dakota Dealerships. Current law requires sellers, be they private parties or dealers, to deliver titles to the pur-chaser within 30 days of the sale. As of July 1st, that delivery time will be 45 days from the date of sale. Again, with this issue there will be some admin-istrative challenges in South Dakota dealerships regarding this change. For that reason, I will be issuing a guidance memorandum prior to July 1st when

NADA Director’s MessageOne of my mantras when I am working on a glass of good bourbon and a fine cigar is to "never allow the truth to derail a good story". It's usually good for a laugh. It's always justifies my embellishment!

Somehow though, it is not quite as funny when the Department of Justice abides by the same premise. In May 2009, the U.S. Justice Department looked at the economic effects of state franchise laws that ban on direct sales of vehicles by manufacturers to consumers. The au-thor of the Justice Department report, economist Gerald Bodisch, used the example of a direct sales model, a GM program in Brazil, whereby a consumer could order a Chevrolet Celta on-line. He opined about how wonderful this program was.

There was only one problem with this report - the program ended in 2006 because it was too costly. That is a full three years before the report by the DoJ was filed. This earned the Department of Justice four Pinocchios from the Washington Post.

Silly me. I did not expect that it would be acceptable for the Justice Department to embellish. I wonder what kind of bourbon Mr. Bodisch drinks. It would appear that it's something in the 100-proof plus range! Cheers!

CFPB's Richard Cordray Takes Tough Questions From Congress: I don't know if you've seen this video of Richard Cordray, director of the Consumer Financial Protection Bureau, testifying before members of Congress who expressed serious concerns about the CFPB’s guidance on dealer-assisted financing. It is worth a couple minutes of your time to see that the CFPB's behavior has garnered bipartisan dismay. (Watch Rep. Roger Williams (R-Texas), a car dealer, tell a story of what really hap-pens in the showroom.)

Members on both sides of the aisle noted that the agency has overstepped its jurisdiction and continues to ignore an impor-tant Charles River Associates study that questions the CFPB’s testing methodology. The flawed methodology is being used in the CFPB’s overreaching guidance of auto loans, yet Cordray refused to discuss the CFPB’s reasoning in dismissing the study.

NADA Supports Efforts to Disapprove NLRB Ambush Rule: In December, the National Labor Relations Board (NLRB) issued the "ambush" election rule which shortens the time between when union organizers ask for a union election and when that election must take place. The rule forces companies to allow these elections to occur as soon as 11 days after they're noti-fied. The rule's new timeframe limits an employer's ability to communicate with employees prior to the election. The rule also requires employers to provide, within two business days of an election direction, employees' personal telephone numbers and e-mail addresses.

NADA opposed this rulemaking in a number of ways, through filing multiple sets of comments and our involvement with the Coalition for a Democratic Workplace (CDW). CDW filed a lawsuit in the United States District Court for the District of Colum-bia to stop the implementation of this rule and coordinated multi-industry Senate and House letters in support of S.J. Res.8., which NADA signed. S.J. Res. 8 is a joint resolution nullifying this rule through the use of the Congressional Review Act. On March 4, the Senate approved S.J. Res. 8 by an almost party line vote of 53-46. The House is expected to take the measure up on March 18. The President's advisors announced on March 3 that they will recommend a veto of the resolution. Congress would need a two-thirds majority to override a presidential veto.

NADA believes that the current election timeframe is reasonable and allows employees to hear from both the union and the employer before making a decision. The NLRB's rule upsets this balance by putting employers at a disadvantage. the 45-day titling law goes into affect. Watch your mail for that memorandum as well and if you have questions in the interim, please call me.

Finally, there is SB 1 which is the highway needs funding bill. As you have heard on the news and/or read in the newspaper, tax on highway use fuels will be increased on April 1st. On that same date, the maximum speed limit on the interstate highways will be increased from 75 to 80 miles per hour. License fees will also see an increase on April 1st. Of most significant impact to dealers is the 1% increase in excise tax on the sale of high-way use vehicles. I am currently working on a memorandum re-garding the rollout of the excise tax rate change. Watch your mail for that to arrive at your dealer-ship soon.
