The Historical Problem

• Michigan generates approximately 10 million scrap tires annually.

• In 1991, an estimated 30 million tires were stockpiled in Michigan.

• Tire piles lead to environmental and public health issues –fires and mosquito borne illness.

How Michigan Chose to Address the Problem

• Regulate the Industry– Require acceptable management and storage– Require financial responsibility (bonding)– Landfill ban on disposal of whole tires– Create regulatory incentive to recycle tires– Create financial disincentives to store or dump tires– Identify and register industry members– Allow private enterprise to establish costs– Assist in development of viable markets, including grants

Regulatory Amendments

• Recent amendments went into effect January 15, 2015• Housekeeping issues• Definitions• Retailers must use registered, bonded hauler• Delivery of tires to a location with location’s consent• Allow owner or operator with property owner’s permission to

bond/register collection site or claim bond exemption• Scrap tires managed in compliance with Part 169 are exempt

from regulation as a solid waste under Part 115 and vice versa• Hauler registration fee and bonding• Hauler vehicle labeling requirements• Require maintenance of records by all entities

• Must be registered & bonded ($10,000) to haul more than 10 tires in Michigan

• Remove $500,000 cap on Market Development grants• Condense language on what funds may be expended for• Prohibits intentional open burning of scrap tires• Add penalties for falsifying registration application, grant

application or scrap tire transportation records• Allow seizure of vehicles used in illegal dumping


PROGRAM FUNDING

A $1.50 fee is collected by the Secretary of State on each vehicle title certificate transfer. The funding mechanism is established in the Motor Vehicle Code, not in the Scrap Tire Statute (Part 169).

Regulation Results

• Stockpile Clean-up– Pre-1991 stockpiles were reduced by over 30.5 million passenger

tire equivalents (PTEs) through Scrap Tire Clean-up Grants– An additional 9.2 million PTE have been cleaned up as a result of

compliance and enforcement – Increased compliance rates at most sites– Market capacity increase– Decrease in dump sites and stockpiles

GRANTS• Clean-up Grants (16908(2)(c))

– A continuing appropriately funded clean-up program to address abandoned scrap tires and tires collected prior to 1991

– A simple goal: to clean-up

• Market Development Grants (16908(2)(d) & (e))– For new or increased usage of scrap tires– Road, drainage, stormwater, plastics projects

• Law Enforcement Grants (16908(2)(f))– Equipment and training

Clean-up Grants

• Tires MUST be in Michigan• Money is used for clean-up or collection of abandoned scrap

tires and scrap tires at collection sites• Funding for community clean-up/drop-off days• MDEQ can also pursue clean-up of sites that post an

imminent danger • Priority to pre-1991 tires • DEQ can place lien on property

Market Development Grants

• Support the development of increased markets for scrap tires

• Available to reimburse up to 50 percent of the cost to purchase scrap tire, the cost of equipment, or for research and development

• Eligibility requirements:– Show new or increased use of scrap tires in manufactured

products rubber modified asphalt, molded or extruded rubber products, rubber in plastics, or aggregate replacement materials; or

– Be for research and development of methods to increase scrap tire usage

– Scrap tires MUST be from a Michigan processor or generator

ENFORCEMENT• Consistent Enforcement of the Statute results in a level

playing field for those voluntarily meeting the statutory requirements– Ensure delivery of scrap tires to approved locations only– Ensure strict compliance at scrap tire collection sites– Prevent new stockpiles– Pursue clean-up of illegal sites by responsible parties

• Periodic review of the Program and Statute to address changing needs

• Working with local Units of Government to raise awareness– Clean-up grants to fund Community Scrap Tire Collections

• Continue to find new uses for stockpiled and newly generated tires

• Scrap Tire Advisory Council (STAC) – Group of stakeholders that meet periodically to advise DEQ and serve as forum to address Program challenges

transportation costs• OTR – oversized tires – difficult to handle and process• Legislative changes to address evolving industry• Tires as resources not waste – education is key
