    Background/Justification:

    The purpose of this agenda item is to request the County Board to adopt Resolution No. 2016-127 to authorizestaffing and funding for a Drug Court and the establishment of a special account for this program.

    On May 31, 2016, in a workshop setting, the County Board of Commissioners reviewed the data and wereadvised that the Courts, County Attorney, Law Enforcement, Social Services, and Corrections had beenworking collectively to deal with the problems surrounding addiction and wanted to establish a Drug Courtalong the following criteria:

    An intensive 14 to 24 month sentencing alternative focusing on treatment of those who commitsubstance related crimes

    A specialized court docket providing the support, structure, and accountability addicts in the criminaljustice system need to find lasting recovery

    Post pleastay of adjudication

    Focus on high riskhigh need offenders Participants who successfully complete drug court and probation can have pending charges dismissed

    The Board was also advised that the goals for this specialty Court were:

    Reduce recidivism (future crime by participants) Prevent overdose deaths Reduce collateral damage against families and community

    Reduce costs to the criminal justice system and community Enable addicts in the criminal justice system to become productive, responsible members of their

    families and community

    In addition, the Board was provided an overview of the fiscal requirements (estimated at between $300,000and $350,000 on an annual basis); the potential funding streams (grants obtained from the State and FederalGovernment); and, asked to authorize:

    Establishing a Drug Court as a demonstration project for a minimum of 3 years beginning on or beforeOctober 1, 2106

    And, establishing a special fund by setting aside $900,000 from the Countys fund balance into aspecial account for the Drug Court

    The Board was further advised that regular (semi-annual) updates would be provided based upon theestablished measures. And, if successful, a decision would be made in 2019 to fund this specialty Court on amore permanent basis through the budget beginning in 2020.

    Staff recommends that the Board adopt resolution authorizing the staffing and funding of a Drug Court andestablishing a special account for this purpose.

    Fiscal Impact:$900,000 from General Fund to Special Account

    RESOLUTION NO. 2016-127; AUTHORIZING A DRUG COURT PROGRAMAND ESTABLISHING A SPECIAL FUND FOR THIS PURPOSE

    WHEREAS, On May 31, 2016; in a workshop setting the County Board of Commissioners reviewed thedata and were advised that the Courts, County Attorney, Law Enforcement, Social Services, and Correctionshad been working collectively to deal with the problems surrounding addiction; and

    NOW THEREFORE BE IT RESOLVED by the Board of Commissioners in and for the County of Scott,Minnesota, authorizes the staffing and funding for the implementation of a Drug Court program within ScottCounty.

    BE IT FURTHER RESOLVED that the Board of Commissioners authorizes Community Corrections tosubmit and accept grants from the Federal and/or State Governments to assist in funding and support for theDrug Court Program through the year 2019.
