Criteria for Granting Variances

Chapter 405, Section 405.40• Special conditions and circumstances exist which are

peculiar to the land, such as size, shape or topography, which are not applicable to other lands in the protected area;

• The special conditions and circumstances do not result from the actions of the applicant;

• The variance, if granted, is the minimum variance that will make possible the reasonable use of the land, building, or structure; and

• The variance is necessary to promote public safety.

• Approve the resolution authorizing a variance to the Scenic Road Corridors Overlay to allow a shed within the 100’ protection area setback at 1709 SW 49th Place.
