INTRODUCTION

Carl Simpkin owns 274ha along Glendale Heights, Kerikeri and seeks Resource Consent to subdivide off one rurallifestyle lot at 15.3ha, one bush block at 95.1 ha, and requests two amalgamation conditions.

The amalgamations include:Lot 5, an ingress strip is to amalgamate with another of the applicants titles RT NA54D/356 (Section 5 Blk XII).Lots 3&4 are the balance areas and would amalgamate with Lot 4DP 502376, also part of the balance title area.

The proposed subdivision is presented as a restricted discretionary activity under the provisions of the RuralProduction zone of the Far North District Plan.

It is proposed to form 3 independent single metalled entrances, each into Lot 1, Lot 2 & Lot 5.The remaining lots have existing farm entrances and form a single title area.

(s) Where a subdivision serves 9 or more residential units, access shall be by public road.There are no shared accesses.

The lots are able to provide adequate onsite parking and manoeuvring.

The proposal upholds the permitted activity criteria under Transportation.

The property has no known natural hazards onsite.

The property does not have any known HAIL inputs.

Water Supply

Potable water is obtainable through roof surface catchment and storage in water tanks.

An existing consent notice (CONO 10769203.2) includes requirements for firefighting water supplies and this wouldcarry forward to the new lots.

Stormwater

All lots are over 2ha not to require a stormwater assessment.Stormwater is effectively disposed within each lot without cause to adverse effects on adjoining properties.

Sewage

Effluent disposal on these sized lots is no concern, and a consent notice already exists on the title (CONO10769203.2) that a TP-58 report be prepared for any building activity.

Power & Telecommunication

Comments from services providers were not required.A consent notice exists (CONO 1 0769203.2), identifying that the lots were not reticulated with power or telephoneconnections and the cost to supply electricity would be at the landowner's expense. This would carry forward to theproposed lots.

There are no easements proposed or existing.

RURAL ENVIRONMENT

OBJECTIVES (Subdivision)

13.3.2 To ensure that subdivision of land is appropriate and is carried out in a manner that does not compromisethe life-supporting capacity of air, water, soil or ecosystems, and that any actual or potential adverse effects on theenvironment which result directly or indirectly from subdivision, including reverse sensitivity effects, are avoided,remedied or mitigated.

13.3.5 To ensure that all new subdivisions provide a reticulated water supply and/or on-site water storagesufficient to meet the needs of the activities that will establish all year round.

The proposal is considered to uphold the subdivision objectives and there are no particular policies of relevancedue to the low environmental impact associated with the activity.

8.6.3 OBJECTIVES

8.6.3.1 To promote the sustainable management of natural and physical resources in the Rural Production Zone.

8.6.3.2 To enable the efficient use and development of the Rural Production Zone in a way that enables people andcommunities to provide for their social, economic, and cultural well being and for their health and safety.

8.6.3.3 To promote the maintenance and enhancement of the amenity values of the Rural Production Zone.

8.6.3.4 To promote the protection of significant natural values of the Rural Production Zone.

8.6.4 POLICIES

8.6.4.1 That a wide range of activities be allowed in the Rural Production Zone, subject to the need to ensure thatany adverse effects, including any reverse sensitivity effects, on the environment resulting from these activities areavoided, remedied or mitigated.

8.6.4.2 That standards be imposed to ensure that the off site effects of activities in the Rural Production Zone areavoided, remedied or mitigated.

8.6.4.3 That land management practices that avoid, remedy or mitigate adverse effects on natural and physicalresources be encouraged.

8.6.4.4 That the intensity of development allowed shall have regard to the maintenance and enhancement of theamenity values of the Rural Production Zone.

The intensity of the proposed development is in keeping with the intent of the Rural Production zone where there isno limit on the number of rural lifestyle lots created at 12ha, and is in a manner that does not conflict with the intentof the wider components of the zone and affiliated Regional Policy Statement discussed below.

NATURAL AND PHYSICAL RESOURCES

There is no earthwork required to complete the subdivision other than forming entrance, and there is no need forvegetation clearance.

SUMMARY

In summary, the subdivision assessment criteria proves to be in line with the production zone intentions withoutcause to any unreasonable environmental effects either at the subdivision stage or proceeding development.

There is no depletion of productive versatile soil in fact the site is unique having an extensive composition of non-arable soils.

The proposal in in accordance with the restricted discretionary provisions, and almost complies with Controlledactivity standards.

RESOURCE MANAGEMENT ACT 1991

The subdivision of land falls under Section 218 the Resource Management Act 1991, and accordingly is required todemonstrate compliance with the provisions applicable to the activity and its status under the District Plan.

ASSESSMENT OF THE ACTIVITY AGAINST THE MATTERS UNDER PART 2 RMA

Part 2 Purpose and Principles

5 Purpose

(1)

The purpose of this Act is to promote the sustainable management of natural and physical resources.

(2)

In this Act, sustainable management means managing the use, development, and protection of natural and physical resourcesin a way, or at a rate, which enables people and communities to provide for their social, economic, and cultural well-being andfor their health and safety while-

(a) sustaining the potential of natural and physical resources (excluding minerals) to meet the reasonably foreseeable needs offuture generations; and(b) safeguarding the life-supporting capacity of air, water, soil, and ecosystems; and(c) avoiding, remedying, or mitigating any adverse effects of activities on the environment.

(a) the preservation of the natural character of the coastal environment (including the coastal marine area),wetlands, and lakes and rivers and their margins, and the protection of them from inappropriate subdivision, use,and development:

No concern.

(b) the protection of outstanding natural features and landscapes from inappropriate subdivision, use, anddevelopment:

There are no known outstanding natural features or landscapes.The SNA is not an outstanding landscape but is significant and according is to be managed with caution. Theproposal presents no adverse effects on the vegetation.

(c) the protection of areas of significant indigenous vegetation and significant habitats of indigenous fauna:

The applicant proposes protecting 6500rr12 of bush as defined by area labelled 'X' on the scheme plan.

(d) the maintenance and enhancement of public access to and along the coastal marine area, lakes, and rivers:

Not applicable.

(e) the relationship of Maori and their culture and traditions with their ancestral lands, water, sites, waahi tapu, andother taonga:

There are no known cultural or ancestral lands within the application site or adjoining.

The proposal is consistent with the plan.

There is no influence on Fisheries.

The proposal is considered to be sufficiently low impact in that regard, and in line with promoting the existingenvironment.

(f) the protection of historic heritage from inappropriate subdivision, use, and development:

There are no known historic heritage sites in close proximity.To provide a level of mitigation it is suggested that an advice note be included regarding that in the event futureearthworks uncovers artefacts that the interested parties be consulted, including Local Iwi and Heritage NZ.

(g) the protection of protected customary rights.

There are no known customary rights to consider.

Other matters

In achieving the purpose of this Act, all persons exercising functions and powers under it, in relation to managingthe use, development, and protection of natural and physical resources, shall have particular regard to-

(a) kaitiakitanga:(aa) the ethic of stewardship:

(b) the efficient use and development of natural and physical resources:(ba) the efficiency of the end use of energy:(c) the maintenance and enhancement of amenity values:(d) intrinsic values of ecosystems:(e) [Repealed]

(f) maintenance and enhancement of the quality of the environment:(g) any finite characteristics of natural and physical resources:(h) the protection of the habitat of trout and salmon:(i) the effects of climate change:(i) the benefits to be derived from the use and development of renewable energy.

The proposal is considered to adequately uphold all aspects without causing any unreasonable adverse effects.

The proposal aligns with the intentions of the Rural Production zone guidelines to allow for rural growth withoutdepleting the environment, in particular versatile soils, waterways, or wetlands.

Treaty of WaitangiIn achieving the purpose of this Act, all persons exercising functions and powers under it, in relation to managing the use,development, and protection of natural and physical resources, shall take into account the principles of the Treaty of Waitanqi

The proposal is not considered to contradict the Treaty of Waitangi's interpretations. There are no known treatysettlements associated with the property, and there is no Section 27B memorial on its certificate of title.

ASSESSMENT OF THE ACTIVITY AGAINST ANY RELEVANT PROVISIONS OF A DOCUMENTREFERRED TO IN SECTION 104(1)(B)

The intended use of Lot 2 would be to establish a family residences on a lifestyle bush block. The remaining blocksare rural

The impact of subdividing the property presents no unreasonable adverse effects as the sites are located in closeproximity to legal road, and various other existing lifestyle lots.

The proposal is not out of character or form and is compatible with the surrounding activities.

04 an assessment of the actual or potential effects on the environment of the activity.

There are no obvious adverse environmental effects arising from the subdivision activity.

(c) if the activity includes the use of hazardous substances and installations, an assessment of any riskto the environment that are likely to arise from such use.

Not applicable.

ld) if the activity includes the discharge of any contaminants, a description of -(i) the nature of the discharge and the sensitivity of the receiving environment to adverseeffects; and

(ii) any possible alternative methods of discharge, including discharge into any other receivingenvironment:

Effluent disposal would uphold high standards in accordance with TP-58 to ensure compliance with the NorthlandRegional Water and Soil Plan, as secured by existing consent notice.

(e) a description of the mitigation measures (including safeguards and contingency plans where relevant) tobe undertaken to help prevent or reduce the actual or potential effects:

There are no issues to address.

A requirement to include information in the assessment of environmental effects is subject to the provisions of anypolicy statement or plan.

The proposed Northland Regional Policy Statement has a particular interest .in protecting waterways and versatilesoils. These and other aspects are described under that heading below.

To avoid doubt, subclause (1)(f) obliges an applicant to report as to the persons identified as being affected by theproposal, but does not-(a)

oblige the applicant to consult any person; or(b)

create any ground for expecting that the applicant will consult any person.

The level of effects afforded by the proposal would suggest effects less than minor not to oblige consultation.

CLAUSE 7

7 Matters that must be addressed by assessment of environmental effects

(1) An assessment of an activity's effects on the environment must address the following matters:

(a) any effect on those in the neighbourhood and, where relevant, the wider community, including anysocial, economic, or cultural effects:

The proposal is considered to promote the Rural Production zone guidelines and surrounding land use, without anyunreasonable effects to concern the wider community including social and economic or cultural aspects.

(b) any physical effects on the locality, including any landscape, and visual effects.

The effects associated with the subdivision activity, presents no actual increase in effects on the locality, landscape,or visual displacement than that already anticipated for this property.

The subdivision does not result in any significant habitat disturbance.

(d) any effect on natural and physical resources having aesthetic, recreational, scientific, historical,spiritual, or cultural values, or other special value, for present and future generations:

The values outlined are not seen to be depleted in this instance.

(e) any discharge of contaminants in to the environment, including any unreasonable emissions ofnoise, and options for the treatment and disposal of contaminants:

There are none.

(1) any risk to the neighbourhood, the wider community, or the environment through natural hazards orthe use of hazardous substances or hazardous installations.

To the best of our knowledge there are no concerns.

(2)A requirement to include information in the assessment of environmental effects is subject to the provisions of anypolicy statement or plan.

The only relevant policy statement is the northland regional policy statement.

(3)To avoid doubt, subclause (1)(f) obliges an applicant to report as to the persons identified as being affected by theproposal, but does not-(a)- oblige the applicant to consult any person; or(b)

- create any ground for expecting that the applicant will consult any person.

The applicant is not considered to need to consult.

Amenity Values

The amenity values within this vicinity are rural based, and as a result of subdividing would not change from thatalready possible under permitted land use guidelines.

The impacts on amenity values are considered less than minor.

Cumulative Effects

The proposal seeks to achieve a practical use of the land, where currently it is vastly restricted for any potential landuse.

There are no cumulative effects because the actual level of effects are consistent with the plan provisions.

There are no concerns regarding traffic movements or noise. Sufficient access and entrance options are possibleand they meet chapter 15 transportation guidelines.

In summary, the proposal is considered an activity that provides for the landowners personal wellbeing through landdiversification, and is possible without cause to any significant adverse effects contrary to the purpose andprinciples of the Resource Management Act 1991.

NORTHLAND REGIONAL POLICY STATEMENT

The Northland Regional Policy Statement presents initiatives and guidelines for the northland region.

PART 3: OBJECTIVES

3.4 Indigenous ecosystems and biodiversitySafeguard Northland's ecological integrity by:a) Protecting areas of significant indigenous vegetation and significant habitats of indigenous fauna;b) Maintaining the extent and diversity of indigenous ecosystems and habitats in the region; andc) Where practicable, enhancing indigenous ecosystems and habitats, particularly where this contributes to thereduction in the overall threat status of regionally and nationally threatened species.

The applicant offers to protect an area of 6500m2 of mature vegetation,

3.5 Enabling economic wellbeingNorthland's natural and physical resources are sustainably managed in a way that is attractive for business andinvestment that will improve the economic wellbeing of Northland and its communities.

We need people and businesses to choose Northland as a place to invest, and our economic development needs tobe aligned with environmental outcomes.

The subdivision diversifies the land and provides rural lifestyle opportunities without affecting pastureland.

5.1.3 Policy - Avoiding the adverse effects of new use(s) and developmentAvoid the adverse effects, including reverse sensitivity effects of new subdivision, use and development, particularlyresidential development on the following:(a) Primary production activities in primary production zones (including within the coastal marine area);

The subject site is not 'primary production' land.

NATIONAL ENVIRONMENTAL STANDARDS

The property is not considered to be subject to the NES 2011 having never had any known HAIL use.

There are no other national environmental standards applicable to the application site and subdivision activity.

CONCLUSION

The subdivision is consistent with the Rural Production zone objectives and policies and demonstrates an adequatecorrelation with the wider environment.

The proposal is not deemed contrary to the higher planning documents, the Northland Regional Policy Statement,

showing a high level of compliance with the relevant policy framework.

The various actual and potential effects from subdividing demonstrates a balanced outcome absent of any

unreasonable impact on the environment.

The subdivision is considered to uphold Part 2, Purpose and Principles under the Resource Management Act 1991,

and outlines sufficient information to meet the requirements of Clause 6 and 7 of the assessment of environmentaleffects, to conclude a less than minor effect.

In consideration of the overall planning framework, the application is recommended to local authority for approval.

REGARDING RC2090661 Variation RC2090571

the Subdivision of Lot 6 DP 395695, Lot 3 DP 380602,Section 78 Blk XII Kaeo SD and Lot 2 DP 373894

PURSUANT to Section 221 and for the purpose of Section 224 (c) (ii) of the ResourceManagement Act 1991, this Consent Notice is issued by the FAR NORTH DISTRICTCOUNCIL to the effect that conditions described in the schedule below are to be compliedwith on a continuing basis by the subdividing owner and the subsequent owners after thedeposit of the survey plan, and these are to be registered on the titles of the allotmentsspecified below.

SCHEDULE

Lot 8 DP 422255

(i) Development of the site shall be undertaken in accordance with therecommendations of the Engineers Report prepared by PK Engineeringand dated May 2009. Development measures shall specifically include,but not be limited to, subsurface drainage to lower ground water levels andenhance slope stability.

(ii) When establishing a habitable bltilding, or any activity which requireswastewater disposal, the lot owner shall obtain a building consent andinstall a wastewater treatment and disposal system as detailed in thereport prepared by PK Engineering and dated May 2009. The cost of theinstalled system is $14,500 + GST. The costing is valid for a period of 6months from the issue of the 224(c) certificate. The ongoing operatjon andmaintenance of the system shall be covered by a maintenance agreementbetween the property owner and the system supplier or their authorisedagent

(iii) Any building shall have foundations specifically designed by a suitablyqualified Chartered Professional Engineer, the details of which shall besubmitted in conjunction with the Building Consent application.

(iv) Each dweiling shall have a roof water collection system with a minimumtank storage of 45.000 litres. The tank(s) shall be positioned so that theyare accessible (safely) for fire fighting purposes and fitted with an outletcornpatible with rural fire service equipment. Where more than one tank isutilised they shall be coupled together and at least one tank fitted with anoutlet compatible with rural fire service equipment. Alternatively, thedwelling can be fitted with a sprinkler system approved by Council.

(Viii) The lot owner shall preserve the living indigenous vegetation within thearea identified on the attached plan as Upper Pungaere Shrubland,P05/114; and shall not, without the prior written consent of the Council,and then in strict compliance with any cor.ditions imposed by the Council,cut down, damage or destroy that vegetation. Such consent may be givenin the form of a resource consent. VVhere practicable, the lot owner shouldexclude stock from entering the area identified on the attached plan. Theowner shall be deemed to be not in breach of this prohibition if any such

(vi) The lot owner shall maintain the stock proof fencing on their side ofthe water course forming the boundary between Lot 7 and Lot 11(including in the case of Lot 7, the area marked as 'Z' on the surveyplan).

(vii) Jay Road is a legal road not currently maintained by the Council. Theresponsibility for the maintenance of the Jay Road carriageway will bethe responsibility of all of the adjoining property owners who use theroad for access. [also applies to land within Lot 3 DP 380602]

(viii) Daroux Drive is a legal road not currently maintained by the Councilbeyond the end of the seal. The maintenance of the carriagewaybeyond the sealed portion is the responsibility of the property ownerswho use this section of road to obtain access.
