STATE BANK OF INDIA - FAMILY PENSION SCHEMEThen & Now

The Family Pension scheme was first notified by the Government Of India,for their employees, in April 1950. The scheme was improved from time to time.Initially the scheme was contributory. However, with effect from 22-9-1977, the schemewas made Non-contributory.

In State Bank of India there was no “Family Pension Scheme”. In view of this, MumbaiCircle Association, in 1980, requested the Bank to introduce ‘Family Pension Scheme’, on the linesof the scheme already in vogue for the employees/pensioners of the Government of India. Thereafterat the 9th Annual General Meeting of the Mumbai Circle Pensioners’ Association held on the20th February 1983, a resolution, as under was passed:-

“Resolution No. 7 : Family PensionWe note that Government’s approval to the introduction of the FamilyPension is yet awaited. Considering the rapid and worsening changesin the social life of the pensioners’ community, kindly pursue the issuetill its accomplishment.”

The above resolution and some other resolutions were incorporated in a letter dated17-3-1983 addressed to the Chairman of the Bank. This letter was signed by late Shri. L. N.Pabalkar as President of Mumbai Circle Association. In reply to this letter, the Bank advised asunder :-

“Family Pension:The matter was taken up with the Government, but the response fromthem is not at all favourable.”(Ref. Letter No. ADM/19520 of 20-5-1983 signed by the Chief Officer(Personnel/Admn.), State Bank of Inida, Central Office, Mumbai.)(Note: Those days Bank used to reply some important letters)

On behalf of Mumbai Circle Association, Shri P.S. Santhanakrishnan, was authorizedto attend the Bank’s Annual General Meeting of Share-holders, held at Bangalore on the 25th April,1985. In his speech, Shri. Santhankrishnan narrated the plight of Bank’s pensioners and theirfamilies. At the end, referring to the Government’s nominee, he appealed:-

“Most of our pensioners have already one foot in their grave. Whateveryou can do, please do it with expedition, so that they will have somerelief before they land both their feet in the grave.”

In view of the above, the Bank in August 1986, submitted to the Government arevised Family Pension Scheme. As in the past, this proposal also remained pending with theGovernment. Finally, our Federation took the decision of filing a Writ Petition in the SupremeCourt. Accordingly in 1987, on behalf of the Federation – a Writ was filed by “IBI Pensioners’Association - Delhi Circle/”. Only thereafter, in March 1988, the Government approved the Bank’sproposal with certain modifications. This was declared by the Bank on the 25th August 1988.

The Family Pension Scheme, as approved by the Bank, was on the lines of the Schemebased on 4th Pay Commission’s Report and based on the salary scales wherein D.A. upto 332points was merged in the basic pay of the employees. This has been clearly stated, as under, in theSupreme Court Judgement dated 23-2-1989.

“The present salary structure of the Bank employees is related to 332

points of CPI (1960 = 100) which means that the dearness allowanceupto 332 points is merged in the existing pay scales”.

The highlights of the Scheme, as approved by the Central Board of the Bank, in itsMeeting held on the 25th August 1988, are as under:-

Family Pension will be payable at the following rates:-Substantive Salary P.M. Rate of Family Pension(a) Rs.1500/- and below - 30% of substantive salary subject

to a minimum of Rs.300/- p.m.(b) Above Rs.1500/- 15% of substantive salary subject

to a minimum of Rs.450/- p.m. and a maximum ofRs.1,000/- p.m.

The maximum Family Pension was stipulated to Rs. 1,000/- p.m. when the salary scaleswere based on DA merger of 332 points. The highest salary that time was Rs.4800/- p.m. (forDeputy Managing Director). Therefore in his case maximum Family Pension works out to Rs.720/- p.m. Even then the maximum pension was stated as Rs.1,000/- p.m. The reason for this hasbeen explained in a letter No. PA:CIR:44 of 10-5-1990 addressed to all Local Head Offices by theCentral Office of the Bank. An extract from the letter is as under:-

Para 2 (ii) sub para 3 (d)“3 (d) – In case both the husband and the wife are governed by thescheme and one of them dies while in service after one year’spensionable service or after retirement, family pension in respect ofthe deceased shall become payable to the surviving husband or wife asindicated in paragraph 3(a) above, and in the event of death of theother, the eligible child shall be granted two family pensions in respectof the deceased parents subject to the limits specified below:i) If both the family pensions are payable at the rates mentioned

in paragraph 2(a) or (b), the aggregate amount of two pensionsshall be limited to Rs.1000/-:

ii) If one or both the family pensions are payable at the ratesmentioned in the provisos to paragraph 2, the amount of boththe family pensions shall be limited to Rs.1000/- or the maximumamount of family pension payable in respect of any one of theparents, whichever is higher, for the specified period.”

This Family Pension Scheme was effective from the 1st January 1986.The benefit arising out of the above scheme was extended to all widows/other eligible

Members, irrespective of the date of death (even prior to 1-1-1986) of pensioner/employee.Please note the following:i) Family Pension is payable only if the deceased employee was eligible for pension. If

the employee was not eligible/deprived of pension benefits, then his/her family willnot get benefits under this scheme.

ii) Family Pension will be payable even if the widow/widower is working in the Bank oncompassionate grounds, subject to other terms and conditions.

iii) Family Pension is payable to adopted child, provided the adoption is done throughCourt.

iv) To avoid any difficulty in calculating Family Pension due to non-availability of records,at our request, it has been decided by the Corporate Centre to sanction Family Pensionsimultaneously with pension of the employee. (Ref. C.O. Letter No. CDO/PM/CIR/13of 28-5-1996). Those employees who retired prior to 1-11-1993 are requested toverify their records and check whether family pension has been sanctioned to theirspouse. If not, immediately do the needful to avoid inconvenience to your spouseafter your death.

The rates for calculation of Family Pension were based on the salary scales wherein DAupto 332 points was merged in the basic pay of the employees. The spouses of those employeeswhose pensionable service ceased prior to 1-11-1987 are in receipt of Family Pension calculatedon the actual salary paid to the employees and as directed by the Supreme Court in the Judgementdated 23-2-1989. However, subsequently the salary scales were revised by merging DA upto 600points in Basic pay (1960=100). The Agreement to this effect was signed on the 10th April 1989.However the effect of this revision was given from 1-11-1987. Immediately thereafter our Federationrequested the Bank to revise the rates for calculation of Family Pension based on the new salaryscales. We, understand that the Bank recommended the revision to the Government of India.However, that proposal was not approved. On the contrary, it is said, that the Government directedthe Bank to calculate the Family Pension on the revised salary without any change in rates as wellas slabs. This resulted in reduction in quantum of F.P. Even the minimum family pension whichwas Rs.300/- p.m. was not raised suitably considering the further merger of dearness allowancefor 268 points (600 - 332 = 268). In Delhi High Court a case is pending on this subject. In case ofthose employees who retire now (i.e. even in 2005) the Family Pension is sanctioned on the salaryscales which was in force from 1-11-1987. (As if there is no revision in salary from 1-11-1987).This resulted in reduction in monthly gross family pension as compared to earlier retirees. Thereafteragain salary scales for the State Bank employees were revised on three occasions by merging D.A.in the salary scales upto 1148 pts., 1684 pts. & 2288 pts.

We have been demanding that the family pension should be calculated at 30% of substantivesalary (flat rate). Original family pension scheme is identical to the recommendations ofthe 4th Central Pay Commission’s report. Therefore only after implementation of the 5thCentral Pay Commission’s report we demanded as above. In this connection we reproduce anextract from the report of the 5th Central Pay Commission (para 134.8 of the report) -

“The existing rates of family pension which are linked to the pay drawnby an employee at the time of death while in service or retirementwould appear to be inadequate to cater to the needs of the family ofthe deceased employee/pensioner. Revision thereof is justified becausethere are certain fixed costs of an establishment which do not gethalved and the family continues to incur them even after the demise ofa Pensioner. There would also appear to be no rationale for prescribingdifferent percentages of family pension with reference to different payslabs because all families suffer equal hardships on the death of abreadwinner. Taking the above and other relevant factors intoconsideration, we recommend that the existing varying rates of FamilyPension (30%, 20% and 15%) may be replaced by a uniform rate of30% of pay for all categories of employees”.The above recommendations were approved by the Government of India and implemented

for the family pensioners of their employees.

Family Pension of those employees who retired in salary scale wherein DA upto 2288 wasmerged was being calculated on the salary scale wherein only 600 pts. were merged. In thisconnection both the Serving Staff Federations of the Bank in their joint notice dated 25-2-2006 forstrike stated that “Industry level formula” should be extended to family pensioners of State Bankof India.

In view of the above demand of Serving Staff Federations, in December 2007, the Bankextended Industry Level formula to family pensioners of State Bank of India. This new formulahas been made effective from 1-5-2005. We do not understand the logic for fixing this datethough the revision has not been made since 1-11-1987. In Banking Industry (other than SBI)Family Pension Scheme was introduced in 1995 effective from 1-11-1993 hence their scheme wasbased on the salary scales wherein D.A. upto 600 pts. was merged. However, as stated above ourscheme was based on the salary scales wherein D.A. upto 332 pts. was merged. This change ofbase has resulted in increasing the anomalies. Shocking part is that even now the Bank has notimplented this so called revised formula.

General expection is that after every revision, Gross Pension/Family Pension should increaseas compared to Pension/Family Pension when calculated on old salary.

Please refer to Annexure 1 from which you will observe that the figures stated in Col. No.4 are strictly based on the salary scale wherein DA upto332 pts. was merged. The gross Family Pension stated in this column is as per Supreme CourtJudgment dt. 23.2.1989. Gross Pension stated in column Nos. 5,6,7, & 8 is based on the revisedScheme as declared in December 2007, which is effective from 1-5-2005. However, so far no onehas received the arrears. Gross Family Pension stated in Col. No. 8 is less than the amounts statedin Col. No. 4 in respect of i) sub-staff, i i) clerical staff & ii i) OfficerJMGS-I. Slight reduction is seen in respect of spouses of employees who were in MMGS-III.Similarly, you will observe that there is reduction in gross family pension for all categories statedin Col. No. 5 when compared with Col. No. 4. Further, except for 2/3 higher categories there isreduction in gross family pension stated in Col. Nos. 6 & 7 when compared with Col. No. 4. Canthis be called as “Revision”? This so called ‘revision’ has taken place after 20 years. During thisperiod salary and gross salary has considerably increased. However gross family pension hasbeen reduced.

As per the illogical revision based on the existing salary scales (2288 pt D.A. merger),Spouse of the Subordinate Staff receives Rs.79 per day and spouse of the highest executive of thebank receives Rs.206/- per day. It is expected the spouse of the pensioner should maintain thestatus which was prior to the retirement of the employee.

In view of the above we have been demanding that the rate of calculation of familypension should be 30% (flat rate) of pensionable pay for the reason stated in the extract quotedabove.

In this connection we reproduce for information of readers an extract from a letter No. 83of 2006/07 dt. 5/2/2007 addressed to the Chairman of Bank by the Federation of State Bank ofIndia Pensioners’ Associations.

“The terms and conditions for sanction of Family Pension under Rule23 (5) are to be approved by the Central Board. In other words, byvirtue of Rule 23 (5) the Central Board has already been empoweredby the Central Government to sanction Family Pension on such termsand conditions as the Central Board of the Bank may deem fit andproper. Such power has already been delegated to the Central Board

by the Central Government by virtue of rule 23 (5) after the same hadbeen framed in consultation with the Reserve Bank of India as mandatedby Section 50 of the State Bank of India Act, 1955. Therefore, in ourview, it is not at all necessary for the Central Board to once again gothrough the process of consultation and/or sanction at least in so faras the revision of the State Bank of India Family Pension scheme isconcerned.”

In the light of the above, we once again request you to kindlyconsider our reasonable request which is nothing but a request forsocial justice and which is based on the recommendations of the 5thPay Commission.

Further, we also reproduce below an extract from the Supreme Court Judgmentdated 23-2-1989:-

“Now, the inspiration for the introduction of this Family Pension Schemeas a welfare measure for Bank employees comes from an identicalfamily pension scheme recommended by the Commission. This becomesevident on a perusal of the recommendations contained in paragraph6.8 of Chapter VI, Part II, of the Report.”

Besides we also reproduce an extract from letter No. CDO/ PM.16/SPL/29 of the19th April 2006 addressed to Shri Vinod Rai Special Secretary/(Financial Sector) Government ofIndia, New Delhi by the State Bank of India, Corporate Centre, Mumbai.

“It may be observed that the Central Board of the Bank is competentto revise the rates and terms and conditions of the Family Pension inthe Bank.”

Inspite of the above position Bank instead of revising entire Family Pension Schemew.e.f. 1-11-1987 which was based on D.A. merger of 332 pts. preferred to adopt the inferiorScheme introduced in other nationalized banks. (Base 600 pts. D.A. merger). While finalizing thelatest revision, care has not been taken by the Bank to retain the principal as stated in Bank’s ownletter dated 10-5-1990 (details explained above) about the ceiling (viz. Rs.1,000/- p.m.) applicableto Family Pension at that time (i.e. prior to 1-11-1987). This ceiling should have been suitablyincreased after every salary revision.

In view of the above we have repeatedly requested the Bank that the rates for calculationof Family Pension should be only 30% (flat rate for all) of pensionable pay.

This would remove all the anomalies and family pensioners will receive modest familypension.

As the bank has not responded to our repeated requests we were compelled to take legalrecourse. Accordingly a Writ Petition No 5904/2007 in Nagpur High Court has been filed inDecember 2007 by few affected family pensioners and Mumbai Circle Association.

In view of the above it is necessary to scrap the revised rates declared in December 2007.Family Pension should be calculated at 30% of pay (flat rate). It is also necessary to pay thearrears from 1-11-1987 as from that date the revision is due.

Stones can be formed anywhere within theurinary tract i.e. within the kidney, urether (the tubedraining urine from the kidney) or in the bladder.Urinary stones can be of various shapes and sizes.

The first symptoms of urinary stones is oftensudden severe pain usually in the back and sideof the kidney area, or in the lower abdomen. Othersymptoms may include vomitting, blood detectionin the urine, burning sensation while urination orsudden blockage of urine.

Any patient having any of the abovesystoms must immediately undergo a sonographywhich will perfectly diagnose the disease. Pleaseremember that disappearance of pain doesn'tmean that the stone has gone away. A sonographyis a must.

On diagnosis, urinary stone can be treatedsafely by different techniques, depending uponsize and location of the stone. Lithotripsy (ESWL)is a non-operative technique where stones arebroken into small fragments by Electro-magneticwaves created by a machine called"LITHOTRIPTER" and those fragments arepassed by over a period of time by urinating.

Endoscopic procedures like URS & PCNLare ideally suitaed for stones of large sizes and iftheir location is complicated.Gall Stones :

The gall bladder is a pear shaped organthat rests under the liver. It stores the bile joicesecreted by liver and contracts periodically to forcethe bile into the intestine.Please note that gallbladder has no role in the manufacturing of bile. Itjust stores the excess bile manufactured by theliver. Due to some chronic infection, the gallbladder walls get damaged resulting in thereduction or loss of contractile power leading tostagnation of bile and gall stone formation. Gallstones can occur to anyone but it is common inover-weight females of middle age.

People with gall stone may have problemsof indigestion usually a rich & heavy meals. Acidity,nausea, vomitting and feeling bloated may beother complaints. Sometimes, there may besevere right side pain in the abdomen along withhigh fever. If there is a blockage of bile due to gallstones, then may get obstructive jaundice, whichis a life threatening condition and may requireemergency treatment.

Laproscopic Cholecystectomy, popularlyknown as 'Lapchol', has now become the treatmentof choice for gall stone patients, where throughsmall punctures laproscope is passed into theabdomen and gall bladder along with stones isremoved. Removal of gall bladder doesn't causeany side effect, it is as good as removing tonsilsor appendix.Enlarged Prostate :

Prostate is a male sexual gland, presentjust below the bladder, surrounding the urethera.The prostate slowly starts to increase in size afterthe age of 50. In most of the conditions it is abenign growth, but as per international standardsone must himself get checked for prostate canceronce every year after the age of 50 years.

The symptons of enlarged prostate areinability to urinate or difficulty in starting urine flow.Increased frequency of urine, especially at night,weak or interupted flow of urine. Inability to

completely empty the bladder with feeling orurgency.

Holmium Laser Enuclation of prostate orHOLEP is a latest technique used in themanagement of enlarged prostate. In thisprocedure a 550 micron fibre attached to a 100watt Holmium Laser machine is used to removeobstructive prostate tissue and seal blood vessels.The enucleated gland is pushed into the bladderand then sucked out with the help of an equipmentcalled a morcellator.

Holmium Laser treatment has manyadvantages over the conventional TURPprocedure. In laser treatment any size gland canbe operated upon, the operation procedure isalmost bloodless and the incidence ofcomplications like erectile dysfunction, urethralstricture and urine incontinuous are much lesscompared to TURP. Holmium Laser treatment ismore safer option for high risk and elderly patients.Gynaecological Diseases (Women related)

Diseases related to women reproductiveorgans i.e. uterus, tubes and ovaries like heavyperiods, uterine fibroids, polyps, infertility, ectopicpregnancy, ovarian cysts, stress urinaryincontinence, pain during periods or irregularcycles can be treated by LaproscopicGynaecology or by key-hole surgery. Here tissuemorcellation plays a very important role wheremultiple or huge fibroids or uterus need to beremoved.

All laparoscopic procedures like URS andPCNL for urinary stones, LAO CHOL for Gallstones, Laproscopic hernia repair, Laprascopicappendixectomy, Holmium Laser treatment forenlarged prostate have overcome almost all thedisadvantages of open surgery like hospital stay,severe blood loss needing blood transfusion, longugly operative scar, prolonged recovery period orrisk of hernia at scar site.Conclusion :

MEMORIES OF GOA LIBERATION DAYI was 17 years old when Goa was liberated

on 19th December 1961. After arrival at my school(Loyola H.S.) in Margao that morning by "carreira"(mini-bus) as usual, I was surprised to see a com-pletely deserted look everywhere in Margao city.With no hope of transport of any kind, I walkedfrom Margao to my village in Verna, nearly 15 kms.All along the road, I could hear occasional burstsof AKF guns at a distance, loud explosions ofbomb blasts that were kept by the Portuguese atstrategic bridges and culverts to slow down theadvances of Indian army.

The Portuguese dictator Salazar had givenstanding orders to the last Governor of Goa "Goaninguem conquistara, por si acabara" i.e. in caseof defeat (Goa will not be conquered by anyone,will perish on her own). Fortunately for us, the lastGovernor was a good hearted and understandingman. He disobeyed the orders and surendered toIndian authorities on 18.12.1961. In the meanwhile,the anti-aircraft fire was from the only Portuguesewarship "Afonso de Albuquerque" that was at an-chor in Mormugoa Harbour. By their historical tra-ditions, it refused to surrender inspite of ceasefireand white flags everywhere. The warship took shel-ter among other commercial ships lying in theHarbour. Its vigorous firing at the IAF aircraftszooming overhead posed danger to the IndianArmy about to enter and spread out at installa-tions overland, besides endangering other com-mercial ships around it. The Indian Task Force atDelhi had given orders to capture it intact. But dueto this nuisance value that it created to the Indianauthorities, Indian frigates "Betwas", "Beas" andINS Cauvery engaged it giving final warning shotsasking "Afonso de Albuquerque" to surender. Thereply was only desperate gunfire after gunfire.Having been mauled and after some casualtieson its board, it gave up the fight. The Indian Navyboarded the frigate on 21.12.1961. It was repairedand refloated on 10.03.1962, auctioned for scrapin June 1965 for Rs. 7.71 lacs only.

Only one Portuguese Bank was operating itsbranches in Goa i.e. Banco Nacional Ultramarino

(B.N.U.) of which State Bank of India is the suc-cessor. Apprehending ground realities and underOrders, B.N.U. shifted entire pawned gold orna-ments to Lisbon in time. However, the full stock ofPortuguese currency notes from B.N.U. chestswas ordered to be burned with kerosene. In theconfusion, those of the staff who were assignedduties of burning the notes, whether they burnedthe entire lot, is a mystery. Such opportunities arerare.
