Subject : Enhancement in the Age of Superannuation of Principals / Teachers / Physical Education Persons working in Higher and Technical Education field.

Whereas, the Government of India in Ministry of Human Resource Development

Department of Higher Education, New Delhi, has issued a letter No. 1-32/2006-U.II/U.I(i) dated 31st December, 2008, regarding Scheme of revision of pay of teachers and equivalent cadres in universities and colleges following the revision of pay scales of Central Government employees on the recommendations of the Sixth Central Pay Commission, for revision of pay scales of teachers and equivalent cadres in the Central Universities.

AND

Whereas, Government of India has mentioned in the above letter dated 31st December, 2008 that the scheme may be extended to Universities, colleges and other higher educational institutions coming under the purview of State Legislatures, provided State Governments wish to adopt and implement the scheme.

AND

Whereas, the Government of Maharashtra in Higher & Technical Education Department, Mumbai, has issued Government Resolution No. NGC 2009/(243/09)-UNI-1, dated 12th August, 2009, regarding Revision of Pay Scales of teachers and equivalent cadres in Higher Education as per UGC Scheme ( 6th Pay Commission), for teachers and other equivalent cadres of library and physical education in all the Universities, Colleges and other higher educational institutes coming under the purview of state legislature through the department of Higher and Technical Education of Maharashtra and governed by the rules of University Grants Commission.

AND

Whereas, the above Govt. Resolution dated 12th August, 2009, of Higher & Technical Education Department, Mumbai, is implemented, vide Direction No. 21 / 2009, dated 17-9-2009, by this university.

AND

Whereas, it is mentioned in the above Government Resolution dated 12th August, 2009 at para 1.2 that the Government after considering all the aspects has decided to revise pay scales and the dearness allowance of all teachers and equivalent cadres w.e.f. 01/01/2006 as per the Central Government (UGC) scheme while other allowances as per the State Government employees; to keep the age of superannuation and leave package unchanged and to take all necessary steps for improving the quality of education for meeting the requirements of the globalised economy and serious concerns expressed by the Hon. High Courts with regards to the poor quality and low employability of education.

AND

Whereas, the Government of Maharashtra in Higher & Technical Education Department, Mumbai, has issued Government Resolution No. SPC-2010 /(34/10)/TE-2, dated 20th August, 2010, regarding Revision of Pay Scales of Teachers and equivalent cadre in Degree / Diploma Level Technical Education as per AICTE Scheme (6th Pay Commission).......Dr. Babasaheb Ambedkar Technological University, Lonare, University Departments, All University Affiliated Government and Non Government Aided Colleges & MSBTE affiliated Government and NON Government Aided Polytechnics conducting Professional Degree / Diploma Courses such as Engineering, Pharmacy, Architecture, Management etc.

Whereas, following para is mentioned under the heading ‘RESOLUTION’ in Government Resolution dated 20th August, 2010. “The Government after considering all the aspects of the scheme announced by the All India Council for Technical Education vide its notification in reference 3 & 4, has decided to revise pay scales and Dearness Allowance of all teachers and equivalent cadres working in Government and non-Government aided institutions w.e.f. 01-01-2006 as per the provision of the scheme with additional provisions prescribed in para-8 of this resolution for enhancing and improving the quality of education. The other allowances applicable, the age of Superannuation and leave package to the teachers and librarians in these institutions shall be as per the State Government Employees.”

Whereas, the above Govt. Resolution dated 20th August, 2010, of Higher & Technical Education Department, Mumbai, is implemented, vide Direction No. 63/2010, dated 20-10-2010, by this university.

AND

Whereas, Government of Maharashtra in Higher and Technical Education Department issued Government Resolution No. Sankirna-2010/(503/10)Vishi-1, dated 5th March, 2011, for Enhancement in the Age of Superannuation of Principals / Teachers working in the State in Higher and Technical Education field, as recommended by UGC and AICTE.

AND Whereas, the above Govt. Resolution dated 5th March, 2011, of Higher & Technical

Education Department, Mumbai, is implemented, vide Direction No. 38/2011, dated 11-8-2011, by this university.

AND

Whereas, Government of Maharashtra in Higher and Technical Education Department & Director of Education (Higher Education), Pune issued following Government Resolutions, Govt. Corrigendum & Govt. Letter, regarding Enhancement in the Age of Superannuation of Principals / Teachers / Physical Education Persons working in the State in Higher and Technical Education field, as recommended by UGC and AICTE.

Whereas, the University has to initiate action to frame suitable Statute, under the provisions of Section 51 of the Maharashtra Universities Act, 1994, to implement the Scheme of Enhancement in the Age of Superannuation of Principals / Teachers / Physical Education Persons working in the State in Higher and Technical Education field.

Whereas, the matter is of urgent nature and framing of Statute is likely to take some time, it is necessary to issue direction in this regard. Contd...

Therefore, to give immediate effect to the provisions contained in the above mentioned

Government Resolutions (1) dated 5th March, 2011, (2) dated 23rd Nov., 2011, (3) dated 1st Dec., 2011, (4) dated 28th Mar., 2012 & Govt. Corrigendum dated 23rd Feb., 2012 and Letter dated 30th Dec., 2011 of Director of Education (Higher Education), Pune, I, Dr. Mohan Khedkar, Vice-Chancellor of Sant Gadge Baba Amravati University, under powers vested in me vide Section 14(8) of the Maharashtra Universities Act, 1994, hereby issue the following directions.

1. This direction shall be known as ‘Enhancement in the Age of Superannuation of Principals / Teachers / Physical Education Persons working in Higher and Technical Education field, Direction, 2012.’

2. This direction shall come into force from the date of its issuance. 3. The Direction No. 38 / 2011, dated 11-8-2011, is hereby stands repealed. 4. Following Government Resolutions, Govt. Corrigendum & Govt. Letter are implemented by this Direction and are enclosed herewith as under......
