AB 5 (Gonzalez)

Adds to existing law resulting from the decision in the Supreme Court case on Dynamex Corporations West that creates a presumption that a worker who performs services for a hirer is an employee. The bill would clarify its application to independent contractors. Would exempt specified professions from these provisions and instead provide that the employment relationship test for those professions shall be governed by the test adopted in case law if certain requirements are met. Expresses legislative intent to ensure basic rights and protections of misclassified workers and would therefore restore their protections.

Would require, commencing with the 2022-23 school year, school districts offering kindergarten and charter schools serving pupils in primary grades to implement at least 1 full‑day kindergarten program. Would provide that a minimum school day for full‑day kindergarten is the same number of minutes per school day that is offered to 1st grade pupils. Intent of the Legislature that 1st priority for implementation of full-day kindergarten before 7/1/22 go to schools receiving federal Title I funds. Establishes 180 minutes as the minimum school day for kindergarten shall be 180 minutes if the governing board of a school district has prescribed a shorter length due to lack of school facilities that requires double sessions.

SB 234 (Skinner)

Would require a large family child care home (FCCH) to be treated as a residential use of property for purposes of all local ordinances. Would also make void an attempt to deny, restrict, or encumber the conveyance, leasing, or mortgaging of real property for use or occupancy as a FCCH and a restriction related to the use or occupancy of the property as a FCCH. Would prohibit a property owner or manager from refusing to sell or rent or refusing to negotiate for the sale or rental of, or otherwise making unavailable or denying, a detached single-family dwelling, a townhouse, a dwelling unit within a dwelling, or a dwelling unit within a covered multifamily dwelling in which the underlying zoning allows for residential use to a person because that person is a FCCH provider. Would require the CDSS to notify applicants for family daycare home licenses that specified housing discrimination remedies are available to a FCCH provider, FCCH applicant, or person who is claiming that any of these protections have been denied. Specifies requirements for Fire Marshal to regularly update regulations relating to the fire and life safety systems in family daycare provider homes. and provide guidance on implementing updates.

Would, commencing 7/1/20, or when the CDSS notifies the Legislature that the Statewide Automated Welfare System can perform the necessary automation for this purpose, whichever date is later, require a county to provide an applicant with immediate childcare assistance for their child if the county determines at the time of application that the applicant is apparently eligible for CalWORKs aid, and (1) the applicant has verification of a job or a job offer and needs childcare assistance in order to maintain or obtain employment or (2) the applicant needs childcare assistance in order to attend an educational or training activity. If an applicant chooses childcare services exempt from licensure and require trustline registration, would require the county to issue childcare payments only after the provider has become a registered trustline provider.

o How many children/families fall into this relapse, in terms of family that enter the systemand then come back?

i. 8% within the first year come back to our services.o What are the major causes of children being pulled from families?

i. The largest reason is general neglect. Primarily the drivers are parental substanceabuse, criminal and mental health issues, and domestic violence between parents.

o Does San Diego County's huge homeless community have an impact on your services?

i. Homelessness does not equal neglect. However, there is often times an impact onthe child, so we work directly with families that are homeless and we have a coupleof different housing programs. We have federally funded vouchers that work likesection 8 where you keep it as long as you need it. There are only 100 of thesetypes of vouchers. There are 100 substance abuse treatment vouchers that familiesget to keep for 2 years. Also offer a program called Bringing Families Home, whichis a rapid rehousing model and a housing first model. There are 100 of thesevouchers which last 12-18 months. This program started about 2 years ago. Thisprogram has been very successful, so we will ask for an increase in funding over thenext couple of years.

Time Item Topic and Description i. CWS is a social services system housed under a legal system. It is governed by 2

sets of legal codes and must follow the penal codes just like law enforcementwhenever we are investigating allegations of abuse and neglect. We follow thesame procedures around the investigation such as filing for search warrants. It isvery rare that we can actually remove a child right on the spot. We must file forprotective custody in court and get a judge to authorize the removal of the child.Otherwise, we violate people’s 4th amendment rights. Once a child is removed, weare governed by the Welfare Institutions code which are codes in California thatgovern the child welfare systems and how we operate. A judge is always overseeinga decision we make.

o LPC talked about how it would be really amazing to have a model that has a housingvoucher that comes with a child care voucher so that the family has stable housing and asafe and secure place for their children to stay while they go look for work, substanceabuse counseling, etc. Looking into how we can partner with agencies that are providinghousing vouchers.

a) LPC Guest: Connie White from WestEd – Introduced herself as the Regional Coordinator thatoversees PITC Partners for Quality training in San Diego. Currently have 4 infant toddler specialists.A budget that allows us to come out to programs that work with 0-3-years old. We have a brand-new seminar – Social Emotional Seminar – which is free to attend. It will provide updatedinformation to Infant Care Teachers. Will also attend October’s LPC meeting as well. Would love tochat with LPC on efforts of quality care in San Diego.

b) S. Lynn – Robyn Layton, Educational Enrichment Systems’ CEO & President was nominated to serveon the Governor’s Early Childhood Policy council. Very excited!

c) A. Arguilez - There were several of us that applied for the Early Childhood Policy council, so this is atremendous opportunity for our region to collectively elevate our voice and begin talking about themessaging across all of our different funding streams. This takes into account the creation of theEarly Childhood Master Plan with the State in addition to the recommendation that came out fromthe Blue Ribbon Commission on early childhood. Received an endorsement from First 5 Association.There are 4 seats at Senator Atkins office and Governor Newsom has 14 seats. It is really importantto get our local leg to appoint folks from San Diego County. It is highly competitive.

d) D. Boles – Reminder that Sept 30 is the deadline to apply for the San Diego Cares Program. This isyour staff’s opportunity to earn up to $9000 per year for continuing education. This last year, thePD option was added so that staff can get up to $300 for completing PD hours. Marcela will be thepoint of contact with any questions. A flyer and applications will be passed around.

10:50 7 Local Planning Council (LPC) Coordinator Updates a) AB377 Pilot Reimbursement Rate status

• On Friday evening, received a phone call from CDE stating our pilot rates are looking good. Theyrequested a letter of intent from each contractor that is participating. They will send an emailout to all within SD County who are participating in AB377 today. D. Martinez will follow-upwith an email and include a Letter of Intent for contractors to submit. This letter of intent is toconfirm that the number of cdes each contractor is willing to target within their program. Manyof the individuals Dez has been working with at CDE are new to the department and they areworking to understand the complexities of this process.

• R. Richardson commented that having unpredictable funding creates unpredictable qualityoutcomes. Agencies can’t give salary raises until funding is confirmed. A recommendation tomake the program more effective is to ask the CDE “Is the intent to fund programs 3 monthsinto the fiscal year?”. D. Martinez stated a letter can be sent regarding this and share howdifficult it has been receiving funding changes so late in the year. We would not the first countyto do this.

• The new rates will be retroactive to July 1, 2019.• Send an email to D. Martinez regarding challenges with CFA so that the information can be

compiled and sent to CDE.b) Quality Assurance Survey Results

d) Needs Assessment Report• The Needs Assessment report is due in January 2020. With the new Preschool Development

Grant, CDE is working on new ways to collect data and plan to provide a template report foreach county. Requested an extension on the due date in order to use the state’s new templatebecause it is more relevant. Waiting on a response from CDE regarding this extension. In themeantime, we must move forward with the report until a response is received.

• A copy of the Needs Assessment report was provided as a handout and reviewed. This reportcontains 2016 data because this is the only data available. There are some updates that need tobe made to the report. D. Martinez will send the revised report to the Needs Assessmentcommittee when complete

• If the extension is not approved and the report must be submitted using the old data, D.Martinez would like to create a letter to send to CDE informing them that the report’s data isnot relevant to San Diego County community.

11:10 8 Reports from Community Partners a) First 5 Commission – Alethea Arguilez

o August 16, CDA hosted a site visit to the Hilltop Center for our IMPACT Funds. Chris Perryjoined and our commissioner Kristina Hassen. Camille Maven and Todd Gloria also joinedthe visit.

o A. Arguilez has been called to serve on a new advisory board as a community voicerepresentative.

o First 5 Strategic Plan was approved in April.o Cal Berkeley is leading a study and they contacted SD County to see if we are interested in

doing an oversampling. First 5 Commission is interested in supporting this and invitingothers to join. There is going to be an incentive to complete the surveys. It will take time forthem to publish the study. Looking at 2021. If you are interested in supporting as a fundingpartner, please talk to A. Arguilez. Looking for about $5000 but if you are willing to provideanything please reach out.

b) County of San Diego – Patty Bakero Stage 1 child care. New regulations coming out. Legislation passed over the summer. Stage

o Received a contract from the Children’s Bureauo Recently published a child care supply map on the website on YMCA.org and search for the

child care supply map.o Fully participating in the community information exchange with 211.o Participating in a few pilots: in North County, anyone that calls our R&R line, we are

providing an enhanced list to callers to help them find placement in open slots. Anotherpilot for having the 800 line get routed directly to an R&R consultant to understand all oftheir child care options in their area.

o As summer closes, we are collecting success stories for the children that received vouchers.Kids got to go to camp, etc.

c) Public Policy:a. Last weeks meeting did not meet quorum. The committee did look at a few bills that are

still on the radar. For AB 1004, you may have received an email to be apart of this if youhave not signed up already. This is a direct linkage to our healthy development at First 5

b. Senate Bill 234 was approved, that affects our child care homes. This is regarding housingprotection and zoning laws. Goes into effect January 2020. It eradicated the zoning andlicensing fees. There are big restrictions on landlords and some protections against HOAs.With this bill, all of the large licenses must have the fire protection standard. Looking tostandardize the fire protections.

c. AB 1001 – it was proposed but it is being held under submission. It may come back at alater time.

d. Requesting a co-chair for Public Policy due. Please let Alethea know if you are interested.e. The Y is launching a Safe Sleep program.f. D. Boles added that there will be a Safe Sleep training at Rady’s on November 5. Please go

NA 4 Public Comment (regarding agenda items): 9:07 5 Local Planning Council (LPC) Coordinator Updates:

a. AB377 Update a. Received an updated template from CDE. They collaborated with Ca Department of

Finance. Expansion funds cannot be included in the pilot reimbursement rate. They calculated the COLA into the reimbursement rate.

b. The rates will be retroactive to July 1, 2019. b. Needs Assessment and Child Care Plan timelines

a. Through the preschool development grant (PDG), there is a lot of work being done at the state and they are working on developing a new template for needs assessment. We can put in a formal request to extend the timeline. D. Martinez is waiting for a response from CDE and will let EC know if the extension is approved or not. As of now, the NA report needs to be completed by Jan 2020 and the Child Care Plan needs to be completed by Jan 2021.

b. D. Martinez suggested adding this to the LPC meeting for September 23 for information sharing because it needs to go to the County Board of Supervisors for approval which could take up to three months. D. Martinez will review the LPC rules and confirm if it needs to go to LPC for voting.

c. AIR data – 2018 data is still not in. The 2016 data is the available. d. The NA will need the report as soon as possible, so they can draft a letter to send to

County BOS with the report. e. D. Martinez will pull the report together and share with LPC.

9:37 6 Update on committee progress since last meeting – Child Care Plan Committee Chair: a. Presentation to San Diego Foundation about the Child Care Plan will be on September 23.

9:56 7 Update on committee progress since last meeting – Needs Assessment Committee Chair: a. M. Soltero provided the update on behalf of R. Michelson. NA committee is asking LPC

members to help brainstorm ideas to close the gaps in the Zip Code Priorities Survey. This can include additional local data sources.

b. Other ways for us to close the gaps on the Zip Code Survey – Right now that’s the only info we get until we have other intensive needs assessment. This question has been posed for a long time. Waiting to see if an extension will be granted for the report due to CDE so that the new template can be used.

c. Next meeting will be held on September 23, after LPC meeting.

10:13 8 Update on committee progress since last meeting – Public Policy Committee Chair a. The PP committee did not have a meeting in August. The next meeting will be held today,

9/16/19. Potential co-chair is a topic of discussion.

10:14 9 Information and Discussion: a. Attendance Review – Absences

a. Reviewed the LPC attendance tracker for absences. Warning letters/emails will need to be sent to any members with 2 or more absences from full LPC or their committee.

b. Review 2020-21 Membership List a. Membership committee proposed that a few members that have 2 or more

absences be moved to an Alternate role for 20/21 term. These members will receive a letter regarding their attendance and the proposal for them to be moved to an Alternate for the 20/21 membership term.

b. What was the process for Denying an application? Applications that may have been denied were due to the following reason:

i. Did not live or work in San Diego County ii. Vendors

iii. Multiple applicants applying from same agency iv. Incomplete applications

c. Applicants that were not accepted will receive a letter or email and will be informed they are welcome to attend LPC meetings as a guest any time.

c. What data are we looking to obtain? - discussed above in Needs Assessment update d. Rick Michelson – Ideas for closing the gap on the Zip Code Survey – discussed above in

Needs Assessment update. e. Strategic Plan Planning – begin planning for Jan 2020 meeting – move to top of EC agenda

for October. f. Workforce Study – San Diego Participation

a. First 5 made a commitment to the study with Cal Berkeley. D. Martinez will be the point of contact for this study.

b. Reached out to several potential funding partners. NHA declined due to other research projects they have going on. YMCA CRS and MAAC are onboard. Will have a call with MAAC’s new Chief Operating Officer tomorrow to give more information.

10:30 11 Next EC Meeting Agenda Items: a. Strategic Plan – Are two separate plans (LPC Strategic Plan and a Child Care Plan) needed?

10:40 12 Announcements: a. A. Arguilez shared that First 5 SD met with the UCSD Mother’s Milk Bank, Dr. Lisa

Stellwagen. They received a sizable gift to build a 3000 sq. ft. warehouse for breastmilk donations to occur here in San Diego County. Their grand opening is slated for Spring 2020. They will be co-located with San Diego Blood Bank at the Gateway Center on Market Street. Their focus and vision is to be the primary milk provider to all of our hospitals/NCUs for San Diego County. First 5 will be partnering with them to elevate the message and help get the word out. There is an app called Mother’s Milk available on smartphone app store. Dr. Stellwagen will be the new Executive Director for the Mother’s Milk Bank. On October 10, Dr. Stellwagen will be presenting at the First 5 Commission meeting.

b. San Diego For Every Child Coalition is a new coalition being formed that we hope will complement the work of the ECE Advocacy Coalition. Jewish Family Services is the fiscal agency for the coalition. First 5 is looking to partner with them as well. The goal of this coalition is to reduce childhood poverty in half. Their high hope is to reach this goal by 2030 but they do understand that it will be tough. Kim McDougal is on the steering committee and has been working with the Director of this coalition on the child care metrics. Because of our gaps in data, it has been very tough to decide what data to show and demonstrate and what is available for working families. May end up mapping the number of children eligible for subsidy in the county and the number of slots available for eligible children based on slots and numbers of vouchers that we are distributing to find the gap between them then overlaying that with their housing poverty data and employment.
