CONDITIONS OF SALETHIRTEENTH- Bidding - minimum acceptable advance in bidding are $25 to $2,000, $50 to $5,000 and $100 thereafter.FOURTEENTH- Consignor has the responsibility to notify the sales management in writing prior to the sale of any unsound-

ness of any nature known to him and they will be announced at time of sale. BUYER HAS THE RIGHT TO HAVE ALIMITED POST PURCHASE EXAMINATION BY A VETERINARIAN WITHIN 12 HOURS OF THE START OF THE SALEAND BEFORE THE PONY LEAVES THE SALE PREMISES. If a qualified veterinarian finds the pony not to be sound forthe advertised purpose, the consignor will accept the return of pony as unsold and hereby authorizes Professional AuctionServices, Inc. to refund the purchase price. This examination will be limited to moving the pony for soundness on ridingponies or show ponies of any type, and checking the reproductive tract on breeding ponies, as well as checking forconditions as stated in Condition Fourteenth. Positive reaction to flexion tests and hoof testers does not constitute un-soundness, if the pony is moving sound. These tests should be a part of a prepurchase examination. THE BUYER HASTHE RESPONSIBILITY TO EXAMINE PONIES BEFORE BIDDING.

FIFTEENTH- The consignor has the responsibility to notify the sales management in writing prior to the sale of the fact thatthe pony is a CRIBBER, a WEAVER, UNSOUND OF EYES or WIND, PARROT MOUTH for mares and stallions only, aCRYPTORCHID, MONORCHID or RIDGLING, has been NERVED, has FOUNDERED prior to the sale, has a LAMENESSDUE TO a navicular disorder, osteoarthritis of a joint or other bone abnormality or neurological disorder including, but notlimited to, EPM or wobbles. Mares and stallions will be exempt from the lameness provision as stated above if they arerepresented only as breeding animals. If a buyer discovers such a condition in the pony which was not stated to the salesmanagement by the consignor, as required and specified above, and NOT stated in the catalog or announced at the timeof the sale, and the pony had such a condition at the time of sale, the buyer may have grounds to reject the pony. Thebuyer must deliver to Professional Auction Services, Inc. a WRITTEN STATEMENT FROM A QUALIFIED VETERINARIANwithin five (5) days of the date of the sale establishing the existence of the condition, IN DETAIL. The veterinarian’sstatement shall include a description of the procedures performed during the examination, the results which caused theveterinarian to diagnose the condition, and state how it was determined that the condition existed prior to the sale. If theevidence is conclusive, the consignor agrees to accept the return of the pony and hereby authorizes Professional AuctionServices, Inc. to refund the purchase price. If the veterinarian’s statement is inconclusive or is not complete with theinformation required above, Professional Auction Services, Inc. may disallow the claim and pay the consignor. In the eventthat a consignor does not agree with the buyer’s veterinarian’s statement, Professional Auction Services, Inc. may holdfunds until buyer and consignor resolve the matter in accordance with Condition Sixteenth.

SIXTEENTH- Disputed Condition - If the consignor disputes the diagnosis by the buyer’s veterinarian for conditionsstated in Condition Fifteenth above, that were not stated in the catalog or announced before the pony was sold, thenP.A.S., Inc. may appoint an equine veterinarian of its choice to determine the condition of the pony. The examination ofthe appointed veterinarian shall be limited to the disputed condition. The appointed veterinarian may inspect the pony andmay apply such diagnostic testing and procedures as deemed to be appropriate. The appointed veterinarian may alsoconfer with the consignor and the buyer and the buyer’s veterinarian, and may review available veterinary medical historyincluding conferring with prior veterinarians having knowledge of the pony, and may review the report and supportinginformation supplied by the buyer’s veterinarian. The decision of the appointed veterinarian shall be final in all respectsand P.A.S., Inc. shall allow or disallow the rejection of the pony by the buyer consistent with the opinion of the appointedveterinarian. The buyer has the duty to present the pony for examination with the appointed veterinarian in cooperationwith the veterinarian’s schedule and has the duty to provide board, necessary farrier and veterinary care, and transporta-tion until the dispute is resolved. The appointed veterinarian shall be within a reasonable proximity to the buyer. If rejec-tion by the buyer is allowed by P.A.S., Inc., the consignor shall pay the cost of services of the appointed veterinarian andthe buyer may recover from consignor any direct costs as stated in Condition Eighteenth. Risk of loss passes back toconsignor immediately upon notice of decision by P.A.S., Inc. to allow rejection by the buyer and consignor shall immedi-ately make arrangements to take possession of the pony.

SEVENTEENTH- The consignor has agreed not to give the pony any drugs to alter soundness or attitude, unless it isdisclosed by a statement in the catalog or announcement prior to the pony being sold. If within five (5) days of the sale,the buyer finds the pony to be unsound for the advertised purpose or makes a claim of misrepresentation of attitude by theconsignor and a blood test proves positive for a drug that could mask such a problem, the pony can be rejected by thebuyer. For a claim to be valid under this Condition the blood sample must be drawn by the sale veterinarian within 12hours of the start of the Sale and before the pony leaves the sale grounds. Notification of a claim by the buyer under thisCondition must be made to Professional Auction Services, Inc. within five (5) days of the date of the sale, by a writtenstatement from a qualified equine veterinarian explaining the diagnosis of any unsoundness or explaining the behaviorproblem. The funds for the pony will be held pending the results of the blood screen.

EIGHTEENTH- In the event a pony is returned to the consignor in accordance with the conditions Fourteenth, Fifteenth,Sixteenth, or Seventeenth, the consignor agrees to pay all reasonable costs involved with the sale and return of the pony,including transportation, board and appropriate sale fees. In the event of legal action over a pony sold in this auctionwhich involves Professional Auction Services, Inc., the Buyer and Seller, jointly and severally, agree to pay all costsincurred by Professional Auction Services, Inc., including reasonable attorney’s fees.

NINETEENTH- The AGE and pedigree given in the catalog for ponies selling without registration papers is only approximateand not guaranteed.

TWENTIETH- IN SITUATIONS OTHER THAN THOSE SPECIFIED IN CONDITIONS FOURTEENTH and FIFTEENTH,THERE IS NO GUARANTEE OF SOUNDNESS OTHER THAN THOSE MADE SPECIFICALLY BY THE CONSIGNOR.

BUYER’S RESPONSIBILITY - SOME HELPFUL HINTS• The Seller has a responsibility to announce defects, that they know of, in their ponies, particularly those that may affect

the soundness of the pony for the purpose they are advertised for. What is a defect to one person, may not be a defect toanother.

• The Buyer has a responsibility to examine a pony carefully before they bid on it. If you have any particular concerns aboutconformation faults or defects, size, attitude, stall manners, riding ability or anything else, check it out BEFORE you bid.If you buy a pony on impulse, without shopping it before you bid, you may expect to find some surprises. In that case youstill own the pony. The seller is not responsible for you, if you don't shop the pony. Once you bid on a pony, you areindicating you have shopped enough to satisfy yourself and no one else is responsible.

Some suggestions:

• READ THE CONDITIONS OF SALE in the catalog. If you have questions, please call the sale management.

• CALL OUR OFFICE FOR PHONE NUMBERS OF SELLERS TO GET MORE INFORMATION BEFORE THE SALE.When you have selected some prospects in your catalog, call the sellers before the sale and ask about the pony. It willsave time.

• Make a list, written or mental, of the things that are important to you in a pony. Think about the good characteristicsyou want and also think about the vices, habits or characteristics you do not want in a pony. Consider what negativecharacteristics you can put up with if a pony can serve your primary purpose well. Go through this checklist for each ponyyou shop. Ask questions and make sure you get the answers. Do this BEFORE you bid, because after you buy a ponyyou cannot change your mind if you don’t like the pony.

• What is the purpose for your new pony? - Show, recreational riding, racing, breeding, etc. Look for a pony that isbred for or trained for the type of use you need.

• Conformation - Examine the pony carefully for conformation defects that may affect your use of the pony. Remember,the “perfect” pony has never been found. Decide what characteristics are important to your purpose and make sure thesesuit you. There are some areas where you may accept some deviations from ideal conformation, if they don’t cause aproblem for you.

• Appearance - A pretty pony will always get your attention. We tend to fall in love with a pony because of eye appeal,then hope it will suit our purpose. Be sure to look past pretty and see if the pony really suits. Try not to let color be youronly criteria. If you want to show or breed for the color breeds, it will be important. The more specific your desire for acertain color, the harder it is to find the right pony for the purpose.

• Soundness - Examine the pony carefully for any blemishes that may cause soundness problems. Watch the pony moveand watch for lameness. Check the ponies eyes for obvious defects. Try to notice if the breathing sounds normal. If yousee something that concerns you, either mark this pony off your list or get a veterinarian to examine the pony before youbid on it.

• Veterinary examination - Before you buy a pony, you may have a veterinarian examine it in any way you want and theseller will allow. In most cases, a general examination by a veterinarian will do quite well. This would involve a visualexamination for defects, watching the pony move, possibly flexion tests and hoof testers and checking the eyes, wind andheart. Some buyers have made arrangments with the seller and a veterinarian to meet early at the sale grounds andallow time for an extensive prepurchase exam, including radiographs. Other buyers have contacted sellers to get aveterinarian to examine the pony before it comes to the sale. REMEMBER, AFTER you purchase a pony the veterinaryexamination allowed by the Sale conditions is very limited.

• Stable Manners - If this is an important issue for you, then make sure you go to see the pony in the stall. Ask the sellerquestions about how the pony is in the stall or in the pasture, alone or with other ponies, how is it to groom, shoe, clip,load, haul or anything else that concerns you. Also ask about cribbing or weaving. To some buyers these items may notbe as important as winning in the show ring. To others, this area may be the most important characteristic to consider.

• Drugs and medication - We feel this is not as much of a problem as some people suspect. If you are concerned about apony being drugged to mask a soundness or performance problem, we can suggest a way to check that, if a problemactually arises. You may have the veterinarian draw a blood sample at the sale, at a small cost, and hold it pending theneed to run a drug screen. The cost of a drug screen is estimated to be $100 to $150. If after a week you have notexperienced problems, that could have been masked by drugs, the veterinarian can discard the blood. If you have aproblem that you suspect was masked by drugs, and you had a sample drawn at the sale, contact the sale managementimmediately and the account will be held for review. We do not condone use of drugs to misrepresent a pony. If thepresence of a drug is found that masked a problem, the seller will get the pony back, if you have notified us in time.Please bear in mind that just because you might not get along with your new pony, doesn’t mean the pony was drugged.Most ponies need to adjust to new owners and places, and owners need to adjust to the pony.

• Riding ponies - Watch the demonstration at the sale. If you are looking for a riding pony make sure the owner’sstatement in the catalog says the pony is broke to ride, see it ride or better yet, ride it. If you want a pony for children orbeginners, make sure the owner's statement in the catalog mentions the pony has experience with this type of rider andhave the rider try the pony. If you are looking for a show pony, watch the demonstration to see it in a show ring situationand talk to the seller about maintenance and preparation.

• Breeding ponies - If the owner’s statement in the catalog does not give the complete breeding history, you may contactthe seller, as well as checking the appropriate breed association, for additional information. For mares that are not in foal,check for visible defects in breeding conformation. If the seller does not have results of a recent reproductiveexamination, culture or uterine biopsy, you may want a veterinarian to check the reproductive tract, as much as they can,at the sale and base your decision on that information. For stallions, check for visible defects in breeding conformation.On young stallion prospects check for reproductive maturity consistant with their age and make sure both testicles aredown.

• Insurance - PAS, Inc. recommends that the buyer obtain Full Mortality Insurance on ponies immediately after purchase,however, this decision and risk rest solely with the buyer.

• WHAT TO DO IF SOMETHING ABOUT THE PONY WORRIES YOU. - If you see or hear something about a pony thatreally worries or bothers you, and you can’t get the answers or information to make you feel comfortable, then “Do NotBuy The Pony.” If there are some things about the pony that make you really want it any way, talk to the Sale manager. Ifyou then don’t have your answers, pass on that pony. There will always be other ponies available.

• LISTEN FOR ANNOUNCEMENTS like selling "breeding sound only" or "As Is" which mean the pony may not be soundto ride.

• YOUR PROTECTION IS YOUR RESPONSIBILITY. Please examine ponies carefully before you bid and listen carefullyto announcements made while the pony is in the Sale ring.
