$istory of the Factories Act – 13,4

The estalishment o the cotton industries in "oma( 'residenc( in the (ear 18:- initiated or theirst time in +ndia, an interest in the actor( le#islation.

+n the (ear 1881, the irst Factor( Act came into orce. +n addition to 'rovisions relatin# to health

and saet(, the act limited the em'lo(ment o children in actories.

"ut this did not satis( the wor$ers and thereore another Act was 'assed in 1891 which made the

wor$ers silent or aout twent( (ears.

+n 19-2 electric li#ht was introduced in the "oma( mills and thereore the runnin# o the mills a

ni#ht was made 'ossile. This resulted in new diiculties necessitatin# new actor( le#islation

and eventuall( the third actor( act namel(, the Act o 1911.

?urin# the First /orld /ar industrial dis'utes ecame ver( common and some chan#es in the

actor( Act ecame im'erative as a result o this the ne3t Factories Act was 'assed in 1900.

A Ro(al Commission on laor was a''ointed and on the asis o its recommendations the Factor(

act, 194 was 'assed.

This Act ater a numer o amendments was inall( re'laced ( the 'resent Factories Act o 1948

&3'erience o the wor$in# o /or$mens Com'ensation Act o 1904 showed that the eneits #iven to

the actor( wor$ers under the Act, in man( cases did not reach to them.

This was due to the ollowin# reasons

i. A claim or com'ensation or in@ur( has to e iled in the ordinar( court o law and the lac$ o

inances oten made it im'ossile or a wor$er to ile such a suit and i#ht.

ii. The wor$ers 'reerred to acce't whatever com'ensation em'lo(ers 'rovide, as the( were not

ale to 'rove that accident occurred due to the ne#li#ence on the 'art o em'lo(er, due to lac$ o

inances and e3'ert le#al advice.

The aove mentioned two deects were ta$en care in the 198s amendments o the Act, ut still some

o the ollowin# loo'holes were there

i. The Act reco#ni6ed onl( a ver( small numer o diseases.

ii. The administrative machiner( set u' under the Act or 'a(ment o com'ensation was so clums(

that thou#h the amount o com'ensation was sanctioned, there was considerale dela( in
