MESSAGE FROM THE CHAIR

75th Anniversary -

Just the Beginning

To all of you who attended the New LicenseeCertificate Ceremony and the Engineering

Board’s 75th Anniversary celebration, thanks forcoming. We had a great turnout. In fact, we hadmore people than we had chairs! The event was heldat the Governor’s mansion pavilion with approxi-mately 175 people from across the state in atten-dance, representing the Board, professional societies,industry, and our new licensees. Thanks again to theattendees who braved the heat and joined us in thishistoric event.

The certificate ceremony and anniversarycelebration were a great way to start off a new fiscalyear for the Board, but there is more to come. Inaddition to this year marking the 75th year of theBoard, it is also going to mark the first year of theBoard actually owning the building that we occupy.Many of you know that the Oklahoma EngineeringCenter, which is the building where the Board office islocated, was built by the Oklahoma EngineeringFoundation (OEF) in 1978 and has been owned by theFoundation since that time. For the last few years,however, the building has been in need of repairs andhas become a financial burden on the OEF. They felttheir true mission was being threatened by this burden.

In light of this, the members of the Board ofLicensure for Professional Engineers and Land

Surveyors found a way to benefit both the mission ofthe Board, which is to protect the health safety andwelfare of the public through the regulation ofengineering and surveying, and the work of theOklahoma Engineering Foundation, which is topromote the profession of engineering by investing inOklahoma’s future engineers. By purchasing thebuilding and continuing to rent space to the varioussurveying and engineering societies that use it, theBoard envisions a win/win situation. In order to makethis happen, the building is going to undergo someneeded upgrading, which should make it even moredesirable as a gathering place for the various engi-neering and surveying groups to have their meetings.

So, if you are down by the Board officewithin the next few months, and you see sometransformations taking place, you are welcome to stopin and view the progress.

Board Member News

George T. Gibson, P.E., was recently reappointedto the Board by Governor Brad Henry. His

second term expired on June 28, 2010, and his newterm will run from June 29, 2010 to June 28, 2016. Hehas served as the Board’s Chair, Vice Chair and Secre-tary. He has served as the Chair of the ContinuingEducation Committee for numerous years and continuesto chair this committee. Mr. Gibson is also the speakerfor each of the bi-annual Certificate PresentationCeremonies.

As a member of NCEES, he has been activelyinvolved in the area of education assessment. He servedon the Committee on Education Assessment andQualificaton from 2001-2002 and has been both amember and consultant to the Education AccreditationTask Force. He also served as an NCEES Representa-tive to TAC/ABET. He served as the NCEES SouthernZone Secretary Treasurer from 2006 - 2010 and was recently appointed to the NCEES FinanceCommittee.

Mr. Gibson is a retired University of Oklahoma adjunct professor in the school of Industrial Engineer-ing. Previously, he was the Assistant to the President-Oklahoma, General Manager-Network and ChiefEngineer for Southwestern Bell Telephone Co.

Robert C. Zahl, PE, was awarded the2010 NCEES Southern Zone Distin-

guished Service Award at the Zone Meeting held inApril in Tampa, Florida. Bob is one of the found-ing principals of an Oklahoma City based struc-tural engineering consulting firm - Zahl-Ford, Inc.Mr. Zahl has served on the FE ExaminationCommittee Since 1999, served as the NCEESSouthern Zone Assistant Vice President for 2years, and is a member of the NCEES Examina-tions for Professional Engineers Committee, wherethis year he will serve a two year term as ViceChair, followed by two years as Chair.

He has served as Chair, Vice Chair, andSecretary of the Oklahoma Board. He is an activemember of SECO, OSEA, and ACEC Oklahoma.He also serves on the Joint Task Force Committeeof Architects, Engineers, and Land Surveyors.

Mr. Zahl is currently a member of theBuilding Committee and serving as Board Chair.for 2010-2011.

This Information Is Critical to the future PLSLicensees of the Board. Because of its impor-tance, it is being reprinted from the last editionof the Board’s Buletin. Please helpfuture Professional Land Surveyors by sharingthis information.

As we have been publicizing since our statutechanged in 2005, education requirements for licen-sure as a PLS are changing. Those changes aresummarized in the 5 Paths to Licensure flow chartshown on the opposite page. Since Long Estab-lished Practice (LEP) will no longer be a path tolicensure after July 1, 2014, the Board is encouragingthose on the path to licensure, regardless of wherethey are right now, to be familiar with this flow chart.Furthermore, the Board strongly encourages poten-

Even those who will qualify for the exams by LEP are encouraged to start taking land surveyingclasses now. For the most part, the surveying exams are based on knowledge obtained in college level landsurveying class work. Taking college classes, particularly those included in the Core Curriculum, willimprove the applicant’s chance of success on the examinations and improve the chance of success in theirsurveying practice. Furthermore, a LEP applicant who does not complete all of the examinations prior tothe April 2014 deadline will be that much closer to qualifying for licensure by an education pathway.

In the Matter of Classic Country Land, L.L.C.; Case No. 2009-050; Through Consent: For offeringand practicing land surveying without a Certificate of Authorization, Classic Country Land, L.L.C. is foundGuilty, assessed an administrative fine of $6,000.00, ordered to remove any and all representations on its web site“that the lots have been staked and property corners have been marked”, and it is further ordered that ClassicCountry Land, L.L.C. provide the Board with a comprehensive list of names and address of all purchasers ofparcels/lots of the six Oklahoma properties and is hereby ordered to Cease and Desist from offering and/orpracticing land surveying in Oklahoma until such time as it has been issued a Certificate of Authorization.

In the Matter of E.D. Hill and Associates, Inc, CA 4951 and Randy King Hill; Case No. 2009-065;Through Consent: For aiding and assisting Randy King Hill in offering and/or practicing land surveying withouta Certificate of Licensure, for issuing a final plat without a properly dated signature and seal and for fraud andmisrepresentation, E.D. Hill and Associates, Inc. is found Guilty, assessed an administrative fine of $2,100.00 andis hereby Reprimanded. Earnest Isch, P.E. 6606 (Inactive) andP.L.S. 54 (Inactive); Case No. 2009-093; Through Consent: For offering and practicing engineering inthe State of Oklahoma with an expired Certificate of Licensure, G. Earnest Isch is found Guilty, assessed anadministrative fine of $5,000.00, ordered to complete the Intermediate Studies in Engineering Ethics at the Collegeof Engineering at Texas Tech University and is hereby ordered to Cease and Desist from offering and/or practicingengineering until such time as he is re-licensed. Unlicensed Practice andCertified Corner Record Update

As you might expect in a struggling economy whereengineering and surveying projects are scarce, thenumber of out-of-state engineers and surveyors pursuing

those projects has increased dramatically this year. Typically a fairlyhigh percentage of out-of-state applications this office receivesindicate that the applicant and/or firm has already either offered orbegun practicing before the license has been issued. This Board hastaken a very clear and consistent position that this practice is aserious violation of our law and is vigorously prosecuted. Ourlicensees and firms who are diligent about following the laws andrules demand this office maintain a level playing field that is fair to all.

Therefore, we have been pleasantly surprised this year because of the very high percentage of thesenew applications that disclose the applicant has not already offered to or actually started practicing. This is asignificant change especially considering the volume of new applications we have received. This officeoptimistically views this change as a positive sign that efforts on our website and in our publications andpresentations are effectively educating licensees and future licensees about our laws and rules. We knowhowever, that the most effective method to combat unlicensed practice is our licensees becoming involvedand insisting that governmental and private entities use individuals and firms that are properly licensed inOklahoma and practicing within our law. This Board recognizes that there are still non-licensed practiceviolations and is therefore still investigating and, where warranted, prosecuting any individual or any firmwho is not properly licensed in Oklahoma.

The Instruction Manual for Oklahoma Certified Corner Records published by this office and postedon our website is being updated to reflect changes by the State Department of Libraries and the Bureau ofLand Management. As most Oklahoma surveyors already know, the State Department of Libraries haspassed rules that will require a $5.00 filing fee for Certified Corner Records effective July 1, 2010. There-fore, it will be more important than ever for surveyors to submit complete and accurate CCR forms in theirinitial submittal to the Library. Surveyors need to be aware that in 2009 the BLM updated and published itsManual of Surveying Instructions. Among the many revisions is a new definition of obliterated corners and alengthy section on the identification and evidence of obliterated corners. Our research indicates a number ofsurveyors who are still not including adequate information on CCR forms about supporting evidence formonuments found and set. Simply stating that a monument was found in the vicinity of a public land surveycorner is not adequate. There are too many situations where a non-licensed individual sets a nail or othertemporary object for control for an engineering, topo or GIS project and then leaves it there after theproject is done. Even surveyors have been known to set temporary points and then failed to pick them up.The description of what evidence was used to support a monument location is vitally important in order toverify the correctness of the location and must be included.

The statute and rules regulating the practice of engineering and surveying continue to be updated toreflect the changes in the professions. This Board publishes the current rules on its website and will continueto rely on its licensees to know the rules and help educate others.

LICENSE EXPIRATIONS - OCTOBER 1, 2009 TO MARCH 30, 2010

EXPIRATION/REVOCATION - Licenses may be revokedby the Board for non-payment of renewal fees. Licenseeswill be notified of revocation by certified mail. Typically thisnotification is mailed 10 days following expiration.RENEWALS - Each license issued by the Board expires onthe last day of the month in which renewal fees are due, andbecomes invalid on that date unless paid. One notice of therenewal is sent by first class mail to the address of record inthe board files. This in effect provides notice two monthsprior to revocation.REINSTATEMENT - Former licensees whose certificateshave expired and were revoked for failure to pay renewalfees and desire to reinstate shall make application forreinstatement within 180 days after expiration and pay theprescribed renewal fee and penalty. After 180 days, a newapplication will be required, which shall be consideredspecifically by the Board, both from the standpoint ofcompetency and of character.

There are no age restrictions, butyour license must be in good standing with the Board to qualify and your license will be considered inactive.You will continue to receive the newsletter, and you will receive a wallet card with the date of the retirementof your license, and you will be able to use the title “Professional Engineer - Retired” or “Professional LandSurveyor - Retired” as applicable.

OAC 245:15-7-1(c) Certificate of Licensure states, “When a professional engineer or land surveyor ingood standing desires to retire his or her license, he or she may do so upon application to the Board, subject toreinstatement and continuing education requirements by the Board.”

OAC 245:15-7-5(a) Reinstatement of revoked or retired licenses states, “Licenses ......that werevoluntarily retired by the licensee may be reinstated by making written application for reinstatement within 180days after expiration and payment of the prescribed renewal fee and penalty. .... Practicing your profes-sion with a revoked or retired license during this reinstatement period is a violation of Title 59, Section 475.1 etseq and the Rules of this Board.”

OAC 245:15-11-3(4) Continuing Education - Scope and exemptions states, “A licensee who elects tochoose Retired status at the time of renewal shall be exempt. In the event such person elects to return toactive practice of professional engineering or surveying, 30 PDH’s must be earned before returning to activepractice.
