New York.
JURISDICTION IQND VENUE
2. This Court has juri~~diction over the subject matter of this action pursuant to
section 39 of the Lanham Act (15 U.S.C. ~ 1121), and 28 U.S.C. ~~ 1331 and 1338, and has
supplemental jurisdiction pursuant to 28 U.S.C. 1367(a). Gucci's claims are'predicated upon
the Trademark Actof·1946,.as amended. 15 U.S.C. -g 1051 et seq,, and substantial. andI'elated
claims underthe statutoryand -cc~mmoa law of the State of Ne~i York.
3. Venue is properly found'ed in this-judicial district pursuant to 28 U.S.C. ~ 1391(6)
and (c) and _1400(11) and·.(b), becarise Defendants ·are ~ut~ject to personal jurisdiction within this
:judicialdistrict and/or because a sui~sti~tial part of the events.giving rise to these claims

also known as E.L. Erman·Cosmetics Manufacturing Corp. ("Erman") is a corporation organized
and existing under the laws of the State of California, havii~g its principal place of business at
31238 Via Colinas, Westlake, California .Upon fUrther information and belief, Erman is
engaged·in manufacturing, disti·ibuting, sellingand advertising skin care and cosmetic products,
including products under license ~om Jennifer Gucci and/or Veratex.

individual residing in the State of Califomia, doing business as Ed ~Litwak and Associates, which
maintainsaprincipal place oft~siness at 12868 Via Latin~-Del Mar, California. Uponfurther
information and belief, Litwak, is, among other things, in the business of attempting to license,
and licensing; to third parties the name and trademark JENNIFERGUCCI for use on various

THE FAMOUS GUCCI BRAND AND TRADEMARKS
15. Gucci is the owner of, and the sole and exclusive distributor offLne leather goods,
clbthin& accessories, home products, fragrances and perfumes, and jewelry and watches sold
under,the world famous GUCCI brand name in the United States. The GUCCI brand has
become synonymous with luxurious and elegant products and services. Moreover, the brand
owners·ofthe GUCCI brand have long been reco~nized as worldwide leaders in the design,
marketing and distribution ofpremium, high quality products. Consirmers and the trade-in~tantly
identify Gucci as the source of all. products bearing the'GUCCI name and trademark.
16. Gucci- is the owner of the right, title and interest in andto, inter alia, the following

the Gucci -Trademarks, For decades, the Gucci Trademarks have reCeived widespread exposure
in the marketplace.- Over the jlears, millions of consumers have been exposed to the.Guc;ci
Trademarks through extensiveadvertising campaigns, in mains~tream and fashion magazinesand
other periodi;cals, as depicted on television andin motion pictures, on the' Internet, and in other
forms ofunsi~~icited media coverage.
Further, over many years, (iucci has realized enormous and ever-increasing
success:in-its sales ofproduct~ bearing the Gucci Trademarks, such sales totaling in the billions
ofdollars inthe UnitedStates alone.
19. Moreover, Gucci always endeavors to maiiltain the prestige and reputation·for

and luxury associated with the GUCCI brand. Strict quality control standards'are imposed
in the manufacture of all GUCCI branded products. Gucci's painstaking adherence to only. the
highest quality standards has resulted in widespread and~favorable -public acceptance among
consumers for all products bearing the Gucci Trademarks.
20- As a result of Gucci's extensive advertising and promotion, adherence to the
highest quality standards, and extraordinary sales success, the Gucci Trademarks, as well as
other well known designs, logos and indicia introduced by Gucci, are among themost widely-
recognized trademarks in the United States, possessing strong secondary meaning among
consumers and the trade, immediately identifying Gudci as the: exclusive source of the products
to which they are af~ixed, and signifying goddwill of incalculable value.
DEFEND;ANTS' ACTS BF INFRINeEMENT AND UNFAIR COMPETITION
21.. Gucci has recently discovered that Defendants are engaged·in licensing,
de~igning, manufacturing, promoting, selling,and offering:for sale consumerproducts in a wide
; - -~:~iet~l-~~produc~--sa~-geries ~nder-t~e~E~P~R·G~:~C~I-~a~e andtrademarlZ in conjunction ·
with various dther designs, logos and source-identifying-indicia that are studied imitations of the
Gucci Trademarks, including a green-red-green stripe design and a-repeating JG design
(M1~6~~,1h~··~i~i~,h~ilarks~). Upoo~b~m~ti~.db~,~h,md~.od~l~F~s~includp~but are not limited to, home textile, bedding, bedding accessory, hath accessory, window treatment,
and skincare and cosmetic products. Copies of marketing mater;ials published by Veratex
depictingthe lnh-inging Marks are attached hereto as Exhibit~C.
22. Upon information and belief, Jennifer Gucci ·who-was married to Paolo ~ucci, a:
Gucci family member, from 1978 to 1991, but who ofhawisehas no afl~iation with Gucci-has,
individually and throu~ jennicor arid Jenco, attempted to capitalize on the popularity of the
Gucci Trademarks by licensing, attempting to license and~r permitting variouscompanies to the

Marks.
23. Upon information and belief, Jennifer Gucci, through jennicor and Jenco, has, on
several occasions over a period of years, attempted to register trademarks comprising or
containinn the name JENNIFER GC~TCCI, both in the United States and 'internationally. In each
instance, such attempted registration has been refused on the basis that the name JENNIFER
GUCCI is likely to be confused with the~ world famous GUCCI trademark.
24. Upon information and belief, Jennifer Gucci has granted-to Veratex a worldwide
master lice~ise to use and license the T~inm'ng Marks across numerous consumer product
categories.
25. Upon information-and belief Veratex· has licensed, manufactured, imported,
advertised, promiited, distributed, sold arid/orof~f~ea for s~e, and/or is causing to be licensed,
manufactured, imported, a~dvertised, promoted, di~tributed, sold and/oroffered for sale, without
authorizationor license ~om Gu~ci, consurher products bearing the In~inging'Marks in a wide
'Yarie~tofI~,roduet-ea~e~ories,
26. Z~pon information and belief, actibg as master licensee of the Infringing Marks,
Verat~ex haS entered into sublicenses with various companies, including, butnot limitedto,
Collezione, f3rmanand- Louisvilfe, for the. use of the I~iriging Marks on awide variety of .
consumer products, including, but not limited to, home textile, bedding, bedding accessory, bath
accessory, window ·treatment, and skincare and cosmetic products. Copies of news articles
-and/or press releas~ issuedby ye~ex concerning -its efforts to hcense the Infr~fr~inging Marks are
attadhe~2 hereto as Exhibit D.
27. - Upon information andbelie~f; Collezione, pursuantto its license agreement with
Veratex, has manufactured, imported, advertised, promoted, distributed, sold and/or offered fdr

and/dr is causing to be manufactured, imported, advertised, promoted, distributed, sold
and/or offered for sale, without authorization or license, home textile, beddmg and bath products,
bearing the Infringing Marks.
28. Upon information and belief~-Erman, pursuant to its~:license agreement with
Veratex, has manufactured, imported, advertised, promoted, distributed, sold and/or offered for
sale, and/or is causirig to be manufactured; imported, advertised, promoted, distributed, sold
and/or offered for sale, without ai~thorization or license, skin we and cosmetic products, bearing
the I~i`nging Marks. A printout from Erman's vi·ebsite depicting productsbearing the brand
name JENNIFER GUCCI is attached hereto as Exhibit E.
29. _ Upon information and belief Louisville, pursuaant to i~s license agreement with
Veratex, has manufadure~,-imported, ~advertised, :promoted, distributedsold and/or offered for
sale, and/or is causing to be man~ifactured, imported, advertised, promoted, ·distributed, sold
and/or offered for sale, with~ut authorization or license, bedding products, including bed pillows,

issued bylouisvi~e conceming its imp~nding launch of a JENNIFER GITCCI branded product
lineis attached hereto as-Exhibit F.
30..- Uponinformation and belief Litwakis~acting as licensing manager or licensing
agent with respect-tothe Infringing M~ir~s on behalf ofJennifer Gucci'and/or Veratex, and has
arranged for aridlor-issuecl licenses an&/or ·sub-licenses for the use of the JENNIFER GUCCI-
name and-·the Infringin~ Marks.
31. Upon inforinationand belief ABC Corporations 1-10 andJohn Does 1-10,
pursuant to license'agreements with Veratex·and/or Jennifer Gucci, have manufacture~.
advertised, promoted- disti·ibuted, sold and/or offered for sale, and/or are causing to be

advertised, promoted, distributed, soldand/or offered for sale, without
authorization or license, additional products bearing the In~inging Marks. Upon learning the
identities of these defendants, Gucci will seek leave to amend its complaint to add them as
parties.
32. Together with the In~inging Marks, Defendants are using various other design
elements and designations, including but not limited to, certain fonts, typefaces and graphic
designs, which are intended to suggest design elements and designations used by or associated
with Gucci, all with the ~deliberate intention to cause consumers and the trade to believe that their
p~oducts beating:the Infiinging Masks are authorized, sponsored, approved, endorsed orli~ed
by Gucci, or that Defendants are in some way af~f~!iated-wit~ Gucci.
33. Defendants are well aware of the extraordinary fame and strength-of the Gucci
Trademarks, and the incalculable'goodwill :symbolized thereby,. andthat the In~ing~ng Marks
cannot be usedb:inclicators of source or sponsorship for the products they are licensing,
inanufacturingand/or distiibuting; Accordirigly, Defendants havebeenengaging in the above-
desi~ibed' unlawful activities knowiriglyand inte;ntionally, orwith-reddess disregard.for· Gucci's
rights in t~e Gucci:Trademarks.

55. Gucci is the exclusive own~ of the Gucci Tr$demarkS in the United States.
56. The Gucci Trademarks are strong and distinctive marks that have been in use for
many years and have achieved enormous andwidespread liublic recognition.
57. The Gucci Trademarksare famous within the meaning of Section.43(c) of the
Lanham Act(lS U.S.CI ~ 1125(c)).
58. Defendants' use of ttieIn~inging Marks, without authoii~ati~n ~dm Gucci, is
diluting the distinctive quality of the Gucci Trademarks and deci-easing the-capacityof such
marks to identifl and distinguish Gucci's goods.
59. Defendants have intentionally and willti~lly ~iluted~the distinctive ciuality of the
famous Gucci Tiademarks in violation of Section43(cj of the Lanham ~ct, 15 I-TIS.C. ~ 1125(c).

engaged in trademark i~i~ngement and unfair competition under the common law of New York;
and (v) Defendants have been uniustly enriched in violation of New York common law.

Defendants, their qf~ii-~ers, agents, employe~es and attornevs,'and all those persons or entities in
active condea or participation with them, or any -of them, ~om:

dis~ibuting~offeringfor sale.or selling any products which hear the infringing Marks, the Gucci
Trademarlts, or an~ dthermark substantially or confUsingly sitnilar thereto, and engaging in any
other activity constituting an in~ingement of aoy of Gucci's rights in the Gucci Trademarks, or
any other trademark owried by Gucci;'and
(i) engaging, in any other activity constituting unfair competition with Gucci,
oi acts and practice~ that deceive the puhhc and/or the trade; and

Trademarks to be diluted.

been manufactured, imported, ~advertised, marketed, promoted, supplied, distribute4: offered for

Veratex Teams with Jennifer Gucci

Panorama CYr, Callf. - Jennifer Gucci, a.former member of the Gucci family renowned for their leather goods and
accessories, has signed a licensing agreement with Veratex to produce a home fumishings collection.
'I'm basically starting from scratch, and it will be Englishy in feeling,' Gucci explained. "I love the'30s with the clean lines; and I adore flowers, soboth elements will be involved," she related. Overall, she noted, the collection will lean toi~vard
feminine looks, "but I wont discriminate towardmen;"
Discussing her home fashions favorites, Gucci said, "My favon'te colors are yellows. My house in Marbella, Spain is all in yellow - it's so warm and sunny." In contrast she noted, "My ex-husband -the late Paolo Gucci 7 loved purple." Polka dots are one of her favorites and "I don't like the super chic and modem."
Gucd, who will be at market this week in the Veratex New York showroom, said that she picked the home arena over apparel "because fashion is flooded now." She added, "I want to do something in the middle [of price pointsl and things
that are easy to put together. I'm a great believer in coordination."
Veratex has the master license for home with the complete textiles segment, includirig bed, bath, nyls, window, and bath accessories - as the first:objectlve. 50R home is the primary area "to begin with' said Ed Litwak, Gucci's licensing manager. "We will stait talking with fumiture companies, and Veratex has the option to develop silvelware and dinnerware." ·
Veratex is developing the bedding, window, rugs, towels, and bath accessories, said Avi Cohen, company ceo. "We also are talking with other textiles companies in specialty areas like pillows, comf6rters, and down."
Distribution, Cohen said, ?Nill be wide - specialty stores, department stores, big boxes - virtually all retail channels."
While the license is global, "We will design everything here for global distribution,' Cohen said. The first collection; Litwak added, ~Nill have a classic look - not wild or specifically young or old in feeling - English with an Italian flair. We will bring in a design specialist for the program." And he added, 'It will have a Gucciesque look with some horse themes."
Veratex expects ~product to be market-ready three months after this week's market, with fall-launches at retail. Price points are expected to:be $199 to $249fora queen bed.
Gucci is currently doing the soundtrack for a movie, using her operatic training. There is a TV mini-series in the works on the Gucci empire, Litwak added.

Recently for the first time, at annual Licensing International Show (LIS) in New York Veratex revealed all its Jennifer Gucci home textiles line, in a massive inb~oduction coven'ng more than 500 Stock Keeping Units (SKUs) in bedding, bath, and rugs.
Veratex, famous for integrated anthology of fabric and home textiles, sources its high quality fabn'csfrom within the county and abroad.
Continual evolvement of new designs and fabrications in regular sateen sheets, developed an extensive range of innovative ~s~les comprising chic contemporary pattems, elegant embroidery as well as comfortable casual fashions.
Display of around 15 beds along with synchronized products was one of the most stn'king affairs at the Veratex showroom.
Addressing people, Veratex President Avi Cohen said that Jennifer Gucci fashion bedding are made up of light fabrics that exude a fresh feel with sparing embellishments of a higher level. Fabrications comprise of sateen, cotton duck, jacquard with silk applique and embroidery on cotton, damask, are among the rest.
