    R&R Benefits for the Affected FamiliesExtracts from the

    Jharkhand R&R Policy 2008SNo Policy No Condition Benefit

    1 7.2 Any affected family owning a

    House and whose house has

    been acquired /lost

    Affected family may be allotted free of cost

    house site to the extent of actual loss of area

    of acquired house, not more than 10decimalof land in rural areas,not more than 5decimal

    of land in Urban areas.

    --Requiring body shall construct on the

    house site, a pucca house ,atleast two bedrooms,one kitchen,one toilet of carpet area

    of equal to 100 Sq.meter

    --Provided further that an affected family

    losing less than 10 decimal of land in ruralarea or

    5 decimal of land in urban area, as the case

    may be, shall be allotted land for homesteadpurpose measuring at least 150 square metre,

    and the pucca house constructed shall have

    carpet area equal to the carpet area of houselost or 55 square metre, whichever is more,

    but limited to carpet area of 100 square

    metre.

    --If family does not want a house/Or desiresto relocate elsewhere,family shall get

    financial assistance of Rs.3.00lacs.

    2 7.3 Affected family below povertyline,which is without homestead

    land,which has been residing inthe affected area

    5 7.7 Allotted land /house to the affected

    family,shall be in the joint names of theHusband and wife.

    --Monitory amount shall be distributed to a

    joint account in the name of Husband and

    wife.6 7.8 If affected family displacedhaving cattle

    Shall get financial assistance of Rs.35000/-for construction of shed.

    7 7.9 Displaced family Shall get financial assistance of Rs.15000/-for shifting the family,building materials

    /belongings and cattle.

    8 7.10 Affected person is a

    trader/having a pucca shop/stall

    and has been displaced

    Shall get a financial assistance of Rs.50000/-

    for construction of work shed or shop.

    9 7.11.1(a) Affected families loosing some

    land on land acquisition due to

    project

    Requiring body shall ensure employment in

    the project at the rate of atleast one eligible

    person per nuclear family,among thoseaffected families.

    --In providing employment,top priority shallbe accorded to those affected families who

    lost all their agricultural and homestead land

    --If additional employment opportunities areavailable, priority shall be accorded to

    displaced persons.

    --Administrator shall decide priorities in

    providing employment in consultation withGramsabha and Requiring Body.

    10 7.11.1(f) In case of Nominees ofdisplaced families eligible for

    employment

    Upper age limit shall be relaxed by 10Years

    11 7.11.1(i) For the Purpose of employment Affected family shall nominate one member

    of such family

    12 7.12 Affected persons , who have not

    provided employment or who

    donot want to avail theemployment

    Shall be entitled to Annuity Policies---It will

    pay Rs.1000/-Month/Acre of land lost for 30

    years.

    --Annuity policies will not pay less than

    Rs.1000/month,even if land lost is less than

    One acre or no land lost.---Amount of Rs.12000/annum/acre, will

    increase by Rs.500 for every two years.

    --Max.amount of Annuity policy will belimited to Rs.10000/- per month /affected

    family.

    13 7.13.1 In case of Commercial Project,

    other than that of public sector

    1% of the annual profit of the Project in

    monetary terms will be distributed every

    undertaking/ agency of State

    Govt, Central.Govt/Corporation/Board

    year.

    Affetced families shall be distributed thissum within a period of 3 months from date

    of declaration of financial results.

    14 7.14 Affected family involuntarily

    displaced on acquisition of land

    Shall get Monthly Subsistence allowance

    of 25days agricultural wages/month for aperiod of One year from the date ofdisplacement

    --Affected families who donot get

    employment will also given an amount equalto 600days of agricultural wages.

    15 7.15 Vulnerable Affected families Shall be paid pension for life of amountRs.1500/Month

    16 7.16 Affected families Shall be given the option of lump sumamount in lieu of one or more of the benefits

    specified in policy.nos.7.2 to 7.18(except

    No.7.13.1 and 7.15) and the amountdetermined by Administrator.

    17 7.17 R&R benefits to Scheduled

    Tribes & Scheduled Caste

    7.18.1 Involuntary displacement of 100or more of ST families,

    A Tribal Development Plan shall beprepared.

    Plan shall contain a programme for

    development of alternate fuel,fodder and

    Non Timber Forest Produce(NTFP)resources on non forest lands within a period

    of 5 Years.

    7.18.2 In case of land acquisition for

    any Project

    of the compensation amount due shall

    be paid to the affected families as a first

    instalment and rest at the time of taking overthe possession of the land.

    7.18.4 Resettlement areas predominantly inhabited

    by Scheduled Tribes shall get land free of

    cost for community and religious gatherings.

    7.18.5 ST/SC/OBC families resettled

    out of the district

    Will get 25% Higher R&R benefits as

    specified in policy.n.s.7.8,7.9, and 7.10

    7.18.8 Affected ST/SC/Other forest

    dweller families

    Who are in a possession of forest lands in

    affected area prior to the 13th

    day of

    December, 2005 shall also be eligible forR&R Benefits under the policy.

    18 7.19 Amenities and Infrastructure

    Facilities to be provided at

    Resettlement Areas:

    7.19.1 In case of Involuntery A comprehensive infrastructure facilities

    displacement of 100 or more and amenities notified by the appropriate

    Govt. shall be provided in the ResettlementAreas.

    Such facilities and amenities shall include

    Roads,public transport,drainage,

    sanitation,drinking water,drinking water forcattle,community ponds, grazing land, land

    for fodder, plantation(social or agro forestry), public utilities such as post offices,fair

    price shops..etc., Food storage Godowns,

    panchayatghars, Cooperative societies, Seed

    cum fertilizer storage, irrigation, electricitysupply,health care facilities,child and mother

    supplemental nutritional services,Children

    play ground parks, community

    centers,schools and educational/training

    facilities,places of worship, land fortraditional tribal institutions, service

    land,burial/cremation grounds and securityarrangements.

    7.19.2 In case of less than 100 families Affected families shall be provided basicinfrastructure facilities and amities asper the

    norms specified by State Govt.

    Mandatory is that provision of Drinkingwater, electricity,schools,dispensaries and

    access to Resettlement site ., etc.are

    provided.

    19 7.21 In Case of Project involvingland acquisition Requiring body shall be responsible fordevelopment of Geographical area within 15

    KM from the periphery of the project site.--Required to contribute socio economic

    development of the areas, for this purpose ,

    requiring body will earmark a minimum of1% of net profit of the project, if no profit of

    the Project is declared by the requiring body

    for that year, such minimum amount as maybe determined by the State Govt. to be spent

    in the specified Zone.

    --Requiring body will carry out thedevelopmental activity within this zone inclose coordination with the Commissioner

    for R&R and concerned Gram Sabha.

    20 8.1.1 Project involves involuntary

    displacement of 100 or more

    families

    Grievance Redressal mechanism:

    R&R Committee at Project Level:

    Stae Govt . shall constitute committee underthe chairpersonship of Administrator R&R

    or an officer not below rank of Sub

    divisional magistrate, and it is called asR&R Committee

    --It shall monitor and review the progress of

    implementation of scheme or plan of R&R

    and carry out post implementation socialaudits.

    21 8.2 R&R Committee at District level:State Govt. shall constitute Standing R&R

    Committee at District level under thechairpersonship of DC of the district to

    monitor and review the progress of

    implementation of scheme or plan of R&R.

    excluding those covered by Project levelcommittee.

    22 8.3 Tribunal:

    Three member Tribunal shall be appointedby State Govt. for time bound disposal of

    Grievances arising of matters covered by theR&R policy.

    23 9.1 Monitoring Mechanism:

    Sate level Council on Resettlement and

    Rehabilitation(SLCRR):

    State level council on R&R will beconstituted under the chairmanship of Chief

    minister.

    There shall be monitoring committee to be

    chaired by Development Commissioner forreviewing and monitoring the progress of

    implementation of R&R Schemerelating to

    all Projects to which R&R Policy applies.

    24 9.4 Department of Revenue and Land Reforms ,Government of Jharkhand will be Nodal

    Department for the State Govt, for thepurpose of implementation of and executionof R&R Policy.
