Notice Inviting Expression of Interest(Eol) for Preparation of Roads Rules & Regulations.

Title of the Proposed Project: Preparation of Roads Rules & Regulations.

The Royal Government of Bhutan Department of Roads, Ministry of Works Human Settlement intends torecruit the consultancy service for preparation of Roads Rules & Regulations for implementation of RoadsAction 2013.

Consultancy Services:

The consultancy services shall include preparation of Roads Rules and Regulations for all categories ofroads in the kingdom of Bhutan, in close consultation with Department of Roads and with other relevantstockholders, such as RTSA, Royal Bhutan Police, Dzongkhags & Local Governments.

The Department of Roads now invites eligible National consulting firms to submit Expressions of Interest(EOI) for the preparation or Rules & Regulations The engagement of consultant is scheduled for threemonths (3months) period The service is expected to commence by end of March 2014.

On the basis of the EOI submissions, the consulting firms shall be shortlisted. Only shortlisted consultingfirms will be invited to submit their proposals, The request for proposal (RFP) is expected to be issued tothe shortlisted consultants in April 2014.

This Notice Inviting Expression of Interest, EOI submission template and the terms of reference includingdetails (can be viewed and downloaded from Ministry of Works & Human Settlement websitewww.mowhs.gov.bt) or may be obtained from the office of Chief Engineer Planning Division, DoR. Headquarter, Thimphu.

Interested consulting firms are requested to submit the hardcopy of the Eols to the address indicatedbelow.

EOI Applications must be submitted on or before (26-2-2014) at the address mentioned below. Latesubmissions will not be accepted. ToR & Forms can be downloaded from Ministry of Works & HumanSettlement website.

Terms of Reference

For preparation of Rules and Regulations for Implementing the Road Act 2013 of kingdom of Bhutan

1. Background

The Road Act of the Kingdom of Bhutan 2013 was approved in the year 2013 by the first Parliamentin the io" National Assembly session. The Department of Roads (DoR) Ministry of Work andHuman Settlement ( MoWHS) is designated as the ational Road Authority of the Kingdom ofBhutan. The DoR being the ational Road Authority is mandated to implement the Road Act of2013.

2. Objective

The objective of the proposed consultancy service is to prepare the rules and regulations for theimplementation of the Road Act 2013

3. Scope of service

The Department of Roads intends to engage the services of a ational Legal Consultant havingextensive experience in the area of drafting of legal instruments to carry out the assigned taskthe consultant shall work under the overall guidance of the Department of Roads. The scope of thework shall include but not limited to the following:

Investigate/review existing legal and institutional framework and draft the appropriate Road rules &regulation.

Identify regulatory and/or institutional issues that may impact the Road rule and regulation.

Conduct in-depth consultation with the relevant stakeholders.

Assist Department of road (DoR) till the final approval of legal instrument by the government.

Do and perform such other tasks and assignments which are reasonably required by DoR from theconsultant that is/are necessary for the achievement of the assignment.

4. Deliverables from Consultant:

I. Summary paper of the existing regulatory framework and international best practices on roadrule and regulation.

2. Present the draft to the relevant stakeholders and incorporate suggestions/feedback into thefinal version for submission to the Government for accord of approval.

3. Submit finalized draft of Road Rules and Regulations to DoR

5. Qualification of National Consultant

The ational Legal Consultant should have:

I. A minimum of Bachelor's Degree in Law;2. Skills and experiences necessary to undertake the range of tasks set out in these Terms of

Reference;3. Substantive experience of working on assignments related to advising public sector entities;4. A minimum of5 years working experience in drafting for similar rules & regulations;5. Excellent communication and interviewing skill:6. Proficiency in writing; and7. Hold a valid Bhutanese consultancy license registered with COB.

6. Timeframe and work

The timel ine for the above mentioned scope of works are as follows:

The submission of initial draft report for presentation to stakeholder within 2 months from theAward Letter

Submission of final draft report: Imonth from the date of draft presentation

The total time allocated for assignment/consultancy is 3(Three months) only

Assist DoR in getting the approval: Till the final approval is received from the Government

ote: The shortlisting of the firms will be done based on the approved criteria up to a maximum of4or 5 firms.
