CONSIDERATION OF SENATE B I L L 192: S e n a t o r McCallum, D i s t r i ~ t 1 2 , s p o n s o r o f S e n a t e B i l l 192 s t a t e d t h i s b i l l would g i v e t h e e l e c t e d coun ty o f f i c i a l s a 20% r a i s e i n pay a s w e have i n t h e p a s t . T h i s p r o c e d u r e seems t o meet w i t h t h e a p p r o v a l o f e l e c t e d o f f i c i a l s .

in support of Senate Bill 192. Mr. Bell asked the committee to consider an amendment to the bill to make a 10% increase in 1977 and a 10% increase in 1978. Tom Honzel, County Attorney's Office, Lewis & Clark County, supported Senate Bill 192 and recommended an amendment to the bill (attached). Ray White, County Assessors Association, stated assessors wanted to be included with the elected county officials. Mr. White supported Mr. Bell's amendment. Bonnie Miller, Clerks and Recorders Association, testified in support of Senate Bill 192 and Mr. Bell's amendment. Robert Deschamps 111, County Attorney's Office, Missoula, favors Senate Bill 192 and Mr. Honzel's amendment. Helen Kovich, Clerk and Recorder, Lewis & Clark County, and Robert Arras, Clerk and Recorder, testified in support of Senate Bill 192. Mr. Arras submitted letters from elected officials in Missoula County (attached).

There were no opponents of the bill present.

After a brief discussion by the committee, Senator McCallum stated he saw nothing wrong with continuing a custom that evidently has been most agreeable to all concerned.

Vice Chairman Watt turned the Chair over to Chairman McCallum to continue the hearing.

CONSIDERATION OF SENATE BILL 195: Senator Flynn, sponsor of the bill, gave a brief resume.

Tom Collins, Montana Association of Realtors, testified in support of Senate Bill 195.

Jim Richard, Department of Community Affairs, opposed Senate Bill 195. Dean Zinnecker, Montana Association of Counties, stated 10,000 square feet is too small and the cash donation in lieu of dedication should remain in effect as it is very difficult for local government to handle small parks and the maintenance of them. Dean Holmes, Mayor, Miles City, opposed certain parts of Senate Bill 195. He feels the cash donation in lieu of dedication to be very important. Dan Obermeyer, Montana Association of Planners, supported key concepts of Senate Bill 195, but opposed the size of parcels that would cause sub-standard parks. Donald Kerns, Assistant Ciky Manager, Helena, opposed Senate Bill 195 (attached>- Denis Vogt, Lewis and Clark Planning Board, opposed Senate Bill 195. Glen Drake, League of Cities and Tow--- opposed Senate Bill 195 due to the density factor contrc;.

Senator Flynn stated that c+.tics have park boards

but in subdivisions the people buying the lots pay for the parks.

Senator Thomas moved to amend Senate Bill 192 as follows :

1. Amend page 4, section 1. Following: line 24 Insert: "Section 2. One-half of the total salary increases provided for in section 1 shall be effective July 1, 1977, and the remainder of such increases shall be effective July 1, 1978."

Senator Lockrem seconded the motion. A roll call vote was called by the Chairman (attached). Motion carried.

Senator Peterson moved the following amendment to Senate Bill 192:

2. Amend page 4, section 1, line 24. Strike: I' ($25,000) " Insert: " ($30,000) "

Senator Watt seconded the motion. A roll call vote was called by the Chairman (attached). Motion carried.

Senator Thiessen moved that Senate Bill 164 be given a "Do Pass" recommendation. Senator Lockrem seconded the motion. Senator Dunkle moved that Senate Bill 164 be given a "Do Not Pass" recommendation. Senator Story seconded the motion. A roll call vote was called by the Chairman (attached). Motion carried. Senator Thiessen asked for a minority committee report.

Senator Watt moved that Senate Bill 192 be give an "And As So Amended, Do Pass" recommendation. Senator Peterson seconded the motion. A roll call vote was called by the Chairman. Motion carried.

Senator Story will work with Senator Flynn on Senate Bill 195.

ADJOURN: The meeting adjourned at 11:15. The next meeting will be Monday, January 31, 1977 to consider Senate Bills 224 & 225.

Dear Senator McCallum:

As I discussed with you previously, Senate B i l l 192, which you are sponsoring, increases the salaries of the elected county off ic ia ls with the exception of county attorneys in the seven largest counties.

The Montana County Attorneys1 Association respectfully proposes for your consideration the following amendment t o that B i l l :

Amend page 4, l ine 24, by striking "$25,000 .OO per year" and inserting therefor the f o l l b g langu- age: "the same as the salary paid to a judge of the d i s t r i c t court."

The principal reason for the proposed amdment is that the qualif i- cations for the position of county.attorneys in counties with populations over 30,000 are exactly the same as the qualifications for d i s t r i c t court judges .

In addition, a number of recent reports, including the report from the Montana Justice Project, recomnend that where the prosecuting at tor- ney is a fu l l time position, h is salary should be the same as that paid to judges having general t r i a l jurisdiction in the state.

I f the proposed amendment is not accepted, we respectfully request that county attorneys in the seven largest counties be given salary in- creases comparable to those which have been proposed for the other elected county officials .

The County Commissioners of Cascade County request your support of Senate Bill 192.

We a r e asking for a 10% sa lary increase f o r Fisca l Year 1977-78 and a 1070 increase fo r F i sca l Year 1978-79. Elected officials of F i r s t Class Counties work on a full- time bas is and we feel an increase in this proportion, covering the next two yea rs , is reasonable and justified.

If this ra ise is not granted, i t would be 1979, when the legislature is again in session, before a pay ra i se for elected officials could be considered.
