INFO FOR ALL TRUCKS


All trucks equipped with an engine electrical managed must have the electronic control and related electric cables suitable for the external manual command.

The trucks delivered to FBG must have the features specified.

All trucks with features different different from those specified should cause delay on delivery and the charge for the modification needed.

Important

The trucks must respect the manufactures specification depending on the destination country and type of equipment installed.

The basic machine includes the following components: 1aE050

LaFBGs.r.l.avràperòlafacoltàdivolgersianchealgiudicedeldomiciliodelcompratore.

ART.1-ORDERTheorder is irrevocable for theBUYINGFIRM,butnonfor FBG S.R.L., unless acceptedin writingby their legal representativeand administrator. Any special agreement related to the supply inthis order, even if arranged with agents or delegates of FBG SRL, is not binding on FBG S.R.Lunless acceptedby his legal representative and administrator.Theorder has tobeconfirmed bythepaymentofadepositof30%ofthetotalprice.Theamountisanon-interest-bearingdeposit.Thedeposit will not bepaid back by FBGS.R.L.andwill bekept as a refund in casetheorder iscountermanded by customer. Should FBG S.R.L. learn, after the order confirmation, that theBUYINGFIRMisinbadeconomical conditions,special guaranteesmaybeasked,thelack ofwhichwillvoidthecontract,withtheabovementionedconsequencesfortheBUYINGFIRM.ART.2-LISTPRICESFor standardproducts,thepriceswill beappliedaccording topricelistsin forceatthemoment oftheorder.Forcustomproducts,priceswill bedeterminedfromcaseto case,andwithoutrelationto prices of standard products with similar features. Any additional machinery applied tostandardproductsare inno caseincluded in list prices and/or offer pricesof standardproducts,and their priceswill have to specified separately and agreed from case to case. Theprices arealwaysreferredtothematerialsandproductsinthecontractandfordeliverytermsspecified.Thus,ifproductionwillbepostponedforreasonsnotduetoFBGS.R.LART.3-DELIVERYDelivery ismeant to beeffectivewhen thecustomer will be informed that thegoodsare inFBGheadquarters.The delivery terms are given just as an indication and start from the moment in which allelements inthecontract havebeenestablished,andalldatahavebeentransmitted toFBGS.R.L..Inaddition,all instalmentsmust bepaidby BUYER.Thedeliverytimeis countedinworkingdays,and isprolongedincaseofeventswhicharenot duetoFBGS.R.L.,including strikes,fire,flooding,delayinreceivingrawmaterialsfromsuppliers,lackofpower.The delivery date refers to the main part and not to accessories, the lack of which does notprevent the main products to be used, and partial deliveries are allowed. Anyway, a delay indelivery will not entitleBUYER to a refund different to the agreed one.Delivery ismeant tobeeffectivewhenthecustomer will beinformedthat thegoodsareinFBGheadquartersreadytobedelivered,or whenthey aregivento the carrier, and from thatmoment onthegoodsare underthebuyer'sresponsibility.After 10calendar days from thenotificationtothecustomer that thegoodsarereadytobedelivered, if theBUYER does not collect them,directly or by designated people,or if FBG S.R.L.cannotsendthegoodstotheBUYERbecausenoinformation isgivenonthedestination,FBGwillbeentitledofsendingthegoodstotheaddressoftheBUYER,or stock themwherepossible,eveninunguardedplace.Inboth cases,expensesfor moving,stocking andmaintenance,and risksduetogoodskeptinunguardedplaceswillbechargedtotheBUYER.ART.4-MODIFICATIONSFBGS.R.L.hasthefacultyofmodifying theproducts,without being obligedto inform theBUYINGFIRM if the modifications are considered by FBG S.R.L. an improvement to the products. Inadditions, modifications introduced by FBG S.R.L. to their standard products after the orderconfirmationarenot tobeintroducedinalready builtproducts,orproductsinactual production.TheBUYERcannotrefusethegoodsopposingtechnicalchangesappliedaftertheorder.ART.5-PAYMENTSTheBUYER will fully pay to thebank indicated by FBG throughbank transactionbefore delivery.Pricesalwaysreferto goodsdeliveredat FBGheadquarters,andthecurrency isEURO.Taxesandcosts related to bills of exchange, contract registration etc. are charged to BUYER. Unlessdifferently agreed and confirmed in writing, it is conventional that for each supply the firstinstalment has to be paidatorder,whiletheremaining sum hasto bepaid in10days from thenotificationthat goods areready to be delivered,andanyway beforethegoods aredelivered tothe buying firm. In default of payment of theentire amount to FBG, the BUYING FIRMwill becharged of interests and an interest rate five points higher that the official bank rate will beapplied.ART.6GUARANTEEThe construction of machinery in the order has a generic guarantee of 12 months startingfromdeliverydate.Thistermwill behalvedif themachineswork formore than16hoursper day,but will not be extended for any reason.TheBUYING FIRMwill have to notify toFBG S.R.L. thedefectsdiscovered,inwriting byregisteredpostwithineightdaysfromtheoccurrence,otherwisetheguaranteewill notbeeffective.TheguaranteeentitlestheBUYERtothesubstitutionor repairof thepartsdefectiveforbadqualityofmaterialsorbadconstruction,ifdefectsarerecognizedbyFBG and prevent the machine from working correctly. Transport, installation, work force forsubstitutionarechargedtoBUYINGFIRM.All partsnotmanufacturedby FBG,i.e.electricmotors,cables, rubber belts,compressors,weighing systems,aredirectly covered byguarantee from therespectiveproducers. By signing this order, thebuying firmsdeclares toaccepts theseterms ofguaranteeandacknowledges they arenot entitled inany case toask for refunds for damagesorexpenses,duefor exampleto themachinerystopduring theperiod requiredforrepair,includingthe period from the notification of the fault to the beginning of the repair. Theguarantee doesnot cover all the part subject to wear and tear, and all damages due to wrong use, lack ofmaintenance,use of wrong spareparts, inadequate oil,bad assembly (if not made by FBG).Theguaranteewill cease in case of debts from the BUYER to FBG, or if changes are made to themachines without FBG approval in writing. In no case the substitution of the wholemachine isprovided, astheguarantee islimitedtothefaulty component. FBG S.R.L.will not be responsiblefor any event,inparticular damagestopersonsor objectsbelongingto theBUYINGFIRMor thirdparts,happenedforreasonsconnectedtofaultsofthemachinery.ART.7-INFORMATIONThepricelist,thedrawingsandtechnical featuresof thegoods,i.e.weights,measures,capacitiesand performances,communicated to the BUYINGFIRM from FBGremain FBGpropriety and aregivenjustasanindicationanddonotrepresentabinding,andanywaytheydependonutilization.ART.8-ASSEMBLYANDFINALINSPECTIONAssembly, if includedin thecontract,will bemadeby FBGbymeansof onetechnician,after therelated priceand conditionsareagreed. Thetechnician will anyway haveto be considered as aworker employed bytheBUYINGFIRMasregardsany injury ordamagecaused totheworker ortothirdpeopleduring orrelatedtoassembly.TheBUYINGFIRMwill havetosupply,at their ownexpenses,toolsandlifting means,andunskilledlabour tohelp thetechnician.TheBUYINGFIRMhas to finish foundation works, civil works, electric and water lines to the switchboard, waterpumpsandall whatrequired forplantinstallation.Thefinal inspectionandtestwillbemadeonlyif included inthecontract,anditwill bemadeatBUYER'sexpensesandfor thetimeagreed.Finaltest will have to bemade without and with raw materials. Cement, aggregates and water willhavetobeprovidedbytheBUYINGFIRMwhenpreviously agreed,otherwisefinaltestwill onlybemadewithout rawmaterials,and the test with rawmaterials will bemade only if the BUYINGFIRMS agrees to cover expenses dueto delay.After final test ismade, theBUYING FIRMhas towrite a statement proving the results of the test. If the final inspection is not made or theaforesaidstatementisnotemitted,theplantisconsideredtobeacceptedwithoutrestrictions.ART.9-SOLVEETREPETENo claimcanbe lodgedby theBUYING FIRM,until theBUYINGFIRMpays theentirepriceof thegoodssupplied.ART.10-PLACEOFJURISDITIONInterpretation of thepresent contract shall be done in its italian version. TheCourt ofBRESCIA,Italy,istheonlycourthavingjurisdition.
