THURSDAY, DECEMBER 10, 2015

Call to order President Molly McLoughlin called the RMGPA General Membership Business Meeting to Order on Thursday, December 10, 2015 at 11:30 am MST at the Embassy Suites Hotel (CS North), Colorado Springs, Colorado. Molly introduced the RMGPA Executive Board Members: Past President – Kristen Spicola, CPPB – (on Google Hangouts) Vice President - Skeet McCracken, CPPO, CPPB Treasurer - Vivian Harvell Secretary - Mary Kirschmer, CPPB President – Molly McLoughlin, CPPB She also welcomed the following attendees from the other Chapters who joined on Google Hangouts: Victor Leamer – State of Alaska Lisa Mendoza – Honolulu, Hawaii Sue Ownby – Washington Chapter of NIGP Approval of minutes President Molly McLoughlin noted that the Fall Conference General Business Meeting Minutes from September 11, 2015, at the Denver Police Protective Association Event Center in Denver, Colorado are in the RMGPA Winter Conference packet for review. President Molly McLoughlin asked for a motion to accept the Minutes as presented. Skeet McCracken, from Poudre School District, made a motion to accept the Minutes for the RMGPA General Membership Fall Business Meeting 2015. Eileen Gonzales, from El Paso County, seconded the Motion. The motion passed unanimously and the Fall Conference General Business Meeting Minutes were adopted. Vice President’s Report (Vice President – Skeet McCracken) Skeet mentioned the student membership brochures and stated that there is a package at the sign-up desk. He went on to say that they turned out really nice and that he and Molly have already used them at a tabling session. Skeet stated that they are also working on the student membership part. They are offering students the opportunity to be able to intern with an agency. He requested that if anyone is open to this, to please let him know. He will then determine where students live, so that when they are out of school, they can intern. Skeet stated that he, Ed Bonnette and Jill Wilson went to CU and explained RFPs, Bids and quotes and how they differ from the private sector. Past President’s Report (Past President – Kristen Spicola) Kristen provided an update on the rewards program. She stated that a few more individuals used their rewards. A total of $884 in rewards were used. She thanked everyone for using them. Kristen encouraged everyone to apply next year for rewards to be used at conferences and courses. She stated that the rewards applications will be available in January. Kristen went on to say that there was $716 in rewards that were not used this year. Vivian Harvell provided the treasurer’s report as of November 30, 2015 Primary Account $38,804.86 Secondary Account $22,129.33 Money Market Account $5,102.60 Total $66,036.79 as of 11/30/15 Profit/ Loss Statement year to date for 2015: 2015 Revenue $86,748.78 2015 Expenses $45,110.71 Net Income $41,638.07 as of 11/30/15 Vivian said thanks to the RVTS, the fall conference and the vendor tradeshow, everything is looking very well. President Molly McLoughlin asked for a motion to accept the Treasurer’s Report as presented. Retired Lifetime Member, Jim O’Neill, made a motion to accept the Treasurer’s Report. Ed Bonette, from City of Fort Collins, seconded the motion. Motion passed and was approved to accept the Treasurer’s Report. Treasurer’s Report is adopted. Committee Reports

Awards (Chair – Curt DeCapite, Co-Chair - Mary Jablonski) Curt encouraged everyone to watch for the Buyer and Manager of the Year nominations, which will be coming out in December. He stated that if anyone has a colleague they want to nominate, please get them in. Communications (Chair – Tim Wellmann) Tim stated that everything was presented earlier in the website and Communications presentation. Chapter Enhancement (Chair – Roman Hernandez, Co-Chair – Traci Burtnett) Winter Vendor Exhibit Showcase has been fully booked, a total of 37 booths were available. Education/Professional Development (Chair – Diana Cantu, Co-Chair – Sherri Gibson) See written report. Diana encouraged members to keep going to the RMGPA website. New classes will be posted on January 4th. She will be sending out a survey in January to see what educational needs there are. Diana encouraged members to apply for scholarships. She said there are a lot out there and only one was issued for an NIGP course. Molly stated that if anyone is in need of CEUs and continuing education and their agency cannot send them, we have scholarship money available. Scholarship forms are on the website under education. Elections (Chair – Linda Meserve) Linda stated that approximately 18% of folks have voted. She advised that the laptop is onsite so individuals could vote if they haven’t already. She went on to say that there are candidates running for Vice President and the Secretary is unopposed. The cutoff is at midnight tonight.

Marketing (Chair – Farrah Bustamante, Co-Chair – Shannon Sprague) There are no additional updates other than that we are in need of volunteers for Marketing. Membership (Chair – Patricia O’Neal, Co-Chair –Barbara Hauptli) See written report. Pat recognized all the first time conference attendees. Newsletter (Chair - Marcia Sieben, Co-Chair – Kelly Wooden) See written report. Marcia stated that the first deadline for 2016 is March 21, 2016. All upcoming newsletter article deadlines are published in each newsletter. Marcia encouraged submittal of articles and stated that there is the potential to submit to NIGP. Marcia stepped down from the Board. Kerry Sheahan will take her place. She stated that she will stay on as committee member to mentor and Kelly Wooden will continue on as Co-Chair.

Programs (Chair – Valerie Scott, Co-Chair – Beth Hewes) See written report. Everyone was encouraged to read the report and thanked for their food donations. Valerie thanked everyone for attending and stated that we have over 100 attendees. Valerie stated that Programs is also looking for volunteers. She will be stepping down as Chair but will continue on the committee. Beth will be the Chair in 2016. A conference survey will be sent out to determine what other topics might be of interest for 2017. Location and topics are being based on membership needs. Business Advisory Community (Chair - Pete Toth) Effective January 1, 2016, the committee will expire. Conversation will be surrounding other aspects for the vendor engagement piece. Molly thanked Pete for connecting us with BidNet to reach out to over 11K vendors. She stated that it truly helped with participation in the shows. Old Business: None. Molly stated that the BAC will be dissolving. She announced that Marketing and Communications are seeking volunteers. She stated that volunteering does not have to be a ton of hours. It could be something simple like making phone calls, etc. New Business: The question was asked if location was an issue for volunteering. Molly replied that it was not.

Molly acknowledged Kristen as Past President and thanked her for everything she did in 2014 as President as well. She stated that Kristen came up with an idea and developed and created a Task Force Committee. She also created new RMGPA connections with other agencies and vendors. In addition, she created an incentive program for free membership at the end of the year, which could also be applied to the next year. In working with Pat, she acknowledged membership milestones. She also came up with the first annual spec drive, as well as website enhancements, volunteer certificates and points in Chapter Manager. Kristen also created the welcome video, conducted 3 CPPO/CPPB study sessions and was a volunteer speaker at the NIGP Forum in 2014. Kristen also participated in panels on disaster support for other agencies going through disasters. One of her greatest accomplishments in leading us was helping us win the Chapter of the Year Award. A plaque was presented to Kristen. Tina Garcia accepted it on her behalf since she was not able to attend in person. Kristen introduced Tina Garcia as her replacement. She recognized everyone involved and stated that everything was done as a team. She stated that the experience, relationship and networking is truly like a family and that this is the most important thing she has done. She encouraged new members to get involved. President Molly McLoughlin requested that all members gather in the lobby for a group picture. Adjournment A motion to adjourn was made at 12:10 p.m. MST by RMGPA Lifetime Member, Curt DeCapite. Barbara Hauptli, from Roaring Forks Transportation Authority, seconded the motion. The motion passed unanimously and the meeting was adjourned. Overview

o Tim and I met on December 31st to transition the Communication Committee. o The Contact Us Page has been updated with new Board members. o We have a new 35th Year banner. o If you have news events you want on the webpage, please let us know [email protected]

As a reminder, we have features on the website to help you in your procurement work. You can track your CEUs under to the Member Profile/ History area of the RMGPA website, this feature allows members to upload non-RMGPA related records for classes and seminars to their membership profiles. This allows the addition of records (not generated automatically by our website and includes storage of points/hours in the record and generates a certificate as well). The uploaded record and certificate will display in your member profile and show as recertification points and/or CEU’s. Another feature we have is MemberConnect. MemberConnect is just one of the valuable services that come with an active RMGPA membership. MemberConnect is a mailing list server that allows active members to submit purchasing-related questions or issues which are then transmitted via email to other members on the list via a single email address: [email protected] . To get onto the listserv to receive or be able to send these emails to your peers, visit http://www.rmgpa.org/insidepages/connect/index.cfm (You may also visit this website if you wish to unsubscribe from this service.) Congratulations are in order to the two recipients of Scholarships to start off the year.

Stacy Romero from Colorado Department of Human Services received a $700 scholarship to

attend the Sourcing in the Public Sector course.

Brittany Wilcox from Denver Public Schools received a $700 scholarship to attend the

Introduction to Public Procurement course.

3. New CPPB Recipient

As a result of certification testing in October 2015, the following RMGPA member has been awarded

the coveted CPPB designations from the UPPCC:

According to the UPPCC website, the Universal Public Procurement Certification Council (UPPCC)

Examinations measure professional competence and the understanding of the body of knowledge

surrounding public procurement. Certification is a voluntary action by a professional group to establish

a system to grant recognition to professionals who have met a stated level of training and work

experience.

Congratulations from the Professional Development Committee and all of RMGPA. We acknowledge

the hard work and dedication required to receive these certification.

2016 NIGP Forum Scholarship Program for Young and/or New Public Procurement Professionals

The Young Public Procurement Professional and New Public Procurement Professional Forum scholarships program

was developed in 2015 by the Forum and Products Exposition Committee to provide assistance to public

procurement professionals 40 years of age or younger OR for people new to the public procurement profession

(three years or less). Last year 44 applications were received and seven people received financial assistance to

attend the 2015 Forum. Forum scholarships are open to any Institute member.*

To be considered, all candidates must meet these criteria:

Be a NIGP member in good standing

Be a first-time NIGP Annual Forum and Products Expo attendee

Submit an application on or before the deadline of March 15, 2016

The applicant’s agency will not pay for Forum attendance Two separate scholarships are available under this program. Those applying for the young professional scholarships must be 40 years of age or less. Those applying for new professional scholarships shall be working full time and have been employed in the public procurement profession for three years or fewer. Application Requirements:

Submit a completed scholarship application form along with the following supporting documentation: o An essay demonstrating an avid interest in a career in government procurement; o A copy of your current resume;

o A recommendation letter on business letterhead from your manager or an agency administrator

who is familiar with your work, or a recommendation letter from the President of your local NIGP

chapter.

Scholarship winners will receive $2,500 that can be used to cover expenses associated with attending the NIGP Annual Forum and Products Exposition including registration fees, meals, and travel expenses. Scholarship recipients will be expected to volunteer for two shifts working onsite during the Forum with the Quality Control Team (estimated commitment = 3 hours total). Submission Information: The applicant must follow all guidelines and instructions to be eligible for an award. Applications will be forwarded to the NIGP Forum and Products Exposition Committee, who will review and select scholarship recipients. Applications must be received by March 15, 2016. All required documentation must be present upon submission of the application. Failure to fully complete the application or submit the required documentation may result in non-consideration your submittal. Checks will be sent in advance of the Forum. If you are unable to attend, your scholarship will be forfeited and a complete refund must be sent to NIGP within 60 days of the completion of the Forum. Complete the application form below and send a scanned copy, along with your supporting documentation to [email protected]. Scholarship winners will be notified via email by April 15, 2016. The Forum Scholarship program will award a maximum of $20,000 for the 2016 Forum in National Harbor, MD. *Membership status may be confirmed by contacting our customer care team at [email protected].

2016 Legislative Update as of March 7, 2016 HOUSE BILL 16-1001 CONCERNING A REQUIREMENT THAT A BUSINESS PERFORMING WORK FOR THE STATE PURSUANT TO A STATE CONTRACT COMPLY WITH EQUAL PAY STANDARDS. The bill requires a business that bids for a contract with a governmental body to submit with its bid certification that it is in compliance with state and federal equal pay standards and laws; except that this requirement does not apply to businesses that have 50 or fewer employees. The executive director of the department of personnel, or the executive director's designee (executive director), is required to develop a form for a business to use to certify that it is in compliance with equal pay standards and laws and that, if awarded a contract, it will remain in compliance with such standards and laws throughout the term of the contract. The executive director is required to ensure that the form requires a business to certify certain general information regarding its employees and employment and hiring practices in connection with equal pay laws. A business that is awarded a contract is required to ensure that any subcontractor that it uses to fulfill the terms of the contract is also in compliance with equal pay standards and laws. All businesses that are awarded contracts by a governmental body or that are subcontractors for a business that was awarded a contract by a governmental body are required to keep and maintain certain information related to their employees, broken down into categories by gender, race, ethnicity, and national origin, for the term of the contract with the governmental body. If, after awarding a contract to a business, a governmental body determines that the business knowingly submitted false information on the certification form for equal pay compliance required by the bill, the governmental body is required to terminate the contract. 01/13/2016 Introduced In House - Assigned to Business Affairs and Labor HOUSE BILL 16-043 CONCERNING THE JOINT TECHNOLOGY COMMITTEE'S AUTHORITY TO APPROVE THE REQUEST FOR A WAIVER OF CERTAIN DEADLINES AFTER MONEYS FOR A PROJECT HAVE BEEN APPROPRIATED. Capital Development Committee. Pursuant to current law, when a state agency or institution of higher education (agency) enters into a professional services contract, the contract must be executed and encumbered within 6 months after the appropriation for the project becomes law. For a project where a professional services contract is not required, the agency must enter into the contract within 6 months after the appropriation for the project becomes law. If an agency determines that it cannot meet the 6-month deadline for a project, the agency may request that the capital development committee recommend to the controller that the deadline be waived for the project. The bill changes the procurement goal into a requirement as follows:

• In the 2016-17 fiscal year, at least one percent of state contracts by dollar value shall be awarded to service-disabled veteran-owned small businesses;

• In the 2017-18 fiscal year, at least 2% of state contracts by dollar value shall be awarded to service-disabled veteran-owned small businesses; and

• In the 2018-19 fiscal year and in each fiscal year thereafter, at least 3% of state contracts by dollar value shall be awarded to service-disabled veteran-owned small businesses.

Current law allows a state agency to grant a preference to a service-disabled veteran-owned small business to satisfy the procurement goal. The bill maintains the ability for a state agency to grant such a preference to satisfy the procurement requirement and also allows a state agency to grant a preference for a business that includes in its bid that it will use at least one service-disabled veteran-owned small business as a subcontractor if the business is awarded the contract. The bill also authorizes a state agency to include work performed by a subcontractor that is a service-disabled veteran-owned small business to satisfy the procurement requirements. If a business is given a preference on the basis of using one or more service-disabled veteran-owned small businesses as a subcontractor, the bill requires the business to submit certain information to the state agency that awarded the contract regarding the number of such subcontractors used and the approximate dollar value of work that was performed by such subcontractors. Current law requires a business to be certified as a service-disabled veteran-owned small business by the center for veterans enterprise within the United States department of veterans affairs before being given a preference. Due to the significant amount of time that it takes for a business owner to obtain a service-disabled veteran-owned small business certification, the bill extends service-disabled veteran-owned eligibility to business owners who have applied for certification from the center for veterans enterprise and who have submitted certain documentation to the secretary of state's office regarding the business owner's release or discharge from active duty military, the business owner's military service-related disability, and the business owner's efforts to become an officially registered and verified service-disabled veteran-owned small business by the center for veterans enterprise. The bill directs the secretary of state to create and maintain on its website a list of businesses that have not yet been officially registered and verified as a service-disabled veteran-owned small business by the center for veterans enterprise but that have submitted the required documentation for service-disabled veteran-owned small business eligibility. The bill specifies that businesses that are on the list maintained by the secretary of state are eligible for a preference in state contracting and authorizes a state agency to include work performed by businesses on the list to satisfy the procurement requirements. In addition, the bill modifies the information that a business must submit with a bid to be eligible to receive the preference and modifies existing reporting requirements. 01/20/2016 Introduced In House - Assigned to Business Affairs and Labor SENATE BILL 16-063 CONCERNING THE AUTHORITY OF A LOCAL GOVERNMENT TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH AN OUT-OF-STATE LOCAL GOVERNMENT TO PROVIDE CRITICAL PUBLIC SERVICES. Section 1 of the bill authorizes any county or municipality in this state to enter into an agreement with a county or municipality from a bordering state to provide emergency services. The agreement must comply with the general requirements established in law for intergovernmental agreements. If the governor declares an emergency and activates the "Emergency Management Assistance Compact", any provision of the agreement that conflicts with a provision of the compact or a procedural plan or program created in accordance with the compact is void. Section 1 also grants immunity for persons performing duties under the agreement and section 2 assigns liability that accrues under the "Colorado Governmental Immunity Act" to the Colorado county or municipality that is a party to the agreement. SENATE BILL 16-028 CONCERNING INCREASED REPORTING OF DEMOGRAPHIC DATA ON GOVERNMENT CONTRACTS ON THE COLORADO TRANSPARENCY ONLINE PROJECT (TOP) SYSTEM. RMGPA Membership Co‐Chair Barbara Hauptli and I are very excited about recognizing and 

acknowledging our awesome RMGPA Membership at upcoming conferences during the year.  It 

is our goal to highlight various members and recognize longevity and service to RMGPA.   So, 

please make sure that your membership profiles are up to date.  We also want to increase 

membership in the surrounding states and the Western Slope so we will be initiating 

membership drives with this focus.  

We are also focusing on increasing the number of Student Members in RMGPA.  We currently 

have one, Jennifer Guzman, a second year law student at the University of Denver.  Jennifer is a 

intern at the Colorado Department of Transportation.   

We currently have 492 Active Members including 22 Lifetime Members and 1 Student Member.  

We will also be encouraging more members to remain active and become Life Time Members 

of RMGPA as they retire.

Programs Committee Report March 11, 2016

1. 2016 conferences: The following locations and dates have been confirmed:

2. Summer Conference will be in Snowmass this year at the Westin. Our keynote speakers are Nick

Kittle, Kathryn Rowe, and Narita Holmes. Nick will be presenting a topic on civic innovation. For more information about Nick, please visit his website at nickkittle.com. Kathryn will be presenting on PTAC, and Narita will be presenting on purchasing fraud and how to spot it. We also have some great break-out sessions lined up including; software terms and conditions, and evaluating bid responsiveness. The conference fee is $129, and the contracted room rate is $119/night for single and double occupancy. The Westin has also agreed to honor the price 3 days before and 3 days after the conference. Also, there is no pet or resort fee for us! Please note this great deal will close on May 13, 2016! IF YOU WANT TO STAY AT THE WESTIN FOR $119/NIGHT, YOU MUST REGISTER WITH THEM BY MAY 13, 2016. Because of this early cut-off date, we will open registration to the Summer Conference in mid-March. The registration will include a link to register for the hotel room and a reservation number.

3. Conference Location Survey results are in. Boulder, Colorado Springs, Denver Metro Area, and Northern Colorado were the top four location picks for the Spring, Fall, and Winter conferences. Summer conference was evenly split on the locations between the mountain ski resorts and the Front Range cities. The Programs Committee will use the results to look for locations for 2017 and 2018.

4. Conference fees are increasing by $10 per conference to help offset the rising cost in conference locations and speakers. The Programs committee did a survey last year with other professional conferences and RMGPA consistently offers a conference fee on the low end of the scale. Our goal is to have the best speakers while making it affordable for our members to attend. This relatively small increase will help ensure the viability of future conferences, as well as help fund other services RMGPA offers, such as scholarships and rewards.
