TAKE notice that an application will be made onthe 26th day of August, 1959, in the forenoon, toa Judge of the Supreme Court in Chambers foran Order that the property mentioned hereunder,viz:

Funds in the hands of the Public Trusteein and for the State of Western Australia (Ad-ministrator of the estate of John Flannigan,deceased) amounting to four hundred andseventy-two pounds one shilling and sixpence(t472 is. 6d.)

shall be and become the property of the Crownby way of Escheat.

General Objects: The general objects of theScheme are to improve and develop the area to thebest possible advantage and to secure suitable pro-vision for new roads and to enable the land inthe Area to be subdivided,

AcquisItion of Land: The land in the Areaof the Scheme shall be resumed or otherwiseacquired for the purposes of the Scheme.

Re-survey of Area: The area shall be re-surveyed according to the design shown on PlanNo. 2.

The remaining lots, if any, will be treated assurplus lots.

7. surplus Lots: All surplus lots shall be soldby the Board.

8. Method of Sale of Surplus Lots: The Boardmay sell the surplus lots, either by public auction,tender or private contracts, as a whole or in sep-arate lots, upon such terms and conditions as theBoard shall think fit. In the event of a sale byprivate contract the price shall be not less thanthe price recommended by the Chief Valuer of theTaxation Department of western Australia unlessafter submitting the land for sale by public auctionor by tender that price has not been obtained.

9. Costs of Scheme: The Scheme shall be debitedwiththe administration costs of the Scheme;the costs of the survey of the Area;

Cc) the costs of construction and drainage ofthe new roads;

Cd) all compensation payable to owners whodo not accept the offer mentioned in para-graph 6 hereof and all costs and expensesof determining and settling the compensa-tion payable;the costs of the transfers of the new lotsto the owners pursuant to paragraph 6hereof.all other costs and expenses incidental tothe Scheme.

10. Apportionment of Costs: The costs of theScheme shall be divided equally between all newresidential lots in the Area. Upon a transfer of anew lot to an owner, his proportion of the net costsof the Scheme shall be paid by him.

11. Claims for Compensation: In the event ofany claims for compensation not having beensettled at the time when the Board is ready totransfer lots pursuant to this Scheme the Boardmay estimate the amount of compensation payableand the costs relating thereto and debit the Schemewith the net amount so estimated. In the eventof the Board doing so the difference between theestimate and the actual compensation and costpayable shall be received or paid by the Board asthe case may be.

12. Encumbrances on Title: In the event of anyland In the Area being subject to a registered mort-gage, charge or lease or to a caveat to protect theinterest of the purchaser, mortgagee, chargee orlessee, the Board shall not transfer a new lot to theowner unless subject to similar encumbrances orwith the consent of all persons entitled to thebenefit of the encumbrances.

13. Minimum Value of Building: No person shallconstruct or permit or authorise the constructionof any building (other than an outbuilding) withinthe Area of a value of less than £2,500.
