6. Re-allocation of Lots: The lots created by there-survey of the Area will be apportioned amongthe owners of the land in the Area as nearly asmay be proportionately to the area of land previ-ously owned by each individual owner. Each indi-vidual owner will be offered a block or blocks ofland as nearly as may be in the same position asthe land acquired from him and where possiblehaving the same amenities of view, corner positionand the like. The offer will be made subject to theowner releasing the Board from all claims for com-pensation in respect of the acquisition of his land,and subject to the payment by him of his propor-tion of the costs of the Scheme.

The remaining lots, if any, will be treated assurplus lots.

7. surplus Lots: All surplus lots shall be soldby the Board.

8. Method of Sale of Surplus Lots: The Boardmay sell the surplus lots, either by public auction,tender or private contracts, as a whole or in sep-arate lots, upon such terms and conditions as theBoard shall think fit. In the event of a sale byprivate contract the price shall be not less thanthe price recommended by the Chief Valuer of theTaxation Department of western Australia unlessafter submitting the land for sale by public auctionor by tender that price has not been obtained.

9. Costs of Scheme: The Scheme shall be debitedwiththe administration costs of the Scheme;the costs of the survey of the Area;

Town Planning Scheme No. 5.(a) Area: This Scheme shall apply to the

land containei within a blue border on Plan No. 1and Plan No. 2. The said land is hereinafter re-ferred to as the Area.

(b) The authority responsible for the adminis-tration and enforcement of this Scheme is thePerth Road Board.

General Objects: The general objects of theScheme are to improve and develop the Area to thebest possible advantage, to secure suitable provi-sion for improvement to existing road layout, tosecure suitable provision for new roads and to en-able the land in the Area to be subdivided.

Acquisition of Land: The land in the Areaof the Scheme shall be resumed or otherwise ac-quired for the purposes of the Scheme.

The land outlined green on Plan No. 2 shall betransferred to the Crown in exchange for the landcoloured red on the same plan, such land beingat present vested in Her Majesty.

Re-Survey of Area: The Area shall be re-surveyed according to the design shown on PlanNo. 2.

Works to be Carried Out: The followingworks shall be carried out within the area:

The roads coloured brown on Plan No, 2shall be constructed and drained.

Re-Allocation of Lots: The lots created bythe re-survey of the Area will be apportionedamong the owners of land in the Area as nearlyas may be proportionately to the area of land pre-viously owned by each individual owner. Each in-dividual owner will be offered a block or blocks ofland as nearly as may be in the same positionas the land acquired from him and where possiblehaving the same amenities of view, corner posi-tion and the like. The offer will be made subjectto the owner releasing the Board from all claimsfor compensation in respect of the acquisition ofhis land, and subject to the payment by him of hisproportion of the costs of the Scheme.

The remaining lots, if any, will be treated assurplus lots.

'J. Surplus Lots: All surplus lots shall be soldby the Board.

8. Method of Sale of Surplus Lots: The Boardmay sell the surplus lots, either by public auction,tender or private contract, as a whole or in sep-arate lots, upon such terms and conditions as the
