PPP Changes INTERIM. FINAL. RULE. (IFR)  (is that an oxymoron??) 

This new document – 31 pages – is what matters most. 

Info for both borrowers and lenders

#1 – Single biggest change – How contractors/1099 expenses are handled (IFR pg. 11, h.)

Warning – still on application, and fact sheet – but IFR is key.

#2 – There is a brand new application form – it indicates you use 2019 calendar year data (IRF pg. 21, b. iii.)

#3 – The interest rate is changed to 1%

#4 – Banks are sort of “off the hook”, have low level of responsibility for verification of applicant data submitted

PPP Changes#4 – continued – Bank underwriting requirements. Confirm borrow certifications/Confirm receipt of information that borrower had employees they paid salaries and taxes for on or around February 15, 2020/Confirm dollar amount of average monthly payroll costs for preceding calendar year by reviewing payroll documentation submitted by borrower (IFR pg. 21, h. ii)

#5 – Confirms “First Come First Served” nature of the PPP (IFR pg. 13, m.)

#6 – Delays today’s submission date to next week, Tuesday??

#7 – Indicates loan forgiveness can be used for principal amount of loan AND accrued interest on the loan (IFR pg. 13, o.)

#8 – Confirmed e‐signatures or e‐consents can be used for submissions (IFR pg 13, l.)

#9 – No real help on forgiveness calculations – says SBA will issue additional guidelines

PPP Changes#10 – NO help on the $100,000 cap on compensation – does it cap benefits, retirement too?
