DECK PREPARATION & REMOVAL:

1. ALL REMOVAL OPERATIONS WILL BE COORDINATED WITH THE OHIO DEPARTMENT OF TRANSPORTATION, THE US COAST GUARD, THE ARMY

CORPS OF ENGINEERS, LAKE CARRIERS' ASSOCIATION, AND MITTAL STEEL.

2. J. B. FAY CO. EMPLOYEES WILL MARK OUT THE BEAMS IN ORANGE PAINT AND LAYOUT THE SAW CUT LINES IN GREEN PAINT.

3. THE EXISTING CONCRETE DECK WILL BE CUT INTO SLABS USING A 65 H.P. DIAMOND SAW. SAW CUTS ARE TO BE LOCATED AT THE CENTERLINE

OF THE EXISTING STRINGERS. DIMENSIONS ARE TO BE VERIFIED IN THE FIELD.

4. 70,000 LB CLASS EXCAVATORS EQUIPPED WITH A SLAB BUCKET WILL LIFT THE DECK SLABS AND LOAD THEM INTO A TRI-AXLE FOR DISPOSAL.

5. EXCAVATORS WILL BE REQUIRED TO ONLY TRACK OVER TOP OF THE EXISTING STRINGERS WHILE PERFORMING PICKS.

6. THE REMOVED DECK SECTION MUST BE CAREFULLY PLACED IN THE TRI-AXLE TRUCK TO AVOID IMPACT LOADS. EXCAVATORS WILL TREAD

CAREFULLY IN ORDER TO AVOID EXCESSIVE POINT AND IMPACT LOADING.

7. ALL DEMOLITION EQUIPMENT MUST REMAIN A MINIMUM OF 3' AWAY FROM ANY LEADING EDGE WHERE CONCRETE HAS BEEN REMOVED.

8. THE EXISTING FASCIA GIRDER IS TO BE REMOVED DURING DECK REMOVAL OPERATIONS. SEE SHEET 3 FOR STEEL REMOVAL DETAILS.

9. SLABS WILL NOT BE REMOVED OVER LIVE RIVER TRAFFIC. A SAFETY PERSON STAGED BELOW THE BRIDGE WILL VISUALLY MONITOR BOAT

TRAFFIC AS WELL AS MARINE CHANNEL.

10. WHEN A VESSEL APPROACHES, ALL WORK ON THE DECK WILL STOP UNTIL THE VESSEL IS CLEAR FROM UNDER THE BRIDGE. THIS WILL BE

ACCOMPLISHED WITH 2-WAY RADIO COMMUNICATION BETWEEN THE SAFETY PERSON BELOW THE BRIDGE AND THE FOREMAN AND OPERATORS

ON THE BRIDGE DECK.

11. SEE SHEET 2 FOR A CONTINGENCY PLAN IN THE UNLIKELY EVENT THAT A DECK SLAB IS DROPPED INTO THE CUYAHOGA RIVER.

A CONTINGENCY IN ORDER TO SAFELY RECOVER THE FALLEN

DECK SLAB AND NOTIFY THE PROPER AUTHORITIES:

1. THE US COAST GUARD IS TO BE NOTIFIED IMMEDIATELY.

2. IMMEDIATELY AFTER CONTACTING THE US COAST GUARD

SAFETY OFFICE, THE CORPS OF ENGINEERS IS TO BE

NOTIFIED. CONTACT FOR THE CORPS OF ENGINEERS IS VITO

MELILLI: 216-685-1205 (OFFICE) 216-701-5659 (CELL PHONE). IF

VITO MELILLI CANNOT BE REACHED THE GENERAL

EMERGENCY CONTACT FOR THE CORPS OF ENGINEERS WILL

BE NOTIFIED: 216-685-1200.

3. A TEMPORARY CHANNEL SHUT DOWN WILL BE COORDINATED

WITH THE US COAST GUARD IN ORDER TO PERFORM WORK.

4. CHANNEL TRAFFIC WILL BE COORDINATED WITH THE

FOLLOWING BUSINESSES:

4.1. LAKE CARRIERS' ASSOCIATION: 440-333-4444

4.2. MITTAL STEEL: 216-429-7536

5. A DIVE TEAM WILL BE MOBILIZED AND REQUESTED TO LOCATE

THE FALLEN DECK SLAB, ASSESS THE SITUATION, AND AID IN

THE IMMEDIATE REMOVAL OF THE FALLEN DECK SLAB IF

REQUIRED. CONTACTS FOR THE DIVE TEAM ARE:

5.1. UNDER WATER MARINE CONTRACTORS GEORGE ZILKA:

MINUTES FROM SITE]

6. A 50-TON HYDRAULIC CRANE WILL BE UTILIZED IN ORDER TO

RECOVER THE FALLEN DECK SLAB.

7. DIVERS WILL BE UTILIZED AS NECESSARY TO LOCATE AND AID

IN THE REMOVAL OF THE FALLEN DECK SLAB.

8. ONCE THE DECK SLAB HAS BEEN LOCATED, DIVERS WILL

ATTACH AIR BAGS TO THE SLAB WHICH WILL RAISE IT TO THE

SURFACE.

9. A WORK BOAT WILL BE UTILIZED IN ORDER TO MOVE THE

DECK SLAB CLOSE TO THE NORTH DOCK WALL TO SHORTEN

THE PICK RADIUS FOR THE RECOVERY CRANE.

10. THE 50-TON RECOVERY CRANE WILL RIG TO THE DECK SLAB

AND LIFT IT OUT OF THE CUYAHOGA RIVER. ONCE LANDED,

THE DECK SLAB WILL BE DISPOSED OF AS PER TYPICAL SLAB

REMOVAL PROCEDURES.

11. ONCE THE DECK SLAB HAS BEEN REMOVED FROM THE

CUYAHOGA RIVER THE DIVE TEAM WILL CONFIRM THAT THE

CHANNEL IS CLEAR OF DEBRIS AND THE US COAST GUARD

AND US ARMY CORPS OF ENGINEERS WILL BE NOTIFIED TO

REOPEN THE RIVER.

This letter is in response to your Pre-Construction Notification (PCN) received by this office on September 13, 2013 and supplemental information received on November 18, 2013 requesting authorization to discharge fill material into the Cuyahoga River. You have indicated the proposed project is needed in order to replace and repair failed bulkheads along the Cuyahoga River prior to replacing the existing, deficient bridge that canies Interstate Route (IR) 90 over the Cuyahoga River in the City of Cleveland, Cuyahoga County, Ohio.

The United States Army Corps ofEngineers (Corps) authority to regulate waters of the U.S. is based on the definitions and limits of jurisdiction contained in 33 CFR 328 and 33 CFR 329. Section 404 of the Clean Water Act (CWA) requires that a Department of the A1my (DA) permit be obtained prior to discharging dredged or fill material into waters of the U.S., including wetlands. Section 10 of the Rivers and Harbors Act of 1899 requires that aDA pe1mit be obtained for any work in, on, over or under a navigable water.

The Cuyahoga River is regulated by the Corps under Section 10 of the Rivers and Harbors Act of 1899 from the mouth, to the confluence of the Little Cuyahoga River, (River Mile 41.1) in Akron, Ohio. In addition, it has been determined that the same p01tion of the Cuyahoga River is a traditional navigable water (TNW) subject to regulation under Section 404 of the Clean Water Act. ·

In the PCN, you have requested authorization from the DA to discharge both pe1manent and temporary fill material into the Cuyahoga River in order to replace and repair failed bulkheads and to install storm water outfall stmctures. These outfall stmctures would be located within the length of the failed bulkheads and within the reconstructed bulkhead lengths. The proposed fill amounts for the project are detailed in the table below.

Based on the provided information, it has been determined the proposal meets the criteria of Nationwide Permits (NWP) 3 and 7, under the February 21, 2012 Federal Register, Final Notice ofReissuance ofNationwide Permits (77 FR 10184) provided you comply with all tetms and conditions of the enclosed material. The attached special conditions are hereby included as part of this permit and must be met to validate this authorization. The Ohio Environmental Protection Agency issued a Section 401 Water Quality Certification (WQC) with conditions for this NWP on March 30,2012. Copies of the NWP and WQC can be found at http:/ /lrh. usace.army .mil/Missions/Regulatory.

It is your responsibility to ensure that your work confmms to all of the environmental management conditions listed within the enclosed material. Please be aware this NWP authorization does not obviate the requirement to obtain other Federal, state, or local assent required by law for the activities.
