1. The Rio Town Center Code consists of the Regulating Plan and these regulations. The Regulating Plan designates Primary and Regular streets and the location of the following building types: Mixed-Use Type (MU),Waterfront Retail Type (WR), Kiosk Retail Type (KR), Townhouse Type (TH), Multi-family Type (MU), Village Center Type (VC), and Single-family Type (SF). 2. The provisions of the Rio Town Center Code, when in conflict, shall take precedence over the Martin County Zoning Code. 3. The provisions of the Florida Building Code, when in conflict, shall take precedence over the Rio Town Center Town. 4. The streets designated as Primary Streets on the Regulating Plan are those streets held to a higher standard, intended to develop as superior pedestrian experiences. Regular streets have reduced reg- ulations and can accommodate less pedestrian friendly situations such as parking lots. As such, buildings located on Primary Streets as designated by the Regulating Plan are subject to the provi- sions of the code indicated by italics and bold; buildings on Regular Streets are exempt from such requirements. New streets and alleys that are created in this plan shall be public rights-of-way. 5. Building height is regulated by number of stories rather than by feet in order to allow flexible ceiling heights and a varied urban skyline, however, overall building height is limited to forty (40) feet. 6. New Planned Developments are not permitted within the Rio Town Center Master Plan area. 7. Parking. The parking required by the Rio Town Center Code may be adjusted with approval by the NAC as follows: a. The required parking amount may be adjusted based on demonstrated demand for the use, exist ing supply in the district, or impact to the neighboring properties. b. 11. A Parking Trust Fund should be established to allow developers the option to pay into the fund inlieu of providing either all or a portion of the required parking spaces. Moneys deposited into the trustfund account shall be used for the exclusive purpose of paying the cost of construction or reconstruc-tion of public parking spaces in the Rio Town Center. While choosing to pay into the fund does relievethe developer of providing the spaces on site, a reserved space in a municipal lot or structure is not pro-vided.

12. Parcels and platted lots which exist prior to the adoption of the Rio Town Center Code (DATE),which do not conform to the required maximum or minimum lot requirements are grandfathered.However, all new subdivisions, agglomerations, and re-plats of property after the adoption of this codemust be consistent with the Rio Town Center Code.

*NOTEThe development code and regulations contained herein reflect the citizens’ of Rio vision for the RioWaterfront Village redevelopment area. This vision was established through community visioning work-shops and has been reviewed and refined with the assistance of the Rio Neighborhood ActionCommittee (NAC). As a document meant to steer policy changes in the future, the complete and fullimplementation of this development strategy and code will require amendments to the Martin CountyComprehensive Plan. Until such amendments are made, the Comprehensive Plan shall take precedenceover these regulations should any conflicts arise.

All building in the Rio Town Center overlay zoneshall be subject the Architectural Standards.Proposed designs must adhere to a documentedand substantiated Florida vernacular architecture.Departures from the Architectural Standards maybe approved by the NAC based upon architectur-al merit and consistency with the vision of themaster plan.

Walls1. Walls shall combine no more than two materi-

als, and shall change material along a horizon-tal line, with the visually heavier material belowthe lighter.

2. Parking levels and industrial uses not lined by a habitable use shall be screened from view bya well composed facade consistent with the Architectural Standards.

3. Garden walls and fences at the frontage line shall be masonry, brick, stone or wooden pick-ets and shall not exceed 42" in height.Ornamental columns and piers may be 4’-6” inheight.

4. Rear garden walls and fences shall be masonry,brick, stone, or wood and shall not exceed 72"in height. All walls and fences shall be finishedon both sides.

Openings1. The glazed area and other openings of a facade

shall be at least 20% and shall not exceed 45%of the total surface area of such facade, with each facade calculated independently.

2. Retail uses at the sidewalk level shall be detailedand glazed as storefronts. Storefronts shall bedirectly accessible from sidewalks and shall have clear glazed areas between two and eightfeet from the ground for 70% of the buildinglength.

3. Openings such as but not limited to arcades,porches, and windows shall be square or verti-cal in proportion.

4. All glazing shall be more clear than opaque inits transparency. Dark tinted windows are pro-hibited.

5. Windows shall be operable except at store-fronts.

6. Windows shall be recessed a minimum of 2”from the exterior face of the facade.

7. Windows and doors shall be centered in porchand arcade openings.

8. Shutters, if used, shall be sized to match the opening.

9. Sliding glass doors are permitted facing the rearand side yard only.

Roofs1. Sloped roofs shall have symmetrical pitches of

at least 5:12 and not exceeding 8:12, except that porch or stoop roofs may be no less than3:12.

2. Flat roofs shall be enclosed by a parapet a min-imum of 42 inches high or as required to shield mechanical equipment from view. The parapet shall be architecturally articulated overthe primary entrance.

3. Pitched roofs shall be metal standing seam,barrel tile, or three dimensional asphalt shingle.

4. Buildings that utilize barrel tile may be pitchedno more than 5:12.

Elements1. Balconies shall not extend further than 3’-0”

from the facade and shall be visibly supportedby brackets.

2. Arcades and galleries may be permitted for retail and commercial uses. Arcades and gal-leries shall be a minimum of ten (10) feet deepand should extend over the public sidewalk;however, an air-rights easement must be obtained from the County for use of the pub-lic right-of-way. The openings of the arcade shall be vertical in proportion. The ceiling ofthe arcade shall be formed as vaults, coffers orequipped with visible beams and shall providelighting.

3. Masonry piers and arches shall have a mini-mum dimension of 8” in any direction.

Building Placement Buildings shall be placedon their lots as follows:1. On Primary Streets buildings no less than

two stories in height shall be built along a minimum of 70% of the frontage line.

2. Along frontage lines, a setback of five (5) feet maximum is permitted.

3. Side setback requirements are subject to the following regulations:

a. A side setback is required when an abutting property has a building that exists as of the date of this ordinance (DATE) with windows facing the same side property line. Then, the new devel-opment shall set back from the property line the amount necessary to provide a minimum of ten (10) feet of separation between the existing and new structures.Separation is not required between new structures.b. New developments abutting propertieswith no buildings that exist as of the effective date of this ordinance (DATE) may build without side setbacks so long asall necessary light and air shafts are pro-vided within their own property.

4. The rear setback shall be a minimum of twelve(12) feet from the centerline of the alley or five(5) feet, whichever is greater. If no alley existsthen buildings shall set back a minimum oftwenty-four feet (24’-0”).

5. The principal pedestrian entrance shall be accessed directly from a frontage line.

Building Height Building Height shall bemeasured in stories as follows:1. Buildings shall be a maximum of three (3) sto-

ries above grade.2. Stories at the first floor shall be no less than ten

(10) feet in height from finished floor to fin-ished ceiling.

4. Structured parking garage levels at the frontageline shall be counted as stories. Structured parking garage levels that are fully concealed by a habitable story and use for a minimum depth of twenty (20) feet are not restricted in the number of levels, provided that the overallheight of the garage does not exceed the over-all height of the habitable building and does not exceed 40’-0”.

Building Use Buildings shall accommodate thefollowing range of uses:1. The first story at the street frontage shall be

for retail and/or office uses only.2. The second story shall be for office or residen-

tial uses only.3. The third story shall be for residential use only.4. Parking as a primary use is not permitted with-

out NAC approval.

Parking and Loading Standards Parkingspaces, loading and service areas shall be regulat-ed as follows:1. A minimum of two (2) parking spaces for each

1000 square feet of office or retail use and two(2) parking spaces for each residential unit shallbe provided on site.

2. On Primary Streets, parking shall be lined by a permitted use along the frontage line for a minimum depth of twenty (20) feet on all sto-ries.3. On regular streets, surface parking lots are per-

mitted along the frontage line if shielded fromview by shade trees planted thirty (30) feet on-center and a streetfront garden wall or hedge three feet six inches (3’-6”) in height.Ornamental columns and piers may be 4’-6” inheight.

4. On regular streets, parking structures are per-mitted along the frontage line provided the facade is designed to be consistent with the overall building architecture.

5. Surface parking lots, loading and service areasshall be accessed from a rear alley, if such exists.

6. Loading and service areas shall not be permit-ted along the frontage line and shall be locatedin the rear of the lot.

7. On-street parking along the corresponding frontage line shall be counted towards the parking requirement for up to 100% of com-mercial requirement and/or 50% of residentialrequirement.

Signage Buildings may accommodate the fol-lowing signage:1. A single external sign band may be applied to

the facade of the building providing that itshall not exceed 36 inches in height by 60% ofthe storefront or office width. This sign bandmust be located within the first two stories ofthe building. If awnings are applied, the copyor logo on the awning shall be considered as square footage against the allowable sign band.

2. One pedestrian blade sign, extending perpen-dicular from the building facade, is permittedper business. Such signs may be attached to the building facade or hung from overhead awnings. Pedestrian blade signs shall not exceed four (4) feet in width by three (3) feet invertical dimension, including all mounting brackets and hardware, and may not be inter-nally illuminated.

3. Two building identity signs, with the same identity, are permitted for buildings two or more stories in height. Only one building identity sign is permitted per facade. Such signshall not exceed 40 square feet and shall not beinternally illuminated. The sign shall be locat-ed with respect to the building’s architecture orcentered over the primary entrance.

4. Signage in windows shall not exceed 20% ofthe window area.

for residential use only.2. The following accessory uses are permitted in

outbuildings: parking garage, apartment,guest house, studio, workshop, tool house,greenhouse, and/or slat house.

3. Home occupations of limited office uses are permitted provided no other provisions the General Ordinances or Land Development Regulations are violated. Such business may employ up to two (2) employees, not includ-ing members of the immediate family
