Dear member New Year, new chairman, at the December board meeting Andrew Moir, Thornton Farm, Laurencekirk was elected as chairman for both Ringlink Scotland and Ringlink Services with David Pate, Kincreich, Forfar being elected as vice chairman. Andrew who is also currently the chairman of NFU Scotland combinable crops committee and the organizing committee of AgriScot has been a director of Ringlink for the past fourteen years, five of those as vice chairman. Looking forward to his term of office leading our 2,600 member strong organisation, Andrew said he was delighted to be elected and wanted to build on the past successes of the co-operative with a view to attracting more key Supplier/Demander members for the benefit of the overall membership and to see us make further progress in encouraging new entrants into agriculture at all levels from the workforce through to management. A further change to the board saw the election of Andrew Stirling who farms at Upper Dysart Farm, Montrose who replaces Mark Ogg who retired at the AGM in November. The board are to look at co-opting on a replacement for Martin Birse who also retired at the AGM. Case Rebate Scheme The numbers of eligible machines for the 2011 scheme have now been collated, and together with the other Scottish Machinery Rings the paperwork has been processed and sent to Case for payment. With the competitive trade-ins this year the overall amount being paid back to members will be in excess of £100,000 which is tremendous and once again shows the benefits of your Ringlink membership. On receipt of payment from Case, we will raise self- billing invoices and make the individual payments to eligible members. The scheme continues to run in 2012 and members can forward details of any eligible purchases throughout the year. AGENCy WoRKERS REGuLATIoNSNew legislation, The Agency Workers Regulations (2010), came into force on 1 October 2011. The regulations which apply to agency workers who are assigned to do temporary work (for hirers) through temporary work agencies such as Ringlink Services. The Regulations provide that all agency workers must have access to certain facilities, amenities and information from the first day on assignment, with further benefit entitlement after 12 consecutive weeks. Members already using Ringlink Services workers will have received new terms and conditions and we would appreciate that these be returned within 14 days to enable us to maintain our usual level of service.

IS ThERE INCoME To BE MADE FRoM FARM WooDLANDS?As with other c o m m o d i t i e s , t h e price of wood has increased significantly over the past few years, some of this price rise has come from increasing demands for fuel wood. Farm woodland will most often have a mixture of trees, some of which might be good for fuel wood, some for saw logs and there might be some specialist quality hardwood where the right tree can worth a good deal of money – into a few thousand pounds for a single tree.

WooDLAND AppRAISAL

Since announcing the free woodland appraisals in August we have conducted over fifty site surveys incorporating around thirteen hundred hectares of woodland. The reports coming back from our surveyors make for some interesting reading; some woodlands are in excellent condition and will require no work for at least five years, further reports conclude that other woodland areas would benefit from an immediate clear fell with a healthy financial return achieved through the process. Having carried out the surveys we will now complete the necessary administration with the Forestry Commission allowing us to prepare for the practical job of felling and extraction. The surveys have also identified a need to maintain new planting and restocking over the first five years, which, together with the clearance operations, will provide significant opportunities for Ringlink members to carry out the work. DEATh & TAXES - AGRICuLTuRAL pRopERTyIn a letter dated 13 November 1789, Benjamin Franklin wrote to a friend, “In this World nothing can be said to be certain, except death and taxes”. Whilst some 222 years on, the first of these wise words is certainly true, the second need not, at least, when it comes to UK agricultural property. Graham asks me regularly about queries he receives from anonymous members about Inheritance Tax (IHT), hence the article. Graham never, by the way, asks me about death!

‘Agricultural property’, as defined in tax legislation, means “agricultural land or pasture and includes woodland and any building used in connection with the intensive rearing of livestock and fish, if the woodland or building is occupied with agricultural land or pasture and the occupation is ancillary to that of the agricultural land or pasture”. It also includes, “such cottages, farm buildings and farmhouses, together with the land occupied with them, as are of a character appropriate to the property”. All-in-all, a pretty wide definition, encompassing potentially a lot of assets.

If you satisfy the “Agricultural Property” requirements, then Agricultural Property Relief (APR) from Inheritance Tax (IHT) is due on death or transfer during lifetime. The relief extends to sole trades, interests in farming partnerships and shares in farming companies. The relief (APR) is given as a percentage reduction of the value transferred on death or during lifetime. The conditions of APR are that: i) It must have been occupied by the owner for the purposes of agriculture throughout the period of two years ending with the date of death or lifetime transfer, or ii) Owned and let for the period of 7 years ending with the date of death or lifetime transfer for the purposes of agriculture.

In general, 100% APR is due on the “Agricultural Value” (see later) for most interests in sole trades, farming partnerships and farming companies, provided the conditions are satisfied.

If you own the land outside the farming partnership or farming company, provided you meet the conditions, you should still qualify for 100% APR.

Life is never simple, however, because there are always complications. An example:

Farmer A owns 500 acres of farmland just outside Aberdeen, which has been occupied for many years, rent free, by a farming partnership in which he is a partner.

For APR purposes, Farmer A is okay, because he satisfies the conditions –used for agriculture and owned for more than two years. The agricultural value is reckoned to be around £7,000 per acre, however, due to the proximity of the land to Aberdeen it has a value of say £50,000 per acre, of which £43,000 per acre is development value. Because the development value is not agricultural value (that is £7,000 per acre) APR does not apply to the excess. What happens to the excess, from an IHT perspective? Another IHT relief comes into play, Business Property Relief (BPR) on the value above the agricultural value (£43,000).

BPR is sometimes less kind than APR and the rules are that if the land is owned “off balance sheet” (ie in an individual’s own name) and not by the partnership, BPR applies to the development value, but only at 50% (and, in our example, exposing potentially 50% of the development value to IHT). If the same land was owned “on balance sheet” (ie by the partnership) 100% BPR would be available. Where is the sense, therefore, in leaving the land off balance sheet. If it is on balance sheet it is potentially subject to a legal rights claim(s) on death (from, say, non-farming children) or if it is in a Limited Company or LLP to a potential claim by creditors, in the event of a business collapse. This is as broad as it is long, however, the considerations extend well beyond tax and family and commercial considerations may well dominate.

Farmhouses are becoming increasingly placed under the microscope by HMRC for APR purposes, on the grounds the house is too big and not of a character appropriate or too far away from the steadings (there is a separate farm office, so how can you justify the farmhouse is a business asset?). Also, where the farmhouse is valuable the DV (a surveyor employed by HMRC) may challenge the IHT status of the farmhouse, claiming it has a value, based upon an agricultural covenant ie as a farmhouse, but that it also has a value (its desirability factor) way above its agricultural value, for example, where it is close to Aberdeen and would attract a substantial premium, if it were sold on the open market, with the premium subject to IHT. Recent tax cases give plenty of cause for concern.

Also, if you have valuable redundant (ie not used in the farming trade) buildings, the DV will not approve any claim for APR or BPR. Ditto, where you let out steadings for commercial occupation not to your own farming business, no entitlement to APR and BPR is due.

Please keep your own house in order to ensure Benjamin Franklin is only half right.
