    CONSTITUTION

    OF INDIA

    Article 21 A : Right to Educationthestate shall provide free and compulsoryeducation to all children of the age of 6to 14 years in such manner as the state

    may, by law, determine.

    Article 45 : Provisions for earlychildhood care and education to

    children below the age of 6 years.-The state shall endeavour to provide

    early childhood care and education forall the children until they complete the

    age of 6 years.

    PROVISIONS OF THE RTE ACT

    2009

    The act covers all children within the age

    range from 6 to 14 who will be entitled tofree and compulsory education in a

    neighbourhood school.

    The scope of the act is limited to elementary

    education i.e. From class-1 to class-8

    The centre and the state govt. Will have

    the responsibility for providing funds

    necessary to meet the expenses under the

    act and be responsible for the availability

    of a neighbourhood school for admission

    of such children.

    It will be mandatory to all schools

    to admit children belonging toweaker sections and disadvantaged

    groups, to the extent of25 percent

    of the strength of the class in class-1

    No admitted child should be held

    back or expelled until completion

    of the elementary education. The

    act specifically bans any type of

    capital fees or any screening

    procedure for admissions to a school.

    The act also makes it mandatory for

    all schools to follow the guidelines of

    the act to be eligible for continuity of

    operation or for start of a new school.

    The act specifies variousstandards and norms including

    infrastructure, teaching

    standards, students-teacher

    ratio, and formation of school

    management committee amongothers.

    It also talks about improving

    the quality of teachers as wellas developing a national

    curriculum for elementary

    education.
