    5.Product Mix:

    The tentative product mix Residential HIG/MIG; Commercial shopping complex, amenities,

    parks/green spaces, physical/social infrastructure as per applicable norms.

    General Condition of Contract

    6.Detailed Scope of Services

    The selected Architectural/Planning Firm would be required to provide end-to-end service for the

    Project. The detailed scope of services, which inter alia includes but not limited to, are as follows:

    Stage 1: Conceptual Design

    Preparation of design brief in consultation with BDA, ascertain BDAs requirements,examine site constraints/ potential and obtain consent of BDA on the design brief

    Preparation of drawings and documents to enable BDA to get done the detailed

    survey and soil investigation at the site of the project

    Preparation of conceptual design (with multiple option, if required) with reference to

    BDAs requirements as per the defined Project Component and preparation of

    indicative cost estimate at OPWD / market rate

    Stage 2: Preliminary Drawings and Design

    Carry out Modification in the conceptual design considering the design suggestions ofBDA;

    Preparation of Architectural schematic drawing, if required, and details based on the

    approved concept plan;

    Obtaining consent from BDA on the preliminary/ conceptual drawings, sketches, study

    model etc. along with preliminary cost estimate;

    Stage 3: Drawings for Statutory Approval

    Preparation of necessary drawings and layout plan for obtaining statutory approvals

    and assisting BDA for obtaining necessary statutory approvals, clearances from other

    statutory body/ local authority as applicable;

    Carry out required due diligence for ensuring compliance of all codes standards and

    legislation as applicable;

    Stage 4: Working Drawings

    Preparation of required working drawings and details;

    Preparation of specifications, schedule of quantities and detailed cost estimates;

    Assisting BDA in finalizing / approving the various elements, components, materials &

    brand names;

    Estimation of the proposed time limit to complete the project with CPM / PERT charts;

    Stage 5: Contractor Selection

    Preparation of Notice Inviting Tender (NIT) including detailed BOQ and Instruction to

    Bidders;

    Assistance to BDA for issuing Tender Document for selection of the Contractor;

    Assistance to BDA for Bid Clarification in the Pre-Bid Meeting;

    Bid Process Management for selection of Contractor including drafting of the

    Construction Contract and getting this legally vetted and approved by BDA;

    Stage 6: Construction

    Visit the project site once in fortnight, to inspect and evaluate quality and progress of

    the construction works and submit the visit report to BDA within three days from the

    date of visit. The visit should comply to all doubts with the satisfaction of BDA. The

    expenses of such visit shall be borne by the selected firm;

    Provide necessary clarification on any identified discrepancy / ambiguity in drawings /

    specifications etc.;

    Provide interpretation of the drawings / specifications;

    Assist BDA in organizing stakeholder meetings (if required) on any disputes/

    bottlenecks arise during implementation process and suggest BDA the requisite

    remedial measures;

    Submission of periodical progress report for BDA on the project;

    Assisting BDA in identification of defects in the construction work and suitable

    measures for rectification;

    Stage 7: Completion Stage

    Issuance of Project Completion Recommendation to BDA for issuing required

    completion certificate to the Contractor;

    Prepare and issue two sets of as built drawings including services and structures;

    Assisting BDA to identify defects during Defect Liability Period and assist in mitigation

    of those defects with proper methodology;

    Any ancillary services required for successful execution of the project;

    7.Deliverables

    Upon selection of the successful bidder viz. Architectural/Planning Firm, the selected firm would

    be required to submit the following deliverables to BDA from time to time. The lists of

    deliverables which inter alia includes but not limited to are as follows:

    Stage 1: Concept Design

    Inception Report containing design brief and development parameters

    Conceptual Design on the proposed project in the form of Site Layout plan

    and conceptual floor plans

    Report on Requirement Analysis & Indicative cost estimate

    Stage 2: Preliminary Drawings and Design

    Architectural schematic drawing incorporating the changes in the stage 1,

    and details based on the approved concept plan;

    Conceptual sketches, study model and preliminary cost estimate

    Stage 3: Statutory Approval

    All necessary designs/ drawings for obtaining required approvals

    Provide necessary clarifications as compliance requirement for obtaining

    necessary approvals

    All necessary action for obtaining Environmental Clearance, AAI clearance as

    required

    Stage 4: Detailed Design Stage

    Detailed Design Report

    Working Drawings Detailed Schedule of Quantity

    Detailed Schedule of Specifications

    Implementation Schedule

    Stage 5: Contractor Selection

    8.Project Milestones

    The selected Architectural/Planning Firm would be required to achieve the following project

    milestones in time bound manner from the date of issuance of the Letter of Award and signing of

    the agreement. Apart from any exigency from the office of the BDA, the scheduled time would

    not be extendable at any point.

    11. Performance Security

    For signing of the Contract Agreement, the selected Architectural/Planning Firm would be

    required to submit a Performance Security in the form of Bank Guarantee in favor of BDA for an

    amount of Rs.5,00,000/-(Rupees five lakhs only). The Performance Security would be valid till

    completion of the project. The Performance Security would be released upon completion of the

    defect liability period of the project.

    12. Site Visit & Verification of Information

    All the prospective bidders are encouraged to submit their proposal after visiting the Project site

    and ascertaining for themselves the site conditions, location, surroundings, climate, access to the

    site, applicable laws and regulations or any other matter considered relevant by them.

    13. Signing of Agreement

    The selected Architectural/Planning will have to sign a Contract Agreement in non-judicial stamp

    paper of adequate denomination with BDA within 15 days from Issuance of Letter of Award.

    14. Default of service

    Deviation and/ or Refusal and/ or non Performance towards any of the obligations described in

    the Scope of Services would be treated as default of service of the selected Architectural/Planning

    firm. Upon default of service, BDA would reserve the right to forfeit the Performance Security and

    the payment outstanding for the said job. In addition, BDA would also have the right to terminate

    the agreement with the selected firm.

    SUBMISSION FORMALITIES & BID EVALUATION METHODOLOGY

    Submission Formalities

    15. Format and Signing of Proposal

    The proposal shall be submitted in two parts

    Part A - Technical Proposal Part B - Financial Proposal

    The proposal shall be typed or written in indelible ink and shall be signed by the applicant or a

    person or persons duly authorized. Any interlineations, erasures or overwriting shall be valid only

    if they are initialed by the person or persons signing the proposal prior to opening of the same.

    16. Submission of Proposal - Packing, Sealing and Marking

    The Technical Proposal (Part A) and Financial Proposal (Part B) must be inserted in separate

    sealed envelopes, along with applicants name and address in the left hand corner of theenvelope and superscribed in the following manner.

    Part-A - Technical Proposal as per the Format attached in the Annexures-I,II,III,IV) of

    this RFP

    Part-BProperly sealed Financial Proposal in the specified format as per Annexure V

    Both the envelopes i.e. envelope for Part-A and Envelope for Part-B must be packed in a separate

    sealed outer cover and clearly super scribed with the following:

    The Applicants Name & address shall be mentioned in the left hand corner of the outer envelope.

    The inner and outer envelopes shall be addressed to BDA, Bhubaneswar at the following address:

    If the outer envelope and the financial proposal envelope is not sealed and marked as mentioned

    above, then BDA will assume no responsibility for the tenders misplacement or premature

    opening. Telex, cable or facsimile tenders will be rejected.

    The opening of the Financial Proposal shall be made after evaluation of technical proposal and as

    per the scheduled dates which shall be intimated by BDA to the eligible applicants. In case of any

    discrepancy between figures and words in the financial proposal, the one described in words shall

    be adopted.

    17. Eligibility Criteria:

    For participating in this RFP process, the Bidder would be required to comply with the following:

    Criteria:

    The bidder shall be:

    1. A Company / Partnership firm registered under relevant Acts.

    2. Consortium of firms having maximum 2 (two) members of which the

    lead member shall fulfill the technical criteria mentioned in the RFP.

    Technical Criteria:

    The applicant must have undertaken (completed) at least three *similar kind of

    projects during the last five years.

    *Similar kind of project means residential/commercial building of minimum

    5,00,000 sqft built-up area in a single project in the last five years.

    Turnover Criteria:

    The applicant must have an average annual Turnover of INR 5 (five) Croresfor the

    last 3 (three) financial years i.e., 2011-12, 2012-13, 2013-14. In case of consortium,

    the aggregate turnover as on 31st

    Mar 2014 should meet the mentioned turnover

    criteria.

    18. Number of Proposals

    A registered Architectural/Planning Firm is eligible to submit only one proposal for this project.

    19. Tender Document Fee

    Non-refundable Tender Document (downloaded from www.bdabbsr.in /www.orissa.gov.in)cost

    in shape of Demand Draft/Pay order from any scheduled commercial bank in favour of

    Bhubaneswar Development Authority, Bhubaneswar payable at Bhubaneswar for Rs.10,500/-

    (Rupees Ten thousand five hundred only) is to be furnished by the bidder along with the technical

    Bid. Bid without the requisite tender Document cost shall be treated as non-responsive and

    rejected. The mentioned Tender cost is inclusive of the VAT of 5%.

    20. Earnest Money Deposit (EMD)

    EMD in shape of Demand Draft / Pay order from any scheduled commercial bank in favour of

    Bhubaneswar Development Authority, Bhubaneswar payable at Bhubaneswar for Rs.50,000/-

    (Rupees fifty thousand only) is to be furnished by the bidder along with the Technical Bid. Bid

    without the requisite EMD shall be treated as non-responsive and rejected. No exemption from

    submission of EMD is allowed. No adjustment of EMD with respect to other works previously lying

    in BDA, Bhubaneswar is allowed. Unsuccessful bidders EMD will be discharged / returned within

    30 days from the date of execution of the agreement between BDA and the selected firm. No

    interest will be paid on EMD. The EMD may be forfeited:

    (a) if a Bidder withdraws its Bid during the period of validity of the Bid

    (b) in case of a successful bidder, if the bidder fails to execute the work assigned

    21. Validity of Bid

    Proposal shall remain valid for 180 days after the date of Proposal opening. A Proposal valid for a

    shorter period shall be rejected as non-responsive.

    22. Disputes

    All legal disputes are subject to the jurisdiction of Bhubaneswar court only.

    23. Addendum / Corrigendum / Notice

    Any Addendum / Corrigendum / Notice etc. for this assignment issued by Bhubaneswar

    Development Authority will be hosted only on the websitehttp://bdabbsr.in/ www.orissa.gov.in

    24. Acknowledgement by Bidder

    It shall be deemed that by submitting the Proposal, the firm has:

    a. made a complete and careful examination of the RFP, general condition of contract,

    submission formalities and evaluation mechanism;

    b. received all relevant information requested from BDA;

    c. acknowledged and accepted the risk of inadequacy, error or mistake in the

    information provided in this invitation document or furnished by or on behalf of

    BDA;d. satisfied itself about all matters, things and information necessary and required for

    submitting the proposal and performance of all of its obligations there under;

    e. acknowledged that it does not have a conflict of interest with any other

    Architectural Firm; and

    f. agreed to be bound by the undertaking provided by it under and in terms hereof.

    BDA shall not be liable for any omission, mistake or error on the part of the firm in respect of any

    of the above or on account of any matter or thing arising out of or concerning or relating to this

    invitation document or the selection process, including any error or mistake therein or in any

    information or data given by the BDA.

    25. Right to reject any or all Proposals

    Notwithstanding anything contained in this invitation document, the BDA reserves the right to

    accept or reject any Proposal and to annul this selection Process and reject all proposals, at any

    time without any liability or any obligation for such acceptance rejection or annulment, and

    without assigning any reasons thereof.

    BDA, also, reserves the right to reject any Proposal if:

    a. at any time, a material misrepresentation is made or uncovered, or

    b.

    the firm does not submit sufficient information as being asked for

    26. Pre-bid Meeting

    Bidders requiring any clarification on the selection process may send their queries to BDA in

    writing before 7 days prior to the Pre-bid Meeting. The envelopes containing the queries shall

    clearly bear the following identification:

    Date and Time for Pre-bid Meeting

    The pre-bid Meeting will be held in the Conference Hall of BDA at the below mentioned time and

    date;

    Date: 29/05/2014. Time: 11.00 A.M

    BDA shall endeavor to respond to the queries within the period specified therein but not later

    than 7 days prior to the Proposal Due Date. The responses will be sent by fax or e-mail. However,

    BDA reserves the right not to respond to any questions or provide any clarifications, in its sole

    discretion, and nothing in this clause shall be taken or read as compelling or requiring the BDA to

    respond to any question or to provide any clarification.

    27. Amendment / Modification

    At any time prior to the deadline for submission of Proposal, the BDA may, for any reason,

    whether at its own initiative or in response to clarifications requested by an Applicant, modify any

    of the terms mentioned in this invitation document by the issuance of Addendum/ Amendment.

    All such amendments/ addendum will be circulated to the bidders and will be binding on all. In

    order to abide by the issuance of the amendment or allow the bidder for giving a reasonable time

    for considering an amendment into their proposal, or for any other reason, the BDA may, in its

    sole discretion, extend the Proposal Due Date.

    28. Penalty

    In the event of delay in stage wise execution of work, specified in this Contract / furnishing

    deliverables due to negligence or in-efficiency attributable to the selected bidder, the selected

    bidder shall be liable to a penalty @ 0.1% of the value of work order in respective phases, for

    every week of delay up to a maximum of 10% (five) of the contract value after which BDA shall be

    at liberty to cancel the award. For the purpose of this clause, part of a week shall be considered to

    be a full week inclusive of Govt./Local holidays.

    29. Language

    The Proposal and all communications in relation to or concerning the Selection Process shall be in

    English language and strictly on the formats provided in this invitation document.

    30. Bid Submission Due Date

    Duly sealed proposal from the bidder filled in all respect must reach BDA at the address, time and

    date specified in the invitation letter through Speed / Regd. Post or courier. If the specified date

    for the submission of proposal is declared as a holiday for BDA, Bhubaneswar, the proposal will be

    received up to the appointed time on the next working day.

    31. Late Submission

    Proposal received after the deadline for submission prescribed by BDA will not be entertained andbe rejected.

    32. Modifications and Withdrawal of Proposals

    No modifications to the Proposals shall be allowed once it is received by BDA, Bhubaneswar.

    33. Bid Opening Date

    BDA will open all technical bids, in the presence of authorized representatives who choose to

    attend, at the date and time mentioned and in the following location:

    The representatives of bidders who are present shall sign a register evidencing their attendance.

    In the event of the specified date being declared a holiday for BDA, the proposal shall be opened

    at the appointed time and location on the next working day.

    Bid Evaluation Methodology: Evaluation of the proposals for Residential cum Commercial

    Complex over 8.39 acres (approx.) of land in Subudhipur; Bhubaneswar, Odishawill be based

    on Least Cost (L1) Basis.

    34. Evaluation of Technical Bid

    The total maximum score for evaluation of technical proposal is 100 marks. This score shall be

    based on an assessment of the technical proposal which shall be assessed through rating of

    various parameters set out in the table below:

    39. Proprietary data

    All documents and other information provided by BDA or submitted by the bidder to BDA shall

    remain or become the property of BDA. The bidders are to treat all information as strictly

    confidential. The BDA will not return any Proposal or any information related thereto. All

    information collected, analyzed, processed or in whatever manner provided by the Consultant to

    BDA in relation to the Consultancy shall be the property of BDA.

    40. Local Office

    The selected Architectural/Planning Firm shall set up a local office in Bhubaneswar before

    executing the contract agreement with BDA
