IMPORTANT INSTRUCTIONS FOR CANDIDATES (For MD/MS/MDS/PG Diploma courses of Uttarakhand State Quota Only)

(For Academic Session 2013-2014)

Introduction: - As per MCI Notifications No. MCI.18 (1)/2010-Med./49070

Dated 21.12.2010 (published in the Gazette of India dated 27.12.2010) &

Notifications No. MCI.18 (1)/2010-Med./62052 Dated 15.02.2012(published in

the Gazette of India dated 27.02.2012) and as per the DCI Notification No. DE-

22-2012 Dated 31.05.2012(published in the Gazette of India dated 01.06.2012)

It has been provided that:

There shall be a single eligibility cum entrance examination namely

‘National Eligibility-cum-Entrance Test for admission to Postgraduate

Medical Courses’ in each academic year.

The reservation of seats in medical colleges/institutions for respective

categories shall be as per applicable laws prevailing in State/Union

Territories. An all India Merit list as well as State-wise merit list of

the eligible candidates shall be prepared on the basis of marks

obtained in National Eligibility-cum-Entrance Examination Test and

candidates shall be admitted to post Graduate courses from the said

merit lists only.

In compliance with the Hon’able Supreme Court decision in writ

petition No. 379(c)/2013, Dr. Nikhil Himthani Vs. State of Uttarakhand

& Ors. and decision of the Hon’able High Court of Uttarakhand in

Special writ petition No. 202/2013,Dr. Vijay Swaroop Gautam, seats

allotted on dated 19.06.2013 and the admissions made thereafter has

been cancelled hence, fresh admission process will be conducted after

Re-registration & Re-counseling as per the Government Order No:-

1890/XXVIII(1)/2013-38/2013-TC & Government Order No:-

1891/XXVIII(1)/2013-38/2013-TC dated 16.08.2013,as per revised

schedule for which following guidelines are laid down:

A- Eligibility Criteria:-

The counseling for admission shall be open to such candidates who:

1. Have passed the M.B.B.S/B.D.S Examination from a Medical/Dental

College, recognized by the MCI/DCI, of Uttarakhand state and having

their name in the State Merit List provided by the NBE/AIIMS.

2. Have completed Compulsory Rotatory Internship training on or before

31.03.2013.

3. The eligible candidates who are selected through NEET-PG 2013/NEET

(MDS)-2013 will be given admission on available seats in post graduate

courses by the Counseling Board according to their rank in State merit

list, made available by NBE/AIIMS and the seat available at that time.

4. Having name in the state merit list of eligible candidates provided by

NBE/AIIMS will not be the right of the candidate for getting PG seats

unless he/she fulfill all the eligibility criteria regarding state reservation

policy, provisions of bond etc. mentioned in the information bulletin

and/or amendments made thereafter till the time of counseling.

B- Reservation Policy: -

(1) Reservation policy will be applicable on sanctioned seats for state quota

only, as per prevailing rules of Govt. of Uttarakhand, applicable at the

time of counseling.

(2) If seats of SC,ST and OBC category remain vacant due to non

availability of eligible candidates of their respective categories , than

these vacant seats will be filled as follows:

a. In case of non availability of eligible OBC category candidates the vacant

seats of the OBC category will be filled by eligible candidates from

general category.

b. In case of non availability of eligible candidates of ST category the

vacant seats will be filled by eligible candidates from scheduled caste

category and in case of non availability of eligible candidates of SC

category the vacant seats will be filled by eligible candidates from

scheduled Tribes category. If eligible candidates of SC and ST category

are not available than these vacant seats will be filled by eligible

candidates from general category.

(3) Regarding reservation, Government Orders issued time to time, by the

Government of Uttarakhand, will be applicable for reservation and the

certificate issued by the competent authority of Uttarakhand Government

will only be valid. The OBC certificate should be valid upto 31.08.2013

or at the time of admission in the concerned college/Institutes.

(4) 10% seats of MD/MS/MDS courses in Government Medical/Dental

colleges will be reserved for PMHS, Uttarakhand (Provincial Medical

and Health Services, Uttarakhand) doctors in clinical subjects only and

these PMHS (Provincial Medical and Health Services) candidates should

be qualified in NEET-PG 2013/NEET (MDS)-2013. Weightage in the

marks shall be given as an incentive at the rate of 10% of the marks

obtained for each complete year of service in remote and/or difficult

areas upto the maximum of 30% of the marks obtained in National

Eligibility-cum-Entrance Test PG -2013/ NEET (MDS)-2013, the remote

and difficult areas as defined by Uttarakhand State Government. Service

duration certificate in remote and/or difficult areas issued by the Director

General, Medical, Health & family welfare, Uttarakhand is required for

this.

(a) All those candidates serving in PMHS, Uttarakhand , having qualified

NEET PG/NEET MDS-2013 and have their name in All India/State merit

list provided by the examination conducting agencies are eligible for 10%

reserved seat for PMHS, Uttarakhand Doctors.

(b) “No Objection Certificate” along with Service duration certificate in

remote and/or difficult areas of Uttarakhand state from the Director

General, Medical, Health & family welfare, Uttarakhand is required for

PMHS Uttarakhand doctors opting for the above mentioned PG state

quota seats.

(c) A Separate merit list of PMHS, Uttarakhand doctors will be prepared by

the counseling board for the above mentioned 10% reserved seats for

PMHS, Uttarakhand Doctors only.

(d) The matter of selected PMHS, Uttarakhand Doctors for the above

category related with Leave, Pay/stipend and execution of bond will be as

per the prevailing policy of Uttarakhand State.

(5) 50% of seats in Post Graduate Diploma Courses shall be reserved for

Medical Officers in the PMHS Uttarakhand Government services, who

have served for at least three years in remote and/or difficult areas of

Uttarakhand.

After acquiring the PG Diploma, the Medical Officers shall serve for two

more year in remote and/or difficult areas as defined by State

Government.

(a) All those candidates serving in PMHS, Uttarakhand , having qualified

NEET PG/NEET MDS-2013 and have their name in All India/State merit

list provided by the examination conducting agencies are eligible for 50%

Post graduate Diploma Courses reserved seat for PMHS, Uttarakhand

Doctors.

(b) “No Objection Certificate” from the Director General, Medical, Health &

family welfare, Uttarakhand is required for PMHS Uttarakhand doctors

opting for the above mentioned 50% PG Diploma state quota seats,

showing that the candidate served in remote or difficult areas of

Uttarakhand state for atleast three years.

(c) The matter of selected PMHS, Uttarakhand Doctors for the above

category related with Leave, Pay/stipend and execution of bond will be as

per the prevailing policy of Uttarakhand State.

(6) 3%seats of the annual sanctioned state quota shall be filled up according

to the state merit list of the eligible candidates under physically

handicapped category. The candidates with locomotory disability of

lower limbs between 50% to 70% will be considered. Provided that in

case any seat in this 3% quota remains unfilled on account of

unavailability of candidates with locomotory disability of lower limbs

between 50% to 70% then any such unfilled seat in this 3% quota shall be

filled up by persons with locomotory disability of lower limbs between

40% to 50% - before they are included in the annual sanctioned seats for

General Category candidates.

(a) The Locomotory disabilities candidates are advised to obtain prescribed

certificate before the date of counselling .For this:

Locomotory disability certificate issued by one of the Medical board

constituted by the conducting body of NEET PG-2013/NEET (MDS)-

2013) for this purpose.

Or

Locomotory disability certificate issued by the Medical board,

constituted by the Director General, Medical, Health & family

welfare, Uttarakhand for this purpose. They will have to submit an

affidavit on Rs. 10/- stamp paper duly notarized mentioning the

declaration that they have not previously appeared in the above

Medical Board constituted by the conducting body of NEET PG-

2013/NEET (MDS)-2013) or any other medical board constituted for

the said purpose. Medical Board constituted for this purpose by the

DG Medical, Health & Family Welfare, Uttarakhand is scheduled

on 20.08.2013 at Office of The Chief Medical Officer, Dehradun,

Chander Nagar Dehradun from 10.00 am onwards. The candidate

who have got Locomotory disability certificate by the board

constituted for this purpose by the Director General, Medical, Health

& Family Welfare, Uttarakhand on 13.06.2013 will also be valid.

Locomotory disability certificate issued by any other authority/board

Other than above mentioned Medical boards shall not be entertained.

(C) Detail of Seats: Seats may be allocated in the following Colleges:

i) Government Medical College, Haldwani.

ii) Himalayan Institute of Medical Sciences, Jolly Grant,Dehradun.

iii) Shri Guru Ram Rai, Medical College, Patel Nagar, Dehradun.

iv) Seema Dental College, Rishikesh.

Note: Availability of Seats is subject to letters of Permission of Govt. of

India/Medical Council of India/Dental Council of India. Hence

number of seats, subjects and detailed roaster will be displayed at the

time of counseling.

(D) Provision of Bond:-

In spite of the best efforts of the state government the medical services

are not improving due to difficult topography and undulated terrain of

the state. Most of the Medical Officers have resigned from these

remote hilly areas that were selected for these particular areas and rest

of them did not join the Government Hospital. At present most of

these posts are vacant in remote hilly areas. The State Government is

bound by Constitution to provide high quality medical facilities to

mitigate infant mortality rate and maternal mortality rate. The State

Government is trying to strengthen the Medical Facilities in these

areas.

In this context the selected candidates desirous to avail the reduced fees structure have the option to execute a bond at the time of

admission for compulsory service in remote hilly areas of Uttarakhand state, as per the Government Order No. 1145/XXVIII (1)/2013-U.O.-03/2008 dated 23.05.2013, details of the terms and conditions are detailed in (Appendix…B.)

(E) Counseling: - In any urgent circumstances counseling board may

send email/phone/fax on the IDs/numbers provided by the candidate

in the CRF. Hence candidates are advised to regularly check their

email/fax/phone and keep them on.

1. Registration for Counseling:-

The candidate will have to deposit a bank draft, issued by a

Nationalized Bank, worth Rs.1500/-(rupees One thousand five

hundred only) in favour of “Director General, Medical, Health &

Family welfare, Uttarakhand” Payable at Dehradun as registration

fee at the time of registration for counseling. The registration fees

once deposited will not be refunded. Hence, candidates are advised to

go through the information bulletin thoroughly before appearing in

counseling and fill the Counseling Registration Form (CRF) carefully.

Candidates should know that the personal information provided by

them is genuine, authentic & nothing is concealed. The candidate

who have already registered themselves for counseling on

18.06.2013 and have deposited bank draft worth Rs. 1500/- in

favour of “Director General, Medical, Health & Family Welfare,

Uttarakhand” payable at Dehradun, need not to deposit fee for

registration on 22.08.2013.These pre-registered candidates have to

report on 22.08.2013 for counseling.

2. Candidates are advised to make sure that they have signed the

attendance sheet at the registration counter.

3. Registration for fresh candidates & reporting for Pre-registered

candidates for MS/MD/MDS/PG diploma courses for the

academic session 2013-2014 will be done only once i.e. on

22.08.2013, and only those candidates who have registered/reported

themselves on that day will be considered for the present counseling

and further seat allotment process through waiting list. Hence,

candidates are advised to register/report themselves on that day to get

considered for MS/MD/MDS/PG diploma courses for the academic

session 2013-2014.If candidate wants to participate in the seat

allotment process through waiting list than he/she must report in the

counseling venue on the scheduled date and time. If he/she fails to

report within time his/her candidature for that particular seat allotment

process through waiting list will not be considered by the Board.

4. The seat once allotted by the counseling board cannot be altered under

any circumstances in the particular counseling session.

5. The candidate who has been issued allotment letter in the counseling

on 23.08.2013, held for academic session 2013-2014, wants to

participate in the successive seat allotment process through waiting

list, held for academic session 2013-2014, he/she will be eligible for

the seat allotment process through waiting list only on providing

Admission Letter issued by the Principal/Dean of the concerned

Medical/Dental college/institute.

6. If a candidate is absent when his/her name is called for counseling and

comes at a later time, he/she shall only be considered for a seat from

among the seats available at the time of his/her appearance in the

counseling. Hence candidates are advised to be present at the

counseling venue.

7. The candidate has to appear in person for counselling but in case a

candidate is unable to appear for counselling in person, he/she can

send his/her representative with an authority letter on the prescribed

format (Appendix…A..) as given in the information bulletin. It will

be necessary for the authorized person to fulfil all requirements as

detailed in the Information bulletin. One person can represent only

one candidate. Acceptance of the authority letter and the grounds

produce for non appearing of the candidate will be at the sole

discretion of the counselling board.

8. All admissions shall be provisional in the first instance and the

Counseling Board/Uttarakhand Government reserves the right to

cancel the admission granted to a candidate without assigning any

reason.

9. Candidates willing to opt for a course will have to deposit a bank draft

of Rs.2000/-(rupees Two thousand only) in favour of “Director

General, Medical, Health & Family welfare, Uttarakhand” payable at

Dehradun as security money at the time of counseling and the same

will be refunded to the candidate after course completion .The

security money will be forfeited in case a candidate do not join or

leave the course after allotment /admission. The candidate who got

seat allotment in the counselling held on 19 June, 2013and have

deposited Bank draft worth Rs. 2000/- need not deposit security

money.

(F) Essential Documents for Counselling:-

Candidates are required to bring the following valid original

documents along with one set of attested copies (attested by the

principal of the concerned college or gazetted officer) at the time of

Counseling without which his/her candidature will not be considered:-

i) High School certificate as proof of date of birth.

ii) High School Marksheet.

iii) Intermediate Marksheet/Certificate.

iv) Mark sheets of all professional Examinations.

v) M.B.B.S. passing out certificate or degree.

vi) Compulsory Rotatory Internship Training completion

certificate.

vii) Provisional/Permanent Registration Certificate of

MCI/DCI/State Medical Council/ State Dental Council.

viii) Two passport size photographs as pasted in the NEET PG-

2013NEET (MDS)-2013 application form.

ix) One Photo ID proof (Driving license/PAN card/ passport/

Voters’ ID card/Aadhar card/MCI/State Medical Council

registration certificate).

x) Employer’s “No Objection Certificate”, if employed.

xi) “No Objection Certificate” along with Service duration

certificate in remote and/or difficult areas of Uttarakhand state

from the Director General, Medical, Health & family welfare,

Uttarakhand is required for PMHS Uttarakhand doctors opting

for the 10% MD/MS/MDS & 50% PG diploma state quota

seats.

xii) In case of PMHS Uttarakhand doctors, relieving certificate

from the appropriate authority is must for joining the concerned

college.

xiii) Domicile /S.C. /S.T/O.B.C. Certificate (The OBC certificate

should be valid upto 31.08.2013 or at the time of admission in

the concerned college.), if applicable.

xiv) Sub category certificate, if applicable.

xv) Admit Card of NEET-PG 2013/NEET (MDS)-2013.

xvi) NEET PG 2013/NEET (MDS)-2013 Score card (showing State

rank,Percentile,marks obtained,category).

xvii) Candidates who are applying for “physically handicapped

category” are required to submit certificate issued to him/her

for this purpose by the authorized medical board as mentioned

under the title Reservation Policy in the information bulletin.

G-ADMISSION:

i) Admission of the candidates to various MS/MD/MDS/PG

Diploma courses will be given by the Principal/Dean of the

respective Medical/Dental college/Institute.

ii) A candidate who has been allotted a PG Degree/Diploma

course in a particular Medical/Dental college shall have to

complete all the admission formalities and join the course

within the specified date. In case fail to join the allotted college

with in specified date his/her claim for PG seat will summarily

be cancelled.

iii) Thumb impression, Signature and photograph will be taken by

college concern at the time of admission.

iv) The process of change of college/subject will be allowed till

first round of seat allotment process through waiting list i.e.

27.08.2013.

v) The seats left vacant in private Medical/Dental colleges will be

filled by the private college on its own in case seats remain

vacant after first round of seat allotment process through

waiting list i.e. 29.08.2013.

(H) Refund of admission fees:

A candidate, if wants to quit the college allotted to him in the

counselling held on 23.08.2013 has to inform the counselling

Board through the Principal concerned, by 26.08.2013, that

he/she has vacated the seat allotted to him/her in the

counselling & than only he/she will be entitled to get refund

of the fees deposited by him/her after deduction of 10%

amount (administrative charges). In addition, charges for the

services availed (e.g. Hostel, mess etc.) by the candidate will

also be deducted from the fees deposited, on actual

consumption/ rational basis, by the college administration.

A candidate if vacates the seat allotted to him in the counselling

held on 23.08.2013 and joins the college allotted to him in the

state of Uttarakhand through waiting list and joins the college

,the fee deposited will be refunded to him after deduction of

10% amount (administrative charges). In addition charges for

the services availed (e.g. Hostel, mess etc.) by the candidate

will also be deducted from the fees deposited, on actual

consumption/ rational basis, by the college administration.

A candidate if vacates the seat allotted to him in the counselling

held on 23.08.2013, and did not join the college allotted to him

through waiting list, the fees deposited by the candidate will be

forfeited.

A candidate after joining the college allotted to him by the

Counselling Board changes the department/speciality allotted to

him through counselling/waiting list in the same college, no

deductions will be done from the fees deposited by him.

(I)- Any dispute concerning NEET PG 2013 counseling would be

subject to exclusive Jurisdiction of the competent courts within

the territorial jurisdiction of Uttarakhand only.

(J) Help Desk-

Candidates must clear all doubts and queries from competent

authorities present at help desk during counseling.

Any updates/amendments made thereafter will be uploaded in the

Hence candidates are advised in their own interest to check the

above websites regularly regarding counseling. No separate

information will be sent to candidates in this regard.

=Disclaimer=

Instances of provision of incorrect information detected at any stage

of the selection process will automatically disqualify the candidate from

the selection process and he/she will not be allowed to appear for NEET in

future. If such instances go undetected during the current selection process

but are detected in subsequent years, such disqualification will take place

with retrospective effect and the Principal/Dean of the concerned

college/institute shall have the authority to cancel admission of the

candidate and to proceed legal action against him/her as all the

information/documents furnished by the candidate will be scrutinized

/verified by competent authorities.

The statement made in information bulletin and all information

contained herein are believed to be correct at the time of publication

/uploading in the website.However, the Uttarakhand Government reserve the

right to make any change without notice, changes and additions to the

regulations, conditions governing the admission procedure, conduct of

students, requirements for degree, fees and any other information, or

statements contained in this information bulletin at any time. Uttarakhand

Counseling Registration Form (CRF) (To be submitted at the time of registration for counseling)

WHEREAS, in such circumstances, the Government has decided that all the PG students enrolling in Government Medical Colleges, Uttarakhand against the State Quota and also the students of Central quota shall have an option to complete the MD/MS course on payment of subsidized tuition fees of Rupees 60,000 (Sixty Thousand) per annum as against the full tuition fees of Rupees 5,00,000 (Five Lakh) per annum.

WHEREAS, the present PG medical student of this bond has opted for the subsidized fees and in consideration there of agrees to serve the State as a Medical Officer/Specialist Doctor on contract basis for minimum of two years in any of the Government Hospital/Health Centre situated in hilly region of the State after completion of the MD/MS Course.

AND WHEREAS, the Medical Student and his/her first and second sureties have agreed to pay the Government jointly and severally the Bond Amount (Full fees of the MD/MS Course minus the fees already paid with compound interest thereon at prevailing Bank lending rate), if the PG Medical Student does not or refuses to serve the State as above,

NOW, THEREFORE, the conditions of the present Bond/Service Contract executed by the PG Medical Student, his/her First Surety and Second Surety on one part and by ………………Principal of the ……………………………..on behalf of the Government of Uttarakhand on another are as follow-

1. That as part of the present bond, the Government will charge subsidized tuition fees of Rs. 60,000/- (Rs. Sixty Thousand) per year from the students executing the bond under this scheme. This is a subsidized tuition fees as compared to full annual tuition fees of Rs. 5,00,000 (Five Lakh) per annum.

2. (1) That the PG medical student will undergo all such courses and training as the Government may prescribe from time to time at Government Medical Colleges, Uttarakhand and associated Institutions. Attendance at all prescribed course and training course is compulsory and absence from which without prior permission from the Appropriate Authority will attract disciplinary and other action as per rules laid down by the Uttarakhand Government.

2. (2) That the PG medical student during his/her study at the Government Medical Colleges of Uttarakhand shall be governed by the prescribed standing orders, code of conduct and any other instructions in this regard and violation of these orders/instructions shall attract penalties awarded by the Government of Uttarakhand/Competent Authority and other action as per rules laid down by the Government/Competent Authority whose decision shall be final.

2. (3) That the PG medical student after successful completion of MD/MS Degree Course/Training unless he/she is prevented from doing so by death or on account of ill health or by being removed from the college roll on the grounds that he/she is considered by the Appropriate Authority to be unfit to continue as a PG medical student (of which the decision of Government of Uttarakhand/Appropriate Authority shall be final), if offered position as a medical officer/Specialist on contractual basis in any of the

Government Hospital/Health Centre in hilly areas of Uttarakhand, shall serve as such for a minimum of two years.

2. (4) That the medical student who have already got subsidized medical education in his/her MBBS course by the Uttarakhand State Government and got selected in MD/MS courses of Government Colleges of Uttarakhand and opt again for subsidized medical education for his/her post graduation education shall also be bound to serve the state of Uttarakhand as medical officers/Specialist on contract basis atleast for a period of two years in addition to the number of years laid down for compulsory service in his/her MBBS bond in any of the Government Hospital or Health centre situated in hilly region of the state failing which he/she shall be liable severally or jointly to pay the Government the total bond amount for both the bonds (executed by him/her) along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand. 2. (5) That the sureties shall be liable severally and jointly to fulfill the conditions of this bond provided the student is declared a Non-Service Liability under Para 5 and 6 herein below. This bond shall subsist throughout the period until the PG student serve the State as a medical officer/ Specialist on contractual basis in the any of the Government Hospital/Health Centre in hilly areas of Uttarakhand for a minimum of two years after completion of MD/MS course, as the case may be, and shall only be discharged from service liability under the Bond when the State Government/ Appropriate Authority (Directorate, Medical, Health & Family Welfare/Medical Education, Uttarakhand) has issued a certificate to this effect. 2. (6) That if PG medical student does not or refuses to serve the State as a medical officer/Specialist on contractual basis in any of the Government Hospital/Health Centre in hilly areas of Uttarakhand for a minimum of two years after completion of MD/MS course, as the case may be, under the present service bond, the Bond Amount shall be paid by the sureties severally and jointly to the Government along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand. 2. (7) That both the sureties agree that the Bond Amount or any other amount which they under the present bond are liable to pay the Government severally or jointly, shall be recoverable from them as arrears of land revenue under the Uttar Pradesh Public Moneys (Recovery of Dues) Act, 1972 (as applicable in the State of Uttarakhand) or any other law relating to recovery of money as arrears of land revenue. 2. (8) That the PG medical student and his/her father/mother/legal guardian as first

surety agree that the original degree of MD/MS course awarded to the student would be kept in the safe custody of the Principal, ……………………………Medical college till the conditions of this bond are fulfilled by the student and his/her sureties and the State Government/Appropriate Authority (Directorate, Medical, Health & Family Welfare Medical Education, Uttarakhand) has issued a certificate to that effect under the sub-para (5) above.

3. That the PG medical student once having joined the college will not be permitted to withdraw from the college after admission without payment or recovery as the case may be, of the Bond Amount calculated at the rate of Rs. 5, 00,000/-(Rupees Five Lakh) per year or part thereof limited to the maximum of Rs 15 lakh along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand, minus the subsidized fees already paid. It is agreed that the PG medical student shall be withdrawn/removed from the roll of the Government Medical Colleges, Uttarakhand by the Appropriate Authority on any of the following grounds:-

(i) Unsatisfactory/disciplinary conduct during the course or training at the College and till the date of the course completion as determined by the college authorities and approved by the Director General, Medical Health & Family Welfare/Director, Medical Education, Uttarakhand whose decision shall be final and binding on the student (ii) Unsatisfactory academic progress as reported by the college authorities and approved by the Government of Uttarakhand whose decision shall be final and binding on the student.

(iii) Knowingly furnishing false particulars for admission to the said college.

(iv) Failing to give correct medical history as required at the time of pre-admission Medical Board. (v) Any other condition which may be imposed by Government /Appropriate Authority from time to time.

4. That it is agreed that admission to Government Medical Colleges of Uttarakhand under the present bond implies service liability as Medical Officer/Specialist on contract basis for minimum of two years in any of the Government Hospital/Health Centre in hilly areas of Uttarakhand. If PG medical student decides not to continue as a service liability or intends to withdraw from the college at his/her own volition, he/she shall be allowed to continue his/her studies or withdraw from the college as a Non-Service Liability after payment of full fees of the course minus the subsidized fees already paid calculated from beginning of the course along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand. 5. Conditions of Non-Service Liability because of Medical reasons :

That the PG medical student will be declared to have become Non-Service Liability on being declared medically unfit by a Medical Board for service in hilly areas of Uttarakhand due to any disease/disability detected at any stage during the course, as under:-

(i) The Medical Board headed by Director General, Medical Health and Family Welfare, Uttarakhand will express their opinion on the circumstances under

which the Student acquired the disease/disability and whether or not he/she had any control over those circumstances. On recommendations of the Medical Board, the PG Medical Student may be declared a Non-Service Liability.

If on the recommendations of the Medical Board headed by Director General,

Medical Health and Family Welfare, Uttarakhand, the PG medical Student is found permanently unfit for service in hilly areas of Uttarakhand during his/her course of studies, he/she would be removed from Service Liability and shall be liable to pay the Bond Amount along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand.

(ii) The Bond Amount will be paid within one month of being declared Non-

Service Liability failing which the amount shall be recovered from PG medical student and his/her sureties of the Student severally or jointly in the manner as provided in sub-para (7) of Para 2 of this Bond .

(iii) The quantum of Bond Amount to be recovered in each case shall be

decided taking into account the following factors:-

(a) Time elapsed between joining the MD/MS course and date of becoming Non-Service Liability.

(b) Severity of the disease/disability. (c) Nature of the disease/disability whether constitutional for example

as result of any accident on land, sea or air.

(iv) Based on the above factors, the Bond Amount to be recovered from the PG medical student and his/her sureties shall be computed as under:-

(a) The Bond Amount shall be calculated at the rate of Rs. 5,00,000/-(Rupees Five Lakh) per year or part thereof limited to the maximum of Rs 15 lakh along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand minus the subsidized fees already paid in Government Medical Colleges, Uttarakhand.

A basic minimum sum shall be recovered in all cases for the free medical education and allied facilities provided by the Government. Depending on the year in which the PG student has been admitted and the year of study in which the PG student is declared Non-Service Liability, minimum charges as under shall always be levied in addition- First year Rs. 60,000.00 Second year Rs. 1,20,000.00 Third year Rs. 1,80,000.00

(b) Bond Amount (in addition to a maximum of Rs 1,80,000.00 mentioned above) shall be decided based on severity of the diseases/disability suffered by the student (in instances of diseases/disability).

(v) However, full waiver of money may be granted by the Government of Uttarakhand in case of grave illness/severe disability necessitating withdrawal from the college or on death of the PG student on the basis of individual cases.

(vi) Provided that the PG student point (i) above, may be allowed to continue

his/her stay in the hostel on payment of the normal expenses of education including tuition fee and fees for boarding and lodging facilities as applicable from time to time if he/she has contracted the disease/disability in the circumstances over which he/she has no control and for which he/she has not refused treatment. The decision of the Government in this regard shall be final.

6. Conditions of Non-Service Liability because of non-medical reasons:

(1) That the PG medical student shall also be declared to have become Non-Service Liability in any of the following condition:-

(i) If he fails to attain attendance below 50% in any consecutive terms of the course for reasons other than medical.

(ii) If he fails to qualify final PG examination within a period of five years from

the date of admission in the college. (2) Where the PG medical student becomes Non-Service Liability under sub-para (1) above, Government shall have right to recover from the student and his/her sureties full tuition fees at the rate of Rs. 5,00,000 (Five Lakh) per year (minus tuition fees already paid) for each year of the student’s stay at the Medical college alongwith compound interest. 7. That where PG medical student is declared a Non-Service Liability under Para 5, 6 and any other provision of this Bond, the sureties shall jointly and severally be liable to pay forthwith to the Government full fees of the MD/MS course for the period from the date of admission to the date of becoming Non-Service liability or removal from the college rolls, limited to a maximum of Rupees Fifteen Lakh minus fee paid along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand. Additional Simple interest shall be levied for late payment i.e. if payment is delayed beyond 45 days from the date of becoming Non-Service Liability or from the date of withdrawal from the college. In case of removal from the college, all dues will be settled before leaving the college. 8. That where PG medical student refusing two years service in hilly regions of Uttarakhand as offered by the Department under this Bond, offers to pay the Government the Bond Amount, he/she may be released from Service Liability by the administration of

the medical college on payment of the Bond Amount along with compound interest thereupon on prevailing Bank lending rate, as may be determined by the Government of Uttarakhand in the account of medical college concerned. 9. That PG medical student while taking admission in Government Medical Colleges, Uttarakhand shall deposit a sum of Rupees 5000/- (Rupees five thousand only) as refundable security money. If the PG medical student withdraws from the college on his/her volition prematurely, the security money shall stand forfeited to the Government. 10. That liability of the sureties shall not be impaired or discharged by reason of time being granted, any forbearance of the Government or any other person authorized by it (whether with or without the knowledge or consent of the surety) nor shall it be necessary for the Government to sue the PG medical student and his/her first surety before suing the second surety. 11. That it is agreed that except in cases where any sum of money is recovered by the Government under the present Bond as arrears of land revenue, if there is any dispute to the effect, meaning of these presents, or otherwise, however, except as to matters for which specific provision has been made in these presents, the same shall be referred to the sole arbitration of the Principal Secretary/Secretary, Department of Medical Education, Government of Uttarakhand or any other person appointed by him as the sole arbitrator whose decision shall be final and binding on the parties. The provision of the Arbitration and Conciliation Act 1996, as amended from to time, shall apply to such arbitration.
