A survey of 345 small businesses by Trade Mark Direct has revealed that 78% of small businesses in the fashion and retail sectors are failing to register a trade mark. The survey also showed that 31% of the small fashion and retail firms asked, had found that 31% had not registered their name or brand as a trade mark because they felt that it wasn't important to their company. According to online trade mark registration service Trade Mark Direct, these businesses are putting their reputation, and the money they have spent on branding, at risk. Businesses that delay registering their trade mark risk their name being registered by a competitor, or later discovering that the name doesn't comply with trade mark law when they do apply. While names such as Gucci are well-protected by trade mark law, smaller firms should also be considering how to safeguard their label. Trade Mark Direct director Mark Kingsley-Williams said: "This research highlights the common misconceptions about trade marks that many retail and fashion businesses share. "What's concerning is that so few businesses in these industries realise how important getting the right protection for their name or logo is. In an industry as creative as retail jewellery, imitation is common, and protecting your business's identity becomes even more important." Jewellers advised to protect their brandwith a trade mark
