Your letter was forwarded to the Office ofPostsecondaryEducation for review and response.Unfortunately, the College did not submit an application for the Fiscal Year 2006 Talent Searchcompetition before the closing dateofFebruary 15, 2006. Applicants were required to submitapplications electronically througb the Grants.gov system. The college claims that it followed" ... to the letter instructions in theFederal Register, Vol. 70. No. 246 ..."For the following reasons we do not agree that the College followed the published instructions.Specifically, the following are relevant provisions from the Federal Register notice:

    We do not consider an application that does not comply with the dead1ine requirements.We will accept your application ifwe can continn that a technical problem occurred withthe Grants.gov system and that that problem affected your ability to submit yourapplication by 4:30p.m.. Washington. DC time, on the application deadline date. TheDepartment will contact you after a determination is made on whether your applicationwill be accepted.     Mr. Stewart Phillips, on behalfofthe College, notified Ms. Margaret Wingfield via email of hedifficulties encountered in registering with theGrants.gov system at 7:58 AM on the morning oft h ~ closing date and"ndicatedthat it would take 72 hours to correct the problem. Mr. Phillipsfurther indicated that the original application would be delivered to the Department.Unfortunately, Somerset Community College did not follow the required procedures forobtaining approval to submit a hardcopy application.After careful review of the matter in OPE, it has been detennined that the college's difficultieswere the result of ts failure to fully register with the Grant.gov system and not a result ofanytechnical issues with the sy!o1em.     (b (6Thank you for your recent letter on behalfofMr. regarding his defaultedstudent loan account with the U.S. Department of Education, Federal Student Aid.Mr.l :J 's concerns, as we understand them, regarding his account are as follows:

    He states that the school placed an unauthorized signature on loandocuments. He states that he is disabled. He objects to the offset ofhis federal and/or state income tax refunds in partialrepaymentof his debt He states that this debt has had an adverse effect on his credit report.

The promissory note is a binding legal document.When the borrower signs the promissory note, he or she is agreeing to repay the loanaccording to the tenns of he note.Our records indicate that in 1992, Mr. (b)(S)Family Educatic;m Loan Program in the to amount of$11,500.00 to attend Cb)(S)College. The loans were later declared in default, and United Student Aid : _ ____,Inc. (USA Funds), the guaranty agency, paid an insurance claim to the lender. Interestwas capitalized, increasing the principal balance. USA Funds subsequently assignedtheaccount to the Department. The loans entered our database on September 4, 2003. At thetime of a s s i g r u n e n ~ the balance was certified to be $12,993.94 in unpaid principal andS7,512.26 in accrued interest.

    Page 2 -The Honorable Harold RogersOn February 4, 2010, we reviewed Mr. l_ _ ] s request for loan discharge due to anunauthorized signature on the loan documents. A student borrower requesting loandischarge due to an unauthorized signature must provide five different authenticspecimens of his or her signature, two ofwhich were made within one year of heCQntested signature. These si ature specimens are required by 34 CFR 682.402(e)(3)and 685.215(c)(2). Mr. Wd not provide the required signature specimens.The Department considers copies ofsignatures on documents signed in the conducting ofpersonal or professional business transactions (for example, a photocopyofa tax return, acancelled check, or a business contract) as reliable specimens ofa borrower's signature.Merely signing a discharge application five times will not satisfy the criteria tor loandischarge. Without the authentic signature specimens, the Department cannot make adetermination regarding the validity of the contested signature. We have enclosed a list ofsuggestions on where to obtain signature specimens.In addition , the "Loan Dischar e A lication: Unauthorized Signature/UnauthorizPayment . form must bear Mr (b)(S) 's original signature and signature date.     Discharge provisions for the Department's student loan programs are established by law.Loans can be discharged if the borrower is totally and permanently disabled. Total andpermanent disability is defined as the inability to work and earn money because ofanimpairment that is expected to continue indefinitely or to result in death. A veteran whohas been determined by the U.S. Department ofVeterans Affairs (VA) to beunemployable due to a service-connected condition is also considered to be totally andpermanently disabled. A borrower who receives Social Security disability benefits doesnot automatically qualify for loan discharge due to total and permanent disability. Aborrower who is able to work and earn money in any capacity in any field ofwork, evenif only on a limited basis, is not eligible for loan discharge.I f M (b)(S) lieves he qualifies for loan discharge basedon the provisions describedabove, e s ould complete the enclosed "Discharge Application: To tal and PermanentDisability." The form must bear a signature ofa physician (M.D. or D.O.) licensed topractice in a state or include documentation from the VA showing that he has beendetermined to be unemployable due to a service-connected condition.

For unsubsidized loans, the borrower is required to pay the interest that accrues whlle he orshe is in school or during periods ofdeferment. In addition, the borrower is responsible for theinterest that accrues during forbearance periods under all of he Department's loan programs;including subsidized loans.The borrower may choose to repay the interest during the in-school, deferment or forbearanceperiod or have the lender capitalizethe interest apd add it to the loan principal when the periodends.
