www.mstcecommerce.com/eprochome/rbi. Tenders will be opened electronically onspecified date and time as given in the Tender.

3. All entries in the tender should be entered in online Technical & Commercial Formatswithout any ambiguity.

Special Note towards Transaction fee: 4. The vendors shall pay the transaction fee using “Transaction Fee Payment” Link

under “My Menu” in the vendor login. The vendors have to select the particulartender from the event dropdown box. The vendor shall have the facility of makingthe payment either through NEFT or Online Payment. On selecting NEFT, the vendorshall generate a challan by filling up a form. The vendor shall remit the transactionfee amount as per the details printed on the challan without making change in thesame. On selecting Online Payment, the vendor shall have the provision of makingpayment using its Credit/ Debit Card/ Net Banking. Once the payment gets creditedto MSTC’s designated bank account, the transaction fee shall be auto authorized andthe vendor shall be receiving a system generated mail.

Transaction fee is non-refundable. A vendor will not have the access to online e-tender without making the payment towards transaction fee. NOTE Bidders are advised to remit the transaction fee well in advance before the closing time of the event so as to give themselves sufficient time to submit the bid.

5. Information about tenders /corrigendum uploaded shall be sent by email only duringthe process till finalization of tender. Hence the vendors are required to ensure thattheir corporate email I.D. provided is valid and updated at the time of registration ofvendor with MSTC. Vendors are also requested to ensure validity of their DSC(Digital Signature Certificate).

6. E-tender cannot be accessed after the due date and time mentioned in NIT.7. Bidding in e-tender :a) Vendor(s) need to submit necessary EMD, Tender fees(if any) and Transaction fees

(If ANY) to be eligible to bid online in the e-tender. Tender fees and Transactionfees are non-refundable. No interest will be paid on EMD. EMD of the unsuccessfulvendor(s) will be refunded by the tender inviting authority.

b) The process involves Electronic Bidding for submission of Technical and CommercialBid.

c) The vendor(s) who have submitted transaction fee can only submit their TechnicalBid and Commercial Bid through internet in MSTC websitewww.mstcecommerce.com → e-procurement →PSU/Govt depts→ Login underRBI→My menu→ Auction Floor Manager→ live event →Selection of the live event

d) The vendor should allow running JAVA application. This exercise has to be doneimmediately after opening of Bid floor. Then they have to fill up Commonterms/Commercial specification and save the same. After that click on the Technicalbid. If this application is not run then the vendor will not be able to save/submit hisTechnical bid.

e) After filling the Technical Bid, vendor should click ‘save’ for recording their Technicalbid. Once the same is done, the Commercial Bid link becomes active and the samehas to filled up and then vendor should click on “save” to record their Commercialbid. Then once both the Technical bid & Commercial bid has been saved, the vendorcan click on the “Final submission” button to register their bid

f) Vendors are instructed to use Attach Doc button to upload documents. Multipledocuments can be uploaded.

a) In all cases, vendor should use their own ID and Password along with DigitalSignature at the time of submission of their bid.

b) During the entire e-tender process, the vendors will remain completely anonymousto one another and also to everybody else.

c) The e-tender floor shall remain open from the pre-announced date & time and for asmuch duration as mentioned above.

d) All electronic bids submitted during the e-tender process shall be legally binding onthe vendor. Any bid will be considered as the valid bid offered by that vendor andacceptance of the same by the Buyer will form a binding contract between Buyerand the Vendor for execution of supply.

e) It is mandatory that all the bids are submitted with digital signature certificateotherwise the same will not be accepted by the system.

f) Buyer reserves the right to cancel or reject or accept or withdraw or extend thetender in full or part as the case may be without assigning any reason thereof.

g) No deviation of the terms and conditions of the tender document is acceptable.Submission of bid in the e-tender floor by any vendor confirms his acceptance ofterms & conditions for the tender.

h) Any order resulting from this tender shall be governed by the terms and conditionsmentioned therein.

i) The tender inviting authority has the right to cancel this e-tender or extend the duedate of receipt of bid(s) without assigning any reason thereof.

The Reserve Bank of India, hereby, invites you to tender for the above work. 2. The tender forms can be viewed on www.mstcecommerce.com/eprochome/rbi and has

to be filled on MSTC website through e-Tendering for submission of on line Techno-

Commercial Bid and price Bid at www.mstcecommerce.com/eprochome/rbi not later

than 2.00 pm on July 16, 2018. 3. The tender details are available for inspection in the office of Reserve Bank of India,

Estate Department, Chandigarh and clarification required, if any, may be obtained by

contacting them, during office hours.

4. The Bank discourages the stipulation of any additional conditions by the tenderer.

However, in case the tenderer wishes to include any condition/ clarification while

tendering for the work, he will have to submit the same in a separate sealed cover. The

tender duly filled in as such without any enclosure shall have to be submitted in another

sealed cover clearly indicating thereon as to which cover contains the tender and which

contains the forwarding letters/ clarifications. The cover containing the forwarding

letters/ clarification/ condition called Part I will be opened on July 16, 2018, the

scheduled date of opening of the tenders in the presence of tenderers or their

authorized representatives who shall be in a position to clarify all the conditions

stipulated by the tenderers.

The clarifications/ conditions etc. if any will be examined and after discussions with all

the tenderers, the conditions that are acceptable to the Bank will be intimated to the

the contents of this letter shall be supplemental to the conditions in the tender and not in

derogation thereof except to the extent specifically provided herein.

Having examined the specifications and schedule of quantities relating to the works specified in the Memorandum hereinafter set out and having visited and examined the site of the works specified in the said Memorandum and having acquired the requisite information relating thereto as affecting the tender, I/we hereby offer to execute the works specified in the said Memorandum within the time specified in the said Memorandum at the rates mentioned in the Schedule of Quantities and in accordance, in all respects, with the specifications and instructions in writing referred to in Conditions of Tender, the Articles of Agreement, Special Conditions, Schedule of Quantities and Conditions of Contract and with such materials as are provided for and in all other respects in accordance with such conditions so far as they may be applicable.

2. Should this tender be accepted, I/We hereby agree to abide by and fulfill the terms andprovisions of the said conditions of contract annexed hereto so as they may be applicableor in default thereof to forfeit the EMD and pay to the Reserve Bank of India, the amountmentioned in the tender.

OR Earnest Money Deposit (EMD) shall be deposited through NEFT in favour of Reserve Bank of India in the A/c 186003001& IFSC – RBIS0CGPA01 (5th and 10th being zero) on or before the date given in NIT.

ARTICLES OF AGREEMENT

ARTICLES OF AGREEMENT made the ___________________________________ day of ____________________________, between the Reserve Bank of India, Chandigarh (hereinafter called “the Employer”) of the one part and _______________________________________________________________ (hereinafter called “the Contractor”) of the other part. WHERAS the Employer is desirous of getting the Annual Maintenance Contract for Plumbing and Sanitary Installation and other miscellaneous works at Bank’s Office Building at Sector 17, Officers’ Quarters at Sector 16,44-B and Staff Quarters at Sector 30-A, Chandigarh as per his Schedule of Quantities showing and describing the work under the direction of the Employer. AND WHEREAS the said work specifications and the Schedule of Quantities have been signed by or on behalf of the parties hereto. AND WHEREAS the Contractor has agreed to execute upon and subject to the conditions set forth herein as Conditions of Contract (all of which are collectively hereinafter referred to as “the said Conditions”) the work shown upon and/or more specifically described in the said Specifications and included in the Schedule of Quantities at the respective rates therein set forth amounting the sum as therein arrived or such other sum as shall become payable thereunder (hereinafter referred to as “the said contract amount”) NOW IT IS HEREBY AGREED AS FOLLOWS:

1. In consideration of the said contract amount to be paid at the times and in the manner set forth in the said conditions, the Contractor shall upon and subject to the said conditions execute and complete the Work shown upon and described in the said specifications and the Schedule of Quantities.

2. The Employer will pay the Contractor the said contract Amount, or such sum as shall

become payable, at the times and in the manner specified in the said conditions.

3. The said Conditions and Appendix thereto and the correspondence attached hereto shall be read and construed as forming part of this Agreement and the parties hereto shall respectively abide by, submit themselves to the said Conditions and the correspondence and perform the agreement on their part respectively in the said Conditions and the correspondence contained.

4. The agreement and documents mentioned herein shall form the basis of this

contract.

5. This contract is a fixed Lump Sum Contract for the complete work to be paid for according to the Schedule of Rates or as provided in the said Conditions.

6. The Employer reserves the right of altering the items to be executed by adding to or

omitting any items without prejudice to this contract.

7. Time shall be considered as the essence of this Contract and the Contractor hereby

agrees to commence the work from the date of issue of work order as provided for in the said conditions and to complete the entire work.

8. All payments by the Employer under this Contract will be made only at Chandigarh.

9. All disputes arising out of or in any way connected with this Agreement shall be

deemed to have arisen at Chandigarh and only Courts in Chandigarh shall have the jurisdiction to determine the same.

10. That the several parts of this Contract have been read and fully understood by the

Contractor.

11. Non-Disclosure Clause: The Contractor shall not disclosed directly or indirectly any information, materials and details of the Bank’s infrastructure/systems/equipments etc., which may come to the possession or knowledge of the Contractor during the course of discharging its contractual obligations in connection with this agreement, to any third party and shall at all times hold the same in strictest confidence. The Contractor shall treat the details of the contract as private and confidential, except to the extent necessary to carry out the obligation under it or to comply with applicable laws. The contractor shall not publish, permit to be published, or disclose any particulars of the works in any trade or technical paper or elsewhere without the previous written consent of the Employer. The Contractor shall indemnify the employer for any loss suffered by the Employer as a result of disclosure of any confidential information. Failure to observe the above shall be treated as breach of contract on the part of the contractor and the Employer shall be entitled to claim damages and pursue legal remedies.The contractor shall take all appropriate actions with respect to its employees to ensure that the obligations of non-disclosure of confidential information under this agreement are fully satisfied. The Contractor’s obligations with respect to non-disclosure and confidentiality will survive the expiry or termination of this agreement for whatever reason.

12. The Contractor / Agency shall comply with the provisions of “the Sexual Harassment of women at work place (Prevention, Prohibition and Redressal) Act, 2013”.

IN WITNESS WHEREOF the Employer and the Contractor have set their respective hands to these presents and two duplicates hereof the day and year first hereinabove written (If the Contractor is a partnership or an individual.

IN WITNESS WHEREOF the Employer has set its hands to these presents through its duly authorized officials and the Contractor has caused its common seal to be affixed hereunto and the said two duplicates/has caused these presents and the said two duplicates hereof to be executed on its behalf, the day and year first hereinabove written (If the Contractor is a Company).

General Instructions to Tenderer (To be read in relevance to e-tendering process only) 1. Issue and Submission of Tender: Participation in this tender will be allowed to the empanelled contractors. Tender for “Annual Maintenance Contract for Plumbing and Sanitary Installation and other miscellaneous works at Bank’s Office Building at Sector 17, Officers’ Quarters at Sector 16,44-B and Staff Quarters at Sector 30-A, Chandigarh" as the case may be shall be uploaded through MSTC website strictly in accordance to the procedures prescribed in Section-I of this document & will remain open to the tenderer for participation before 14:00 hrs on 16 July,2018 under any circumstances whatsoever.

2. Part I – Technical & Commercial: a. Part-I shall contain the unpriced tender consisting of scope of works as specified,

specifications of an item of works, documents and commercial terms and conditions etc. Earnest Money shall be submitted through NEFT only.

b. Part-I of the tender as submitted shall contain the following and to be deposited in the RBI, Estate Department, Chandigarh Office unless otherwise stated separately in this document: (i) Intending tenderer has to deposit a sum of ₹ 26,300/- (Rs. Twenty Six

thousand and three hundred only) as Earnest Money Deposit with the Reserve Bank of India, Estate Department, Chandigarh-160017 by depositing DD/PO of said amount personally with Shri A.K Salwan (Manager) on or before 14:00 hrs on 16 July,2018.

OR Earnest Money Deposit (EMD) shall be deposited through NEFT in favour of Reserve Bank of India in A/c 186003001 & IFSC – RBIS0CGPA01 (5th and 10th being zero) on or before the date given in NIT.

(ii) Power of Attorney/authorization with the seal of the company/firm in the name

of the person signing the tender documents. (iii) Performance Guarantee as stated in the ‘Memorandum’

c. The tenderers are advised to submit the tender based strictly on the General Conditions of the Contract and scope of works as specified contained in the tender documents, and not to stipulate any deviations. If acceptance of the terms and conditions given in the tender documents has any price implications, the same should be considered and included in the quoted price. Tender containing deviations from the terms and conditions is liable to be rejected.

(a) This part shall contain prices in Indian Rupees only and shall be opened through

online after due fulfilment of condition as per Part-I tender. Change of terms and conditions and technical deviations, if any, found in Part II of the tender will not be taken into account and will be treated as null and void.

a. Rates should be quoted in Indian Rupees only. No request for any change in rate or conditions after the opening of the part II tender will be entertained.

b. The rates quoted shall be based on the Part-II of tender and shall be firm and binding without any Escalation whatsoever till the entire Contract period.

c. For any item, if the rate and amount do not tally with respect to the bill of quantities, then the amount arrived on the basis of quoted rates shall only be acceptable and in case of variation of rates in the original and duplicate, the lower of the two rates will be considered for arriving at the total amount for that item.

4. Opening of Tender: As per the procedures laid down in Section-I hereto for opening of e-tender. The tenderer whose tender is not accepted shall not be entitled to claim any costs, charges, damages and expenses of and incidental to or incurred by him through or in connection with his submission of tenders, even though the Bank may elect to modify/withdraw the tender. 5. (i) Earnest Money Deposit (EMD) during contract period:

a) Intending tenderers shall pay an Earnest Money Deposit (EMD) a Rs. 26,300/-(Twenty Six thousand and three hundred only) through depositing DD/PO of said amount personally with Shri A.K Salwan (Manager) on or before 14:00 hrs on 16 July,2018. OR

b) Earnest Money Deposit (EMD) shall be deposited through NEFT in favour of Reserve Bank of India in the A/c 186003001 & IFSC – RBIS0CGPA01 (5th and 10th being zero) on or before the date given in NIT.

c) Under no circumstances Earnest money deposit will be accepted in the form

of fixed deposit receipt of Bank or Insurance Guarantee or Cheque etc.

d) The Earnest Money Deposit (EMD) Rs. 26,300/-(Twenty Six thousand and three hundred only) paid by the tenderer shall be held by the Reserve Bank of India as Security for the execution and due fulfilment of the contract. No interest shall be paid on the said deposit.

e) The Earnest Money Deposit (EMD) furnished by the Contractors at the time of submission of tender will be returned thereafter to all the Contractors except the successful tenderer.

1.

General Instruction to Contractors Annual Maintenance Contract for Plumbing and Sanitary Installation and other miscellaneous works at Bank’s Office Building at Sector 17, Officers’ Quarters at Sector 16, 44-B and Staff Quarters at Sector 30-A, Chandigarh" should be uploaded on MSTC website www.mstcecommerce.com/eprochome/rbi not later than 14.00 hrs on 16 July, 2018. No tender can be uploaded after 2.00 pm on 16 July, 2018 under any circumstances whatsoever.

(a) The tenders will be opened on-line on www.mstcecommerce.com/eprochome/rbi at 2.30 pm on 16 July, 2018. at the office of Reserve Bank of India (RBI), Estate Department, Chandigarh or any other office designated for this purpose by the Bank.

(b) Tenders shall remain open to acceptance by the Bank for a period of three months from the date of opening the tender which may be extended by mutual agreement and the tenderers shall not cancel or withdraw the tender during this period.

2. No tender can be uploaded after 2.00 pm on 16 June, 2018 under any circumstances whatsoever..

a. The tender shall be submitted in two parts comprising. • Part I in the prescribed form, commercial terms and conditions, technical

aspects of the tender such as equipment data sheet, tests and inspections, makes of materials, technical description, drawings etc. in envelope superscripting Part I tender supplied along with the tender documents.

• Part II Schedule of quantity containing price bid in envelope superscripting Part II supplied along with the tender document. Tender Part II shall not contain any covering letter with terms and conditions, conditional discount or rates/amounts for any additional items of work. It shall contain only Part II (Schedule of quantities) as supplied by the Bank with the rate and amount column duly filled in.

4. (a) Each of the tender documents should be signed by the person or persons submitting the tender in token of his/their acquainted himself/themselves with the General Conditions of Contract, Specifications, Special Conditions, etc. as laid down. Any tender with any of the documents not signed will be rejected.

(b) The tender submitted on behalf of a firm shall be signed by all the partners of the firm or by a partner who is authorized on behalf of the firm to enter into the proposed contract. Otherwise the tender may be rejected by the Bank.

5. The Bank does not bind itself to accept, the lowest or any tender and reserve to itself the right to accept or reject any or all the tenders, either in whole or in part, without assigning any reasons for doing so.

6. On receipt of intimation from the Employer of the acceptance of his/their tender, the successful tenderer shall be bound to implement the contract and within fourteen days thereof the contractor shall sign an agreement in accordance with the draft agreement

and the Schedule of Conditions but the written acceptance by the RBI of a tender will constitute a binding contract between the RBI and the person so tendering, whether such formal agreement is or is not subsequently executed.

7. All compensation or other sums of money payable by the Contractor to the Employer under the terms of this Contract may be deducted from the Security Deposit if the amount so permits and the Contractor shall, unless such deposit has become otherwise payable, within ten days after such deduction make good in cash the amount so deducted.

8. The Contractor shall not assign the Contract to any other party. He shall not sublet any portion of the Contract except with the written consent of the Employer. In case of breach of these conditions, the Employer may cause to serve a notice in writing on the Contractor rescinding the Contract whereupon the security deposit shall stand forfeited to the Employer.

9. The Contractor shall carry out all the work strictly in accordance with details and instructions of the Assistant Caretaker/Caretaker/Officials Designated.

10. A Schedule of Probable Quantities in respect of each work and Specification accompany these Special Conditions. The Schedule of Probable Quantities is liable to alteration by omissions, deductions or additions at the discretion of the Bank. Each tender should contain not only the rates but also the value of each item of work entered in a separate column and all the items should be totaled in order to show the aggregate value of the entire tender.

11. The tenderer must obtain for himself on his own responsibility and at his own expenses all the information which may be necessary for the purpose of making a tender and for entering into a contract and must inspect the site of the work and acquaint himself with all local conditions, means of access to the work, nature of the work and all matters appertaining thereto.

12. The Contractor should note that unless otherwise stated the tender is strictly on item rates basis and his attention is drawn to the fact that rates for each and every item should be correct, workable and self supporting. The quantities in the Schedule of Quantities approximately indicate the total extent of work but may vary to any extent and may even be omitted thus altering the aggregate value of the Contract.

13. The Contractor shall not be entitled to any compensation for any loss suffered by him on account of delays in commencing or executing the work, whatever the cause of delays including delays arising out of modifications to the work entrusted to him or in any sub-contract connected therewith or delays in awarding contracts for other trades of the project or in commencement or completion of such works or in procuring Government controlled or other building materials or in obtaining water and power connections for construction purposes or for any other reason whatsoever and the Employer shall not be liable for any claim in respect thereof. The Employer does not appear liability for any sum besides the tender amount, subject to such variations as are provided for herein.

14. The successful tenderer is bound to carry out any items of work necessary for the completion of the job even though such items are not included in the quantities and rates.

15. The successful tenderer must co-operate with the other Contractors appointed by the Employer so that the work shall proceed smoothly with the least possible delay and to the satisfaction of the Bank’s Engineer.

16. The Contractor must bear in mind that all the work shall be carried out strictly in accordance with the Specifications and also in compliance of the requirements of the local public authorities and to the requirements of the Bank and no deviation on any

account will be permitted. 17. The successful tenderer should make his own arrangement to obtain all materials

required for the work. 18. The water and electricity required for the work shall be provided by the Bank at one

place free of cost, the Contractor shall have to make his own arrangements by providing the wire from electrical point to working place.

19. 20.

The Contractor shall strictly comply with the provision of safety code annexed hereto. The Contractor shall not be entitled to any compensation for any loss suffered by him on account of delays in commencing or executing the work, whatever the cause of delays may be, including delays arising out of modifications to the work entrusted to him or in any sub-contract connected therewith or delays in awarding contracts for other trader of the project or in commencement or completion of such works or in procuring Government controlled or other building materials or in obtaining water and power connections for construction purpose or for any other reason whatsoever and the employer shall not be liable for any claim in respect therefore. The Employer does not accept liability for any sum besides the tender amount, subject to such variations as are provided for herein.

21. The Contractor shall be deemed to have carefully examined the work and sited conditions including labour, the general and special conditions, the specifications, schedules and drainage and shall be deemed to have visited the site of work, to have fully informed himself regarding the local conditions and carried out his own investigations to arrive at the rates quoted in the tender. In this regard he will be given necessary information available with the Bank but without any guarantee about its accuracy.

22.

The Contractor shall be responsible for all injury or damage to persons, animals or things, and for all damage to property which may arise from any factor omission on the part of the Contractor or any Sub-Contractor or any nominated Sub-Contractor or any of their employees. All Risks Policy for Insurance for the full amount of the contract including earth quake risk in the joint names of the Employer and the Contractor (the name of the former being placed first in the policy) against all risks as per the standard all risk policy for Contractors and deposit such policy or policies with the Employer before commencing the works.

23 The Contractor shall reinstate all damage of every sort mentioned in this clause so as to do delivery of the whole of the works complete and perfect in every respect and so as to make good or otherwise satisfy all claims for damage to property or third parties.

24 The Contractor shall also indemnity and keep indemnified the Employer against all claims which may be made against the Employer by any person in respect of anything which may arise in respect of the works or in consequence thereof and shall at his own expense, effect and maintain until the virtual completion of the contract, with an Insurance Company approved by the Employer a policy of Insurance in the joint names of the Employer and the Contractor (name of the Employee (RBI) being placed first in the policy) against such risks and deposit such policy or policies before commencement of the works.

25. The minimum limit of the coverage under the policy shall be Rs.2 lakh per person for any one accident or occurrence and Rs.5 lakh in respect of damage to property for any one accident or occurrence. The Contractor shall also indemnify the Employer against all claims which may be made upon the Employer, whether under the Workmen’s Compensation Act or any other statute in force, during the currency of this contract or at Common Law in respect of any employee of the Contractor or Sub-Contractor and

shall be at his own expense effect and maintain until the Virtual Completion or the Contract with an Insurance Company approved by the Employer a policy of Insurance against such risks and deposit such policy or policies with the Employer from time to time during the currency of this contract.

26. In default of the Contractor insuring as provided above, the Employer may so insure and may deduct the premiums paid from any money due or which may become due to the Contractor.

27. The Contractor shall be responsible for any liability which may not be covered by the insurance policies referred to above and also for all other damages to any person, animal or defective carrying out of this contract, whatever, may be the reasons due to which the damage shall have been caused.

28 The Contractor shall upon settlement by the insurer of any claim made against the insurer pursuant to a policy taken under this clause, proceed with due diligence to rebuild or repair the works destroyed or damaged. In this event all the money received from the insurer in respect of such damage shall be paid to the Contractor and the Contractor shall not be entitled to any further payment in respect of the expenditure incurred for rebuilding or repairing of the materials or gods destroyed or damaged.

29. The Contractor shall reinstate all damage of every sort mentioned in this clause so as to do delivery of the whole of the works complete and perfect in every respect and so as to make good or otherwise satisfy all claims for damage to property or third parties.

30. Without prejudice to his liability under this clause, the Contractor shall also cause all nominated sub-Contractors to effect, for their respective portions of the works similar policies of insurance in accordance with the provisions of this clause and shall produce or cause to produce to the Employer such policies. The Contractor shall not permit a nominated Sub-Contractor to commence work at the site unless said insurance policies are submitted. In the event of failure, of the Sub-Contractor to take out such policy or policies of insurance before commencing the works at the site, the Contractor shall be responsible for any claim or damage attributable to the said Sub-Contractor.

31. The Bank is not bound to accept the lowest or any tender. The Bank reserves the right to split and award the work to different agencies, Bank reserves the right to accept either in full or in part of any tender. The Bank also reserves the right to reject all the tenders without assigning any reason therefor

SCOPE OF WORK & SPECIAL/ GENERAL TERMS AND CONDITIONS

Annual Maintenance Contract for Plumbing and Sanitary Installation and other miscellaneous works at Bank’s Office Building at Sector 17, Officers’ Quarters at Sector 16,44-B and Staff Quarters at Sector 30-A, Chandigarh. Details of items of work – Specifications, General Terms & Conditions

1. Subject to the other provisions, the Bank shall engage the Contractor for Annual Maintenance Contract for Plumbing and Sanitary Installation and other miscellaneous works at Bank’s Office Building at Sector 17, Officers’ Quarters at Sector 16, 44-B and Staff Quarters at Sector 30-A, Chandigarh for a total period of three years. However the contract will be renewed at the end of every year on the same terms and conditions provided the Bank finds services of the Contractor satisfactory and if Bank desire, so. The decision of the Bank in this regard will be final. 2. The Contractor shall be solely responsible for the proper upkeep of Plumbing work etc. 3. The Contractor, from time to time after completion of work, shall to take the certificate/acknowledgement from the resident of the flat that the work has been completed satisfactory with due certification from Assistant Caretaker/Caretaker and Security Officer/Maintenance Officer designated the same shall be enclosed along with the bill. Payment shall be made on monthly basis. 4. The Contractor shall provide necessary service personnel to ensure proper maintenance of plumbing & other allied services and to ensure that the work carried out as specified in schedule of quantity. The personnel so engaged by him would always be deemed to be his personnel and would not have any claim on the Bank whatsoever. 5. The Contractor shall comply with all such statutes or laws as may be applicable to them or to the personnel engaged by them to manage and maintain the flats. 6. The Contractor shall obtain necessary licences and permits in their name at their own expenses and shall keep the Bank indemnified against any loss arising due to non-compliance to any statutory requirement. 7. The Contractor shall be responsible for the maintenance of plumbing work and materials will be supplied/purchase by them/other agency and will be paid separately by the Bank. 8. The Contractor shall submit to the Bank their regular report every month in such manner as may be prescribed from time to time. 9. Damages caused during the work shall be replaced at contractors risk and cost immediately. Bank shall be entitled to obtain forced possession without any

further notice to the contractor at the contractor’s cost and risk. 10. As the arrangement is by way of Special Assignment on a contractual basis for a fixed period, the contractor and his service personnel will not be eligible for any benefit like provident fund, Gratuity etc. available to the staff of the Bank. 11. Within one month from the date of awarding the contract the successful bidder shall obtain a license under the Contract Labour (R & A) Act, from the licensing authority as applicable. 12. The personnel deployed should be well experienced and trained adequately and of sound health. They should be well behaved and well mannered. They should be provided with uniforms and identity cards prominently displayed. They should have knowledge of local language and preferably Hindi also. 13. If a particular person is absent on any day another should be deployed in his/her place. 14. The personnel will perform all the duties assigned to the contractor and as specified by the Bank from time to time. 15. Insurance cover protecting the agency against all claims applicable under the Workmen’s Compensation Act, 1948 shall be taken by the service provider. The service provider shall arrange necessary Insurance cover for any persons deployed by him even for short duration. The Bank shall not entertain any claim arising out of mishap, if any that may take place while discharging the duties by the labour provided for outsourcing by the contractor. In the event of any liability/claim falling on this commissionerate, the same shall be reimbursed/indemnified by the service provider. 16. The Contractor should pay to their personnel a minimum wage at the prevailing rate as fixed under Minimum Wages Act. The Chief Labour Commissioner (Central) any breach of this condition will be liable for termination of the contract and the same would be dealt with accordingly. Besides, ESI and PF per head at the current rate should be paid by the contractor every month as per the existing rules and copies of paid cash challans should be submitted every month to the Bank. 17. The contractor is responsible for payment of monthly salary including leave salary, bonus, gratuity etc., to the personnel as applicable to them. 18. The contractor should ensure that there is no scope for any grievance from the personnel on delayed payment of wages. The employees engaged by the Plumbing agency will be in the employment of the plumbing Agency only and not of the Reserve Bank of India. 19. The contractor shall indemnify and shall keep this office indemnified against Acts of omission or negligence, dishonesty or misconduct of the men/women engaged for the work and this office shall not be liable to pay any damages or compensation to such person or to third party. All damages caused by the

Plumbing personnel shall be the Plumbing Contractor shall strictly comply with the terms and condition of the agreement which will be executed with the successful contractor. Failure by the contractor to comply with such statutory requirements and / or the terms of the agreement during the period of agreement of deficiency in services shall result in termination of the contract. 20. All the Plumbing materials /consumables as required to execute the above job shall be supplied by the Contractor. Separate payment will be made for supply of material by the Bank. Materials shall be Bank’s approved make/manufacturer or equivalent make. 21. Any dispute arising out of this agreement or that which may arise in future, shall be resolved by taking recourse to mutual settlement, arbitration/conciliation clauses, failing which the dispute will be subject to Chandigarh court jurisdiction only. 22. The Bank will have the right to terminate the agreement without assigning any reason with a notice of forty eight hours and the contractor will not be entitled to any compensation for premature termination of the agreement. Before expiry of the notice period given in the termination notice, the contractor shall vacant the premises. 23 .In case of any dispute arising out of this agreement, the decision of the Bank will be final and binding on the contractor. 24. An Agreement shall be executed in duplicate, the Bank retaining the Original and the contractor retaining the duplicate thereof. The stamp duty on the original and the duplicate shall be borne by the contractor. 25. The Bank will not provide accommodation to the contractor in the premises. 26. Work shall be carried out with minimum disturbance to the employees of the Bank/occupants/residents at the convenience in allowed time slot. 27. JOB CARD shall be maintained for each flat/common area by the successfully contractor with due signature of Occupant/Caretaker/Asst Caretaker on Weekly/Quarterly progress. 28. The Contractor should be able to supervise the work done by the labourers engaged by him either directly or through a supervisor. 29. The Contractor should deploy the minimum work force on retainer basis who

shall attend the work between 9.00 AM to 5.00 PM, from Monday to Saturday (In

case of emergency, they shall continue to work till emergency is over).

30. Before quoting the tender contractors shall visit the above mentioned

staff/officers’ quarters/premises and assess the area & scope of the work

involved in detail and quote accordingly.

31. The Contractor shall provide all the tools, implements, equipment, etc., to carry out the job. 32. The agreed contract amount shall be fixed throughout the tenure of contract and will not subject to any fluctuations due to increase in the cost of materials, labour. Rate quoted shall also include GST, Income Tax and any other taxes required under the statute, if any, no additional amount will be paid.

33. The contract will be for a period of one year. The Bank may cancel the contract after giving a notice of one month to the Contractor. If the Contractor wants to cancel the contract, he will have to give a notice of two months to the Bank in advance. The contract can be renewed subject to the satisfactory service rendered by the Contractor and on mutual agreed condition by both the parties.

34. The contractor shall arrange to carry out police verification of the staff employed by him and submit the verified documents

35. The tender for the work shall remain open for acceptance for a period of 90 days from the date of opening of Part II of tender. If any tenderer withdraws his tender before the said period, then the Bank shall be at liberty to forfeit the EMD deposited along with the tender.

36. The Bank has reserves the right to accept or cancel the tender at any point of time

37. The Bank is not bound to accept the lowest or any tender. The Bank reserves the right to withhold the issue of application form/quotation to any or all the applicants and split award the work to different agencies without assigning any reason therefor.

38. The monthly payment against respective items mentioned in schedule of quantity will be made after satisfactory completion of work and the certificate from the official/s designated for the purpose.

39. All the monthly bill should be submitted separately with the Assistant Caretakers/Assistant Manager (Maintenance) certificate duly attached along with acknowledgement received from the occupants. 40. Penalty / Deduction for absence of the Plumber and helper will be made on pro-rata basis. 41 Settlement of disputes by Arbitration: All disputes and differences of any kind whatever arising out of or in connection with the Contract or the carrying out of the works (whether during the progress of the works or after their completion and whether before or after the determination, abandonment or breach of the contract) shall be referred to and settled by the Bank who shall state his decision in writing. Such decision may be in the form of a final certificate or otherwise. The decision of the Bank with respect to any of the expected matters shall be final and without appeal as stated in Clause 32 hereof. But if either the Employer

or the Contractor be dissatisfied on a matter, question of dispute of any kind except any of the excepted matters then and in any such case either party (the Employer or the Contractor any such case either party (the Employer or the Contractor may within 28 days after receiving notice of such decision give a written notice to the other party requiring the matters in dispute be arbitrated upon such written notice shall specify the matters which are in dispute or difference of which such written notice has been given and no order shall be and is hereby referred to the Arbitration and final decision of an arbitrator to be agreed upon and appointed by both the parties or, in case of disagreement as to the appointment of a single arbitrator, to the appointment of two arbitrators, one to be appointed by each party, which arbitrators shall before taking upon themselves the burden or reference appoint an Umpire. The Arbitrator or Arbitrators, as the case may be, shall have power to open up, review and revise any Certificate, opinion, decision requisition or notice, save in regard to the excepted matters referred to in the preceding clause, and to determine all matters to dispute which shall be submitted to arbitration and of which notice shall have been given as aforesaid. The Arbitrator or Arbitrators, as the case may be, shall make his or their award within one year (or such further extended time as may be decided by him or them as the case may be with the consent of the parties) from the date of entering on the reference. In case during the arbitration proceedings the parties mutually settle, compromise or compound their dispute or difference, the reference to arbitration and the appointment of the Arbitrator or Arbitrators, as the case may be, shall be deemed to have been revoked and the arbitration proceedings shall stand withdrawn or terminated with effect from the date on which the parties file a joint memorandum of settlement thereof, with the Arbitrator or Arbitrators as the case may be. Upon every of any such reference, the cost of an incidental to the reference and Award respectively shall be in the discretion of the Arbitrator or Arbitrators, as the case may be who may determine the amount thereof, or direct the same to be taxed as between attorney and client or as between party and party, and shall direct by whom and to whom and in what matter the same shall be borne and paid. This submission shall be deemed to be a submission to arbitration within the meaning of the Indian Arbitration Act (latest amendment) or any statutory modification thereof. The Award of the Arbitrator or Arbitrators, as the case may be, shall be final and binding parties. It is agreed that the contractor shall not delay the carrying out of the works by reasons of any such matter, question or dispute being referred, to arbitration, but shall proceed with the works with all due diligence and shall, until the decision of the Arbitrator or Arbitrators, diligence and shall, until the decision of the Arbitrator or Arbitrators, as the case may be, is given, abide by the decision of the Bank and no Award of the Arbitrator or Arbitrators, as the case may be shall relieve the Contractor of his obligations to adhere strictly to the Bank's instructions with regard to the actual carrying out of the works. The employer and the Contractor hereby also agree that arbitration under this clause shall be a condition precedent to any right of action under the Contract.

42. Engagement of Contract Lobour : The contractor shall obtain a licence as contemplated under the Contract Labour (Regulation and Abolition) Act, 1970 or any other law, as applicable, failing which he alone would be responsible for actions/proceedings ensuing thereto. The Bank shall not be held responsible for acts, commissions or omissions of the contractor and shall in no way made liable to the labourers engaged by the contractor.

The principal employer shall ensure the presence of his authorized representative at the place and time of disbursement of wages by the contractor to workmen and it shall be the duty of the contractor to ensure the disbursement of wages in the presence of such authorized representative. The authorized representative of the principal employer shall record under his signature a certificate at the end of the Register of Wages to the (Register of Wages-cum-Muster Roll) as the case may be, in the following form: “Certified that the amount shown in column No… has been paid to the workman concerned in my presence on ….at….”

43. The Sexual Harassment of women at work place:

The Contractor / Agency shall comply with the provisions of “the Sexual Harassment of women at work place (Prevention, Prohibition and Redressal) Act, 2013”. In case of any complaint of sexual harassment against its employee within the premises of the Bank, the complaint will be filed before the Internal Complaints Committee constituted by the Contractor / Agency and the Contractor/Agency shall ensure appropriate action under the said Act in respect to the complaint. a. Any complaint of sexual harassment from any aggrieved employee of the contractor against any employee of the Bank shall be taken cognizance of by the Regional Complaints Committee constituted by the Bank. b. The contractor shall be responsible for any monetary compensation that may need to be paid in case the incident involves the employees of the contractor, for instance any monetary relief to Bank’s employee, if sexual violence by the employee of the contractor is proved. The contractor shall be responsible for educating its employees about prevention of sexual harassment at work place and related issues.

Preamble to Schedule of Quantity: (i) The contractor is advised to visit the site before quoting their rates to assess the

quantum of work. (ii) Making available the services of maintenance staff for maintaining the Bank’s Office

Building at Sector 17 and Residential colonies at Sector 30-A, 44-B & 16. The charges quoted shall be for deputing the experienced and well-dressed workers to the Office/colonies for 6 days in a week (The person employed should work on all days except Sundays and National holidays) and shall generally follow the working hours from 9.00 a.m. to 5 p.m. (including 1 hour lunch break), however, in case of emergency the staff have to continue to work till the emergency is over.

(iii) The maintenance staff should report to the Assistant caretaker/Caretaker or to the officials concerned.

(iv) The charges quoted should include wages, transportation charges, providing and maintenance of kit containing all tools, cleaning materials like nylon brush, broom, detergent, toilet cleaner, soft cloth, detergents etc. required for the work, incidental charges and contractors profit and overhead and taxes as may be levied by statutory authorities.

(v) Mode of Payment:- The Payment to contractor shall be made on Monthly basis for the works carried out flats/common area only at the rate quoted. If the contractor fails to carry out the work properly with the instructions of the Bank and within a reasonable period as specified, the Bank, at his discretion will forfeit the amount retained with the Bank and terminate the contract without assigning any reason and any further reference to the contractor. Bank’s decision in this regard will be final and binding on the contractor and the contractor will not have any claim in this regard whatsoever it may be.

(vi) The successful tenderer shall employ only reliable workers and furnish their complete details with their two photographs and obtain their Identity Card from Protocol & Security officer. After expiry of the contract, the same may be returned. In case of any dispute, default like theft or burglary on the part of worker, the contractor will be totally responsible and initiate action to set it right.

(vii) The Contractor should arrange to maintain the Plumbing/other misc. allied works in the Bank's various properties. The charges quoted shall be on monthly basis. He shall attend to the work from 9.00 a.m. to 5.00 p.m. However, in case of emergency he shall continue to work till the emergency/lies is/are over. Further in an emergency he may be called upon by authorized officials of the Bank before/after prescribed working hours on all days at any time. He should deploy one skilled Plumber, having good knowledge of other ancillary trades also, and a semiskilled helper to the plumbers for this purpose.(i.e. One plumber & one helper for each property)

I. The Contractor shall report to Assistant Caretaker / Caretaker/A.Mgr (Maint) / A.Mgr(T) /JE(C) / Manager (P&S)/AM (Security) etc. as the case may be on all week days (Monday to Saturday) and shall work as per directions issued by them from time to time. His services will be utilized in any of the Bank's properties which are listed below:

The charges quoted shall include wages, allowances, transportation/Cartage charges for workmen/materials, tools & plants including scaffolding, zoola etc. as required for the maintenance work incidental charges cost of all types of screws, nails, trawl plugs, nuts, bolts, adhesives, oil, grease, washers, wooden plugs, wedges and also such petty materials etc.as may be required for the work, taxes, levies, insurance premium, contractor's profit and overheads etc. complete and the rate/charges shall be deemed to have been quoted for providing satisfactory monthly services in all respects. As regards payment of wages to the workers employed, the Contractor shall abide by the provisions of Minimum wages act of labour laws obligations

Safety Code

1. First aid appliances including adequate supply of sterilized dressing and cotton wool shall be

kept in a readily accessible place.

2. An injured person shall be taken to a public hospital without loss of time, in cases where the

injury necessitates hospitalization.

3. Suitable and strong scaffolds should be provided for workmen for all work that cannot safely be

done from ground floor.

4. No portable single ladder shall be over 8 meters in length. The width between the side rails

shall not be less than 30 cm(clear) and the distance between two adjacent rungs shall not be

more than 30 cm. When a ladder is used an extra mazdoor shall be engaged for holding the

ladder.

5. Every opening in the floor of a building or in a working platform shall be provided with suitable

means to prevent the fall of persons or materials by providing suitable fencing or railing;

minimum height shall be one meter.

6. No floor, roof or other part of the structure shall be so overloaded with debris of materials as to

render it unsafe.

7. i) No chemical containing lead or lead products shall be used except in the forms of paste or

readymade paint.

ii) Suitable face masks shall be supplied for use by the workers when the chemical is applied in

the form of spray or surface having lead dry rubbed and scrapped.

8. Overalls shall be supplied by the Contractor to the workers and adequate facilities shall be

provided to enable the working to wash during the period of cessation of work.

9. Hoisting machines and tackle used in the works, including their attachments, anchorage and

support shall be in perfect condition.

10. The ropes sued in hoisting or lowering material or a means of suspension shall be of durable

quality and adequate strength and free from defects.

FIRE SAFETY CODE

i. Cutting / drilling machine and other electrically operated equipment used at site shall be

plugged into correctly rated electrical outlets.

ii. Only ISI marked 3-pin plug and other appliances and equipment shall be used.

iii. Electrical power cables/wires used shall not have any joints and shall be properly rated.

iv. All electrical appliances i.e. welding, drilling, cutting machine etc. shall be safely and securely

earthed to prevent leakage current while in operation.

v. Before commencing the welding work for the first time on any day, the Engineers shall be

informed and only after the site inspection by them, work shall be started.

vi. Two buckets of water and sand shall be kept in an easily accessible area on the site.

vii. Fire extinguishers recommended shall be kept on the site.

viii. Used drums shall be stored in specified store only after closing them properly.

ix. Personal protective equipments such as safety shoes, hand gloves, welder’s mask, ear plug

etc. depending upon the requirement of the work shall be provided by the contractor to the

workmen to prevent occupational health hazards.

x. The safety belt shall be provided by the contractor and used by the workmen while working

from height for more than 10 feet from Ground level.

xi. None of the passages near lift lobby and staircases shall be used for stacking / dumping any

kind of materials/waste.

xii. Both the staircase doors shall be normally kept closed.

xiii. None of the fire extinguishers shall be removed/shifted from its designated location.

xiv. Power supply shall be switched off from the mains when equipment is not in use.

xv. Wood-shavings and sawdust generated from the work shall be collected on daily basis,

removed from site and stored at the designated place in proper manner.

xvi. Any debris generated from the work shall be collected on daily basis, removed from site and

stored at the designated place in proper manner.

xvii. Battery operated emergency light/torches shall be provided by the contractor to the workmen

while working beyond office hours.

Preamble to Schedule of rates The Contractor should arrange to maintain the plumbing and Sanitary Installations in the Bank's various properties. The charges quoted shall be on monthly basis, he shall attend to the work from 9.00 a.m. to 5.00 p.m. daily from Monday to Saturday. In case of the emergency, he shall continue to work till the emergency/lies is/are over. Further, in an emergency, he may be called upon by authorized official of the Bank after/before prescribed working hours on working days and at any time on Sunday/Holidays. He should deploy one plumber and one helper for the purpose. The contractor shall abide by the prevailing / future labour laws of the Govt. & shall produce requisite details to them if demanded. The contractor should quote the rate after considering the minimum wages act.

i) The contractor shall report to A.Mgr. (Civil), Junior engineer/Caretaker/Manager (P & S)/Asstt. Manager (Security) for office building as well as for residential colonies. He should report to Caretaker of respective colonies on week days and shall work as per directions issued by them from time to time. His services will be utilized in any of the Bank's properties.

ii) The charges quoted shall include wages, transportation charges, kit of tools and equipment required for the work, making holes in walls/concrete etc & making good the same, incidental charges, all taxes applicable (GST), contractors profit and overheads etc. complete.

iii) The services rendered under the contract shall include following items of works:

(a) Removal of chokages from drainage lines/water supply lines, gully traps, nahani traps, bottle traps, kitchen sinks, wash basins, urinals, W.Cs, bath tubs etc. including removal and re-fixing of connecting pieces, taps and valves etc., making hole in the wall, if necessary and redoing the same etc. complete.

(b) Replacement of washers of taps, cocks, pillar cocks, etc. (Inclusive of cost of washer).

(c) Repairing of flushing cisterns including removal of siphons, float valves and re-fixing them after adjustments.

(d) Disconnecting and reconnecting plumbing connections in case of water heaters, geysers, water coolers, water purifier etc gadgets wherever required to be replaced/ repaired by using Teflon tape for jointing or any approved jointing material.

(e) Cementing of joints of various drainage lines, gaps between wash basins, sinks and that of walls, damaged pointing of joints of existing tiles, leaky connections of G.I. pipes and specials including cost of cement, white lead, spun yarn etc. as required.

(f) Disconnecting & reconnecting suction and delivery connections of water pumps whenever the pumps are required to be taken away for repairs or on spot repairs. Removal of air lock in suction and delivery lines as and when required.

(g) Re-fixing of loose fixtures, fittings and supporting brackets of wash basins, sinks, flushing, cisterns, towel rods, mirrors, glass shelves, soap holders, gratings and any other fixtures and fittings including grouting of new wooden gutties in cement mortar, screws etc. wherever necessary.

Cleaning of plumbing fixtures in Bank’s Office Building (including Annexe Building & service quarters etc.) should be carried out weekly on Saturday. As & when required, in an emergency, he may be called upon by authorized official of the Bank after/before prescribed working hours on working days and at any time

NOTES 1. Contractor should inspect the site before quoting the rates. 2. Works should be carried out quickly without causing any inconvenience to the staff and

residents and without affecting the normal working of the Bank's Departments. 3. Contractor should bring all the tools, equipment, etc. while working in the bank along with a

good plumber in case needed. 4. Appropriate and adequate insurance cover for the laborers engaged in the work should be

obtained and produced before taking up the work. 5. Works should be done under the supervision of Bank's authorized staff. CONDITIONS 1. Replacements of fittings and fixture should not be done without prior approval by

Competent authority. 2. Old, worn out replaced fixtures and other materials should be taken away by the Contractor

and adjustment of rebate made in the relative bill itself. 3. All the monthly bills should be submitted separately after obtaining Caretaker's Certificates

on the bill. 4. List of approved materials shall be handed over to the contractor on award of the work. 5. In case of any materials of specified brands being not available, prior approval of Bank
