online at www.mstcecommerce.com/eprochome/rbi. Tenders will be opened electronically on specified date and time as given in the Tender.

Special Note towards Transaction fee: 4. The vendors shall pay the transaction fee using “Transaction Fee Payment”

Link under “My Menu” in the vendor login. The vendors have to select the particular tender from the event dropdown box. The vendor shall have the facility of making the payment either through NEFT or Online Payment. On selecting NEFT, the vendor shall generate a challan by filling up a form. The vendor shall remit the transaction fee amount as per the details printed on the challan without making change in the same. On selecting Online Payment, the vendor shall have the provision of making payment using its Credit/ Debit Card/ Net Banking. Once the payment gets credited to MSTC’s designated bank account, the transaction fee shall be auto authorized and the vendor shall be receiving a system generated mail.

Transaction fee is non-refundable. A vendor will not have the access to online e-tender without making the payment towards transaction fee. NOTE Bidders are advised to remit the transaction fee well in advance before the closing time of the event so as to give themselves sufficient time to submit the bid.

5. Information about tenders /corrigendum uploaded shall be sent by email only during the process till finalization of tender. Hence the vendors are required to ensure that their corporate email I.D. provided is valid and updated at the time of registration of vendor with MSTC. Vendors are also requested to ensure validity of their DSC (Digital Signature Certificate).

6. E-tender cannot be accessed after the due date and time mentioned in NIT. 7. Bidding in e-tender : a) Vendor(s) need to submit necessary EMD, Tender fees (if any) and

Transaction fees (if any) to be eligible to bid online in the e-tender. Tender fees and Transaction fees are non-refundable. No interest will be paid on EMD.

EMD of the unsuccessful vendor(s) will be refunded by the tender inviting authority.

b) The process involves Electronic Bidding for submission of Technical and Commercial Bid.

c) The vendor(s) who have submitted transaction fee can only submit their Technical Bid and Commercial Bid through internet in MSTC website www.mstcecommerce.com → e-procurement →PSU/Govt depts→ Login under RBI→My menu→ Auction Floor Manager→ live event →Selection of the live event

d) The vendor should allow running JAVA application. This exercise has to be done

immediately after opening of Bid floor. Then they have to fill up Common terms/Commercial specification and save the same. After that click on the Technical bid. If this application is not run then the vendor will not be able to save/submit his Technical bid. e) After filling the Technical Bid, vendor should click ‘save’ for recording their

Technical bid. Once the same is done, the Commercial Bid link becomes active and the same has to filled up and then vendor should click on “save” to record their Commercial bid. Then once both the Technical bid & Commercial bid has been saved, the vendor can click on the “Final submission” button to register their bid

f) Vendors are instructed to use Attach Doc button to upload documents. Multiple documents can be uploaded.

a) In all cases, vendor should use their own ID and Password along with Digital Signature at the time of submission of their bid.

b) During the entire e-tender process, the vendors will remain completely anonymous to one another and also to everybody else.

c) The e-tender floor shall remain open from the pre-announced date & time and for as much duration as mentioned above.

d) All electronic bids submitted during the e-tender process shall be legally binding on the vendor. Any bid will be considered as the valid bid offered by that vendor and acceptance of the same by the Buyer will form a binding contract between Buyer and the Vendor for execution of supply.

e) It is mandatory that all the bids are submitted with digital signature certificate otherwise the same will not be accepted by the system.

f) Buyer reserves the right to cancel or reject or accept or withdraw or extend the tender in full or part as the case may be without assigning any reason thereof.

g) No deviation of the terms and conditions of the tender document is acceptable. Submission of bid in the e-tender floor by any vendor confirms his acceptance of terms & conditions for the tender.

h) Any order resulting from this tender shall be governed by the terms and conditions mentioned therein.

i) The tender inviting authority has the right to cancel this e-tender or extend the due date of receipt of bid(s) without assigning any reason thereof.

1.2 We also agree that our tender will remain valid for acceptance by the Bank for

SECTION-B

Articles of Agreement ARTICLES OF AGREEMENT made the ______________ day of ________________ between the Reserve Bank of India, having its Central Office at Mumbai 400001 (hereinafter called “the Employer”) of the one part and __________________________________________________ (hereinafter called “the Contractor”) of the other part. WHEREAS the Employer is desirous of Design, Supply, Installation, Testing and Commissioning of Intelligent Analog Addressable Fire Alarm System for the Bank's Main Office Building at Nagpur and has caused drawings and specifications describing the works to be done to be prepared by or under the direction of Bank’s Engineer. AND WHEREAS the said Drawings numbered ________________ to _________________ inclusive, the Specifications and the Schedule of Quantities have been signed by or on behalf of the parties hereto. AND WHEREAS the Contractor has agreed to execute upon and subject to the Conditions set forth herein, and to the General Instructions, General Terms and Conditions, Special Conditions of Contract, Appendixes, Specifications, Workmanship, Mode of Measurement, Schedule of Quantities set forth in the tender document, (all of which are collectively hereinafter referred to as “the said Conditions”) the works shown upon the said Drawings and/or described in the said Specification and included in the Schedule of Quantities at the respective rate therein set forth amounting to the sum as therein arrived at or such other sum as shall become payable there under (hereinafter referred to as “the said Contract Amount”). NOW IT IS HEREBY AGREED AS FOLLOWS 1. In considerations of the said Contract Amount to be paid at the times and in the

manner set forth in the said Conditions, the Contractors shall upon and subject to the said Conditions execute and complete the work shown upon the said Drawings and described in the said Specifications and the Schedule of Quantities.

2. The Employer shall pay the Contractor the said Contract Amount or such other sum as shall become payable, at the times and in the manner specified in the said Conditions.

3. The term “Bank’s Engineer/Engineer/Engineer-in-Charge” in the said Conditions

shall mean the technical officer or any other successor of the Bank nominated by the Employer for that purpose will function as “Bank’s Engineer/Engineer/Engineer-in-Charge”.

4. The Reserve Bank of India will administer and arrange for supervision of works

through the Bank’s Engineer including certification of bills, making payments and implementation of various terms, conditions and stipulations of the contract, execution of the work, quality of construction, quality of materials, progress and completion of the project.

5. The said conditions and Appendix thereto shall be read and construed as forming part of this agreement, and the parties hereto shall respectively abide by, submit themselves to the said Conditions and perform the agreements on their part respectively in the said Conditions contained.

6. The plans, agreement and documents mentioned herein shall form the basis of this Contract.

7. This Contract is neither a fixed Lump Sum Contract nor a piece work contract but is a contract to carry out the work in respect of execution of ‘Design, Supply, Installation, Testing and Commissioning of Intelligent Analog Addressable Fire Alarm System for the Bank's Main Office Building at Nagpur as per the specifications as specified in the schedule and as per the drawing enclosed. It is an item rate contract as per schedule details to be paid for according to actual measured quantities at the rate contained in the Schedule of rates and Probable Quantities or as provided in the said Conditions.

8. The Contractor shall afford every reasonable facility for carrying out of all works relating to civil works, installation of sanitary work and fittings, permanent water supply, electrical installations, fittings, lifts, telephone, air – conditioning and other ancillary works in the manner laid down in the said conditions and shall make good any damages done to walls, floors etc. after the completion of such works.

9. The Employer reserves to itself the right of altering the Drawings and nature of the work by adding to or omitting any items of work or having portions of the same carried out without prejudice to this contract.

10. Time shall be considered as the essence of this contract and the Contractor hereby agrees to commence the work from tenth day after the date of issue of formal work order as provided for in the said Conditions whichever is later and to complete the entire work within 4 months from the 10th day of issue of work order subject nevertheless to the provisions for extension of time.

11. All payments by the Employer under this Contract will be made only at Nagpur. 12. All disputes arising out of or in any way connected with this agreement shall be

deemed to have arisen at Nagpur and only Courts in Nagpur shall have jurisdiction to determine the same.

13. That the several parts of this Contract have been read by the Contractor and fully understood by the Contractor. The Contractor shall not be entitled for the payment for the quantities beyond the tendered quantities unless ordered for by specific written instructions from the Bank’s Engineer.

14. The Contractor shall not disclose directly or indirectly any information, materials and details of the Bank's infrastructure/systems/equipment’s etc., which may come to the possession or knowledge of the Contractor during the course of discharging its contractual obligations in connection with this agreement, to any third party and shall at all times hold the same in strictest confidence. The Contractor shall treat the details of the contract as private and confidential, except to the extent necessary to carry out the obligations under it or to comply

with applicable laws. The Contractor shall not publish, permit to be published, or disclose any particulars of the works in any trade or technical paper or elsewhere without the previous written consent of the Employer. The Contractor shall indemnify the Employer for any loss suffered by the Employer as a result of disclosure of any confidential information. Failure to observe the above shall be treated as breach of contract on the part of the Contractor and the Employer shall be entitled to claim damages and pursue legal remedies. The Contractor shall take all appropriate actions with respect to its employees to ensure that the obligations of non-disclosure of confidential information under this agreement are fully satisfied. The Contractor's obligations with respect to non-disclosure and confidentiality will survive the expiry or termination of this agreement for whatever reason.”

Section C

General Instructions to Contractors and Special Conditions

2.0 Tenders are invited for Intelligent Analog Addressable Fire Alarm System for Bank's Office Building at Nagpur. The work is estimated to cost Rs. 37.00 lakh and is to be completed within 16 weeks from the 10th day of issue of work order. Participation in this tender will be allowed to the firms which are eligible as per the eligibility criteria given below:

Eligibility Criteria:

Only those contractors who fulfill the following criteria will be considered eligible to participate:

(i) Valid License issued by Fire Authority of Maharashtra or Local Fire Authority as applicable for undertaking works pertaining to installation and Maintenance of Addressable Fire Alarm System. And

(ii) Minimum 5 years of experience in the field of undertaking similar works viz. SITC of Intelligent Analog Addressable Fire Alarm System for large office buildings / commercial premises / industrial houses (as on March 31,2013)

And

(iii) Have executed successfully similar works on or after March 31,2013 individually costing as under:

a) Three works each costing not less than 40 % of the estimated cost

OR b) Two works each costing not less than 50 % of the estimated cost

OR c) One work costing not less than 80 % of the estimated cost,

And

(iv) Have a minimum yearly turnover of 100 % of the estimated cost during the last 3 years

And (v) Have a service set up in Nagpur for rendering after sales service

Only Tenderers who qualify as above will be eligible to tender for the work. A Tender submitted by a firm who is found to be not satisfying any of the above criteria will be liable for rejection.

2.1 The Earnest Money Deposit as mentioned in the memorandum at section- A of this tender by NEFT or Demand Draft drawn in favour of Reserve Bank of India, Nagpur. A tender which is not accompanied by EMD will not be considered. The EMD will be returned to the tenderer without Interest if his tender is not accepted by the Bank on award of work. The EMD paid by the successful tenderer shall be held by the RBI as a part of security for execution and due fulfillment of the contract. No interest shall be paid on this deposit. EMD shall be refunded on completion of work and handed over the system to Bank.

2.1 (a) The tenderers may obtain for himself at his own responsibility and at their own expenses all the information which may be necessary for the purpose of making tender and for entering into a contract and may examine the drawings, inspect the site of the work, for reference, acquaint himself with all local conditions, means of access to the work, nature of the work and all matters pertaining thereto. The intending tenderer can obtain any clarifications regarding the tender drawings, specifications, if any, from the office of the Regional Director, Estate Department, Reserve Bank of India, Nagpur on any Bank’s working day between 11:00 AM to 4:00 PM from June 27, 2018 to June 29, 2018 by contacting Shri S.S. Phadke.

2.1.A. PART-I of the tender, as submitted shall contain the following:

(i) Unpriced tender consisting of scope of the works as specified, technical specifications, commercial terms and conditions. (ii) Earnest money in the form of DD in favour of Reserve Bank of India, Nagpur or through NEFT in favour of Reserve Bank of India, Nagpur in the A/c. No.- 8714295, IFSC Code: RBIS0NGPA01 (5th & 10th digit being zero). (iii) Power of Attorney/authorization with the seal of the company/firm in the name of the person signing the tender documents.

2.1.B. Part-II of the tender will contain prices in Indian Rupees only and shall be opened through online after due fulfilment of conditions as mentioned in part I of the tender.

(i) Rates should be written in figures and words either in Hindi or in English in the columns specified against each item of work in the document. All items of work shall be quoted. (ii) The rates quoted shall be deemed to be for the finished work and shall be firm and binding without any escalation whatsoever till the entire work is completed & handed over to the Bank.

2.1.2. Opening of Tender:

(i) Part I of the tenders will be opened as mentioned in schedule of tender. (If this day falls to be a holiday, tenders will be opened on the next working day of the Bank)

(ii) The Bank reserves the right to reject offer even after opening Part – I of the tender and his Part – II of the tender will not be considered for further processing.

(iii) Part-II of the tender will be opened on a subsequent date, which will be intimated to the tenders in advance.

2.1.3. Validity of Tender: The Tender along with the prices shall remain valid initially for a period of 3 months from the date of opening of Part-I, which period may be further extended by mutual agreement in writing by the Tenderer and the Tenderer shall not cancel or withdraw the tender during this period or change the quoted rates.

2.1.4. The Reserve Bank of India does not bind itself to accept the lowest or any tender and reserves to itself the right to accept or reject any or all the tenders either in whole or in part without assigning any reasons for doing so. The tenderer whose tender is not accepted shall not be entitled to claim any costs, charges, damages and expenses of and incidental to or incurred by him through or in connection with his submission of tenders, even though the Bank may right to modify/withdraw the tender. 2.1.5. The Contractor shall note that unless otherwise stated, the tender is strictly on item rate basis and his attention is drawn to the fact that rates for each and every item should be correct, workable and self-supporting. The quantities in the Schedule of Quantities approximately indicate the total extent of work but may vary to any extent and may even be omitted thus altering the aggregate value of the contract. No claim shall be entertained on this account.

2.2 The tenders for the above work shall be in two parts i.e. Part- I containing technical specifications of equipment, and the terms and conditions (Rates and amounts of items shall not appear anywhere in this part) and Part-II containing only rates of items stated in figures and words and amounts in figures. 2.3 Part-I of the tenders will be opened on the same day at time as specified in NIT. 2.4 The tenders shall be valid for acceptance by the Bank for four months from the

opening of tender Part-I and shall be extended by such period as may be mutually agreed to. 2.5 Pre-Bid Meeting

(a) A pre-tender briefing meeting of the eligible tenderers will be held on date and time as specified in the Notice Inviting Tender (NIT) to clarify any point / doubt raised by them in respect of the tender. No separate communication will be sent for this

meeting. The minutes of pre bid meeting will be part and parcel of tender and communicated through email and also be uploaded RBI website. (b) All communication regarding points requiring clarifications shall be communicated on email {as stated in tender inviting notice} on or before as specified in the Notice Inviting Tender. (c) It is advised to intending tenderers to attend the pre-bid meeting in order to get clarification on any issue related to the tender from the Bank. No request for change in date of pre-bid meeting will be entertained thereafter. (d) Inclusion/submission of any deviations in the tender conditions in Part-I of the tender after pre-bid meeting is liable for rejection.

Earnest Money Deposit & Bank Guarantees To be submitted by the Tenderers

2.6 Intending tenderers shall pay as interest free earnest money a sum of Rupees as stated in NIT by way of a NEFT/DD. As stated in the notice inviting tender, the earnest money will be returned without any interest to the tenderers if his tender is not accepted by the Bank. (i) Tender not accompanied by EMD, shall be treated as non-responsive, and will be summarily rejected by the RBI. (ii) The EMD of unsuccessful Bidders shall be discharged/ returned by RBI after award of work to successful bidder. (iii) The Bid Security of the Successful Bidder shall be returned upon the Bidder after completion of the work.

2.6.a. In addition to the Earnest Money Deposit and as further security for the due fulfillment of the contract by contractor under clauses of General Instructions to Tenderers, 5% of the total value of work done will be withheld from their each running A/c bill by the Bank as Retention Money (RM). The amount of retention money deducted from each bill may be released against Bank Guarantee valid till the completion of ‘Defect Liability Period’ for equivalent amount after the virtual completion of the work till the completion of defect liability period. The EMD shall be released without any interest to the contractor on completion of the work after issue of virtual completion certificate. Bank Guarantee for Security Deposit shall be released after successful completion of 12 months of Defect Liability Period from the date of completion certificate provided all the defects pointed out are rectified. B.G. for security Deposit of the successful tenderer will be invoked if he/they fails to comply with any of the conditions of contract.

All compensation or other sums of money payable by the contractor to the Bank under the terms of this Contract may be deducted from his earnest money and the security deposit if the amount so permits and Contractor shall, unless such deposit as become otherwise payable, within ten days after such deduction make good in cash the amount so deducted.

2.6.1. As a security against due fulfillment of the terms and conditions and obligation of the contract, Guarantee period and annual maintenance service contract for the entire life cycle of the equipment, the successful tenderer shall furnish

(a) A Bank Guarantee (BG) valid for 1.5 years (to cover completion period and Guarantee period of 1 years) in a form acceptable to the Bank, for a sum of five percent (5%) of the contract value. The Bank Guarantee should be obtained and submitted immediately on the award of the contract. All payments due under this contract will be made only after submission of this BG.

(b) After completion of 01 year of the Guarantee period, the tenderer shall furnish a fresh BG valid for a further period of FIVE years for a sum of five percent (5%) of the contract value for due fulfillment of the obligations towards Annual Maintenance Contract. This renewed BG should be submitted at least 30 days in advance before expiry of above referred previous BG of 5% amount. In case of failure on the part of firm to submit renewed 5% BG, initial 5%BG will be invoked without any notice to the firm.

2.6.2 The EMD shall be forfeited: (i) Made misleading or false representations in the forms, statements and attachments submitted, suppressed any material information, details of any legal proceedings pending in the court which might otherwise would have created any impact on the eligibility criteria; or (ii) Bidder left blank the column of the financial bid (iii) If a Bidder withdraws his Bid during the period of Bid Validity, or (iv) The Bidder has been blacklisted by any government agency and the blacklist is still in force. (v) In the case of the Successful Bidder, if he fails to complete the work within the prescribed time limit. It will be forfeited. 2.7 The tenderers shall furnish full details of all such similar works carried out by them during the last 5 years, as per the Proforma included in this tender. The Bank will inspect one or all the works and satisfy itself about the performance of the installed equipment including the quality and reliability of the service rendered before opening Part II of the tenders. Thereafter, the Bank at its discretion will consider or reject any or all the tenders without assigning any reason therefor. 2.8 Insurance The Contractor shall be responsible for all injury or damage to persons, animals or things and for all damage to property which may arise from any factor omission on the part of the Contractor or any Sub-Contractor or any nominated Sub-Contractor or any of their employees. The liability under this clause shall cover also, interalia any damages to structures, whether immediately adjacent to the works or otherwise; any damage to roads, streets, footpaths, bridges as well as damage caused to the buildings and other structures and works forming the subject matter of this contract. The contractor shall also be responsible for any damage caused to the building and other structures and works forming the subject, matter of this contract due to rain,

wind, frost or other inclemency of weather. The contractor shall, indemnify and keep indemnified the Employer and hold him harmless in respect of all and any loss and expenses arising from any such injury or damage to persons or property as aforesaid and also against any claim made in respect of injury or damage, whether under any statute or otherwise and also in respect of any award or compensation or damage consequent upon such claims. The Contractor shall, at his own expense, effect and maintain till issue of the virtual completion certificate under this contract, with an insurance company approved by the Employer, an All Risk Policy for Insurance for the full amount of the contract including earthquake risk in the joint names of the employer and the contractor (the name of the former being placed first in the policy) against all risk policy for contractors and deposit such policy or policies with the employer before commencing the works. The contractor shall reinstate all damage of every sort mentioned in this Clause so as to do delivery of the whole of the works complete and perfect in every respect and so as to make good or otherwise satisfy all claims for damage to property or third parties. The Contractor shall also indemnify and keep indemnified the Employer against all claims which may be made against the Employer by any person in respect of anything which any arise in respect of the works or in consequence thereof and shall at his own expense, effect and maintain until the virtual completion of the contract, with an Insurance Company approved by the employer a policy of Insurance in the joint names of the Employer and the Contractor (name of the former being placed first in the policy) against such risk and deposit such policy or policies before commencement of the works. Third party liability in “Contractors All Risk Policy” shall be minimum ₹ 2.00 lakh (Rupees Two lakh only) per person for any one accident or occurrence and ₹ 5.00 lakh (Rupees Five lakh only) in respect of damage to property for any one accident or occurrence. The contractor shall also indemnify the employer against all claim which may be made upon the Employer, whether under the Workmen’s Compensation Act or any other statute in force, during the currency of this contract or at Common Law in respect of any employee of the contractor or of Sub-Contractor and shall at his own expense effect and maintain until the virtual completion of the contract or with an Insurance Company, approved by the Employer, a policy of insurance against such risks and deposit such policy or policies with the Employer from time to time during the currency of this contract.

In default of the contractor insuring as providing above, the employer may so insure and may deduct the premiums paid from any moneys due or which may become due to the contractor. The contractor shall be responsible for any liability which may not be covered by the Insurance Policies referred to above and also for all other damages to any person, animal or defective carrying out of this contract, whatever, may be the reasons due to which the damage shall have been caused. The contractor shall also indemnify and keep Indemnified the Employer against all

and any costs, charges or expenses arising out of any claim or proceedings relating to the works and also in respect of any of damage or compensation arising there from. Without prejudice to the other rights of the employer against contractor in respect of such default, the employer shall be entitled to deduct from any sums payable to the contractor the amount of any damages, compensation costs, charges and other expenses paid by the employer and which are payable the contractor under this clause.

The Contractor shall upon settlement by the insurer pursuant to a policy taken under this clause, proceed with due diligence to rebuild or repair the works destroyed of damaged. In this event all the monies received from the Insurer in respect of such damage shall be paid to the Contractor and the contractor shall not be entitled to any further payment in respect of the expenditure incurred for rebuilding or repairing of the materials or goods destroyed or damaged. The contractor, in case of re-building or reinstatement after damage shall be entitled to such extension of time for completion as the Employer may deem fit, but shall, however, not be entitled to reimbursement by the employer of any shortfall or deficiency in the amount finally paid by the insurer in settlement of any claim arising as set out herein. Without prejudice to his liability under this clause, the contractor shall also cause all nominated sub-contractors to effect, for their respective portions of the works, similar policies of insurance in accordance with the provisions of this clause and shall produce or cause to produce to the employer such policies. The contractor shall not permit a nominated sub-contractor to commence work at the site unless the said insurance policies are submitted. In the event of failure of the sub-contractor to take out such a policy of insurance before commencing the works at the site, the contractor shall be responsible for any claim or damage attributable to the said sub-contractor.

2.9 The rates shall also be firm, shall be valid for the entire duration of the contract and / or extension thereof and shall not be subject to exchange variations, labour conditions, fluctuations in railway freights or any conditions whatsoever.

The rates quoted in the tender shall include all charges including for packing, transport, loading, unloading and for delivery at site. Tenderers must include in their rates of all prevailing taxes including Goods and Service tax, royalties and any other tax and duty or other levy levied by the Central Government or any State Government or local authority, if applicable. No claim in respect of Goods and Service Tax and any other tax, duty or levy whether existing or future shall be entertained by the Employer. No concessional form for any taxes, duties and levies will be issued by the Bank. Similarly no import license will be issued by the Bank. Equipment, if required to be imported shall be arranged to be imported against the

contractors own import license. All payments will be made at Nagpur and will be in Indian rupees only.

2.10 Each tender shall contain not only the rates but also the value of each item of work entered in a separate column and all the amounts quoted against various items shall be totaled in order to show the aggregate value of the entire tender.

2.10 (a) The Owner reserves the right to adjust arithmetical or other errors in the tender in accordance with the following general rules. In the event of discrepancy between words and figures quoted, the description in words shall prevail. Similarly in the event of an error in the amount column arising as a result of wrong product extension, the unit or item rates shall be regarded as firm and extension amended accordingly.

2.10 (b) Each of the Tender documents shall be signed by the person or persons submitting the tender in token of his/their having acquainted himself/themselves with the Instructions to tenderers, General Conditions of Contract, General Specifications, Special Conditions, etc. as laid down. Any tender with any of the documents not so signed will be rejected.

2.10 (c) The tender submitted on behalf of a firm shall be signed by all the partners of the firm or by a partner who has the necessary authority on behalf of the firm to enter into the proposed contract or by a person holding the power of attorney in the case of a company. Otherwise the tender will be rejected by the Bank.

2.10 (d) All the statutory deductions will be deducted at source but excluding GST. Tenderer should have GST registration number and must quote their rates including GST levied by the Central Government and State Government at the prevailing rate while quoting their rates for various items and no claim in this regard shall be considered by the Bank at any stage. It is mandatory for contractor to disclose the brake up of his portion of tax liability while submitting the claims (bills) for payment i.e. taxable value and applicable taxes in prescribed bill format/schedule issued by GST council for composite or supply of goods as applicable in the cases. The Bank is not responsible for payment of GST for the service rendered by the contractor. It is the responsibility of the contractor to pay GST to the tax authority.

2.11 Tenderers are advised to quote strictly as per BOQ. The schedule of quantities is based on probable quantities. The quantities for individual items may increase or decrease without any restriction depending upon the site conditions and requirements solely at the discretion of the Bank. No increase in rates will be considered. This is not a fixed lump sum contract but a contract based on item rates. Bank will not pay for any surplus/unused material. As regards make of equipment acceptable to the Bank the tenderers are advised to refer to "Section F – Approved Makes” and to the list of approved make of materials/equipment.

2.12 Evaluation of tenders: Tenders will be evaluated on the basis of capital cost of the system, rebate offered for dismantling and taking away the old FIRE ALARM SYSTEM Systems and taking into account the effect of rates quoted for comprehensive service contract for a period of 7 years after the expiry of One year of defect liability / guarantee period. Tendered offers shall be evaluated on the basis of the Net Present Value (NPV) of owning the FIRE ALARM SYSTEM having 8 years of useful service life. The said NPV shall comprise:

(a) Cost of FIRE ALARM SYSTEM Say (A)

(b) NPV of comprehensive annual maintenance Service contract charges for the period of 7 years after 1 year defect liability period shall be calculated assuming 5% increase in contract amount every year after first year of AMC, half yearly payment and with a discount rate of 8%. Thus, the Multiplying Factor (MF) for working out NPV of AMC for 7 years after (1 year guarantee period) shall be 4.89

Note:

(i) AMC amount for calculating the NPV shall be taken as quoted in the Part II of the tender (without rebate).

(ii) Life of equipment : 8 years including defect liability period of 01 year (iii) Discount factor for calculating NPV : 8% (iv) Period of AMC : 7 years (v) Annual Escalation factor :5%

(c) Buyback value of the old FIRE ALARM SYSTEM Systems with all accessories includes old cables etc.

(d) NPV of Owning the FIRE ALARM SYSTEM System for 8 years of useful service life shall be worked out as

2.13 Scope of work during Guarantee and Annual maintenance contract period:

The equipment supplied shall be guaranteed against all types of defects for the period of 01 years from the date of handing over of the Fire Alarm System to the Bank. Upon successful completion of defect liability period of 01 year the system will be put under Comprehensive Annual Maintenance Contract for 7 years.

The scope during the DLP and AMC will be as follows:

(a) Any defect(s) in the system/sub-assemblies, found within the guarantee period and the annual maintenance contract period shall be rectified / replaced by the tenderer without any additional cost including replacement of detectors, all spare parts and loop wiring and labour involved etc. the rates quoted should include all such factors.

(b) During this period, full servicing and cleaning of devices once in a half year shall

be done including attending to ANY NUMBER of breakdown calls.

The tenderers shall also quote their charges separately for Annual maintenance service contract after expiry of one year guarantee period. The payment shall be made on half yearly basis on rendering satisfactory service. The service contract rate shall also take into account all the cost, including travel cost from the nearest service station, cost of spares (except armoured cable) Critical area detectors viz. server rooms/UPS rooms etc. should be invariably included and checked during the half yearly visits. Suitable log register indicating faults, rectification done with date & time of breakdown should be maintained and got signed from the security officer of the Bank. Bank will not provide any assistance in the form of men/material during the currency of the guarantee and service contract. The tenderers will have to make their own arrangements for deputing a helper to skilled personnel including all necessary spares for rectification of the defects reported/observed. This being an emergency system, any fault in the system shall be rectified as per the rectification time given below failing which penalty shall be applied as under:

2.14 The tenderers shall indicate details such as the service centre from which the

proposed system at Nagpur will be serviced, the staff strength at that centre and the availability of spares for the system at that centre.

The tenderer should impart training to the Bank’s staff for a period not less than one week on the system before handing over of the system without any additional charge to the Bank.

2.15 a) The tender shall be accompanied by leaflets / literatures giving complete

technical & constructional details, makes of components of the equipment offered.

b) Tenderers are advised to visit the site of installations and acquaint themselves of

the site conditions before tendering. A confirmation in this respect needs to be furnished in the enclosed Annexure II along with Part I of the tender.

c) Tenderers should be specific and offer comments only if their system differs from

the Bank’s detailed specifications/ features in any manner. d) A write up of working of the system as a whole and the individual components

shall also be enclosed in Part I.

2.16 The successful tenderer, on completion of the work, shall furnish three sets of schematic and coloured laminated layout drawings in minimum A-3 size and maintenance manuals.

2.17 The following terms of payment shall be applicable to this contract subject to statutory deductions:

a. 60% of the quoted rates pro-rata against delivery of materials after checking at

site. The Minimum amount of supply of material will be considered 7.5 Lakh (for running account bill).

b. 40% of the quoted rates on completion of erection, testing, commissioning and

handing over the system along with

(i) The submission of Bank Guarantee (PBG) as stated at para 2.6.1(a) above. (ii) And submission of the necessary certificates, Form – ‘B’ from the local fire

authority regarding the satisfactory installation of the fire alarm system.

2.18 Time is the one of the important factor of the contract. The entire work shall be completed within 16 weeks from the 10th day of letter of award by the Bank failing which liquidated damages at a rate of 0.25% of contract value per week subject to maximum of 10% of the contract amount, shall be levied.

2.19 The successful tenderer shall submit an activity chart for completion of Design, Supply, Installation, Testing & commissioning of the various components & sub-assemblies. As the work is to be executed in a working building, the program for carrying out the work should be framed to cause minimal disturbance to the office functioning.

The work may also be planned on all Saturdays, Sundays and holidays including extended working hours during week days.

All debris generated during execution should be removed on the same day including taking adequate precautions to prevent dust / debris falling on computers / telephones / etc. Broken false ceiling should be repaired after completion of the work. 2.20 The successful tenderer shall execute an agreement with the Bank on stamped paper within fourteen days of receipt of letter of acceptance. However, the issue of letter of acceptance by the Bank shall be construed as a binding contract, as though such an agreement has been executed and all the terms and conditions shall apply on this contract.

2.20(a) On receipt of intimation from the Bank of the acceptance of his/their tender, the successful tenderer shall be bound to sign the formal Contract agreement within fourteen days, in accordance with the draft agreement and the Schedule of Conditions, but written acceptance by the Reserve Bank of India of a tender will constitute a binding contract between the Reserve Bank of India and the Person so tendering, whether such formal agreement is or is not subsequently executed within the stipulated period of Fourteen days. Unless the contract agreement is signed, no payment shall be entertained by the Bank. The agreement shall be executed in duplicate. One copy will remain in the custody of Employer and the second set of copy will remain in the custody of contractor. The agreement shall be made on necessary stamp paper (having worth equal to applicable stamp duty in the state of Maharashtra) and the cost of necessary stamp duty on both the document shall be borne solely by the contractor.

b. The Contractor shall not assign or not sublet any portion of the contract except with the written consent of the Employer. In case of breach of these conditions, the Employer may serve a notice in writing on the Contractor rescinding the contract whereupon the security deposit shall stand forfeited to the Employer, without prejudice to his other remedies against the Contractor.

c. The Contractor shall carry out all the work strictly in accordance with schedule of quantities drawings, details and instructions of the Bank’s Engineer. If in the opinion of the Banks Engineer changes have to be made in the design & with the prior

approval in writing from the Bank. If any changes required during the currency of the contract by deviating the tender requirements based on the opinion of the Bank’s Engineer (with the prior approval in writing from the Employer), the Contractor shall carry out the same. The Bank’s Engineer’s decision in such cases shall be final. The Banks decision in such cases shall be final & shall not be open to arbitration.

d. A schedule of probable Quantities in respect of each work and Specifications accompany the Special Conditions. The Schedule of Probable Quantities is liable to alterations by omission, deductions or additions at the discretion of the Bank. The Reserve Bank of India also reserves the right to increase or decrease the quantities and even omit any item of work after the order is placed and the Contractor shall execute the same without claiming anything extra for the same. In this context, the rates quoted for each item must be self-supporting and relevant.

A schedule of probable quantities in respect of each work and specifications accompany these special conditions. The Schedule of probable quantities is liable to alteration by omission, deductions or addition at the discretion of the Bank. Each tender should contain not only the rates but also the value of each item of work entered in a separate column and all the items should be totaled in order to show the aggregate value of the entire tender. No extra condition like discount, rebate will be considered by the Bank in Part –II of the Tender.

2.21 The tenderer shall furnish the name and address of the Bankers with whom they normally Bank.

a) They shall also furnish the name and addresses of their recent clients for whom they have carried out similar works/supplies in the recent past, along with full details like the cost and capacity of the system/machine supplied, the date of the supply etc. Refer Section III.

2.22 Settlement of dispute by Arbitration - All disputes and differences of any kind whatever arising out of or in connection with this Contract or the carrying out of the works (whether during the progress of the works or after their completion and whether before or after the determination, abandonment or breach of the contract) shall be referred to and settled by the Regional Director, Reserve Bank of India, Nagpur who shall state his decision in writing. Such decision may be in the form of a final certificate or otherwise. If either the Employer or the Contractor be dissatisfied with the decision of Regional Director on a matter, question or dispute of any kind or as to the withholding by the Bank or any Certificate to which the Contractor may claim to be entitled, then and in any such case either party (the Employer or the Contractor) may within 28 days after receiving notice of such decision give a written notice to the other party requiring that matters in dispute be arbitrated upon. Such written notice shall specify the matters which are in dispute or difference of which such written notice has been given and no other shall be and is hereby referred to the arbitration and final decision of an arbitrator to be agreed upon as appointed by both the parties or, in case of disagreement as to the appointment of a single arbitrator, to the appointment of two arbitrators, one to be appointed by each party, which arbitrators shall, before taking upon themselves the burden of reference, appoint an Umpire. The entire arbitration process will be governed by the Indian Arbitration and Conciliation Act, 1996.

All disputes and differences of any kind whatever arising out of or in connection with the contract or the carrying out of the works (whether during the progress of the works or within 12 months from the date of virtual completion of the work and whether before or within 12 months of determination abandonment or breach of contract) shall be referred to giving inter-alia full details of the matter under dispute like quantities, rates, amount claimed and reason thereto, and settled by Architect who shall state his decision in writing. The decision of Architect with respect to any of the expected matter shall be final and without appeal as stated in clause 33 hereof. But if either the Employer or the contractor be dissatisfied with the decision of the Architect on a matter, question or dispute of any kind except any of the expected matter or as to the withholding by the Architect of any certificate to which the contractor may claim to be entitled, then and in any such case either party (The Employer or the Contractor) may within 28 days after receiving notice of such decision give a written notice to the other party through the architect requiring that matter in dispute be arbitrated upon. Such written notice shall specify the matters with full details and amounts which are in dispute or difference of which such written notice shall specify the matters with full details and amounts which are in dispute or differences of which such written notice has been given and no other shall be and is hereby referred to the arbitrators and final decision of an arbitrator to be agreed upon and appointed by both the parties .The sole arbitrator shall be from the panel of arbitrators suggested by the Employer. This submission shall be deemed to be a submission to arbitration within the meaning of the Indian Arbitration and Conciliation Act, 1996 or any statutory modification thereof.

It is agreed that the contractors shall not delay the carrying out of the works by reason of any such matter, question or dispute being referred to arbitration, but shall proceed with the works with all due diligence and shall until the decision of the arbitrator or arbitrators as the case may be, is give abide by the decision of the Architect and no award of the arbitrator shall relive the contractor of his obligations to adhere strictly to the Architects instruction with regard to the actual carrying out of the works. The Employer and the contractor hereby also agree that arbitration under this clause shall be a condition precedent to any right of action under the Contract. 2.23 Right of Technical Scrutiny of Final Bill - The employer shall have a right to cause a technical examination of the works and the final bill of the Contractor including all supporting vouchers, abstracts, etc., to be made at the time of payment of the final bill. If as a result of this examination or otherwise, any sum is found to have been overpaid or over-certified, it shall be lawful for the Employer to recover the sum.

2.24 The Bank reserves the right to accept or reject any or all the tenders either in full or in part without assigning any reasons thereof.

2.25 The Bank discourages the stipulation of any additional conditions by the tenderer. However, in case the tenderer wishes to include any condition / clarifications/ covering letter while tendering for the work, he will have to submit the

same in a separate sealed cover. The tender filled in as such without any enclosure shall have to be submitted to another sealed cover clearly indicating thereon as to which cover contains the tender and which contains the forwarding letters/ clarifications/ conditions. The cover containing the forwarding letters / clarifications/ condition called Part I/Techno-Commercial Bid will be opened on the scheduled date of opening of the tenders in the presence of the tenderers or there authorised representatives who shall be in a position to clarify all the conditions stipulated by the tenderers. The clarifications/ conditions etc. if any, will be examined and after discussions with all the tenderers, the conditions that are acceptable to the Bank will be intimated to the tenderers. The tenderer shall withdraw all his conditions which are not acceptable to the Bank and can in lieu quote a percentage above or below their tendered amounts already submitted in separate sealed cover, called as Part II (Financial Bid) of the tender. The quoting of such a percentage above or below their tendered amount shall have a definite bearing on the condition/s the tenderers have to withdraw or additional benefit liable to be received as per condition accepted by the Bank. The letter containing the tenderer’s quoting percentage above or below their quoted tendered amount should be submitted in duplicate in a sealed cover on or before a fixed subsequently and advise to the tenderers. This letter together with the second sealed cover containing the tender called Part II will be opened

2.26 The Contractor / Agency shall comply with the provisions of “the Sexual Harassment of women at work place (Prevention, Prohibition and Redressal) Act, 2013”. In case of any complaint of sexual harassment against its employee within the premises of the bank, the complaint will be filed before the Internal Complaints Committee constituted by the Contractor / Agency and the Contractor/Agency shall ensure appropriate action under the said Act in respect to the complaint. The contractor shall be responsible for educating its employees about prevention of sexual Harassment at work place and related issues. Any complaint of sexual harassment from any aggrieved employee of the contractor against any employee of the Bank shall be taken cognizance of by the Regional Complaints Committee constituted by the Bank.

2.27 Tenderer is advised to ensure payment of wage to all employee including contract workers only through bank account. Being a Principle Employer the Bank shall be at liberty to call upon the tenderer to submit the evidence in respect of complying with this condition at Banks discretion. 2.28 The Bank shall not be responsible for payment of any compensation for death of or injury or accident to any of the firefighting personnel which may arise out of and in the course of their duties and employment. It is agreed and understood that the Contractor shall alone be liable to pay such damages or compensation to such firefighting personnel.

2.29 The Tenderer shall be responsible for due observation, compliance and implementation of the entire statutory conditions and requirements of labour laws as applicable to his workmen such as Industrial Disputes Act, Payment of P.F., ESI Act, Workmen’s compensations Act, etc. and all Government Liabilities. 2.30 Under the CLARA Act including those with regard to payment of wages and

providing essential amenities etc., It is necessary for the contractor in addition to the terms and conditions of the contract which also contains provisions for payment of wages and providing essential amenities as per the CLARA Act so agreed to an undertaking should be given on a Non Judicial Stamp paper of applicable value before award of work to the effect that if the particular job /work/project is awarded to him, he under takes to actually pay wages to all the labourers of all descriptions to be engage by him for completion of that particular job/work /project, at the rate which is not less than the one prescribed under the Minimum Wages Act 1948 and to ensure compliance of essential amenities as provided under the CLARA Act and also keep the principle Employer Indemnified against all the action that may be initiated against the Principle Employer by the Statutory Authorities for his failure to pay such wages and provide the essential amenities. Before release of its final payment a contractor has to submit a certificate that he has actually paid all the dues of all the labours of all descriptions engage by him for completion of the warded job/work/project at the rate which is not less than the one prescribe under the Minimum Wages Act 1948 and he has complied with the provisions of CLARA Act with regard to providing the essential amenities to the contract labour. Section (E)

Technical Specifications

Description This section of the specification includes the Design, Supply, installation, testing, commissioning and handing over of an intelligent analog addressable fire alarm system required to form a complete, operative, coordinated system for the Bank’s Office Building, Nagpur. It shall include, but not be limited to, alarm initiating devices, alarm notification appliances, control panels, auxiliary control devices, annunciators, power supplies and wiring as specified herein. The fire alarm system shall comply with requirements of NFPA Standard No. 72 for protected premises signaling systems except as modified and supplemented by this specification. The system shall be supervised either electrically or by software-directed polling of field devices. Scope of work The scope of work includes Design, Supply, installation, testing, commissioning and handing over of an intelligent analog addressable fire alarm system for the Bank’s Office Building at Nagpur. A new intelligent reporting, fire detection and alarm annunciation system shall be supplied and installed in accordance with the specifications, replacing the existing Fire Alarm Panel(s) and other devices using the existing loop cabling.

(A) Basic Performance

(i) All signals from various type of devices shall be digitally encoded onto a looped multiplex communication system of appropriate class (Digitized electronic signals shall employ check digits or multiple polling).

(ii) The devices shall be of low current, solid-state integrated circuits, and shall be powered from the central primary power and standby battery power source.

(iii) A single ground or open on any system signaling line circuit, initiating device circuit, or notification appliance circuit shall not cause system malfunction, loss of operating power or the ability to report an alarm on other circuits

(iv) Alarm signals arriving at the main FACP shall not be lost following a power failure (or outage) until the alarm signal is processed and recorded.

(B) Basic System Functional Operation

When a fire alarm/trouble condition is detected and reported by one of the system initiating devices or appliances, the following functions shall immediately occur:

(i) The System Alarm LED shall flash or the system trouble LED shall flash. (ii) A local piezo-electric signal in the control panel shall sound.

(iii) The LCD display shall indicate all information associated with the fire

alarm / trouble condition, including the type of alarm point and its location within the protected premises.

(iv) Printing and history storage equipment shall log the information

associated with the fire alarm control panel condition, along with the time and date of occurrence.

(v) All system output programs including sounding of hooters assigned via control-by-event equations to be activated by the particular point in alarm/trouble condition shall be executed, and the associated system outputs (alarm notification appliances and/or relays) shall be activated.

(C) FIRE DETECTION & ALARM PANEL General

1. The Panel shall be UL864/EN 54, listed and shall comply with latest standards of NFPA 72.

2. The panel shall be a Microprocessor based, Analogue addressable networkable and Intelligent.

3. The Panel shall have all necessary provisions for interfacing with

smoke evacuation system, Air handling units, firefighting equipment, elevators, access control system, and other third party systems as required.

4. The Fire Alarm Control Panel / system shall be supplied with all required Hardware, Software, Technical support, Software Development Key (SDK), Application Program Interface (API) to integrate the Fire Alarm System to the proposed Command and Control Centre through open communication protocol such as BACNET / Modbus / OPC etc.

5. In the event of CPU failure, all signaling loop circuit (SLC), modules

shall fall back to degrade mode. Such degrade mode shall treat the corresponding SLC Loop Control Module and associated detection devices as conventional two wire operation. Any activation of a

detector in this mode shall automatically activate associated notification appliance circuits.

6. The system shall support a detector response time to meet world

annunciation requirements of less than 3 seconds.

7. The system shall be designed so that spare capacity of at least 20% in each loop is available for future expansion.

Main Fire Alarm Control Panel (MFACP)

The control panel shall be microprocessor based networkable system designed specifically for fire detection and alarm applications. The control panel shall include all required hardware, software and site specific system programming to provide a complete and operational system. The control panel shall be designed such that interactions between any applications can be configured, and modified. The control panel operational priority shall assure that life safety takes precedence among the activities coordinated by the control panel. The Panel should be controlled by a Central Processing Unit (CPU). The CPU shall interface with all the loop cards which shall have its individual microprocessors for executing the functions of the fire alrm system. In case of failure of the CPU, a standy CPU should take over the functions of the main CPU without affecting requirements of the system. Alternatively, in case the system design does not provide for on line standby CPU, a Preloaded and Pre programmed ready for use standby CPU should be provided to ensure normal and satisfactory operation of the system. The Loop shall contain its own microprocessor and shall be capable of operating in a degraded mode (any addressable device input shall be capable of activating any or all addressable device outputs) in the unlikely event of a failure of the main CPU/standby CPU. In such eventuality, the hooter/alert device present in the Main FACP should always be activated. Fire Alarm panel shall be a multi-loop (exact number of loops as per schedule of quantity) panel and all the loop card should be of same size with a minimum capacity of 250 detectors/devices. It shall have a backlit minimum 640-character liquid crystal/LED display or touch screen, individual, color coded system status LEDs, and alphanumeric keypad and control of the fire alarm system, and the provision of internal / external printer. The panel shall maintain a history file of the last 2500 events, each with a time and date stamp. History events shall include all alarms, troubles, operator actions, and programming entries. The control panels shall also maintain a 1000 event Alarm History buffer, which consists of the 1000 most recent alarm events from the 2500 event history file.

The loop interface board shall be able to drive an NFPA Style 6 twisted

shielded circuit up to 5280 feet in length. The loop Interface shall also be capable of driving an NFPA Style 6, no twist, no shield circuit up to 5280 feet in length. In addition, loop wiring shall meet the listing requirements for it to exit the building or structure. "T"-tapping shall be allowed in either case.

The FAS shall have pre-signal and Positive Alarm Sequence that is the

system shall provide means to cause alarm signals to only sound in specific areas with a delay of the alarm from 60 to up to 180 seconds after start of alarm processing. The system shall support a detector response time to meet world annunciation requirements of less than 3 seconds.

To obtain early warning of incipient or potential fire conditions, the

system shall support a programmable option to determine system response to real-time detector sensing values above the programmed setting. Two levels of Pre-alarm indication shall be available at the control panel: alert and action.

The system shall provide means to allow panel programming either

through an off-line software utility program away from the panel or while connected and on-line. The system shall also support upload and download of programmed database and panel executive system program to a Personal Computer/laptop.

The system shall support two password levels, master and user. Up to

9 user passwords shall be available, each of which may be assigned access to the programming change menus, the alter status menus, or both. Only the master password shall allow access to password change screens.

The system shall provide means to obtain a variety of reports listing all

event, alarm, trouble, supervisory, or security history. The system shall provide means to link one detector to up to two

detectors at other addresses on the same loop in cooperative multi-detector sensing. There shall be no requirement for sequential addresses on the detectors and the alarm event shall be a result or product of all cooperating detectors chamber readings.

The Addressable Main Power Supply shall operate on 120/240 VAC,

50/60 Hz, and shall provide all necessary power for the FACP. The FAS shall be networkable in a peer to peer style and shall be able

to communicate with other network nodes at a minimum speed of

3Mbps on copper. It shall be able to build a network on copper or fiber optics.

FIRE ALARM SYSTEM DEVICES

General

1. Each device shall be UL 864/ EN 54 Listed. 2. Addressable devices shall use simple to install and maintain decade,

decimal address switches. Devices shall be capable of being set to an address in a range of 001 to 150. Devices shall receive power and communication from the same pair of conductors of the SLC.

3. The contractors shall not install the detectors until after the construction cleanup of all trades is complete and final.

4. Initiating devices shall be installed in all areas, compartments, or locations where required by other NFPA codes and standards or as required by the authority having jurisdiction.

5. In the event of duplicate addressing of a device, the fire panel shall indicate this as a fault condition. However, the SLC should continue to function normally with the trouble condition display at the Fire panel.

6. Each addressable detector & device shall respond to Fire Alarm Panel scan for information with an analog representation of measured fire related phenomena (smoke density, particles of combustion, temperature).

7. The standard base of the Detector shall be interchangeable with other Smoke/Heat/ Multicriteria Detectors.

8. Using software in the FACP, detectors shall automatically compensate for dust accumulation and other slow environmental changes that may affect their performance. The detectors shall be listed by UL 864 / EN54as meeting the calibrated sensitivity test requirements of NFPA Standard 72.

9. Addressable devices shall use simple to install and maintain type address switches.

INITIATION DEVICES Intelligent Multi Criteria Detector with floating sensitivity

The intelligent multi criteria detector shall be an addressable device that

is designed to monitor a minimum of photoelectric and thermal technologies in a single sensing device. The design shall include the ability to adapt to its environment by utilizing a built-in microprocessor to determine its environment and choose the appropriate sensing settings automatically i.e. have floating sensitivity. The detector design shall allow a wide sensitivity window as per UL 864/EN 54 standards. This detector shall utilize advanced electronics that react to slow smoldering fires and thermal properties all within a single sensing device. It shall be capable

of operation in heat-only alarm mode, enabled by a special command from the panel.

The microprocessor design shall be capable of selecting the appropriate

sensitivity levels based on the environment type it is in (office, manufacturing, kitchen etc.) and then have the ability to automatically change the setting as the environment changes (as walls are moved or as the occupancy changes).

The intelligent multi criteria detection device shall include the ability to

combine the signal of the thermal sensor with the signal of the photoelectric signal in an effort to react hastily in the event of a fire situation. It shall also include the inherent ability to distinguish between a fire condition and a false alarm condition by examining the characteristics of the thermal and smoke sensing chambers and comparing them to a database of actual fire and deceptive phenomena.

Analog Addressable Photo Electric Smoke Detector

It shall have an optical sensing chamber that operates on the light scattering principle. When smoke enters the sensing chamber it scatters light which is received by a photo cell. The signal is amplified and digitized for reception by the panel. Detector shall be completely solid state with LED indication at the detector. The minimum coverage per Photoelectric Smoke Detector shall be 50 M. Sq. This coverage area will reduce depending upon structural configurations or partitions etc. as per NFPA 72, Chapter 5. It shall be possible to connect Smoke Detector with Heat Detector or Manual Push Buttons in the same SLC. The sensitivity of Detector shall be adjusted and set by the contractor to suit the site requirement. The location of smoke detectors shall be based on an evaluation of potential ambient sources of smoke, moisture, dust, or fumes, and electrical or mechanical influences to minimize nuisance alarms. The selection and placement of smoke detectors shall take into account both the performance characteristics of the detector and the areas into which the detectors are to be installed to prevent nuisance alarms or improper operation after installation. As per NFPA 72, Chapter 5, smoke detectors shall not be installed if the ambient conditions are any of the four - Temperature below 0°C (32°F), Temperature above 38°C (100°F), Relative humidity above 93 percent, Air velocity greater than 1.5 m/sec (300 ft/min). Photoelectric smoke sensor shall have a nominal sensitivity as per UL 864/EN 54 Standards.

Addressable Heat Detectors

The Heat Detector shall be a Addressable Detector with its own manually set digital code and shall be able to give a single digitized output to the Fire Alarm Panel regarding its condition. Heat detectors shall be rated at 135 degrees Fahrenheit and have a rate-of-rise element rated at 15 degrees F per minute. It shall connect via two wires to the fire alarm control panel signaling line circuit. It shall be able to withstand temperature variations from 0 to 38 deg C. Further, relative Humidity (non Condensing type) upto 93% shall not hamper its performance. The Voltage rating shall be from 15-33V DC, though the voltage may be changed depending upon the working voltages of a proprietary Fire Alarm Panel. The Detector shall meet the requirements of NFPA 72 and shall be listed with UL 864 /EN 54. The approved coverage per Detector for unhampered areas shall not be less than 30 sq. M. The detector shall be capable of being reset automatically after any alarm condition.

Remote monitoring: The system should be provided with a remote monitoring/repeater panel with all necessary cabling and connectivity. The panel shall preferably mimic all the functions provided in the local onsite control panel including providing audible and visual annunciations. Integration with fire fighting systems: The system should be provided with necessary controls & wiring to activate third party fire fighting systems like suppression systems/automatic fire extinguishers etc in the event of confirmed detection of fire/smoke inside the controlled area/room. Addressable Flammable LPG Detector The LPG gas detector shall be designed to sense the leak of LPG flammable gas. It shall be connected to the fire alarm panel by use monitor modules and shall be UL/EN Listed. The scale, range, calibration, relay operation and alarm set points of the detector shall all be adjusted via the transmitters’ backlit LCD/LED. The detector shall be mountable on a wall or round support pole using universal brackets.

Addressable Manual Call Point

Manual Call Point shall be of the dual action design. Addressable manual fire alarm boxes shall, on command from the control panel, send data to the panel representing the state of the manual switch and the addressable communication module status. They shall use a key operated test-reset

lock, and shall be designed so that after actual emergency operation, they cannot be restored to normal use except by the use of a key.

All operated stations shall have a positive, visual indication of operation and utilize a key type reset. Manual fire alarm boxes shall be constructed of Lexan with clearly visible operating instructions provided on the cover. The word FIRE shall appear on the front of the stations in raised letters.

NOTIFICATION DEVICES

Strobe cum Alarm Hooters

Strobe cum Alarm hooters shall be suitable for indoor applications. All

hooters shall be 24 V DC operated. The minimum sound level shall be 80 db at 10 feet. Listed to UL 1971 and UL 864/EN 54. Strobe cum Alarm hooters shall be wired as a primary signaling notification appliance.

The strobe shall flash at 1 Hz over the strobe’s entire operating voltage

range. The strobe light shall consist of a xenon flash tube and associated lens/reflector system. The hooter shall have two tone options, two audibility options (at 24 volts) and the option to switch between a temporal 3 pattern and a non-temporal continuous pattern. Strobes shall be powered independently of the sounder. The horn on horn/strobe shall operate on a non-coded power supply.

The strobe cum alarm hooter shall be loop powered or else shall draw independent power from the FACP or any centralized reliable source of power supply. Making arrangement for the power cable and power supply units for this purpose shall within the scope of SITC of strobe cum alarm hooters and shall not be paid separately. In case of separately powered Hooters the status of the power supply at each strobe cum hooter level should be monitored continuously and in case of any power interruption it should initiate alarm / alert at FACP and repeater panels.

MODULES

Monitor Module (for input to fire alarm panel)

The monitor module shall be used to monitor the health status of systems such as wet riser system, sprinkle system etc. The monitor module should be addressable and shall be able to communicate any abnormal status of the supervised system to the FACP. The module shall contain an LED which blinks upon being scanned by the Fire Alarm panel.

Control Module (for output from fire alarm panel)

The addressable control module shall be provided to control the operations of the systems like AHUs, staircase pressurization system, firefighting system etc. The control module shall receive necessary communication from FACP and shall initiate required trigger to control the operation of the controlled system such as shut down of AHU(s) in the event of any fire sensed by FACP. The Control module should be capable of being configured for the above operations for designated AHUs, firefighting equipments etc. Upon transmission of the required signal to the designated equipment, a suitable indication should be provided in the FACP to indicate that the desired functions viz shutdown of the designated AHU and/or starting of the staircase pressurization system etc have been completed/initiated. In order to perform the above, the control module be equipped with required relays, circuitry, hardware potential free NO/NC contacts etc. The device module shall also contain an LED which blinks upon being scanned by the Fire Alarm panel to indicate its health or fault conditions.

Fault Isolator Device

A wire-to-wire short circuit fault on any circuit or device, before or after the circuit or device has been activated, shall initiate a trouble signal and shall isolate that circuit or device from the rest of the system. The Fault Isolator Device shall detect and isolate a short-circuited segment or device of a fault-tolerant loop. The fault isolator device shall automatically determine a return to normal condition of the loop and restore the isolated segment. The Fault isolators shall be provided in the loop as per manufacturer’s /UL/EN standard requirement for each detector/device or after a set of not more than ten detectors/devices.

Repeater Panel

The Repeater Panel shall be with minimum suitable display or touch-screen to indicate the status of system and location of incident which shall mimic the main fire alarm panel. It shall be supervised, remotely located and shall have a back-lit LCD display. It shall have an on-board input, output, and status indicators to support diagnostics. It shall display all alarm and trouble conditions in the system. The Repeater panel shall be UL/EN 54 Listed. The Repeater Panel shall be capable of a wiring distance of up to 3300feet from the main control panel using recommended cables. It shall have functional keys like Acknowledge, Signal Silence, System Reset, Lamp Test etc.

Networked Graphic Control Station (NCS)

The NCS shall utilize a Microsoft TM operating system. Each Network Control Station shall be capable of graphically annunciating and controlling all network activity. Network display devices that are only capable of displaying a subset of network points shall not be suitable substitutes.

The NCS shall be a Desktop computer with latest processor but not earlier

than Intel core i-7 processor, 4GB RAM, 1TB SATA hard disk, DVD-ROM/CDRW, sound card, mouse, speakers, keyboard, Ethernet card, PCI slot, RS-232 serial COM port, Windows OS, Colour Deskjet printer and 21” Flat Screen LED monitor.

The NCS workstation shall be capable of storing over 65000 network

events in a history file. Events shall be stored on hard disk and shall be capable of back-up storage to a tape drive. The history buffer shall allow the operator to view events in a chronological order. A filter shall be available for displaying chronological events by operator, date, time, fire alarms, troubles (including security, supervisory and system/device), disabled points/zones, system programming, operator response and operator log in/log out. The ability to print NCS history files shall also be available.

The NCS software shall be a high-performance color graphic system

capable of displaying all network events and points. The workstation shall use Microsoft® Windows®, providing an easy-to-use graphical user interface. The operator shall be presented with a consistent look and operation for all monitored equipment. The NCS software shall have the ability to monitor up to four Fire Alarm Control Panels.

It shall have but not be limited to the following features:

- All off-normal events displayed simultaneously with text and Corresponding graphic screens.

- Automatic screen navigation (selectable for each device) that locates and zooms to the device related to an alarm or event, based on the priority of the event.

- Dynamically generated floor plan overview. - Floor plans can be zoomed in and out and devices can be placed at

Batteries

Battery (i) Battery (SMF) shall have sufficient capacity to power the fire alarm

system for not less than 30 Minutes in alarm condition and at least 24 hours in normal condition.

(ii) The batteries are to be completely maintenance free. Approvals

(i) All the equipment shall have proper listing and/or approvals and shall comply to the requirements of the following recognized agencies.

Cables/conduits

All cables/conduits to be laid on wall, ceiling and on the hangers wherever necessary and as directed by Bank’s engineer with required hardware. The cables shall be FRLS, armored PVC twisted 1.5 sq. mm multistranded insulated, copper conductor cables, conforming to IS:1554 and shall be of specified make. All the cables shall be properly terminated and labeled.

Section (IV) Execution Installation

(i) As the work is to be carried out in existing occupied building, the actual functioning of the existing fire alarm system cannot be put under shut down. Therefore, the execution of this work has to be meticulously planned and executed in consultation with site engineer and Fire officer in such a manner that fire safety of the building is not hampered.

(ii) The work shall be taken for execution only after the entire material has been supplied at site.

(iii) Before commencement of execution of work, the tenderer shall design the system and prepare the drawings for the proposed new Fire alarm system and get the same approved from Bank.

(iv) Installation shall be in accordance with the NEC, NFPA 72, local and state codes, as shown on the drawings, and as recommended by the major equipment manufacturer.

(v) All conduit, junction boxes, conduit supports and hangers shall be concealed in finished areas and may be exposed in unfinished areas as per Bank’s direction.

(vi) Removing and re-fixing of the light fixtures / false ceiling tiles in order to access the area above the false ceiling for laying of cable and fixing of detectors etc., will be in the scope of this contract. No additional payment shall be made on this account. Any damage to the Bank’s property shall be made good without any additional claim.

(vii) Smoke detectors shall not be installed prior to the system programming and test period. If construction is ongoing during this period, measures shall be taken to protect smoke detectors from contamination and physical damage.

(viii) All fire detection and alarm system devices, control panels and remote annunciators shall be flush mounted when located in finished areas and may be surface mounted when located in unfinished areas.

(ix) Addressable intelligent break-glass units (Manual Stations) shall be suitable for surface mounting or semi-flush mounting as existing, and shall be installed not less than 42 inches, nor more than 48 inches above the finished floor.

Testing of the System The contractor shall arrange and provide at no extra cost, the service of a competent, factory-trained engineer or technician authorized by the manufacturer of the fire alarm equipment to technically supervise and participate during all of the adjustments and tests for the system.

(i) Before energizing the cables and wires, check for correct connections and test for short circuits, ground faults, continuity, and insulation.

(ii) Open initiating device circuits and verify that the trouble signal actuates. (iii) Open signaling line circuits and verify that the trouble signal actuates. (iv) Open and short notification appliance circuits and verify that trouble signal

actuates. (v) Ground initiating device circuits and verify response of trouble signals. (vi) Ground signaling line circuits and verify response of trouble signals. (vii) Ground notification appliance circuits and verify response of trouble

signals. (viii) Check alert tone and prerecorded voice message if any to all alarm

notification devices. (ix) Check installation, supervision, and operation of all intelligent smoke

detectors using walk test. (x) Each of the alarm conditions that the system is required to detect should

be introduced on the system. Verify the proper receipt and the proper

processing of the signal at the FACP and the correct activation of the control points.

(xi) When the system is equipped with optional features, the manufacturer's manual should be consulted to determine the proper testing procedures. This is intended to address such items as verifying controls performed by individually addressed or grouped devices, sensitivity monitoring, verification functionality and similar.

Final Inspection

At the final inspection a factory trained representative of the manufacturer of the major equipment shall demonstrate that the systems function properly in every respect.

Instruction

(i) Provide instruction as required for operating the system. "Hands-on" demonstrations of the operation of all system components and the entire system including program changes and functions shall be provided.

(ii) The contractor and/or the systems manufacturer's representatives shall provide a typewritten "Sequence of Operation."

Documentation

(i) Sufficient information, clearly presented, shall be included to determine compliance with drawings and specifications.

(ii) It should include manufacturer’s name(s), model numbers, ratings, power requirements, equipment layout, device arrangement, complete point to point wiring diagrams, annunciator layouts and main control layout, configurations and terminations

(iii) Complete operating and maintenance manuals including technical data sheets

(iv) Provide a clear and concise description of operation which gives, in detail, the information required to properly operate the equipment and system

(v) Four copies of the above documents in book form well bound should be submitted

Draft Articles of Agreement

ARTICLES OF AGREEMENT made the ______________ day of ________________ between the Reserve Bank of India, having its Central Office at Mumbai 400001 (hereinafter called “the Employer”) of the one part and __________________________________________________ (hereinafter called “the Contractor”) of the other part. WHEREAS the Employer is desirous of Design, Supply, Installation, Testing and Commissioning of Intelligent Analog Addressable Fire Alarm System for the Bank's Main Office Building at Nagpur and has caused drawings and specifications describing the works to be done to be prepared by or under the direction of Bank’s Engineer. AND WHEREAS the said Drawings numbered ________________ to _________________ inclusive, the Specifications and the Schedule of Quantities have been signed by or on behalf of the parties hereto. AND WHEREAS the Contractor has agreed to execute upon and subject to the Conditions set forth herein, and to the General Instructions, General Terms and Conditions, Special Conditions of Contract, Appendixes, Specifications, Workmanship, Mode of Measurement, Schedule of Quantities set forth in the tender document, (all of which are collectively hereinafter referred to as “the said Conditions”) the works shown upon the said Drawings and/or described in the said Specification and included in the Schedule of Quantities at the respective rate therein set forth amounting to the sum as therein arrived at or such other sum as shall become payable there under (hereinafter referred to as “the said Contract Amount”). NOW IT IS HEREBY AGREED AS FOLLOWS 1. In considerations of the said Contract Amount to be paid at the times and in the

manner set forth in the said Conditions, the Contractors shall upon and subject to the said Conditions execute and complete the work shown upon the said Drawings and described in the said Specifications and the Schedule of Quantities.

2. The Employer shall pay the Contractor the said Contract Amount or such other sum as shall become payable, at the times and in the manner specified in the said Conditions.

3. The term “Bank’s Engineer/Engineer/Engineer-in-Charge” in the said Conditions shall mean the technical officer or any other successor of the Bank nominated by the Employer for that purpose will function as “Bank’s Engineer/Engineer/Engineer-in-Charge”.

4. The Reserve Bank of India will administer and arrange for supervision of works through the Bank’s Engineer including certification of bills, making payments and implementation of various terms, conditions and stipulations of the contract, execution of the work, quality of construction, quality of materials, progress and completion of the project.

5. The said conditions and Appendix thereto shall be read and construed as forming part of this agreement, and the parties hereto shall respectively abide by, submit themselves to the said Conditions and perform the agreements on their part respectively in the said Conditions contained.

6. The plans, agreement and documents mentioned herein shall form the basis of this Contract.

7. This Contract is neither a fixed Lump Sum Contract nor a piece work contract but is a contract to carry out the work in respect of execution of ‘Design, Supply, Installation, Testing and Commissioning of Intelligent Analog Addressable Fire Alarm System for the Bank's Main Office Building at Nagpur as per the specifications as specified in the schedule and as per the drawing enclosed. It is an item rate contract as per schedule details to be paid for according to actual measured quantities at the rate contained in the Schedule of rates and Probable Quantities or as provided in the said Conditions.

8. The Contractor shall afford every reasonable facility for carrying out of all works relating to civil works, installation of sanitary work and fittings, permanent water supply, electrical installations, fittings, lifts, telephone, air – conditioning and other ancillary works in the manner laid down in the said conditions and shall make good any damages done to walls, floors etc. after the completion of such works.

9. The Employer reserves to itself the right of altering the Drawings and nature of the work by adding to or omitting any items of work or having portions of the same carried out without prejudice to this contract.

10. Time shall be considered as the essence of this contract and the Contractor hereby agrees to commence the work from tenth day after the date of issue of formal work order as provided for in the said Conditions whichever is later and to complete the entire work within 4 months from the 10th day of issue of work order subject nevertheless to the provisions for extension of time.

11. All payments by the Employer under this Contract will be made only at Nagpur. 12. All disputes arising out of or in any way connected with this agreement shall be

deemed to have arisen at Nagpur and only Courts in Nagpur shall have jurisdiction to determine the same.

13. That the several parts of this Contract have been read by the Contractor and

fully understood by the Contractor. The Contractor shall not be entitled for the payment for the quantities beyond the tendered quantities unless ordered for by specific written instructions from the Bank’s Engineer.

The Contractor shall not disclose directly or indirectly any information, materials and details of the Bank's infrastructure/systems/equipment’s etc., which may come to the possession or knowledge of the Contractor during the course of discharging its contractual obligations in connection with this agreement, to any third party and shall at all times hold the same in strictest confidence. The Contractor shall treat the details of the contract as private and confidential, except to the extent necessary to carry out the obligations under it or to comply with applicable laws. The Contractor shall not publish, permit to be published, or disclose any particulars of the works in any trade or technical paper or elsewhere without the previous written consent of the Employer. The Contractor shall indemnify the Employer for any loss suffered by the Employer as a result of disclosure of any confidential information. Failure to observe the above shall be treated as breach of contract on the part of the Contractor and the Employer shall be entitled to claim damages and pursue legal remedies. The Contractor shall take all appropriate actions with respect to its employees to ensure that the obligations of non-disclosure of confidential information under this agreement are fully satisfied. The Contractor's obligations with respect to non-disclosure and confidentiality will survive the expiry or termination of this agreement for whatever reason.”

Subject to the maximum limit of our liability as aforesaid, this guarantee will cover all your claim or claims against the contractor from time to time arising out of or in relation to the said contract and in respect of which your claim in writing is lodged on us before expiry of six months from the date of expiry of this guarantee.

9. Any notice by way of demand or otherwise hereunder may be sent by special courier, telex, fax or registered post to our local address as aforesaid and if sent by post, it shall be deemed to have been given when the same has been posted.

10. This guarantee and the powers and provisions herein contained are in addition to and not by way of limitation of or substitution for any other guarantee or guarantees heretofore given to you by us (whether jointly with others or alone) and now existing

Any forbearance, act or omission on the part of the Bank in enforcing any of the conditions of the said tender or showing of any indulgence by the Bank to the Tenderer shall not discharge the Surety in any way and the obligations of the Surety under this guarantee shall be discharged only on the intimation thereof being given to the Surety by the Bank.

13. This guarantee is irrevocable during the period of its currency and shall not be revoked without your previous consent in writing.

14. We further agree and undertake to pay you without demur the amount demanded by you in writing notwithstanding any difference or dispute or controversy that may exist or arise between you and contractor or any other person.

15. Notwithstanding anything contained herein above our liability under this guarantee is restricted to INR _____ (INR _______only).
