1.3 Qualification Submissions or Proposals (collectively referred to as "Responses") will not beaccepted after the deadlines set for receipt thereof. No submittals received after this deadline will beconsidered. If USPS P.O. Box is used respondent is cautioned to allow sufficient time. City of Ennis is notresponsible for lateness of mail, carrier, or any method of delivery. Delivery by FAX or Email is NOTacceptable. The time/date stamped by the Public Works Secretary shall be the official time of receipt.

1.4 Responses must address each applicable requirement set out in this RFQ/RFP. Only Respondentswho can provide, either directly or as part of a team under its control, both design and constructionservices should tender their Qualifications Submission or Proposal.

1.5 Unless expressly allowed by a written authorization from the City, no Qualification Submissionsor Proposals may be changed, amended, or modified in any manner after it is delivered to City;however, a Qualification Submission or Proposal may be withdrawn and resubmitted any time prior tothe deadline set for receipt thereof.

1.6 Interested persons, entities or teams, submitting Qualification Submissions or Proposals, mustsubmit one unbound original (suitable for photocopying) and four (4) bound copies of their QualificationSubmission or Proposal. Two of the bound copies must be executed originals bearing the signature ofan authorized representative of the Respondent or Team.

1.7 Responses must be typed on standard (8 1/2" by 11") paper, with each page numberedsequentially. Responses must contain a table of contents with page numbers and be arranged tocorrespond the terms/requirements of this RFQ/RFP in the order that those terms/requirements appearin this RFQ/RFP.

1.8 Qualification Submissions will be opened by Public Works Staff at 2:00 p.m. local time onDecember 21, 2021, in the Public Works Conference Room, 500 Lake Bardwell Drive, Ennis, Texas 75119.

1.9 Persons, entities or teams delivering qualifying Qualification Submissions will be notified byclose of business, December 30, 2021, as to whether they have been selected as a Finalist to submit asealed Proposal for the Project ("Finalist").

1.10 Proposals from Finalists selected to submit a sealed Proposal will be opened at 2:00 p.m. localtime on January 19, 2022, in the Public Works Conference Room, 500 Lake Bardwell Drive, Ennis, Texas75119.

2.0 SELECTION

Qualification Submission (STEP I)

2.1 Prior to any receipt of, request for, or consideration of, any Proposal, City requests, and willconsider, the relative qualifications of any person, entity or Team ("Respondent") seeking to provide allthe goods and services necessary for design and construction of the City Hall alteration to create aninterim Public Library Facility at 115 W. Brown Street, Ennis, Texas 75119. After such consideration, Citymay choose to interview any Respondent, or request additional information.

2.2 Each Respondent must submit a Qualifications Submission containing a full and completeresponse to each of the Questions and Requests set forth below, and fully complying with the GeneralRequirements set out in Section 1 above, and all other applicable requirements of this RFQ/RFP. No priceor cost information is to be included with a Qualifications Submission. The inclusion of pricing or costinformation in a Qualifications submission may be an automatic disqualification of the Respondent, at thesole discretion of the City.

GENERAL PROJECT DESCRIPTION

Provide design and construction services for alteration of the (old) City of Ennis City Hall building at 115W. Brown Street, Ennis, Texas to create an interim Public Library Facility. Demolish walls, ceiling andrestrooms and construct and install HVAC, lighting, ceiling, ADA compliant restrooms and other buildingalterations as described and referenced in the Design Criteria Package.

QUESTIONS and REQUESTS for Qualification Submission

In preparing your Qualifications Submission, answer each of the following questions and requeststhoroughly. The completeness of your answers to these questions and requests will be considered inevaluating your response.

a. Describe the experience of your firm, and of any team members, in designing libraries or similarfacilities.

b. Describe the experience of your firm, and of any team members, in constructing libraries or similarfacilities.

c. For each Project identified in answer to the questions above, provide a contact name at thatfacility or governmental agency, and the name of the chief executive officer of the entity for whichthe work was done if different than the contact provided. For each person identified provide acurrent address and telephone number at which they can be reached.

d. Describe the experience of your firm, and of your team members, with building renovationprojects.

e. Identify all lawsuits filed, legal claims, or demands against the Respondent (or any of Respondent'sTeam members) and/or any of their respective principals/officers received within the last 5 years.

f. Identify the design professionals (architects and engineers) who will be working on the Project,their qualifications, and provide a copy of their license to practice in the State of Texas.

g. Certify that each design professional you intend to use for this Project was selected based ondemonstrated competence and qualifications in the manner provided by Section 2254.004, TexasGovernment Code

h. Identify any special certifications, degrees, or professional designations held by each designprofessional you propose to use for the Project.

i. Provide a full resume (educational, professional, work related history) of:i. Respondent's key team members;

ii. Proposed Project Manageriii. Proposed Project Superintendent

j. Provide a summary that you believe is relevant to the consideration that you (and your teammember's) have the capability to perform this project.

k. Provide a summary of any similar projects that your team has completed and any projectscompleted in the City of Ennis.

l. Are you able and willing to provide all of the services requested in this RFQ/RFP, including design,construction and compliance with all applicable laws, rules, regulations and court orders?

2.3 The Selection Criteria to be applied to Qualifications Submissions (Step I) are as follows:

Step IEvaluation Factors and Weighting of those Factors

For Evaluation of Qualification Submissions.

The Qualification Submissions received from the Respondents, will be reviewed, evaluated and ranked bythe City, and/or its designees, based upon the application of the following evaluation criteria andweighting factors. If a Respondent is unable to provide qualifications responsive to each of the criterialisted below, it is disqualified. No other criteria or factors will be considered in Step I (Evaluation andRanking of Qualification Submissions).

[Only the information included in the Responses to the Request for Qualifications will be used to rank andselect the Finalists who will be offered the opportunity to submit a Proposal for the Project.]

2.4 City will select no more than five qualified Respondents to submit Proposals in Step II (the"Finalists").

Request for Proposals (STEP II)

2.5 After Finalists selected by the City are notified that they have been selected to submit a Proposalfor the Project, the Finalists (not to exceed five in number) may submit a Proposal for the Project that willbe reviewed and evaluated by the City and/or it designees (Step II). The City may, at its option, request aninterview with Finalists. A Proposal submitted by any person, entity, or team, other than a Finalist selectedby the. City, will be deemed to be void, ineffective, and disqualified from further consideration.

2.6 The Proposals received from the Finalists, will be reviewed, evaluated and ranked by the Cityand/or its designees, based upon the application of the following evaluation criteria and weighting factors.

Group B —The following factors will be given a total weight of 35%4. Respondent's (and team's) capability to perform5. Ability of respondent to meet schedules and estimated time for completion6. The extent to which the respondent's Proposal complies with the requirements

of this RFQ/RFP.

Group C — The following factors will be given a total weight of 35%7. The degree to which Respondents Guaranteed Maximum Price is less than the

Amount of the Project Budget.8. The price/cost for the goods and services requested under the Request for

Proposals

2.7 City reserves the right to reject any or all Proposals, and reserves the right to waive any irregularityin the Proposals received.

2.8 Each Proposal submitted by a Finalist selected by the City, must fully and thoroughly respond to,and comply with, each of the applicable criteria, requests and requirements of this RFQ/RFP, including butnot limited to the following:

1. Proposals for the Project will not be accepted from any entity other than the Finalistsselected by the City as a result of the evaluation of Qualifications Submissions (Step l).

2. City will evaluate the Proposals that are submitted by the Finalists, based on the selectioncriteria and weighting set forth in the Request for Proposals stated herein.

3. Respondents must not include detailed engineering or architectural designs as part of theproposal. Respondents are encouraged to include conceptual drawings and illustrations in theirproposals, to assist the City, and its designees, in evaluating the Proposal.

4. Proposals must comply with the applicable deadlines and all other applicablerequirements described in Section 1 —General Requirements set out above.

5. Proposals must comply with all of the applicable requests and requirements of Section IllDesign and Construction, Section IV Additional Requirements, and Section V Miscellaneous of thisRFQ/RFP set out below.

6. Proposals must comply with the criteria, requirements and elements of the DesignCriteria Package.

7. Proposals must be signed by a person authorized to bind the person or entity making theProposal, and proof of this authority must be included in the Proposal. Proposals must contain aletter or other clear evidence of such authority, and all other information requested or requiredby this RFQ/RFP, or as determined by the City. All Proposals must be delivered in sealedwrappings.

8. The thoroughness by which the Proposal responds to each of the requirements of thisSection 2.8 and this RFQ/RFP is one of the criteria upon which each Proposal will be evaluated.

2.9 The City shall select the Finalist Design/Build Team, based upon the determination of the Proposaloffering the best value for the City on the basis of the evaluation criteria and weighting factors and setout in this RFQ/RFP.

2.10 The City shall first attempt to negotiate a contract with the selected Finalist Design/Build Team. Ifthe City is unable to negotiate a satisfactory, contract with the selected Finalist Design/Build Team, theCity shall, formally and in writing, end negotiations with that selected Finalist Design/Build Team, andproceed to negotiate with the next Finalist Design/Build Team in the order of the evaluation ranking, untila contract is reached or negotiations with all ranked Finalist Design/Build Team end.

2.11 Following selection of Finalist Design/Build Team, and agreement upon an acceptable contract,engineers or architects associated with that Finalist Design/Build Team shall complete the design of theProject, submitting all design elements to City or the City's designee, before or concurrently withconstruction. The design elements so submitted shall be reviewed to determine their compliance with theDesign Criteria Package, this RFQ/RFP, the Proposal submitted by the Finalist Design/Build team and theterms of Design/Build contract agreed upon by the City.

2.12 The Finalist Design/Build Team shall supply a set of "as built" construction documents for theProject to the City at the conclusion of construction of the Project.

2.13. Proposals are deemed to include the previously submitted Qualifications Submission of eachFinalist. The Qualifications Submission of each Finalist will be included in the review, evaluation andranking of the Proposals submitted.

3.0 DESIGN AND CONSTRUCTION

3.1 Only respondents who propose to provide either directly or through a team under its control allgoods and services requested in the Request for Proposals should respond. This includes design andconstruction. The maximum construction period of two (2) calendar months is desired, not to exceedthree (3) calendar months.

3.2 An in-house engineer, employed by City shall act as City's independent representative forpurposes of independent, professional assistance and evaluation of technical and qualitative issues forthe duration of the design/build work.

3.3 Following selection, the successful respondent's design team shall complete the design submittingall design elements for review and approval by City and its in-house Engineer.

3.4 Each Proposal submitted in this Step II must contain the Guaranteed Maximum Price for whichthe Proposer (or Design/Build Team) will agree to design and build the Project in full compliance with therequirements of Step II of this RFQ/RFP, in full compliance with all applicable laws, rules, regulations andcourt orders, and in full compliance with all the offers, proposals, terms and conditions set forth in theirProposal. Failure to include a Guaranteed Maximum Price in the Proposal submitted in Step II will begrounds for immediate rejection of the Proposal at the discretion of the City.

3.5 Payment and performance bonds as required by Texas law will be required from the successfulrespondent in the amount of the Guaranteed Maximum Price, less the portion of the GuaranteedMaximum Price attributable to design services only. A Bid Bond in the amount of at least 10% of theGuaranteed Maximum Price must be delivered to City at the time that the Design/Build contract isawarded to the successful respondent. The successful respondent must deliver the performance andpayment bonds to City not later than the 10th day after the contract is signed.

3.6 Design professionals on the Project must be covered by professional liability insurance in acoverage amount of not less than $1,000,000.00 per occurrence and $2,000,000.00 aggregate. Designprofessionals on the Project must be licensed/registered to practice their profession in the State of Texas.

3.7 Contractors Insurance: Without limiting any of the other obligations or liabilities of theContractor, during the term of the contract, the Contractor and each subcontractor, at their own expense,shall purchase and maintain the herein stipulated minimum insurance with companies duly approved todo business in the State of Texas and satisfactory to the Owner. Certificates of each policy shall bedelivered to the Owner before any work is started, along with a written statement from the issuingcompany stating that said policy shall not be canceled, non-renewed or materially changed without 30days advance written notice being given to the Owner, except when the policy is being canceled fornonpayment of premium, in which case 10 days advance written notice is required. Prior to the effective

date of cancellation, Contractor must deliver to the Owner a replacement certificate of insurance or proofof reinstatement. Coverage shall be of the following types and not less than the specified amounts:

a) Workers' compensation in at least the minimum statutory amounts on all employees as requiredby Texas law, with the policy endorsed to provide a waiver of subrogation as to the Owner.

b) Commercial general liability insurance, including independent contractor's liability, completedoperations and contractual liability covering, but not limited to, the liability assumed under theindemnification provisions of this contract, fully insuring Contractor's (or subcontractor's) liabilityfor injury to or death of Owner's employees and third parties, extended to include personal injuryliability coverage with damage to property of third parties, with minimum limits of $1,000,000.00as the combined single limit for each occurrence of bodily injury, personal injury and propertydamage.

i. The policy shall include coverage extended to apply to completed operations, asbestoshazards (if this project involves work with asbestos) and XCU (explosion, collapse andunderground) hazards. The completed operations coverage must be maintained for aminimum of one year after final completion and acceptance of the work, with evidenceof same filed with Owner.

c) Comprehensive automobile liability insurance, covering owned, hired and non-owned vehicles,with a combined bodily injury and property damage minimum limit of $1,000,000.00 peroccurrence for bodily injury and for property damage. Such insurance shall include coverage forloading and unloading hazards.

d) The successful respondent must provide builder's risk/property insurance for the Project in theamount of the full contract sum.

e) City of Ennis must be named as an additional loss payee on the insurance.

3.8 Respondent shall be solely responsible for any cost, loss, injury, harm, expense, fee, charge orother expenditure or damage of any nature, whether now, known or unknown, arising directly orindirectly, from:

a) Safety and security of the site during construction;b) Any regulatory permitting required for the Project;c) Certification of the Project as complying with the applicable standards of the ADA; andd) Any natural disasters or other force majeure events.

3.9 Construction shall be carried out in accordance with the contract documents (including theapproved drawings, plans, and specifications), and in accordance with the all applicable federal, state andlocal rules, laws, regulations, court orders and standards. Construction draws and retainage shall be inaccordance with the negotiated contract.

3.10 As part of its proposal, the Respondent should include the basic terms and general conditions itproposes for the design/build of the Facility. The agreement to be negotiated will not become effectiveuntil City and its counsel have approved the agreement, and it has been approved, and its executionauthorized by the City Commissioner.

4.0 DESIGN CRITERIA

In order to assist Respondents in formulating their Responses, and if selected, their Proposals; additionaldesign criteria are provided in the Design Criteria Package. Each Proposal must comply with each of therequests, requirements and elements set forth in the following Design Criteria Package.

a) Demolish the portions of the existing ceiling, walls, wall wainscoting, doors, floor, restrooms andplumbing, commission chamber platform, reception counters, break kitchen, drive-thru window,HVAC Duct, LED lighting, electrical, Wi-Fi antennas, exterior building sign and other appurtenantelements as necessary to complete the building alteration.

b) Install plumbing to proposed restroom location and repair floor.c) Construct a wall over existing doorway to old Police/Fire Station on the west side of facility and

over the opening exposed by removal of the existing payment kiosk (removed by others). Furnishand install drywall and texture walls where wanes coating was removed, and repair locationsexposed by demolition operations. Paint all walls in a color approved by the Owner.

d) Install book-drop at previous drive-thru window location.e) Construct ADA / TAS compliant restrooms and with the requisite number of fixtures in accordance

with the adopted building code. Furnish or relocate water heater (removed with Break Kitchen).f) Provide and install acceptable drop ceiling.g) Provide and install acceptable LED lighting.h) Provide and install acceptable HVAC ducting and registers and furnish or relocate existing

thermostat(s).i) Reinstall Wi-Fi antennasj) Provide and install commercial grade flooring.k) Provide or relocate the kitchen style sink and other accommodations for a new break room.l) Provide or relocate the janitor style sink and accommodations for a new janitor closet.m) Provide and install ADA compliant new primary entrance at the existing back door location.n) Provide and install Emergency Exit Only at the existing front door location.o) Furnish and install new exterior signage on the front of building, (existing) back of building

identifying new entrance, and exterior directional signage as approved by the owner.p) Project Budget is $200,000.00 and the Timeline goal is 2-months.q) The Project must be designed and built in compliance with all applicable laws, rules, and

regulations and all applicable Federal, State, and City Codes and Standards.r) Refer to RFP Appendix A – Existing Layout, Demolition, and Conceptual Layout Drawingss) Refer to RFP Appendix B - Asbestos Survey and mitigation

5.0 STATEMENT OF QUALIFICATIONS AND PROPOSALS

5.1 City does not assume, and hereby specifically disclaims, any responsibility or obligation of anynature, to any of the persons or entities responding to this RFQ/RFP (or to any other entity) and will makeno payment or reimbursement of any cost, fee or other expenditure whatsoever associated with thepreparation or submission of a Qualification Submission or Proposal.

5.2 The contract(s) awarded will be governed by the laws of the State of Texas, and is (are) deemedpayable and performable in Ennis, Texas. The venue for all disputes thereunder shall lie in Ellis County,Texas.

5.3 As required by Section 2267 of the Texas Government Code, City has established a budget for thisProject of Two Hundred Thousand Dollars and Zero Cents $200,000 ("Project Budget"). If the GuaranteedMaximum Price contained in a Proposal received during Step 2 of this RFQ/RFP exceeds the ProjectBudget, the City may, in its sole discretion, reject such Proposal. The City expects the proposed.Guaranteed Maximum Price to be less than the Project Budget.

5.4 In addition to all rights provided by law, City:

a) Reserves the right to reject any or all Proposals;b) May, at its sole discretion, waive technical mistakes, informalities or irregularities in any Proposal

received;c) Reserves the right to select the Proposal or negotiated Proposal which in its discretion is

determined to provide the best value to City and which it believes to serve its best interests andin accordance with all applicable laws, including but not limited to Texas Government CodeSection 2267.

5.5 Neither this document, nor the advertisement of the Notice of the RFQ/RFP is an offer. TheExhibits attached hereto are incorporated herein for all purposes.

5.6 Respondents shall, as a part of their Proposal, address and identify how they intend to complywith all existing laws or rules related to the use of women, minority, small or disadvantaged businesses.Respondents shall, as a part of their Proposal, address and identify how they intend to comply with allexisting laws related to historically underutilized businesses.

5.7 It is the express intent of the City, that each Proposal as submitted be: comprehensive, preparedin good faith, present a reasonable likelihood to be developed, built and become fully operational in areasonable length of time, and its design and construction to be in full compliance with all applicable laws,rules, regulations, court orders, standards and ordinances. Acceptance of any Proposal is expresslyconditioned upon approval of all documents by counsel for City and formal approval of a resolution bythe City Commission. Acceptance of any Proposal is not acquiescence or agreement with any term orcondition set forth in the Proposal or any proposed documents included in, or referenced by, the Proposal.

It is the intent and desire of the City of Ennis to identify, through this RFQ process, the most qualified teamfor this project. The teams submitting sealed RFQs responses will be evaluated based on the criteria andpoint scale enumerated above. Using the scores derived from these criteria, the teams will be ranked.

If so desired or deemed necessary by the committee, the top ranked teams may be asked to come in foran interview. Once the top ranked team is identified, the City will move forward with the terms of theagreement. If negotiations should stall, then negotiations shall begin with the second highest team andso on until an agreement can be made.

Once terms are agreed upon with a team, it shall be presented to the City Manager, followed by the CityCommission for approval.

The most qualified teams will be selected to further engage the City regarding the project.

5.8 Respondents who provide false or misleading information, whether intentional or not, in anydocuments presented to the City for consideration in the selection process shall be excluded.

5.9 All responses shall be held confidential from other parties by the City to the extent allowable bylaw until after the selection process is completed. Respondents should be aware that at the completionof the selection process, the contents of their proposals are subject to the provisions of the Texas PublicInformation Act and may be made public. Confidential and/or Sensitive information should not beincluded in the proposal.

5.10 The City of Ennis reserves the right to award in the best interest of the City. The City reserves theright to accept or reject any and all submittals, without prejudice or any items or part thereof, or to waiveany informality in submittals.

There is not expressed or implied obligation for the City to reimburse responding team for any expenseincurred in preparing submittals in response to this request. Statements of qualifications submitted tothe City shall become property of the City and will not be returned to respondent.

5.11 Refer to and complete the Conflict of Interest Questionnaire forms attached as RFP Appendix Cregarding disclosure and reporting obligations on vendors and potential vendors to local governmententities.

The attached report summarizes these services in accordance with ESEI Proposal No. P03426 and Professional Services Agreement dated November 3, 2021. Regulated amounts of asbestos were detected in the sheetrock ceiling and furdown texture, floor tile mastic, wallboard wall systems (joint compound and texture), and cove base mastic. The sample results summary is attached in Appendix A of this report. ESEI licenses are attached in Appendix B of this report. General information about suspect ACM

Asbestos has historically been a component of a wide variety of building materials. These types of building materials, which may potentially contain asbestos, are termed "suspect asbestos-containing materials” (or suspect ACM). Suspect ACM may or may not contain asbestos. The actual asbestos content of a suspect material can be determined only through proper sampling and analysis performed by a qualified building inspector and laboratory.

Pursuant to the National Emission Standards for Hazardous Air Pollutants (NESHAP) asbestos regulation (40 CFR §61.141, et seq.) ACM can be classified into two categories: friable ACM which can be reduced to powder or crumbled under light hand pressure (e.g., ceiling textures and thermal system insulation) and nonfriable ACM, which are materials that cannot be easily crumbled (e.g., floor tile and floor tile mastic).

Regulated asbestos containing materials (RACM) which are those materials containing over 1% asbestos as defined under asbestos NESHAP.

2.0 STANDARD OF CARE AND LIMITATIONS:

This report was prepared for the exclusive use of the Client named herein to aid in the identification and management of ACM and RACM in the renovation/demolition Target Areas identified by the Client. ESEI performed its services in a manner consistent with the level of care and expertise exercised by asbestos professionals performing the same or similar services at the same time and in the same geographic area.

Samples for this asbestos survey were collected from discrete sample locations within the rooms and areas specifically identified herein (i.e., Target Areas). While attempts were made to obtain representative samples most likely to contain asbestos, findings and conclusions herein are necessarily limited by the number of samples taken and access provided for sampling activities. The results herein cannot guarantee that no asbestos is present in any area not sampled. This asbestos survey was not intended to be a comprehensive asbestos inspection of the site, nor was it intended to be used for evaluation of worker health and safety conditions. To determine whether regulated ACM is present at other locations not sampled herein, a comprehensive asbestos inspection of the site would be necessary.

Conclusions and recommendations herein represent the professional opinions of the ESEI personnel involved with the project. The results of this report should not be considered as legal interpretation of existing federal, state or local environmental, health and safety laws or regulations. ESEI assumes no responsibility or liability for errors in information or data provided by third party sources.

3.0 REPORT USE AND RELIANCE:

This report represents ESEI’s services as of the sampling date. As our final document, it may not be altered after final issuance. This study and report were prepared on behalf of and for the exclusive use of the Client solely for its use and reliance in determining the presence of RACM in identified Target Areas of the site. The Client was the only party to which ESEI explained the risks and was solely involved in shaping the scope of services. Accordingly, reliance on this report by any other party may involve assumptions leading to an unintended interpretation of findings and opinions. With the consent of ESEI and the Client, ESEI may offer reliance to third parties or contract with other parties to develop findings and opinions related to such party’s unique risk management concerns. Notwithstanding the foregoing, any and all third party reliance upon this Report shall be limited to the fair market value of the services undertaken to perform this Report as of the report date.

4.0 METHODOLOGIES:

4.1 Sampling

This limited inspection was guided by the Texas Asbestos Health Protection Rules (TAHPR) (see 25 TAC §295.58) and generally in accord with AHERA (the Asbestos Hazard Emergency Response Act of 1986, Public Law 99-519) sampling protocols (see 40 CFR §§ 763.86 and 763.88). The AHERA sampling protocols are statistically-based and were originally developed to implement AHERA which amends the Federal Toxic Substances Control Act (see 15 USC, §2641, et seq.). These rules are often followed by the OSHA, and the Department of State Health Services (DSHS). ESEI generally followed these sampling protocols to in an effort to collect representative samples of the various suspect building materials in the Target Areas.

Suspect ACM samples were collected by physically removing a small portion (approximately one square inch) of the suspect material using a sharp instrument. All layers of the material samples were penetrated and registered as separate samples. Disturbance of adjacent material was minimized during the sampling activities. Each sample was placed into a separate labeled container and then sealed. Each sample was labeled with the sample number and collection location, and a chain-of-custody form was completed. The sampling instrument was cleaned between each sample collected to mitigate potential cross-contamination between samples collected.

4.2 Analytical Procedures

If the results of the bulk laboratory analysis reveal asbestos, the percentage of asbestos contained within the sample is compared with criteria outlined in the EPA definition of asbestos-containing material (and which value is also followed by OSHA and DSHS). If a concentration of greater than one percent (1%) asbestos is reported, it is defined by the Asbestos NESHAP as a positive identification and the material could be considered RACM depending upon the nature of the ACM and its coverage.

The Asbestos NESHAP states that RACM (as defined in 40 CFR §61.141) containing less than 10% asbestos should be verified by point counting. If bulk sampling analysis determines that asbestos content of a friable asbestos sample is less than 10%, the building owner may: (i) elect to assume the asbestos content to be greater than 1% and treat the material as RACM, or (ii) require verification of asbestos content by point counting. If a result obtained by point counting is different from a result obtained by visual estimation, the point count result is used.

5.0 RECOMMENDATIONS:

Based upon the foregoing results, if applicable, ESEI offers the recommendations presented below. Such recommendations should be implemented prior to the commencement of any renovation or demolition activities or other activities that would potentially disturb the identified ACM or RACM at the site.

⦁ Identified ACM, including nonfriable ACM, that will be disturbed by renovation or demolition activitiesshould be removed as soon as feasibly possible by appropriately licensed personnel and in accordance with applicable laws and regulations.

⦁ Identified ACM which will not be disturbed by renovation or demolition activities but which is damaged, should be repaired or encapsulated (by appropriately licensed personnel and in accordance with applicable laws and regulations) to prevent future damage.

⦁ ACM to remain in place should be enclosed in airtight impermeable barrier or encapsulated to prevent damage.

⦁ An Asbestos Operation and Maintenance Program should be implemented to manage existing ACM in place.

In the event renovation or demolition activities are slated for portions of the site outside of the Target Areas, an asbestos survey should be performed for those portions of the site—prior to the initiation of renovation or demolition activities.

BACKGROUND:

EcoSystems Environmental, Inc. (ESEI) is accredited by the National Voluntary Laboratory Accreditation Program, NVLAP Lab Code 101162-0 through the National Institute of Standards and Technology (NIST). ESEI is also licensed and authorized to perform as an asbestos laboratory by the Texas Department of State Health Services (License No. 30-0117). This report may not be used to claim product certification approval or endorsement by NVLAP, NIST, or any agency of the federal government. Results apply only to samples as received.

METHOD & LAYERING:

Bulk Samples are prepared and analyzed in accordance with the polarized light microscopy procedures outlined in the EPA – 40 CFR Appendix E to Subpart E of Part 763, Interim Method of the Determination of Asbestos in Bulk Insulation Samples. And the alternate EPA 600/R-93/116: Method for the Determination of Asbestos in Bulk Building Materials. The test reports can not be reproduced except in full and with ESEI’s permission.

When a sample consist of two or more distinct layers or materials, each layer is analyzed and reported separately. Any layer containing more than 1% asbestos is declared by the National Emissions Standards for Hazardous Air Pollutants (NESHAP) as an asbestos-containing material (ACM).

PERCENTAGES & POINT COUNTING

Reported percentages of asbestos are visual estimates by volume; quantitation is achieved by utilizing a stereobinocular microscope. The Asbestos NESHAP Revision Final Rule states that regulated asbestos-containing materials (as defined in 40 CFR Section 61.141) containing less than 10% asbestos (including the samples that contain a trace or less than 1% asbestos which are considered by the EPA as asbestos-containing materials if analyzed by Polarized Light Microscopy (PLM) may be verified by point counting. If the lab detects the asbestos content of a sample to be <10%, the client may: 1) elect to assume the amount to be greater than 1% and treat the material as asbestos containing or 2) require the verification of the amount by point counting. If a result obtained by point counting is different from a result obtained by visual estimation, the point count result will be used. Samples for which no asbestos is detected by the PLM do not need to be point counted.

TYPES OF ASBESTOS:

Asbestos is a general term to one of several naturally occurring fibrous minerals. These are divided into two categories: serpentine and amphiboles. Chrysotile, a serpentine, is the most commonly found form of asbestos. The five other types are all amphiboles. These include Amosite, (fibrous grunerite), Crocidolite (fibrous riebeckite), fibrous Anthophyllite, fibrous Tremolite and fibrous Actinolite.

BACKGROUND MATERIALS:

Materials which do not contain Asbestos are reported for each sample. These background materials are divided into Fibrous and non-fibrous types. Common Fibrous materials include glass, mineral wool, cellulose, paper, and synthetics (nylon, rayon, Dacron). Common non-fibrous materials include binder (glues), mica, quartz, vermiculite, clays, lizardite and talc.

SAMPLE STORAGE:

Bulk samples are double bagged and stored for 90 days unless otherwise arranged with the client. Samples can be returned within 90 day period upon receipt of written authorization and payment of a return fee.
