1.4. Conditions

By participating in this RfP, Proposers accept to be bound by the conditions set out in this RfP. In particular,

Proposers acknowledge that:

it is unacceptable to give or offer any gift or consideration to an employee of IUCN as a reward or

inducement in relation to the awarding of a contract and that such action will give IUCN the right to

exclude a Proposer from the procurement process; and

any price fixing or collusion with other legal entities in relation to this RfP shall give IUCN the right to

exclude the Proposer(s) from the procurement process and may constitute an offence.

By issuing this RfP, IUCN is not bound in any way to enter into any contractual or other arrangement with any

Proposer. IUCN reserves the right to terminate the procurement process at any time prior to contract award.

IUCN is under no obligation to accept the lowest priced Proposal or any Proposal and reserves the right to

reject any Proposal which is incomplete, conditional or not complying with the RfP documents.

It is the Proposer’s responsibility to ensure that any consortium member, sub-contractor and adviser also

abides by these conditions.

1.5. Queries and questions during the RfP period

Proposers are to direct any queries and questions regarding the RfP content or process to the IUCN Contact.

No other IUCN personnel are to be contacted in relation to this RfP unless directed to do so by the IUCN

Contact. IUCN reserves the right to disqualify and reject Proposals from Proposers that do not comply with this

requirement. All questions should be submitted in writing to the nominated email address.

Proposers may submit their queries relating to this RfP no later than 01.04.2016. Any queries should clearly

reference any appropriate paragraph in the RfP and, to the extent possible, should be aggregated rather than

sent individually. As far as is reasonably possible, IUCN will respond to all questions submitted before the

deadline.

IUCN reserves the right to issue the responses to any questions to all Proposers unless the Proposer asking

the question expressly requests, at the time the question is posed, for it to be kept confidential. If IUCN

considers the contents of the question and/or the answer not to be confidential, it will inform the Proposer, who

will then have the opportunity to withdraw the question.

Any attempt by a Proposer or their appointed advisers inappropriately to influence the contract award process

in any way will result in the Proposal being disqualified. Any direct or indirect canvassing by a Proposer or

their appointed advisers in relation to this procurement or any attempt to obtain information from any of the

employees or agents of IUCN concerning another Proposer may result in disqualification at the discretion of

IUCN.

1.6. Amendments to RfP documents

IUCN may amend the RfP documents by issuing notices to that effect to all Proposers and may extend the

RfP closing date and time if deemed appropriate.

1.7. Proposers’ due diligence

IUCN has taken all reasonable care to ensure that this RfP is accurate; however IUCN gives no representation

or warranty as to the accuracy or sufficiency of the contained information. Proposers are required to inform

themselves fully of all conditions, risks and other circumstances relating to the proposed Contract prior to

submitting a Proposal. Proposed prices shall be deemed to cover the cost of complying with all the conditions

of the RfP and of all things necessary for the due and proper performance and completion of the proposed

Contract.

1.8. Costs of preparing Proposals

All costs relating to the preparation and submission of a Proposal are the sole responsibility of the Proposer.

IUCN shall not pay any Proposer, wholly or in part, for their Proposal.

1.9. Confidentiality

Except as required for the preparation of a Proposal, Proposers must not, without IUCN’s prior written

consent, disclose to any third party any of the contents of the RfP documents. Proposers must ensure that

their employees, consultants and agents also are bound and comply with this condition of confidentiality.

1.10. Proposal lodgement methods and requirements

Proposers must submit their Proposal to IUCN ECARO no later than 17h CET on 08.04.2016 by email to

[email protected]. The subject heading of the email shall be [RfP – National Nature Conservation

Expert - [Proposer Name]].

Proposals must be prepared in English and include the information requested in Part 4 of this RfP. The

maximum size of the attachment(s) to the email shall not exceed 10 MB.

1.11. Late Proposals

Proposers are responsible for submitting their Proposals prior to the RfP closing date and time in accordance

with the acceptable lodgement requirements described in Clause 1.10. There will be no allowance made by

IUCN for any delays in transmission of the Proposal from Proposer to IUCN. Any Proposal received by IUCN

later than the stipulated RfP closing date and time will not be considered.

1.12. Incomplete Proposals

IUCN shall have the right to disqualify any Proposal that is incomplete. IUCN shall also have the right to

disqualify Proposals at any stage in the process if it becomes aware of any omission or misrepresentation in

response to any question.

1.13. Withdrawals and Changes to the Proposal

Proposals may be withdrawn or changed at any time prior to the RfP closing date and time by written notice to

IUCN. No changes or withdrawals will be accepted after the RfP closing date and time.

1.14. Partial and Alternative Proposals

Proposals must be for the entire Requirement; partial Proposals will not be accepted.

Proposers must submit one Proposal that complies with the Requirement. Alternative proposals will not be

accepted. IUCN reserves the right to accept or reject any proposed alternative either wholly or in part.

1.15. Validity of Proposals

Proposals submitted in response to this RfP are to remain valid for a period of 90 calendar days from the RfP

closing date.

1.16. Evaluation of Proposals

The evaluation of proposals shall be carried out exclusively with regards to the evaluation criteria and their

relative weights specified in part 3 of this RfP.

1.17. Acceptance of Proposals

A Proposal will not be considered accepted by IUCN unless and until IUCN has signed a Contract or sent a

'Notice of Award' or Purchase Order in writing to the successful Proposer.

PART 2 – THE REQUIREMENT

IUCN Regional Office for Eastern Europe and Central Asia (ECARO) is a partner in the implementation of the project “Towards strengthened governance of the shared transboundary natural and cultural heritage of the Lake Ohrid Region”. The project is managed by UNESCO World Heritage Centre in cooperation with UNESCO Venice Office/Antenna Office in Sarajevo, and financed by the European Union under its assistance to pre-accession countries in the field of Environment and Climate Change.

IUCN ECARO wishes to award a consultancy contract to a nature conservation expert to provide technical assistance to Albanian authorities in the elaboration of a management plan or other documented management system, and also in the elaboration of the nomination file for the extension of the existing World Heritage property “Natural and Cultural Heritage of the Ohrid Region” in the former Yugoslav Republic of Macedonia. The consultant will be required to work according to the detailed Terms of Reference contained in the following sections.

BACKGROUND

Lake Ohrid has long been recognized as a superlative natural phenomenon. With a geological and biological history of over one million years, Lake Ohrid stands out as one of the oldest lakes in Europe and a remarkable biodiversity hotspot of global importance. It has been estimated that it is the lake with the highest biodiversity in the world, taking into account the number of endemic species per surface area. The catchment area also supports equally rich and important biodiversity with exceptionally high number of endemic species. These natural phenomena are matched by significant cultural heritage in the form of some of Europe’s earliest human settlements and heritage routes bordering the lake. Two-thirds of Lake Ohrid, and a significant part of its watershed located in the former Yugoslav Republic of Macedonia have been inscribed on the World Heritage List as the property “Natural and Cultural Heritage of the Ohrid Region”.

The Upstream pilot project “Towards strengthened governance of the shared transboundary natural and cultural heritage of the Lake Ohrid Region” is designed to address the main threats affecting the natural and cultural heritage of the Lake Ohrid Region shared between Albania and the former Yugoslav Republic of Macedonia. It aims to strengthen transboundary cooperation over the region’s cultural and natural heritage, help recognize and profile the transboundary area by assessing its values and sustainable development opportunities, and improve capacities for the effective management of natural and cultural heritage. The project will also support integrated management planning based on active cross-sectorial cooperation and public participation and the preparation of an extension file for the World Heritage property to cover the Albanian part of the Lake Ohrid Region.

SCOPE OF WORK

The preparation of the extension file for the transboundary World Heritage property “Natural and Cultural Heritage of the Ohrid Region'” includes work on elaboration of a management plan or other documented management system, with the view of integrating it with other national sectoral and development plans and/or operational instruments and in the view of strengthening transboundary management. The document needs to be in line with the Operational Guidelines for the Implementation of the World Heritage Convention. Following the Operational Guidelines for the implementation of the World Heritage Convention, “each nominated property should have an appropriate management plan or other documented management system which must specify how the Outstanding Universal Value of a property should be preserved, preferably through participatory means (Paragraph 108). Paragraph 109 of the Guidelines states that “the purpose of a management system is to ensure the effective protection of the nominated property for present and future generations.” Furthermore, the Guidelines note that “an effective management system depends on the type, characteristics and needs of the nominated property and its cultural and natural context” (Paragraph 110).

IUCN has contracted an expert (lead expert) to assist the Albanian authorities in the elaboration of a management plan or other documented management system which must specify how the Outstanding Universal Value of a property should be preserved based on active cross-sectoral cooperation and participation of key stakeholders (hereinafter: “the management system”). At the outset of the work the consultant will provide advice to the Albanian authorities on options for an appropriate management system to be established for the nominated extension as well as in determining the borders of the potential extension of the existing World Heritage property in Albania. The management system should also address, among other, issues of monitoring, climate change adaptation, visitor management, business planning, and disaster risk

reduction management of both natural and cultural heritage (tangible and intangible). Furthermore, the management system should specifically address gender related issues, such as the involvement of women in the management of the property, and also take into account the needs of other vulnerable groups, such as the disabled and youth. A GIS expert will be involved in the preparation of appropriate maps in support to the management system.

IUCN is also to contract an expert (lead expert) to assist Albanian authorities in the preparation of the extension dossier for the World Heritage. The purpose of the dossier is to set out as clearly as possible what the property consists of and how it is documented; why it has potential Outstanding Universal Value; the state of conservation and the factors affecting the property; and how the property is to be protected, conserved, managed, presented and monitored in relation to its potential Outstanding Universal Value.

In the frame of the project ICOMOS and IUCN, with the participation of key stakeholders and local experts, have conducted baseline assessments and mapping of natural and cultural heritage and their vulnerabilities, of socio-economic current situation and trends and identification of arising development opportunities of the entire Lake Ohrid area. The reports on the baseline assessment and the strategy document identifying sustainable development opportunities will serve as an important source of information in the preparation of the document on the management system and the nomination dossier.

Working under supervision and guidance from the lead experts on the management system and the nomination dossier and in close cooperation with IUCN and ICOMOS, the national nature conservation expert shall assist the Albanian authorities in the preparation of the two documents focusing specifically on all aspects related to nature conservation. A national cultural heritage expert will also be part of the team working on the documents.

SPECIFIC TASKS

The national nature conservation expert will be required to conduct the following specific tasks:

• Contribute to the work of eight (8) meetings with the members of the Core Management Planning Team and other stakeholders to be consulted on relevant issues in the development of the management system, including the determination of the borders of the potential extension of the existing World Heritage property “Natural and Cultural Heritage of the Ohrid Region” to Albania;

• Contribute to the development of the draft document on the management system, in particular in the sections related to natural values;

• Contribute to the work of four (4) meetings with the Albanian authorities during the preparation of the nomination dossier for the extension of the existing World Heritage property “Natural and Cultural Heritage of the Ohrid Region” in the former Yugoslav Republic of Macedonia;

• Contribute to the development of the nomination dossier for the extension of the existing World Heritage property “Natural and Cultural Heritage of the Ohrid Region” in the former Yugoslav Republic of Macedonia, in particular in the sections related to cultural values.

EXPECTED DELIVERABLES

The consultant will be required to deliver the following results and products under the supervision and guidance from the lead experts on the management system and the nomination dossier:

• Contribute to the work of eight (8) meetings with the members of the Core Management Planning Team during the development of the management system (April – September 2016);

• Contribute to the work of four (4) meetings with the Albanian authorities during the preparation of the nomination dossier for the extension of the existing World Heritage property “Natural and Cultural Heritage of the Ohrid Region” in the former Yugoslav Republic of Macedonia (July – November 2016);

• Under the guidance of the lead expert on the management system, and in collaboration with the national expert on cultural heritage, and the relevant experts of the Albanian authorities, gather and collate information on natural heritage required for the preparation of the document on the management system (April – September 2016);

• Prepare initial drafts of relevant sections related to natural heritage of the document on the management system, following the guidance to be provided by the lead expert on the management system in consultation with the relevant experts of the Albanian authorities and with ICOMOS and ICCROM where needed within the Upstream Process framework (May – July 2016);

• Revised drafts of relevant sections related to natural heritage of the document on the management system, following the comments from the Albanian authorities, IUCN, ICOMOS and ICCROM within the Upstream process framework and under the supervision of the lead expert on the management system (July – August 2016);

• Initial drafts of relevant sections related to natural heritage of the nomination dossier, following the guidance to be provided by the lead expert on the nomination dossier and in consultation with the relevant experts of the Albanian authorities and with the IUCN and ICOMOS where needed within the Upstream process framework (September – November 2016);

• Revised drafts of relevant sections related to natural heritage of the nomination dossier, following the guidance to be provided by the lead expert on the nomination dossier and in consultation with the relevant experts of the Albanian authorities and with the IUCN and ICOMOS where needed within the Upstream process framework (November 2016).

DURATION OF THE ASSIGNMENT AND AVAILABLE BUDGET

The duration of the assignment is estimated at 40 working days, over the period from April to November 2016, including time equivalent to 6 working days for participating in 12 meetings with the Albanian authorities and stakeholders. The maximum available budget for this assignment is estimated at US$ 5,400.00, excluding duty-related travel costs, accommodation and subsistence costs.

TRAVEL TO TIRANA AND THE LAKE OHRID REGION

All related travel and subsistence costs to Tirana and the Lake Ohrid Region will be covered by the project.

LANGUAGE

Applicants should be fluent in Albanian (written and spoken) and should have a good command of written and spoken English.

Applicants may be required to provide some ad hoc informal translation and interpretation between Albanian and English.

All outputs shall be produced in English. The project will be responsible for translating them into Albanian.

PART 3 – THE EVALUATION MODEL

The evaluation of proposals shall be carried out exclusively with regards to the evaluation criteria and their relative weights specified in the table below:

A Price Score (PS) is assigned to all Proposals applying the following formula:

PS = 10 x LP/PP

where:

PS is the Price Score of the offer under evaluation;

10 is the maximum score in points obtainable in the Price evaluation;

LP is the value of the lowest Expert Input Cost offered by all Proposals in the Price evaluation;

PP is the value of the Expert Input Cost offered through the Proposal under evaluation.

The contract will be awarded to the Proposal which has obtained the highest total score.

PART 4 – INFORMATION TO BE PROVIDED BY PROPOSERS

By participating in this RfP, Proposers are indicating their acceptance to be bound by the conditions set out in

this RfP.

This Part details all the information Proposers are required to provide to IUCN. Submitted information will be

used in the evaluation of Proposals. Proposers are discouraged from sending additional information, such as

sales brochures, that are not specifically requested.

4.1. Technical information/Service Proposal

Proposers are required to submit the following details in their technical proposal:

i. CVs of the Proposer;

ii. One relevant example demonstrating experience in development of management plans for protected areas;

iii. One relevant example demonstrating qualifications of the expert in development of management systems of World Heritage sites;

iv. References – contact details of 3 referees familiar with the Proposer’s experience relevant to protected area management and World Heritage management planning.

4.2. Pricing information

This clause sets out the information necessary for Proposers to furnish rates and prices as consideration for

delivering the Requirement under any resultant Contract.

Prices include all costs

Submitted rates and prices are deemed to include all costs, insurances, taxes, fees, expenses, liabilities,

obligations, risk and other things necessary for the performance of the Requirement. Any charge not stated in

the Proposal as being additional, will not be allowed as a charge against any transaction under any resultant

Contract, with the exception of duty-related travel and subsistence costs.

Unless otherwise indicated, all rates and prices submitted by Proposers shall be in US Dollars.

Travel expenses in connection with this contract shall not exceed [currency/amount in numbers]. Annex II IUCN – INTERNATIONAL UNION FOR CONSERVATION OF NATURE CONDITIONS OF CONTRACT GENERAL 1. All tasks under the Contract shall be carried out as required by and to the satisfaction of the Director

General of IUCN. 2. Any variation of the terms and conditions of the Contract must be agreed in advance and in writing

between the contractee and IUCN. 3. The Contract may be terminated by written notice of either party to the other party in the event of breach

of essential terms or conditions by the other party. In such a case, IUCN and the contractee reserve the right to recover such sums as may be appropriate.

4. If the Contract is not completed because of ill health, or for other reasons beyond the control of the

contractee, payment shall be made at the discretion of the Director General of IUCN for all work accepted by IUCN.

5. If the tasks defined in the contract are not fulfilled to the satisfaction of IUCN within the requested time

limit, IUCN reserves the right to recuperate any funds already paid and to withhold any further payments until completion of all tasks to the satisfaction of IUCN.

6. The contractee is deemed to be an independent contractee providing the services called for under the

Contract. The documents constituting the Contract do not therefore imply an offer of employment as a member of IUCN staff, permanent, temporary or otherwise. IUCN does not accept any liability for acts of third parties, accident, sickness or losses of any kind, however caused, arising in the course of or from the performance of the Contract. The contractee is advised to take out whatever insurance is appropriate to cover such risks and contingencies.

7. The contractee has no right to sub-contract work under this Contract unless expressly stated in writing

by IUCN. Where the contractee is given the right to sub-contract, all contractual and other matters concerning sub-contracts, including all payments, will remain the exclusive responsibility of the contractee.

RESOURCES 8. The resources provided may be used only for the specific purposes described in the Contract and

elaborated in the project description. 9. Budgets are indicative only: Payment will be authorised only on the basis of actual costs reasonably

incurred. Apart from fees and other fixed expenses specifically identified in this Contract, expenditure should be kept to the strict minimum required for the achievement of the objectives of the project, regardless of the amounts budgeted or approved.

10. The contractee will be reimbursed for approved travel on production of receipts for fares (for example,

air travel at economy class and rail at first class) and will receive daily allowances for approved work time spent away from the contractee's place of residence, in accordance with the terms laid out in the contractual letter to which these conditions are annexed. Cost of rental cars will not be reimbursed unless specifically authorised in writing in advance by IUCN. Travel claims should be submitted on the forms enclosed with the Contract, supported by appropriate receipts, for example, hotel bills, transport, and so on, and must reach IUCN within sixty days of the completion of the Contract.

11. Any funds not spent should be reported to IUCN and held pending its instructions. 12. It is an essential condition of this Contract that if resources additional to those provided under the

present Contract are made available for the project from other sources, the contractee shall immediately notify IUCN.

NON-CONSUMED EQUIPMENT AND OTHER RESOURCES 13. All equipment and other resources paid for or supplied by IUCN which remain non-consumed shall

remain vested in and revert to IUCN unless otherwise expressly stated in this Contract. ADVICE AND ASSISTANCE 14. Scientific and technical guidance on the implementation of the project shall be provided to the

contractee as necessary by IUCN. REPORTS 15. The reports required are as stated in the Contract. 16. IUCN reserves the right to request any other report, progress, financial or otherwise, which could be

considered to be reasonably required to evidence satisfactory performance under the Contract. INTELLECTUAL PROPERTY RIGHTS - PUBLICATIONS AND PUBLICITY 17. All legal rights throughout the world in works or inventions created by the contractee in connection with

the Contract shall vest in IUCN. The contractee recognises that such rights include, but are not limited to, copyright and other rights in written material (hard copy or electronic), sound and video recordings (including films), maps, photography, etc., as well as patents and other rights in inventions, and that the said rights enable IUCN to control all publications, publicity material and other exploitation of the said works and inventions.

18. IUCN shall not unreasonably refuse to consent to exploitations of works or inventions proposed by the

contractee for the advancement of his/her professional or scientific career. 19. Any dispute between the contractee and IUCN arising from the interpretation of the preceding

paragraph shall be referred to the Council of IUCN. CONFIDENTIALITY 20. As a general rule all information or material arising under or in connection with the project, including the

project description, supporting documentation, correspondence, progress and final reports, and audio-visual material, shall be open and available for public inspection. However, where circumstances reasonably require confidentiality, project information or material, excluding the project description, can be specified "confidential" by the writer and be treated as such.

PART 6 – DEFINITIONS

For the purposes of this Request for Proposal (RfP) the following definitions apply:

Contract Means any contract or other legal commitment that results

from this Request for Proposals.

Contractor Means the entity that forms a Contract with IUCN for provision

of the Requirement.

Instructions Means the instructions and conditions set out in Part 1 of this

Request for Proposals.

IUCN Means IUCN, International Union for Conservation of Nature

and Natural Resources.

IUCN Contact Means the person IUCN has nominated to be used

exclusively for contact regarding this Request for Proposals

and the Contract.

Proposal Means a written offer submitted in response to this Request

for Proposals.

Proposer Means an entity that submits, or is invited to submit, a

Proposal in response to this Request for Proposals.

Requirement Means the supply to be made by the Contractor to IUCN in

accordance with Part 2 of the RfP.
