II

DESCRIPTION OF THE PROJECT

The Sierra Sands Unified School District (“District”) is seeking qualified architecture/engineering firms to provide architectural services for the installation of two temporary relocatable classrooms at Murray Middle School (hereinafter referred to as the “Project”).

The classrooms must be ready for student instruction for the 2019-2020 school year. The District plans to seek approval from the Division of State Architect (DSA) for the Project buildings pursuant to Interpretive Regulation A-1.16 (“IR A- 1.16”) which establishes the process for the “temporary approval for school use of DSA approved relocatable buildings.” IR A-1.16 creates an approval process to address “unanticipated increase in students wherein educational facilities are immediately needed for displaced or unhoused pupils” and allows for the “placement of already fabricated DSA approved relocatable buildings in advance of securing DSA temporary approval for site placement.” The District anticipates a sudden increase in its student population because the local charter school is no longer serving middle school students.

Interested Design Professionals must develop site plans for the placement and installation of the modular buildings, including all necessary utility and support connections and take all actions necessary to obtain DSA approval for the modular buildings, whether through IR A-1.16 or otherwise. Thus, the Design Professional must represent the District and work directly with DSA to seek and obtain approval of the Project, including providing all site plan information necessary to secure immediate approval of the Project so the relocatable buildings can be used for the 2019-2020 school year. Specifically, the Design Professional must make initial contact DSA to notify DSA of the District’s intention of seeking immediate approval pursuant to IR A-1.16 due to the unanticipated increase in student population.

It is the desire of the District to select a Design Professional that can meet or exceed the design, budget and schedule requirements set forth by the District and to provide comprehensive architectural services at the lowest cost and highest quality, in accordance with the information provided in this RFP as well as the Attachments included with this RFP.

III

REQUIREMENTS FOR SUBMITTAL

Each Architectural/Engineering Firm shall submit the following information and documents. All

submittals must be received by the District on or before 5/3/2019, at 12:00 p.m. Proposals must

be received at the address listed in Section IV (F) below either through mail, personal delivery, or

electronic mail.

A. COVER LETTER

B. DESCRIPTION OF FIRM

Include name of firm, address, telephone number, fax number, type of firm (i.e., corporation, partnership, etc.), California Registration Number and name of principal contact. Provide a brief history of the organization, including:

* Number of years in business

* Senior member(s) and length of association

* Whether the organization has gone by a different name while under substantially the same management

* Location of office where project team members will complete the design and manage the project

* List of basic services provided by firm

* A detailed explanation of any litigation related to school construction Project in which the organization has been involved, as well as a discussion of how the litigation was resolved.

C. EXPERIENCE RELATIVE TO DISTRICT NEEDS

Discuss the organization’s knowledge of and experience with similar projects, either dealing with school districts or modular / relocatable building placement and obtaining the associated DSA approval.

Provide the total number of school projects in progress in office at this time and phase status, grade level and current dollar value.

Discuss the organization’s change order history, including the firm’s approach to problems and change orders, and a summary of change orders for three school projects which were completed over the last two years.

D. QUALIFICATIONS OF ARCHITECTURAL FIRM’S PERSONNEL

Identify the personnel and financial resources available for the Project. List all specific personnel experience which uniquely suits the personnel to the District’s needs.

E. EXPERIENCE WITH STATE REGULATORY AGENCIES

Describe your experience with DSA approval procedures, including any experience with obtaining approval through IR A-1.16 and/or similar relocatable / modular installation projects.

F. PROJECT PLAN AND METHODOLOGY

Identify the proposed structural, mechanical, electrical, and civil engineers and consultants for landscape, energy and other relevant disciplines for this project. List license numbers and dates as well as business address, phone number and fax number. Include resumes and related experience for appropriate members of these firms.

G. FEES

Provide breakdown of proposed fees and personnel to be assigned to the Project. The proposal should include a lump sum fee or a “not-to-exceed” payment amount based on the services required herein.

H. INSURANCE

Provide the following:

* Name of professional liability insurance carrier

* Whether the policy of insurance is on an occurrence or claims made basis

* Policy limits

* Deductible on the policy of insurance

* Number of years with carrier

* Claims made on any policy of insurance held by the organization

(a) A detailed explanation of the nature and type of claim

(b) Whether the claim has been resolved

(c) The terms of the resolution

Provide a statement describing the methodology utilized to estimate the probable installation cost of the Project. Include:

* Methodology

* Contingencies utilized

* Standard estimating manuals used as reference

J. DESCRIPTION OF PROJECT PLAN

As set forth in the “Description of the Project” section, the District requires all services necessary to obtain DSA approval and fully install modular buildings at the Murray Middle School site. Proposers must provide a general description of the actions they will take to ensure the installation of fully functional modular buildings at the Murray Middle school site before the 2019-2020 school year, including, but not limited to, seeking DSA approval through IR A-1.16 by describing the process and timeline for the design and approval of the installation of the modular buildings. Proposers must demonstrate they have the capacity, knowledge, and plan to ensure the relocatable buildings will be fully operational and approved before the 2019-2020 school year.

IV GENERAL INFORMATION

A. SUBMITTAL OF STATEMENT OF QUALIFICATIONS

All submittals should be verified before submission. Adjustments will not be permitted after submission to the District. The District will not be held responsible for any errors or omissions on the part of the firm in the preparation of the submittal. The District reserves the right to reject any and all submittals, or to waive any irregularities or information in the submittals.

B. SIGNATURES

Submittal must be signed by a representative of the organization with authorization to bind the organization by contract.

C. DISQUALIFIED STATEMENTS

Any submittal received by the after the time and dated stated above, shall be refused and returned.

D. WITHDRAWAL OF SUBMITTAL

Organizations may withdraw their submittal, either personally or by written request, at any time prior to the closing time for the receipt of submittals.

E. COPIES OF SUBMITTAL

Each organization making a submittal must include an original and three (3) copies.

F. QUESTIONS / CONTACT

Organizations interested in making a submittal are directed not to make personal contact with members of the District’s Governing Board. Any contact will constitute grounds for disqualification of consideration. Any questions must be submitted in writing via email or mail) at least one day prior to the Due Date for Proposals. The District, at its sole discretion, may respond to questions or supplement the information provided with this RFP on its website, located at: www.ssusd.org. G. RIGHTS OF THE DISTRICT

This Request for Proposal (“RFP”) does not commit the District to award a contract or pay any costs incurred in the preparation of a response to this request. The District reserves the right to accept all or part of any submittal or to cancel in part or in its entirety the RFP. The District further reserves the right to select the professional consultant that it considers to be in the best interest of the District by considering al factors set forth in this RFP including, but not limited to, price.

H. FEES

The District will negotiate contract fees for the services to be provided from the best qualified organizations.

I. CONTRACTS

In accordance with Public Contract Code section 20103.6, the professional consultant, upon selection, will be required to enter into a standard Architectural Services Agreement which contains the following indemnity clause:

INDEMNITY BY ARCHITECT.

In addition to any indemnity provision included in the Agreement, all proposers must confirm that they will accept the following indemnification requirements:

To the fullest extent permitted by law, ARCHITECT agrees to indemnify and hold the DISTRICT harmless from all liability arising out of:

a. Workers’ Compensation and Employer’s Liability. Any and all claims under Workers’ Compensation acts and other employee benefit acts with respect to ARCHITECT’s employees or ARCHITECT’s subcontractor’s employees arising out of ARCHITECT’s work under this AGREEMENT; and

b. General Liability. If arising out of, pertaining to, or relating to the negligence, recklessness, or willful misconduct of the ARCHITECT, the ARCHITECT shall indemnify and hold the DISTRICT harmless from any liability for damages for (1) death or bodily injury to person; (2) injury to, loss or theft of property; (3) any failure or alleged failure to comply with any provision of law; or (4) any other loss, damage or expense arising under either (1), (2), or (3) above, sustained by the ARCHITECT or the DISTRICT, or any person, firm or corporation employed by the ARCHITECT or the

DISTRICT upon or in connection with the PROJECT, except for liability resulting from the sole or active negligence, or willful misconduct of the DISTRICT, its officers, employees, agents, or independent Architects who are directly employed by the DISTRICT. The ARCHITECT, at its own expense, cost, and risk, shall defend any and all claims, actions, suits, or other proceedings that may be brought or instituted against the DISTRICT (other than professional negligence covered by Section c below), its officers, agents, or employees, that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the ARCHITECT, and shall pay or satisfy any judgment that may be rendered against the DISTRICT, its officers, agents, or employees, in any action, suit or other proceedings as a result thereof; and

c. Professional Liability. If arising out of, pertaining to, or relating to thenegligence, recklessness, or willful misconduct of the ARCHITECT, the ARCHITECT shall indemnify and hold the DISTRICT harmless from any loss, injury to, death of persons, or damage to property caused by any act, neglect, default, or omission of the ARCHITECT, or any person, firm, or corporation employed by the ARCHITECT, either directly or by independent contract, including all damages due to loss or theft, sustained by any person, firm, or corporation, including the DISTRICT, arising out of, or in any way connected with, the PROJECT, including injury or damage either on or off DISTRICT property; but not for any loss, injury, death, or damages caused by sole or active negligence, or willful misconduct of the DISTRICT. With regard to the ARCHITECT’s obligation to indemnify for acts of professional negligence, such obligation does not include the obligation to provide defense counsel or to pay for the defense of actions or proceedings brought against the DISTRICT, but rather to reimburse the DISTRICT for attorneys’ fees and costs incurred by the DISTRICT in defending such actions or proceedings brought against the DISTRICT that arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the ARCHITECT.

J. DISTRICT PROCESS

Upon receipt of proposals, the District, at its sole discretion, may contact proposers individually or schedule interviews to discuss the specifics of the Project and the information submitted by the proposer pursuant to this RFP. The District will then provide a complete contract to the selected proposer incorporating the requirements and information set forth in this RFP and the proposer’s response. By submitting a proposal, proposers are hereby establishing that they can meet the District’s needs as set forth herein immediately and will execute a contract with the terms set forth herein upon the District’s request.
