Dear Adams County Planning & Development:

Amendment to Existing Conditional Use Permit: RCU2015-00020, Rec # 201600000529

The original project CUP that was approved unanimously on October 20, 2015 was approved for development of 35 acres of solar PV. SunShare still plans on building out the entire 35 acre parcel per the conditions set by the original CUP (attached). Same equipment, same height, same fence, same landscape plan, same setbacks, same pervious vs impervious surface calculations, same ROW dedication, same everything. The amendments requested are more administrative in nature.

SunShare would like to make two amendments to the Conditional Use Permits (Case # RCU2015-00020, Rec # 201600000529:

1. On October 20th, 2015 the Adams County Board of County Commissioners voted unanimously to approve SunShare’s Imboden II solar garden CUP. The original CUP expiration is October 20th, 2036. We would like to request an extended expiration date December 31st, 2037. This is about a 15 month extension of a 21 year permit.

In our original CUP application we asked for a 21 year duration to account for 1 year of development and construction and 20 years of operation as required by the utility and our subscribers. Our development timeline has taken longer than expected but is still going well and construction is set to take place in early Summer 2017. We are requesting expiration extension to this CUP so we can fulfill the full 20 year interconnect agreement with the utility, 20 year subscriber contracts with our clients, and have small amount of buffer time on back end to decommission the system and restore the land.

2. SunShare still wishes to develop solar across the entire site, as the original CUP described. However, we want to accommodate several small projects each owned by a separate entity but co-located on the site. This is to accommodate a new rule from Xcel only allowing a maximum of 2 MW (14 acres) to be owned by one developer. To realize the benefit of our land and CUP SunShare would allow other solar developers to build their projects next to ours. This would comply with Xcel rules and stay within constraints and spirit of original CUP. Further, Xcel

provides awards in small increments causing us to develop projects with different financiers, different owners, on different timelines. For this reason, we’d like to request that the CUP’s apply to multiple projects owned by one or more solar developers. For example, SunShare will build a 14 acre project, simultaneously SunShare may lease a portion of the land to another solar developer so they can build a similar solar project within the constraints of the CUP. This will allow the site to be built out per the full potential of the CUP while also complying with utility rules of small system increments with different owners.

SunShare still plans on developing and constructing both projects, we plan on constructing the Imboden II solar garden in conjunction with the Imboden III solar garden on the adjacent parcel. We will be asking for similar amendments to the Imboden III CUP. Both are slated to break ground in late Spring and be finished by late Summer 2017.

We appreciate Adams County’s general acceptance of solar projects and especially solar gardens thus far. The approval of these amendments will help fulfill the original intentions of the previously approved CUP. In short, we just need more time than we originally anticipated to finish our solar developments. These amendments will provide the financiers the comfort to release funds so we can pursue construction.
