A RESOLUTION AUTHORIZING THE MAYOR, OR HER DESIGNEE, TO APPLY FOR A FY 2019 U.S. DEPARTMENT OF TRANSPORTATION BETTER UTILIZING INVESTMENTS TO LEVERAGE DEVELOPMENT ("BUILD") DISCRETIONARY GRANT IN AN AMOUNT NOT TO EXCEED SIXTEEN MILLION DOLLARS ($16,000,000.00) FOR THE CONSTRUCTION OF THE ATLANTA BELTLINE SOUTHSIDE TRAIL; AND FOR OTHER PURPOSES.
WHEREAS, on April 16, 2019, the United States Department of Transportation ("USDOT") published a Notice of Funding Opportunity ("NOFO") under the U.S. Department of Transportation National Infrastructure Investments FY 2019 Better Utilizing Investments to Leverage Development ("BUILD") discretionary grant; and
WHEREAS, $900 million in grant funds will be awarded on a competitive basis to fund up to 80% of project costs of capital investments in surface transportation infrastructure projects that will have a significant local or regional impact; and
WHEREAS, this NOFO solicits applications from all eligible applicants, which includes local governments like the City of Atlanta ("City"): and
WHEREAS, the application deadline established by USDOT is July 15, 2019: and
WHEREAS, Ordinance Number 05-0-1733, adopted by the Atlanta City Council on November 7. 2005 and approved by the Mayor on November 9, 2005, authorized the City to create the BeltLine Redevelopment Area and Tax Allocation District ("TAD"): and
WHEREAS, the Redevelopment Plan financing plan called for leveraging local and BeltLine TAD contributions with federal transportation funds as a part of funding the completion of several sections of the Atlanta BeltLine Project and
WHEREAS, the Atlanta BeltLine Southside Trail construction project (the "Project"), which meets or exceeds the selection criteria and performance measures identified in the NOFO to address safety, state of good repair, economic competitiveness, environmental sustainability, and quality of life in the City's transportation network: and
WHEREAS, the Atlanta BeltLine Project is identified in the City's adopted Comprehensive Development Plan and comprehensive transportation plan, known as the Connect Atlanta Plan; and
WHEREAS, the Atlanta BeltLine Project is identified in the Atlanta metropolitan planning organization's long-range transportation plan, known as PLAN 2040.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the Atlanta City Council supports the FY 2019 BUILD grant application for the Project.

BE IT FURTHER RESOLVED, that the Mayor, or her designee, is encouraged to prepare and submit the FY 2019 BUILD grant application to USDOT pursuant to the April 16, 2019 NOFO for the Project.
BE IT FURTHER RESOLVED, that the Mayor, in her sole discretion, is hereby authorized to partner with one or more agencies in preparing and submitting the FY 2019 BUILD grant application to USDOT.
BE IT FINALLY RESOLVED, that If an award is made to the City by USDOT pursuant to the FY 2019 BUILD grant application, execution of agreements which are necessary to accept the award shall be approved by subsequent action of the Atlanta City Council.
