TITL I"A$IC PRINCIPL$

ctio+ 1.Title.- This Act shall be known and cited as the "ocal !overnment Code of ##".

ctio+ .$eclaration of Policy.-

(a) It is heeby declaed the !olicy o" the State that the teitoial and !olitical s#bdi$isions o" the State shall en%oy &en#ine andmeanin&"#l local a#tonomy to enable them to attain thei "#llest de$elo!ment as sel"-eliant comm#nities and make them moee""ecti$e !atnes in the attainment o" national &oals' Towad this end the State shall !o$ide "o a moe es!onsi$e andacco#ntable local &o$enment st#ct#e instit#ted tho#&h a system o" decentaliation wheeby local &o$enment #nits shallbe &i$en moe !owes a#thoity es!onsibilities and eso#ces' The !ocess o" decentaliation shall !oceed "om thenational &o$enment to the local &o$enment #nits'

(b) It is also the !olicy o" the State to ens#e the acco#ntability o" local &o$enment #nits tho#&h the instit#tion o" e""ecti$emechanisms o" ecall initiati$e and e"eend#m'

(c) It is likewise the !olicy o" the State to e*#ie all national a&encies and o""ices to cond#ct !eiodic cons#ltations witha!!o!iate local &o$enment #nits non&o$enmental and !eo!le+s o&aniations and othe concened sectos o" thecomm#nity be"oe any !o%ect o !o&am is im!lemented in thei es!ecti$e %#isdictions'a%phil.net

ctio+ -.&perative Principles of $ecentrali'ation.- The "om#lation and im!lementation o" !olicies and meas#es on local a#tonomy

ll be ided by the "ollowin& o!eati$e !inci!les:

(a) Thee shall be an e""ecti$e allocation amon& the di""eent local &o$enment #nits o" thei es!ecti$e !owes "#nctionses!onsibilities and eso#ces,

(b) Thee shall be established in e$ey local &o$enment #nit an acco#ntable e""icient and dynamic o&aniational st#ct#eand o!eatin& mechanism that will meet the !ioity needs and se$ice e*#iements o" its comm#nities,

(c) S#b%ect to ci$il se$ice law #les and elations local o""icials and em!loyees !aid wholly o mainly "om local "#nds shallbe a!!ointed o emo$ed accodin& to meit and "itness by the a!!o!iate a!!ointin& a#thoity,

(d) The $estin& o" d#ty es!onsibility and acco#ntability in local &o$enment #nits shall be accom!anied with !o$ision "o

easonably ade*#ate eso#ces to discha&e thei !owes and e""ecti$ely cay o#t thei "#nctions: hence they shall ha$e the!owe to ceate and boaden thei own so#ces o" e$en#e and the i&ht to a %#st shae in national taes and an e*#itableshae in the !oceeds o" the #tiliation and de$elo!ment o" the national wealth within thei es!ecti$e aeas,

(e) .o$inces with es!ect to com!onent cities and m#nici!alities and cities and m#nici!alities with es!ect to com!onentbaan&ays shall ens#e that the acts o" thei com!onent #nits ae within the sco!e o" thei !escibed !owes and "#nctions,

(") /ocal &o$enment #nits may &o#! themsel$es consolidate o coodinate thei e""ots se$ices and eso#ces commonlybene"icial to them,

(&) The ca!abilities o" local &o$enment #nits es!ecially the m#nici!alities and baan&ays shall be enhanced by !o$idin&them with o!!ot#nities to !atici!ate acti$ely in the im!lementation o" national !o&ams and !o%ects,

(h) Thee shall be a contin#in& mechanism to enhance local a#tonomy not only by le&islati$e enablin& acts b#t also byadministati$e and o&aniational e"oms,

(i) /ocal &o$enment #nits shall shae with the national &o$enment the es!onsibility in the mana&ement and maintenance o"ecolo&ical balance within thei teitoial %#isdiction s#b%ect to the !o$isions o" this 0ode and national !olicies,

(k) The ealiation o" local a#tonomy shall be "acilitated tho#&h im!o$ed coodination o" national &o$enment !olicies and!o&ams an etension o" ade*#ate technical and mateial assistance to less de$elo!ed and dese$in& local &o$enment #nits,

(l) The !atici!ation o" the !i$ate secto in local &o$enance !atic#laly in the deli$ey o" basic se$ices shall be enco#a&edto ens#e the $iability o" local a#tonomy as an altenati$e state&y "o s#stainable de$elo!ment, and

(m) The national &o$enment shall ens#e that decentaliation contib#tes to the contin#in& im!o$ement o" the !e"omanceo" local &o$enment #nits and the *#ality o" comm#nity li"e'

ctio+ .Scope of (pplication.- This 0ode shall a!!ly to all !o$inces cities m#nici!alities baan&ays and othe !oliticaldi$isions as may be ceated by law and to the etent heein !o$ided to o""icials o""ices o a&encies o" the national &o$enment'

ctio+ /.Rules of )nterpretation.- In the inte!etation o" the !o$isions o" this 0ode the "ollowin& #les shall a!!ly:

(a) Any !o$ision on a !owe o" a local &o$enment #nit shall be libeally inte!eted in its "a$o and in case o" do#bt any*#estion theeon shall be esol$ed in "a$o o" de$ol#tion o" !owes and o" the lowe local &o$enment #nit' Any "ai andeasonable do#bt as to the eistence o" the !owe shall be inte!eted in "a$o o" the local &o$enment #nit concened,

(b) In case o" do#bt any ta odinance o e$en#e meas#e shall be const#ed stictly a&ainst the local &o$enment #nitenactin& it and libeally in "a$o o" the ta!aye' Any ta eem!tion incenti$e o elie" &anted by any local &o$enment #nit!#s#ant to the !o$isions o" this 0ode shall be const#ed stictly a&ainst the !eson claimin& it'

(c) The &eneal wel"ae !o$isions in this 0ode shall be libeally inte!eted to &i$e moe !owes to local &o$enment #nits inacceleatin& economic de$elo!ment and #!&adin& the *#ality o" li"e "o the !eo!le in the comm#nity,

(d) Ri&hts and obli&ations eistin& on the date o" e""ecti$ity o" this 0ode and aisin& o#t o" contacts o any othe so#ce o"!esentation in$ol$in& a local &o$enment #nit shall be &o$ened by the oi&inal tems and conditions o" said contacts o thelaw in "oce at the time s#ch i&hts wee $ested, and

(e) In the esol#tion o" conto$esies aisin& #nde this 0ode whee no le&al !o$ision o %#is!#dence a!!lies esot may behad to the c#stoms and taditions in the !lace whee the conto$esies take !lace'

ctio+ 6.(uthority to Create ocal !overnment *nits.- A local &o$enment #nit may be ceated di$ided me&ed abolished o itsndaies s#bstantially alteed eithe by law enacted by 0on&ess in the case o" a !o$ince city m#nici!ality o any othe !oliticaldi$ision o by odinance !assed by the san&nian& !anlalawi&an o san&nian& !anl#n&sod concened in the case o" aan&ay located within its teitoial %#isdiction s#b%ect to s#ch limitations and e*#iements !escibed in this 0ode'

ctio+ 7.Creation and Conversion.- As a &eneal #le the ceation o" a local &o$enment #nit o its con$esion "om one le$el tothe le$el shall be based on $ei"iable indicatos o" $iability and !o%ected ca!acity to !o$ide se$ices to wit:

(a) Income' - It m#st be s#""icient based on acce!table standads to !o$ide "o all essential &o$enment "acilities andse$ices and s!ecial "#nctions commens#ate with the sie o" its !o!#lation as e!ected o" the local &o$enment #nit

concened,

(b) .o!#lation' - It shall be detemined as the total n#mbe o" inhabitants within the teitoial %#isdiction o" the local&o$enment #nit concened, and

(c) /and Aea' - It m#st be contio#s #nless it com!ises two o moe islands o is se!aated by a local &o$enment #nitinde!endent o" the othes, !o!ely identi"ied by metes and bo#nds with technical desci!tions, and s#""icient to !o$ide "os#ch basic se$ices and "acilities to meet the e*#iements o" its !o!#lace'

0om!liance with the "oe&oin& indicatos shall be attested to by the 2e!atment o" inance (2) the ational Statistics""ice (S) and the /ands 6ana&ement 7#ea# (/67) o" the 2e!atment o" n$ionment and at#al Reso#ces (2R)'

ctio+ 9.(bolition of ocal !overnment *nits.- A local &o$enment #nit may be abolished when its income !o!#lation o land aeabeen ie$esibly ed#ced to less than the minim#m standads !escibed "o its ceation #nde 7ook III o" this 0ode as ceti"ied bynational a&encies mentioned in Section 9 heeo" to 0on&ess o to the san&nian& concened as the case may be'

ctio+ 10.Plebiscite Re,uirement.- o ceation di$ision me&e abolition o s#bstantial alteation o" bo#ndaies o" localenment #nits shall take e""ect #nless a!!o$ed by a ma%oity o" the $otes cast in a !lebiscite called "o the !#!ose in the !oliticalo #nits diectly a""ected' Said !lebiscite shall be cond#cted by the 0ommission on lections (06/0) within one h#nded

ctio+ 11.Selection and Transfer of ocal !overnment Site- &ffices and acilities.-

(a) The law o odinance ceatin& o me&in& local &o$enment #nits shall s!eci"y the seat o" &o$enment "om whee&o$enmental and co!oate se$ices shall be deli$eed' In selectin& said site "actos elatin& to &eo&a!hical centalityaccessibility a$ailability o" tans!otation and comm#nication "acilities daina&e and sanitation de$elo!ment and economic!o&ess and othe ele$ant consideations shall be taken into acco#nt'

(b) istoical 0ommission (.>0) chan&e the name o"the "ollowin& within its teitoial %#isdiction:

(1) 0om!onent cities and m#nici!alities #!on the ecommendation o" the san&nian concened,

() .o$incial oads a$en#es bo#le$ads thoo#&h"aes and bid&es,

(3) .#blic $ocational o technical schools and othe !ost-seconday and tetiay schools,

(4) .o$incial hos!itals health centes and othe health "acilities, and

(5) Any othe !#blic !lace o b#ildin& owned by the !o$incial &o$enment'

(b) The san&nian o" hi&hly #banied cities and o" com!onent cities whose chates !ohibit thei $otes "om $otin& "o!o$incial electi$e o""icials heeina"te e"eed to in this 0ode as inde!endent com!onent cities may in cons#ltation with the.hili!!ine >istoical 0ommission chan&e the name o" the "ollowin& within its teitoial %#isdiction:

(1) 0ity baan&ays #!on the ecommendation o" the san&nian& baan&ay concened,

() 0ity oads a$en#es bo#le$ads thoo#&h"aes and bid&es,

(3) .#blic elementay seconday and $ocational o technical schools comm#nity colle&es and non-chateedcolle&es,

(4) 0ity hos!itals health centes and othe health "acilities, and

(5) Any othe !#blic !lace o b#ildin& owned by the city &o$enment'

(c) The san&nians o" com!onent cities and m#nici!alities may in cons#ltation with the .hili!!ine >istoical 0ommissionchan&e the name o" the "ollowin& within its teitoial %#isdiction:

(1) 0ity and m#nici!al baan&ays #!on ecommendation o" the san&nian& baan&ay concened,

() 0ity m#nici!al and baan&ay oads a$en#es bo#le$ads thoo#&h"aes and bid&es,

(3) 0ity and m#nici!al !#blic elementay seconday and $ocational o technical schools !ost- seconday and othetetiay schools,

(4) 0ity and m#nici!al hos!itals health centes and othe health "acilities, and

(5) Any othe !#blic !lace o b#ildin& owned by the m#nici!al &o$enment'

(d) one o" the "oe&oin& local &o$enment #nits instit#tions !laces o b#ildin&s shall be named a"te a li$in& !eson nomay a chan&e o" name be made #nless "o a %#sti"iable eason and in any case not o"tene than once e$ey ten (1;) yeas'The name o" a local &o$enment #nit o a !#blic !lace steet o st#ct#e with histoical c#lt#al o ethnic si&ni"icance shallnot be chan&ed #nless by a #nanimo#s $ote o" the san&nian concened and in cons#ltation with the .>0'

(e) A chan&e o" name o" a !#blic school shall be made only #!on the ecommendation o" the local school boad concened'

(") A chan&e o" name o" !#blic hos!itals health centes and othe health "acilities shall be made only #!on theecommendation o" the local health boad concened'

(&) The chan&e o" name o" any local &o$enment #nit shall be e""ecti$e only #!on ati"ication in a !lebiscite cond#cted "o the!#!ose in the !olitical #nit diectly a""ected'

(h) In any chan&e o" name the ""ice o" the .esident the e!esentati$e o" the le&islati$e distict concened and the 7#ea#o" .osts shall be noti"ied'

(i) In$estment s#!!ot se$ices incl#din& access to cedit "inancin&,

() @!&adin& and modeniation o" ta in"omation and collection se$ices tho#&h the #se o" com!#tehadwae and so"twae and othe means,

(i) Inte-m#nici!al telecomm#nications se$ices s#b%ect to national !olicy idelines, and

(4) o a 0ity:

All the se$ices and "acilities o" the m#nici!ality and !o$ince and in addition theeto the "ollowin&:

(1) Ade*#ate comm#nication and tans!otation "acilities,

(c) otwithstandin& the !o$isions o" s#bsection (b) heeo" !#blic woks and in"ast#ct#e !o%ects and othe "acilities!o&ams and se$ices "#nded by the national &o$enment #nde the ann#al ?eneal A!!o!iations Act othe s!ecial laws!etinent eec#ti$e odes and those wholly o !atially "#nded "om "oei&n so#ces ae not co$eed #nde this Sectionece!t in those cases whee the local &o$enment #nit concened is d#ly desi&nated as the im!lementin& a&ency "o s#ch!o%ects "acilities !o&ams and se$ices'

(d) The desi&ns !lans s!eci"ications testin& o" mateials and the !oc#ement o" e*#i!ment and mateials at .19; "om both"oei&n and local so#ces necessay "o the !o$ision o" the "oe&oin& se$ices and "acilities shall be #ndetaken by the local&o$enment #nit concened based on national !olicies standads and idelines'

(e) ational a&encies o o""ices concened shall de$ol$e to local &o$enment #nits the es!onsibility "o the !o$ision o" basic

se$ices and "acilities en#meated in this Section within si () months a"te the e""ecti$ity o" this 0ode'

As #sed in this 0ode the tem de$ol#tion e"es to the act by which the national &o$enment con"es !owe and a#thoity#!on the $aio#s local &o$enment #nits to !e"om s!eci"ic "#nctions and es!onsibilities'

(") The national &o$enment o the net hi&he le$el o" local &o$enment #nit may !o$ide o a#&ment the basic se$ices and"acilities assi&ned to a lowe le$el o" local &o$enment #nit when s#ch se$ices o "acilities ae not made a$ailable o i" madea$ailable ae inade*#ate to meet the e*#iements o" its inhabitants'

(&) The basic se$ices and "acilities heeinabo$e en#meated shall be "#nded "om the shae o" local &o$enment #nits in the!oceeds o" national taes and othe local e$en#es and "#ndin& s#!!ot "om the national &o$enment its inst#mentalitiesand &o$enment-owned o contolled co!oations which ae tasked by law to establish and maintain s#ch se$ices o "acilities'

Any "#nd o eso#ce a$ailable "o the #se o" local &o$enment #nits shall be "ist allocated "o the !o$ision o" basic se$iceso "acilities en#meated in s#bsection (b) heeo" be"oe a!!lyin& the same "o othe !#!oses #nless othewise !o$ided inthis 0ode'

(h) Re&ional o""ices o" national a&encies o o""ices whose "#nctions ae de$ol$ed to local &o$enment #nits as !o$ided heeinshall be !hased o#t within one (1) yea "om the a!!o$al o" this 0ode' Said national a&encies and o""ices may establish s#ch"ield #nits as may be necessay "o monitoin& !#!oses and !o$idin& technical assistance to local &o$enment #nits' The!o!eties e*#i!ment and othe assets o" these e&ional o""ices shall be distib#ted to the local &o$enment #nits in the e&ionin accodance with the #les and elations iss#ed by the o$esi&ht committee ceated #nde this 0ode'
