Republic Act No. 10354, otherwise known as the Responsible Parenthood and Reproductive Health Act of 2012 (RH Law) - Enacted by Congress on December 21. 2012 - 14 petitions and 2 petitions-in-intervention were presented, assailing the constitutionality of the RH Law on the ff grounds: o Violates the right to life of the unborn (Section 12, Art II, 1987 Constitution o Violates the right to health and the right to Protection against hazardous products o Violates the right to religious freedom. o Violates - Respondents, on the other hand prayed for the dismissal of the petitioners for the reasons that o No actual case or controversy and, therefore, the issues are not yet ripe for judicial determination o Some petitioners lack standing to question the RH Law o Petitions are essentially petitioners for declaratory relief over which the Court has no original jurisdiction - Despite the pendency of case, the IRR for the enforcement of the assailed legislation took effect on March 15, 2013 RH Law - Enacted to provide Filipinos, especially the poor and the marginalized, access and information to the full range of modern family planning methods, and to ensure that its objective to provide for the peoples’ right to reproductive health be achieved. - Made it mandatory for health providers to provide information on the full range of modern family planning methods, supplies and services, and for schools to provide reproductive health education. - An enhancement measure to fortify and make effective the current laws on contraception, women’s health and population control.
