    REPUBLIC ACT No. 10121

    AN ACT STRENGTHENING THE PHILIPPINE DISASTER RISK REDUCTION ANDMANAGEMENT SYSTEM, PROVIDING FOR THE NATIONAL DISASTER RISK REDUCTION ANDMANAGEMENT FRAMEWORK AND INSTITUTIONALIZING THE NATIONAL DISASTER RISKREDUCTION AND MANAGEMENT PLAN, APPROPRIATING FUNDS THEREFOR AND FOR

    OTHER PURPOSES.

    it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

    Se!"o# 1.Title.- This Act shall be known as the "Philippine Disaster Risk Reduction andManagement Act of 2010".

    Se!"o# $.Definition of Terms.- For purposes of this Act, the following shall refer to:

    (h) "Disaster" - a serious disruption of the functioning of a communit or a societ in!ol!ingwidespread human, material, economic or en!ironmental losses and impacts, which eceeds theabilit of the affected communit or societ to cope using its own resources# Disasters are often

    described as a result of the combination of: the eposure to a ha$ard% the conditions of !ulnerabilitthat are present% and insufficient capacit or measures to reduce or cope with the potential negati!econse&uences, Disaster impacts ma include loss of life, in'ur, disease and other negati!e effectson human, phsical, mental and social well-being, together with damage to propert, destruction ofassets, loss of ser!ices, ocial and economic disruption and en!ironmental degradation# 1avvphi1

    (i) Disaster !itigation- the lessening or limitation of the ad!erse impacts of ha$ards and relateddisasters# itigation measures encompass engineering techni&ues and ha$ard-resistantconstruction as well as impro!ed en!ironmental policies and public awareness#

    (') Disaster Preparedness- the knowledge and capacities de!eloped b go!ernments, professionalresponse and reco!er organi$ations, communities and indi!iduals to effecti!el anticipate, respond

    to, and reco!er from, the *mpacts of likel, imminent or current ha$ard e!ents or conditions#+reparedness action is carried out within the contet of disaster risk reduction and management andaims to build the capacities needed to efficientl manage all tpes of emergencies and achie!eorderl transitions from response to sustained reco!er# +reparedness is based on a sound analsisof disaster risk and good linkages with earl warning sstems, and includes such acti!ities ascontingenc planning, stockpiling of e&uipment and supplies, the de!elopment of arrangements forcoordination, e!acuation and public information, and associated training and field eercises# Thesemust be supported b formal institutional, legal and budgetar capacities#

    (k) Disaster Prevention- the outright a!oidance of ad!erse impacts of ha$ards and relateddisasters# *t epresses the concept and intention to completel a!oid potential ad!erse impactsthrough action taken in ad!ance such as construction of dams or embankments that eliminate floodrisks, land-use regulations that do not permit an settlement in high-risk $ones, and seismic

    engineering designs that ensure the sur!i!al and function of a critical building in an likelearth&uake#

    (l) Disaster Response- the pro!ision of emergenc ser!ices and public assistance during orimmediatel after a disaster in order to sa!e li!es, reduce health impacts, ensure public safet andmeet the basic subsistence needs of the people affected# Disaster response is predominantlfocused on immediate and short-term needs and is sometimes called "disaster relief"#

    Se!"o# 11."rgani#ation at the $ocal %overnment $evel.- The eisting +ro!incial, it, andunicipal Disaster oordinating ouncils shall henceforth be known as the +ro!incial, it, andunicipal Disaster isk eduction and anagement ouncils# The .aranga Disaster oordinatingouncils shall cease to eist and its powers and functions shall henceforth be assumed b the

    eisting .aranga De!elopment ouncils (.Ds) which shall ser!e as the /Ds in e!erbaranga#

    (a) omposition: The /D shall be composed of, but not limited to, the following:

    (0) The /ocal hief 1ecuti!es, hairperson%

    (2) The /ocal +lanning and De!elopment 3fficer, member%

    (4) The 5ead of the /D3, member%

    (6) The 5ead of the /ocal ocial 7elfare and De!elopment 3ffice, member%

    (8) The 5ead of the /ocal 5ealth 3ffice, member%

    (9) The 5ead of the /ocal Agriculture 3ffice, member%

    () The 5ead of the ;ender and De!elopment 3ffice, member%

    (eterinar 3ffice, member%

    (0?) The 5ead of the /ocal .udget 3ffice, member%

    (00) The Di!ision 5ead@uperintendent of chools of the Dep1D, member%

    (02) The highest-ranking officer of the Armed Forces of the +hilippines (AF+)assigned in the area, member%

    (04) The +ro!incial Director@it@unicipal hief of the +hilippine ational +olice(++), member%

    (06) The +ro!incial Director@it@ unicipal Fire arshall of the .ureau of Fire+rotection (.F+), member%

    (08) The +resident of the Association of .aranga aptains (A.), member%

    (b) The /Ds shall ha!e the following functions:

    (0) Appro!e, monitor and e!aluate the implementation of the /D+s and regularl re!iewand test the plan consistent with other national and local planning programs%

    (2) 1nsure the integration of disaster risk reduction and climate change adaptation into local

    de!elopment plans, programs and budgets as a strateg in sustainable de!elopment andpo!ert reduction%

    (4) ecommend the implementation of forced or preempti!e e!acuation of local residents, ifnecessar% and

    (6) on!ene the local council once e!er three (4) months or as necessar#

    Se!"o# 1%.Coordination During &mergencies.- The /Ds shall take the lead in preparing for,responding to, and reco!ering from the effects of an disaster based on the following criteria:

    (a) The .D, if a baranga is affected%

    (b) The cit@municipal Ds, *f two (2) or more barangas are affected%

    (c) The pro!incial D, if two (2) or more cities@municipalities are affected%

    (d) The regional D, if two (2) or more pro!inces are affected% and

    (e) The D, if two (2) or more regions are affected#
