6. Results achieved in terms of assistance to victims:

Victims of torture were participated in program activities and received a high level of professional care as well as a feeling of security that they have a safe place to turn for care.

The standardized diagnostic system which is developed in this program for identification, documentation and rehabilitation of torture victims and their family members is successfully operating.

The international standards according to the Istanbul Protocol for medical and psychological expertise of victims of torture are set up and developed in Georgia that EMPATHY and PRI can promote for duplication in other NIS countries.

This program is provide a model for rehabilitation and treatment of victims of torture that EMPATHY and PRI can promote for duplication in other NIS countries.

The program was provide opportunities for positive change on the policy level, including providing capacity to the Ministry of Health to include victims of torture in its program design for the future (through cooperation with this NGO) and helping to build the capacity of the Ministry of Justice and its departments to accurately identify and track victims of torture in its system, as well as to train prison personnel and other officials how to treat victims of torture and all prisoners or detainees, following basic human rights standards. - 2 -that in several cases MoJ and MoH were provided co – financing of the urgent cases that were needed inpatient treatment or surgery operations. But it should be mentioned too that the state officials do not recognize officially that the torture exists in Georgia.

Several important publications and public awareness campaigns, including PR actions and TV advertisements were provided for aware victims of torture that they can applied to the RCT/EMPATHY for qualified assistance.

Was set up a multi-disciplinary, treatment system for victims of torture the procedure for treatment was automatically improved. The awareness of torture victims and the number of victims tortured still in Georgia were hopefully bring about a will for Government officials to stop this practice through policy change and pressure on the responsible parties to stop. A Public awareness campaign, including information on program activities, some preventative program activities and the wide advertisement of available services, also made a positive change in improving the general acceptance by the victims themselves (not to be ashamed to seek treatment) of psychological and psychiatric treatment.

The “Hot line” Service with duty doctor position for immediate reacting and assistance was developed and operated for victims of torture, that is innovation activities and helps not only victims of torture, but presents the important preventive mechanism for prevention of torture in Georgia.

Despite of furious resistance of MoJ and several prison officials the Branch offices of the RCT/EMPATHY in Penal system – Women Colony Rehabilitation Centre and Juvenile Colony Rehabilitation Centre - still are operating and the crisis intervention and monitoring programmes in Penal System of Georgia are still running as well, that is the great direct support for existing in this system torture victims and as well as presents the strong preventive mechanism for prevention of torture, ill – treatment and inadequate medical care toward to prisoners.

It should be mentioned that the Branch Office of the RCT/EMPATHY – Partner in Military Conflict Zone in Abkhazia – Gali Crisis Centre - is successfully operating, that is very important support in created new tension situation in this military conflict zone where are great number of new torture and ill – treatment victims.

7. Major developments and challenges encountered during the implementation period (organizational

matters, events in the country, etc.): New Developments:

At the Organizational level, it should be mentioned that in the framework of the RCT/EMPATHY new activities funded from the EC Micro Grant and IRCT Rausing Trust New Initiatives the following Branch Offices of the RCT/EMPATHY were established and operating up today: 1) Art Studio for Victims of Torture and 2) Crisis intervention Centre inside the Juvenile’s Pre – Trial Prison.

Events and other activities:

The free of charge programme (Services and “Hot Line”) advertisement were providing by the Public Broad Casting of Georgia (TV and Radio); For that the special video – clip was prepared that were presenting in mentioned above TV;

Information on Campaigns and services of RCT/EMPATHY is published on web page of the organization; IV Conference “Together against Torture” was held at the Marriot Hotel in Tbilisi, in 26 of June, 2007,

UN International Day in Support of Victims of Torture. The main topic of Conference was the RCT/EMPATHY Annual Report and statistical data analysis research work outcomes. The specially prepared CD with wide range of specific publications and presentations was distribute in the end of the Conference among participants (This CD is attached). In the end of the Conference after the discussion the prepared by the RCT/EMPATHY special IV th Declaration “Together against Torture” was presented and signed by the participants, individuals or NGO and professional organizations representatives. More then 80 persons, representatives of the International Organizations, NGOs and Professional Organizations representatives were participated in this Conference. This Conference was widely announced in the Mass Media (TV Channels and Radio, Newsletters). All partner organizations of the RCT/EMPATHY were organizers and actively were participated in this action.

The special Roundtable meeting was held in May 11, 2007 in the Court Yard Marriott Hotel. Main thematic area of this Roundtable Meeting was Health Care in Prison – Developing of Networking.

All prison independent public monitoring commissions’ representatives were invited by the PRI and participated in this action (Total N 15 persons); As well as the public Defender and it’s representatives, International organizations’ Representatives, different embassy representatives, Ministry of Justice Monitoring Department and Prison Department Representatives were participated in this meeting, as well as the professional medical organiztations representatives from Georgian Medical Association and Georgian Psychiatrists’ Society were participated in this action. Total Number of participants was 47 persons. The Mass – media representatives were attending this meeting too. Following presentations and discussions were presented during this meeting: Welcome by lead organisation in EIDHR and UK Embassy torture rehabilitation projects (Maka Jishkariani, RCT/Empathy) EC contribution to protection of prisoners’ right to health (Alexis Loeber, representative of EC Delegation to Georgia) UK Embassy contribution to protection of prisoners’ right to health (William Robinson, representative of Embassy of UK to Georgia) MoJ and MoH activities and plans to guarantee prisoners’ right to equivalent healthcare, including information on the work with ICRC (representative of Penitentiary Department Anton Kelbakiani) Model Project _ “Programme of Rehabilitation for Torture Victims in Georgia” – Mariam Jishkariani, RCT/EMPATHY, President Common problems in meeting international standards for healthcare in the Georgian penal system – M. Jishkariani, Levan Labauri, RCT/EMPATHY, GMA Results of audit of prison commissions by PRI; support for Commissions under EIDHR torture prevention project (M Murphy, PRI) Presentations by prison commissions on prisoner healthcare in their institutions: problems, action taken, solutions/plans (members of all 11 commissions). Guided discussion on opportunities for productive collaboration between Empathy/GMA and the prison commissions, addressing issues of: recruitment of medical specialists to the commissions, medical specialists as consultants to the commissions; opportunities for and limitations to information sharing. Outcome: practical working relations established between the parties present at the roundtable; network for healthcare in prison widened and strengthened; exploration of the possibilities for practical collaboration on healthcare by Empathy/GMA/Ombudsman and prison monitoring commissions. Follow up measures that were take place after this meeting was the Conference in 26 of June, were the several international guidelines and special publications on international and national standards on health care in prison, including the guideline for monitors, were distributed by the RCT/EMPATHY among prison commission’s members. In the Training – Seminar held by the RCT/EMPATHY on international instruments for the fight against torture, in 29 – 30 of September, 2007 at the Public Defender’s Office, the 11 members from prison monitoring commissions (including the regions) were participated and certified on the field of prevention of torture. All this knowledge they successfully use in their practical work and reporting of prison monitoring results.

TOTAL Other outputs – torture victims’ art therapy works. During the Conferences the sale exhibition were conducted.

The special Publication “Annual Report 2006” and International Standards and Mechanisms for the fight against Torture were distributed together with other publications on the 26 of June Conference. As well as several publications were distributed in the May 11, 2007 Roundtable meeting. As well as during the Training – Seminar on IPIP (Phase 2) and ToT training held at the RCT/EMPATHY Office.

All materials are published on Web Page and distributed in the Military Conflict Zone in Abkhazia with the support of the Crisis Intervention Centre (partner of the RCT/EMPATHY, Georgia); materials were distributed during the training – seminar held at the Public Defender’s Office too.

Other specific developments:

Publications were distributed by the support of the MoJ Probation Department among probationers and their family members, in the distribution of informational leaflets of the RCT/EMAPTHY the probation service officer’s, as well as probationers themselves were participated.

All manuals were distributed during the Training – Seminar held in September 29 – 30 at the Ombudsman’s Office among Prison Commission Representatives, Public Defender’s Office Staff and Probation Officers. The special report will be at the web page of EMPATHY and will be distributed among international and national organizations, the specific roundtable discussion will be held on these reports in the framework of the activities of RCT/EMPATHY in 2008.

Assessment of the results of this activity:

For evaluation and monitoring of the Rehabilitation System following mechanisms were set up:

Centre standardised documentation (Medical Card, Consultation Forms – For Doctors; for social Workers; for psychologist and Psychotherapists; For Art Therapist, For Lawyers, Referral Forms) created.

Centre Treatment and Rehabilitation Standards created in accordance with international standards for Health Care and Ministry of Health of Georgia guidelines.

Centre Medical License obtained from MoH. Elaborated methodology in accordance with International Standards (ICD – 10), Istanbul Protocol and

other relevant health care guidelines. Monthly reporting forms; electronic Data Basa System that includes several items related to the client and to the course of

rehabilitation; Statistical Analysis of Data regarding system; Rehabilitation Includes client’s re – evaluation mechanisms with medical, psychological re – evaluation

with standardised Subjective re – evaluation questionnaire. Following Registration Journals: For Medicines – medicines income and outcome registration and same

outcome registration Journal for each Branch; Medicines Ordering Journal for Doctors and Online ordering software for Nurse.

Used Methodology: Holding of medical and psychological study (diagnostic) program: A) Medical and psychological diagnostic by using the special prepared clinical questionnaires in accordance with ICD – 10: 1. Center "Empathy" questionnaire

- 6 -"Medical and Psycho - Social Monitoring and Rehabilitation Programme for Victims of Torture", apparently with International clients monitoring program of the IRCT/ICAR /Denmark, Copenhagen/ and “Istanbul Protocol”. – clinical/structural Interview method B) Psychological examination by using the following clinical psychological questionnaires: 1. Harvard Trauma Questionnaire. 2. Posttraumatic Stress Disorder Symptoms Questionnaire (for adults - Watson, 1991). 3. Civilian Mississippi Questionnaires (Mollica et al); 4) Shikkhan Anxiety Scale; 5) Buss – Durki Aggressive Scale; 6) MMPI; 7) BDI (Beck Depression Inventory); 8) Hamilton Depression Rate Scale; For Adolescents: Lusher Test and “Hand Test”, as well if appropriate PTSD and other relevant scales will be used. I. Medical and psycho -social rehabilitation for victims of torture and ill - treatment:

A) Psychotherapy Methods: individual, group, family. Types: NLP, Methods of Testimony and "eye movement", Analytical psychotherapy, Psycho - synthesis, Existential analysis, Cognitive - Behavioural, Psychodrama and role player psychotherapy etc.

B) Psychological Support: Psycho - correction, Re - socialization, by using Reality Therapy and Behavioural Therapy methods. Psychological consultations for prisons staff and victims family members as well.

C) Art - Therapy - by using of painting and clay modelling methods. D) Social Therapy: By using the methods of environmental support and case management. Revealing the

current problems and needs of the torture victims (prisoners and former prisoners and their family members or other torture victims and their family members). Providing the support for planning and solving their problems, client advocacy and, in cases of necessity, to collaborate with Governmental and Non - Governmental organizations having more specific directions (legal aid or other) for solving the revealed problems. Creating the Self - Supporting groups among torture victims and an active participation of such groups in social rehabilitation process (participating in the movement against torture, client advocacy or other prevention activities etc). Facilitation activities between prison administration or medical authorities and prisoners for conflict resolution and improvement of general situation in the prisons. Activation of the prison staff, especially health professionals and prisoners' rights protection staff in client advocacy activities.

E) Medical consultation - General Doctor's, Psychiatrists, Neurologist, Traumatologists and other needed

consultations consultations and treatment and rehabilitation, in cases of necessity providing facilitation activities with Ministry of Justice Health system or Ministry of Health several institutions for sending the patients for more specialized relevant treatment.

F) To provide independent Psycho - Physical expertise – conclusion (record) regarding client's health

condition - for Governmental structures (for ex. for Court etc) or non - governmental organizations working in the Human Rights protection sphere, especially for Ombudsman Office. The Independent Medical Records are provided by the multidisciplinary Team of Health Care Specialists in accordance with international standards of torture investigation and documentation (Istanbul Protocol, CPT Recommendations etc).

G) For more specialized service that were not included in the Centre service list the clients were guided in several contracting Medical Service Centres. For comprehensive health care for VT Centre EMPATHY have close collaboration with following Health Care institutions and other contracting authorities :

2) Multiprofile Treatment Centre in Tbilisi – for more specialized investigations, consultations, treatment and instrumentary Investigations.

Centre of Gynecology, TSMU Central Clinic and other relevant health care institutions of MoH; Research Institute of Psychiatry;

7) Independent Medical Forensic Expertise Centre “Vectori” 8) Dermato – Venerology out Patient Clinic 9) Farm Firms: GPS, PSP, for Psychotropic Drags – “Titani”

As well as for more specialized treatment Centre EMPATHY collaborated with Ministry of Health or

independent health institutions;.

- 7 -H) Legal Consultation and assistance – through providing the legal consultations to VT and their

family members outside and inside of the prison institutions, support in appealing to the Court and leading cases that are under investigation;

Re–Evalution of the Client’s Health Condition, Post-Treatment :

Clinical and as needed para - clinical methods. Re–evaluation using psychological questionnaires PTSD tests MMPI Depression and anxiety evaluation questionnaires Using the EMPATHY’s Client’s Subjective Evaluation Questionnaire

For each activity of the RCT/EMPATHY the particularly important are following approaches:

1. Research activities: The statistical date analysis was provided on materials of 2006 and the annual Report was published on these materials and distributed among international and national organizations.

2. The International Training – Seminar (Phase 2) was held in May 31 June 2, 2007 in the framework of the IRCT programme on documentation and investigation of cases of torture. The RCT/EMPATHY was local partner (coordinator) organization and members and partners of the RCT/EMPATHY were involved in this training as trainers too. All relevant manuals were prepared by the IRCT and international partners and adopted by the RCT/EMPATHY, as well as the several presentations and manuals were elaborated by the GMA and RCT/EMPATHY and all materials were published and written on the CD. During this training of trainers programme 12 Legal experts and 12 medical doctors were trained and the experts’ panel was established. Participants were from State and NGO representatives, as well as from Ombudsman Office and Forensic Medicine field representatives too.

3. All this materials were used in the additional ToT training held by the RCT/EMPATHY and GMA at the RCT/EMPATHY office for 13 several specialties doctors from RCT/EMPATHY, GMA and Georgian Psychiatrist’s Society.

4. In addition, it should be mentioned that by the IRCT was invited special mission of experts from Kirgistan for training in the RCT/EMPATHY. The aim of the training was to support in establishment of the Torture Victims Rehabilitation Centre in Kirgistan. The RCT/EMPATHY was provided 3 days training on methodology, organization and capacity building, tactics and strategy of torture victims’ rehabilitation, human resource identification and management. All materials on Russian language were provided from the RCT/EMPATHY to the Colleagues from Central Asia. The Kasagstan Open Society Institute Representative was attending this meeting as well As the result of networking development with Central Asian representatives the RCT/EMPATHY Psychiatrist (Deputy Director) was invited as the international trainer in the Central Asian Regional Seminar – Strategic Litigation on Human Rights on National and International Levels – held in July 20 – 23, 2007 in Almaty, Kazakhstan, were he held several presentations and discussions on Istanbul Protocol and media communication and diplomacy of clients’ advocacy. It should be mention that following international networking developments were conducted during the year 2007L the Project Director was participated as the representative from Georgian Medical association in the General Assembly of the World Medical Association, Held in Copenhagen in October 2007, were the new resolution on prevention of torture was adopted. Training Programme Coordinator from GMA visited the European Doctors’ Standing Committee in Brussels and develops relations for accreditation of the Training Programme according to the European Educational Standards.

- 31 -02.07.2006 – in Kutaisi # 2 Pre – Trial Prison, 03.07.2006- 15.06.2007 - in Kutaisi # 2 Pre – Trial Prison several times ,(it should be mentioned that person was in cell of so called “Katmebi” together with adults) - 1 person; 2006 summer – in Didube- Cughureti Police Station within a day, 2007 March –Tbilisi Central railway nearby territory, within quarter an hour, -1 person; 2007 August spec – operation was conducted in Juvenile’s Colony, as the “preventive measure” massive panic reaction with salve harm reactions among Juveniles was developed that reason was torture and ill – treatment experience or hearing on such actions from each other in different pre – trial prisons (especially from persons with experience of torture in Kutaisi Prison, Juvenile’s Pre – Trial Prison in Tbilisi and Rustavi Prison #6), based on such experience most of the juveniles were expected torture and as the preventive measure they conducted massive self – harm actions, according to widespread opinion among Juvenile prisoners “after the strong self – harm actions the spec forces and other prison regime staff could not use torture and ill treatment measures”. Total Number 9 Juveniles were monitored after this operation in Prison Hospital. Among 9 persons 3 persons were beaten in Kutaisi Prison (2 persons) and 1 person in Rustavi Prison #6 in 2007, other 6 persons declared that were presenting during the beating and ill – treatment of other prisoners being in their Cells.
