INTRODUCTION
Based on Section 82.2 (i), of the Public Procurement Law of Kosova No. 02/L-99,
promulgated with Regulation No. 2007/20, Public Procurement Regulatory Commission (
PPRC ) for each calendar year shall prepare and submit to the Government and Assembly
of Kosova an Annual Report, in which are analysed the activities of public procurement in
Kosova, for that calendar year, together with recommendations for the improvement of
public procurement system and for the improvement of the Public Procurement Law
according to the needs. This report shall be provided to the Government and Assembly of
Kosova no later than the end of February of the following calendar year.
Public Procurement Regulatory Commission based on the request of the above
mentioned section of the Public Procurement Law, has prepared on time the Annual Report
for 2008, and the same report shall be send to the Government of Kosova and to the
Assembly of Kosova.
This report has been prepared in full compliance with the requirements of the Public
Procurement Law No. 02/L-99, presenting in considerably detailed analysis on all public
procurement activities developed in Kosova, according to public contracts signed during
the period January 1st, 2008 until December 31
st, 2008.
Preparing this report fulfils the requirement of Section 82.2 (h) of the Public
Procurement Law, according to which the PPRC must collect, analyse and publish
information for public procurement procedures, and public awarded contracts.
This is the fourth year that PPRC prepares such report, trying to advance it every
year, and to complete it as much as possible, in order that the Government and the
Assembly of Kosova have better view to all procurement activities in Kosova conducted
during 2008. This report will be also very welcomed for all international financial
monetary institutions that operate in Kosova, because they will have available such
material in which are included public procurement activities in Kosova according to the
financial resources, values of the procurement contracts, types of procurement activities,
and procurement procedures. The report shall also be useful for various donators who in the
future intend to invest in Kosova, since that based on the data of Report it can be stated that
77.40 % of the budget for public procurements in Kosova during 2008 were spent through
open procedures that are known as the most transparent procedures.

1. PUBLIC PROCUREMENT REGULATORY COMMISSION
Public Procurement Regulatory Commission of Kosova has been established based
on section 81 of Public Procurement Law No. 2003/17, which has entered into force on
June 9th, 2004. PPRC has started to function on February 3
rd, 2005. With the amendment of
Public Procurement Law, by the Assembly of Kosova on February 8th, 2007 promulgated
by the Regulation No2007/20 on June 6th, 2007, duties and responsibilities of Public
Procurement Regulatory Commission changed adapting to the requests arising by two
Procurement Directives of EU No. 2004/17 and 2004/18, and circumstances that have
occurred in Kosova in public procurement field during the period of 2004-2006
According to the Public Procurement Law of Kosova No. 02 - L/99, Public
Procurement Regulatory Commission:
• Shall be responsible for the overall development, operation and supervision of the
public procurement system in Kosova;
• Establish detailed rules to ensure the proper implementation of the PPL;
• Provide and publish written interpretations, and offers technical help and advice to
the contracting authorities and economic operators for the implementation of the
PPL provisions;
• Establishes and maintains informative web-site on the net that offers to the public
unlimited access on the data of public procurement in Kosova, and enables the
improvement of publications required according to the PPL;
• Supports KIPA and other training and educational public authorities to ensure
training and to increase skills of public procurement officers in Kosova;
• Initiate and support the development of electronic procurement and communication
within the field of public procurement;
• Collect, analyse and publish information about public procurement procedures and
all awarded public contracts in Kosova;
• Cooperate with other organisations at home and abroad on matters associated with
public procurement;
• Proposes to the Government and Assembly measures for improvements of public
procurement system, and improvement of this Law;
Public Procurement Regulatory Commission is managed by the Board which is
comprised of five members, which are proposed by the Government and appointed by the
Assembly of Kosova. With amendments made in PPL it is foreseen that the Board of PPRC
in future have 3 permanent members, whereas each member of PPRC that is in function
from December 31st, 2006 shall continue to serve in that position until the end of his
mandate, as foreseen in the procurement legislation that was in force at the time of its
nomination.

2. PUBLIC PROCURTEMENT ACTIVITIES IN KOSOVA DURING 2008
Based on Section 82.2 (n), of the Public Procurement Law of Kosova No. 02/L-99,
Public Procurement Regulatory Commission should prepare and maintain a comprehensive
list of all contracting authorities in Kosova that are obliged to implement the Law on Public
Procurement. On January 1st, 2008 in Kosova were 137 contracting authorities, while on
December 31st, 2008 the number of these contracting authorities has increased to 142.
Through this annual report for public signed contracts, which the contracting
authorities during January 2009, have sent in electronically, the IT department has prepared
the summary annual report for all public procurements conducted in Kosova during 2008.
From altogether 142 contracting authorities that have existed in Kosova at the end of
2008, 135 contracting authorities have submitted on time the annual reports to the PPRC, 4
contracting authorities have not conducted any procurement activity during 2008, whereas
3 contracting authorities that have not sent the annual report at all. The contracting
authorities that have not sent the annual reports are only three municipalities from the
northern part of Kosova - the municipalities of Zvecan, Zubin Potok and Leposavic. The
foreseen budget to be spent for the procurements for these three municipalities according to
the KCB during 2008 is 1.304.524 €, that participate only with 0, 16% in overall value of
public signed contracts for 2008.
Based on all reports sent by contracting authorities, in PPRC it is noticed that during
2008 all over Kosova were signed 14317 public contracts conducted according to the
Public Procurement Law of Kosova including all types of procurement values.
Further to this report we will present public procurements in Kosova according to
contract that were signed during 2008. Taking as a base the report of the previous year
where for the first time has been prepared a general report on the procurement activities
conducted in Kosova, based according to the PPL requirement, this report shall present
procurement activities, respectively all signed contracts by the contracting authority, and by
presenting an analyse of public procurements according to the financial resources, type of
contracting authorities, according to the type of contracts, the value of the contracts, the
procedures used, the economic operators awarded with the contract, deadlines of
publication and contract award criteria. Therefore, this report will reflect the ongoing
activities of all public procurement conducted in 2008 in Kosova, analysing and comparing
with the previous year, so we see the trend of development of the procurement activities
conducted in Kosova.

2.1. PUBLIC PROCUREMENTS ACCORDING TO THE CONTRACTING
AUTHORITIES DURING 2008

Based on the signed contracts according to the contracting authorities in table 1 and
graphic 1, it is noticed that at the budgetary units - Governmental during 2008 has
increased the number of contracts signed compared to the previous year to 2.45%.At public
companies has decreased the number of contracts signed for 25.05%, while at other
authorities NGOs, are represented only 4 contracts signed, and compared with the previous
year we have reduction of their number to 77, 78%.
The total number of contracts signed based on the Public Procurement Law in Kosova
during 2008 is 14317, and compared with the previous year is represented a decrease of
5.92%.

Graphic 2 presents the percentage of the participation of the contract signed during
2008 in total according to the type of contracting authorities. Budgetary governmental
organizations participate with 76.01%, public companies with 23.96%, while the other
authorities - NGOs with only 0.03% in the general structure of signed contracts.

Based on classification of the contracting authority under contracts signed during
2008, in table 2, and graphic 3, the value of the procurement budgetary units -
Governmental is 456,695,720.32 €, which compared with the previous year we have an
increase of 143.62%. At public companies this value is 369,627,159.60 €, where growth in

the percentage is of 72.87% compared with the previous year, while at other authorities -
NGOs, the value of contracts signed is 160,682.75 €, and compared with the previous year
appears the decrease in percentage of 82.92%.

Graphic No. 4 represents the percentage of the participation contract signed by the

According to the financial resources table 3, and graphic 5, it is noticed that from self
incomes, during 2008 have signed 3298 contracts, compared with the previous year, it
represented a reduction in the percentage of 26.55%. From the Kosova Consolidated
Budget number of signed contracts during 2008 reaches 10,875, compared with the
previous year is represented by increase of 3.6%, whereas the number of contracts signed
funded by donations is 144, compared with the previous year we have a reduction of 36 ,
56%.

financial resources during 2008. From self incomes this percentage is 23.00%, from the
Kosova Consolidated Budget 76.00%, while from donations only 1.00%.

During 2008 according to the financial resources in table 4, and graphic 7 from self
incomes the value of signed contracts is 145,264,989.52 €, compared with the previous
year we have a reduction of 0.38%. From the Kosova Consolidated Budget the value of
contracts signed is up to 676,563,199.06 €, compared with the previous year we have an
increase of 170.46%, while from donations the value of contracts signed is up to
4,655,374.09 €, compared with the previous year we have a reduction of 25, 63%

Consolidated Budget, 81.86% whereas from donations this participation is only 0.56%.

Based on the number of contracts signed during 2008 according to the type of
procurement in table 5, and graphic 9, it can be stated that for the supplies are signed 9169
contracts, or 15.66% less compared with the previous year. For the services are signed
3601 contracts, compared with the previous year we have an increase of 16.73%, for design
contest have signed 62 contracts during 2008, and with an increase compared with the
previous year of 3.33%. While the number of contracts signed for works during 2008 is up
to 1485, compared with the previous year we have an increase of 23.65%.

In Table 6, and graphic 11 where is presented the value of signed contracts according
to the type of procurement, during the year 2008, for supplies the value is up to
334,982,809.59 €, compared with the previous year we have increase of 38.06%. The value
of contracts signed for services is € 44,243,562.12, compared with the previous year we
have increase of 49.97%. The value of contracts signed for design contest is 845,583.04 €,
compared with the previous year we have reduction of 80.09%, while the value of contracts
signed for work is up to 446,411,607.92 €, compared with the previous year we have
increase of 254.76%.

Public procurement divided according to the type of values during 2008 and table 7
and graphic 13 show that according to the large value, number of contracts signed is 858
and compared with the previous year we have an increase in the number of these contracts
for 28.44%. Number of contracts signed with medium value is up to 2557, compared with
the previous year we have increase of 14.87%. Number of contracts signed with the small
value is 4429, respectively in comparison with the previous year we have a reduction from
9.48% in the number of contracts signed, which represents a positive trend, given that the
price quotation procedure that is used for these values is not sufficiently transparent. The

According to graphic No. 14, it is noticed that during 2008, contracts of large values
participate with 6.00%, in general number of signed contracts. Contracts with medium
values participate with 18.00%, those with small values participate with 31%, whereas at
the contracts with minimum values the participation is 45% in the general structure of
contracts signed during 2008.

contracts signed during 2008 is 680,198,284.54 € and compared with the previous year we
have an increase of 137, 39%.Signed contracts with medium value in 2008 are up to

value of contracts signed with a small value is 23,599,031.30 € compared to the previous
year we an increase of 3.38%, while compared with the double value of procurement in
relation to the previous year, so this indicates a highly positive trend of reduction of these
procurements. The value of contracts signed with the minimum value during 2008 is
3,529,294.97 €, compared with the previous year we have an increase of 16.54%, whereas
compared with the double value of procurement in relation to the previous year, so this
shows a very positive trend of reduction of these procurements.

According to graphic No. 16 it is noted that the participation of contracts with large
value in general value of contracts signed is 82.30%. Contracts with medium value
participate in the general value of signed contracts with 14.42%. Contracts with small value
participate in the general contracts signed with 2.86%, while contracts with minimal value
participate with 0.42%.

25.37%. During 2008 we do not have any contract presented by the contracting authority

negotiated procedure during 2008 is 485, compared to the previous year we have increased
the number of these contracts for 16.59%.
Number of contracts signed according to price quotation procedure during 2008 is
up to 3726, with a decrease compared with the previous year of 15.43%.Number of
contracts signed by minimum value procedure during 2008 is 6437, compared with the
previous year we have a decrease of the number of signed contracts for 13.38%, and the
number of contracts signed that result from design contest during 2008 is 62, compared
with the previous year we have an increase of 3.33%.

general structure of the contracts signed for 2008 is 25.19%. Participation of negotiated
procedures is 3.39%, while participation of procedures under the price quotation procedure
is 26.03%. Procedures according to the minimum value participate with 44.96%, while the
design contest participates only with 0.43% in general signed contracts during 2008.

negotiated procedure during 2008 is 164,156,690.61 €, compared with the previous year
we have an increase of 227.31%.Value of contracts signed according to price quotation
procedure during 2008 is 18,288,457.42 €, respectively 11.93 % less than the previous
year. Whereas according to the minimum value contracts the value of contract during
2008 is 3,513,627.82 €, compared with the previous year we have an increase of 16.02%,
but in relation to the double value of contracts during 2008, we have a positive trend for a
reduction in the value of contracts under this procedure. The value of contracts signed
according to design contest during 2008 is 845,583.04 €, compared with the previous year
we have an increase of 368.05%.

before starting the procurement activity must ensure that funds for that procurement
activity are provided based on the calculated value of the relevant project. From table 12
we can notice that the estimated value for all public procurement activities in Kosova for
2008 was 900,203,954.31 €, whereas the value according to the signed contracts was
826,483,562.67 €. Budget savings in all public procurement activities in Kosova for 2008
are 73,720,391.64 €, or expressed in percentage we have a budget saving for 8.92%. This

Comparing contracts signed during 2008, divided according to the contract award to
local and non-local economic operators, in table 13, graphic 22 and 23, arise that the
number awarded to local operators is 14,010, compared with the previous year we have the
decrease of contracts number for 6,52%, whereas the participation in the general number of
signed contracts during 2008 is 98, 00%. While the number of contracts signed during 2008
by non-local operators is 307, compared with the previous year we have an increase of
32,90% of these contracts and with participation from 2.00% in the general structure of
signed contracts during 2008.

€, compared with the previous year we have increased the value of contracts for 115,57%,
while the participation in the general value of contracts signed during 2008 is 71.03%.
While the value of contracts signed during 2008 by non-local operators is 239,466,169.09
€, compared with the previous year we have an increase of 84,32% of the value of these
contracts and with the participation of 28,97% in the general structure of contracts signed
during 2008.

3. ACTIVITIES OF PUBLIC PROCUREMET REGULATORY COMMISION
The Public Procurement Regulatory Commission was successfully in cooperation with
OECD /SIGMA from Paris, during September 2008 has organized Regional Conference in
Pristina, with the topic “Public Procurement Reform in Western Balkans" with particular
concentration on the key challenges and priorities for change. This was one of the most
important events in the field of public procurement in all Europe during 2008. Participants
of the conference were the representatives of state institutions on public procurement from
the Western Balkans region as: Albania, Bosnia and Herzegovina, Croatia, Kosova,
Macedonia, Montenegro, Turkey, then the representatives of EC from Brussels OECD /
SIGMA from Paris, and representatives and procurement experts from different countries
of Europe.
During 2008, Public Procurement Regulatory Commission based on the competences
arising from Section 82.2 (a) of the Law on Public Procurement No. 02-L/99, has compiled
and promulgated the entire secondary legislation in accordance with the amended Law on
Public Procurement which entered into force on 6th, June 2007.

Through Supervising and Monitoring Department, Public Procurement Regulatory
Commission during 2008 has accomplished complete supervision and monitoring of the
procurement activities according to the annual plan, inspection according to the request or
according to the case, monitoring of the public opening and interpretations of the PPL
sections for the needs of the contracting authorities or economic operators.

During 2008, the PPRC’s Supervising and Monitoring Department has accomplished:
• 12 Monitoring and supervisions of the procurement activities in the CA according
to the plan.
• 5 Monitoring – Inspections of the procurement activities according to the request.
• 7 Observations of the public opening.
• 13 Replies to requests for interpretations of the PPL. During 2008, training for public procurement has continued to be held in close
cooperation with the Kosova Institute for Public Administration in Kosova.
Training in the field of public procurement conducted during 2008 has been focused
on amendments of the Public Procurement Law, in the manner of functioning of public
procurement official site of Kosova, and in a manner of the fulfilment of the standard
procurement documents. For this purpose were held ten training sessions with ten groups of
the participants of procurement officers. The participants of these trainings were the
procurement officers of all contracting authorities in Kosova, including Kosova's
Governmental institutions, public companies and several NGOs. Testing was held on
December 23rd and 24
th, 2008 in the premises of KIPA, whereas the testing have
successfully passed 431 procurement officers that have gained procurement professional
certificate for 2009.
2008 is the fourth year that according to the requirements of the PPL that the training
and certification of public procurement officers in Kosova has been carried out. If you
compare the four year performances since 2005 until 2008, regarding the training in the
field of public procurement, it can be concluded that each year the number of trained
officers has increased. While in 2005 this number was 302, in 2006 has grown to 360, in
2007 to 414, and 431in 2008.

According to data presented in graphic, during 2006 compared to 2005, the number of
certified officers has increased to 58, or expressed in a percentage of 19%, during 2007
compared to the year 2006 the number of certified officers has increased to 54, or
expressed in a percentage of 15%, while during 2008 compared with 2007, the number of
certified officers has increased to 17, or expressed in a percentage of 4.1%.
Department of Information Technology and Statistics at the PPRC has begun to
publish contract notices in the website from July 2007, continuing during 2008 which we
are presenting in the following table.

As seen from table 1 and graphic 1, the number of all reports published during 2008 is
9463. Contract notice, the number of publications is 4566, while the contract award notice
3160, Cancellation notice 1612, Indicative notice 36, design contest notice 56, design
contest result notice 23, Request for expressions of interest 8, and design contest notice
opening of financial offers 2. Notices published in web web-site most of them are
established in the system by the contracting authority and a part of them are sent in
electronically and are controlled and published by the procurement IT Department.

Graphic 35 reflects the structure or the participation of cancellation reasons of tenders
during 2008. As noted 82% of the cancellation reasons were that less than 3 responsive
tenders or requests to participate were received.
Based on Executive Decision No. 2008 / 1, dated 18 January 2008, the SRSG
authorises PPRC in the exercise of PRB functions until March 31st, 2008, and later on April
30th
with the amendment of Executive Decision No. 2008 / 1, this authorisation was
extended to the PPRC until June 30th, 2008
According to the authorisations noted above, the PPRC’s Review Panel has been
reviewing complaints in public procurement in Kosova until the 30th June, 2008. For this
period the Review Panel has prepared a report on the review of complaints, which has also
published in the official web-site of public procurement in Kosova, in three language
versions(www.ks-gov.net/krpp).
PPRC has officially sent to the PRB a copy of this report on the review of complaints
by the PPRC’s Review Panel for the period January to June 2008, in order that the PRB
can prepare an Annual Report, according to the request of Section 115 of the PPL, to
prepare an annual report completed for the entire year of 2008, and also to compare it with
the previous years.

4. RECOMMENDATIONS ON IMPROVING PUBLIC PROCUREMENT SYSTEM
IN KOSOVA
Legislation in force on public procurement in Kosova constitutes a modern base for the
functioning of public procurement system in Kosova. Law on Public Procurement covers in
detail the public procurement process from all aspects, from procurement planning up to
the signing of the contract. Law covers governmental institutions, and public companies,
including all types of procurement for goods, works, services and the design contest. The
law also contains provisions for supervision and monitoring of procurement activities, as
well as provisions on the complaints review.
Section 82.2 (i), of the PPL besides that requires by the PPRC the preparation of the
annual report, that analyses public procurement activities in Kosova, also requires to attach
to this report the recommendations for improving public procurement system in Kosova,
and the improvement of Public Procurement Law according to the needs.
Based on the analyse of the report on public procurement activities in Kosova for 2008, in
the monitoring and inspections conducted during 2008, and the comments that PPRC has
received by the contracting authorities of Kosova regarding the manner of the
implementation of the Public Procurement Law in practice, PPRC recommends measures
on improving and advancing the public procurement system in Kosova.
Even though within a very short period of time in the field of public procurement in
Kosova have been achieved significant results, and taking into account the fast
development and advancement that are happening in the field of public procurement in the
EU, and in the international organizations of public procurement and in order that Kosova
moves parallel to these developments, it is essential to undertake these steps in the future:
- To amend the PPL as often as possible, according to the needs of time and not after a
three-year period, as has happened in the period 2004-2007.
In the further amendment of PPL, that it would be reasonable to commence during 2009
and include sections that cover:
- To interfere in the Public Procurement Law and in the Law of Ministry of Foreign
Affairs, regulating by law the matter of procurement that relate to the Kosova
Diplomatic Missions in various countries of the world.
- To simplify the existing law, by transferring some parts in the secondary legislation.
- To prepare a special regulation that regulates procurement activities in the sector of
public companies based on the EU Directive No. 2004/17.
- The manner of complaints review should be regulated by law, in a manner that appeal
should be previously addressed by the concerned contracting authority, before
addressing it to the PRB.
- Within the following amendment of the PPL, to eliminate Section 30A.4, which
makes it obligatory to receive three responsive, offers.

- That the contracting authorities of Kosova implement the procedures and
procurement rules that promote an efficient procurement; based on modern practices
of procurement and new technology, such as framework agreements and electronic
procurement.
- In the future the training in public procurement should be reduced from 10 to 5 days,
expanding officer’s base for the training.
- Amendment of Section 23 of Public Procurement Law No. 02/L-99
- The validity of public procurement licence to be extended from one to three or five
years.
- Increasing skills and training the staff who deal with public procurement in private
sector, regarding the manner of completion and submission of bids, and especially on
the manner of preparation and filing a complaint by dissatisfied bidders with the
contract award .
- Raising awareness on public procurement in contracting authorities and economic
operators of Kosova.
- Increasing access to information on public procurement in Kosova for all interested
parties.
- Offering more support to the central institution of public procurement in Kosova as a
bearer for development of the system.
- To consider the possibility on reducing the tendering deadlines for contracts with
large values from 40 to 30 days, whereas for medium value contracts from 25 to 20
days.
- Taking into account that PPL makes responsible the Procurement Manager of a
contracting authority to implement the Law, to consider the possibility of his
protection from the influences that can be imposed to him during the conduction of
the procurement activities.
- To look at the possibility that by the law the right for signing contracts for the
procurements of medium and large values to be transferred from the procurement
officer to the MAO.
- Simplification of the procurement procedures that deal with the manner of
commitment of budgetary means before the inception of the procurement activity.
- Maximal use of restricted procedures for the realisation of the procurement activities,
especially at the procurements that deal with public companies.
- To reduce as much as possible the use of contracts with minimal values using public
framework agreements and centralised procurements.
- Further advancement of the official electronic web-site of public procurement, that
enables to raise the transparency in public procurement.

5. ANNEX: PPRC’s BUDGETARY SPENDING FOR 2008
For accomplishment of the activity foreseen with the Public Procurement Law of
Kosova, during 2008, PPRC has spent the budgetary amount of 311,545.63 €.

amount of 330,170.30 € it has been spent 94 %. In the part of the budget that has not been
spent has influenced the part of wages, non fulfilment of some vacancies, and non
