Report on Internal Review of Remunerationsof Senior Executives of Government-Funded Bodies
Introduction
In January 2002, the Chief Secretary for Administration announcedthat the Government would embark on a review of remunerations of seniorstaff of government-funded bodies. The review was conducted internallywithin the Administration, as a separate exercise from the consultancy studyof remunerations of senior executives of ten selected statutory and otherbodies. Findings of the consultancy study were reported to the LegislativeCouncil in mid 2002. This report sets out the review results arising from thetwo-stage review of government-funded bodies.
Objective
2. The internal review aims to ascertain whether the number, rankingand remuneration packages of senior executives of major government-fundedbodies are appropriate in present day circumstances. A Steering Committee,chaired by the Chief Secretary for Administration, was set up to oversee theexercise. The main tasks of the Steering Committee include:
(a) to determine whether the ranking and remuneration packages ofthe senior executives under study are appropriate in present daycircumstances, drawing reference to the original policyconsiderations when these posts were first established;
(b) to determine whether the number of staff employed at the topthree tiers of the bodies under study are excessive; and
(c) to determine the strategy to redress identified discrepancies withestablished policies or guidelines, or impropriety such as over-payment vis-à-vis comparable civil service ranks or marketpractices, as the case may be.

Review Approach
3. The review adopted a two-stage approach. At Stage I of theexercise, relevant Bureaux conducted a brief examination of the staffing andfunding positions of all government-funded bodies under their purview.Based on the information collected by the Bureaux, the Steering Committeedecided on the bodies to be selected for detailed examination under Stage IIof the exercise. For each of these selected bodies, the responsible Bureauconducted in-depth review and made recommendations related to theremuneration arrangements for its top three-tier executives.
Stage I of Review
4. Over 300 bodies or groups of bodies were examined by relevantBureaux under Stage I of the review. The full list of these bodies is atAnnex A. The Steering Committee considered the Bureaux’ returns onthese bodies and decided that the following types of organizations should beexcluded from further stages of the exercise:
(a) 194 bodies or groups of bodies (Annex B) that are servicedentirely by civil servants and have not employed their ownexecutive staff e.g. appeal boards and advisory committees;
(b) 32 bodies or group of bodies (Annex C) that have not receivedany form of Government funding e.g. trust funds and registrationboards;
(c) 41 bodies or groups of bodies (Annex D) covering -
(i) bodies that receive only limited Government funds assubsidy for their administrative expenses and/orsecretarial service e.g. village offices and mutual aidcommittees;
(ii) cases where Government funds are for ‘procuring’specified services or activities e.g. management of Mai

(iii) organizations that are subject to special funding and/orremuneration policies or are already under separatereview, hence rendering a general review not appropriatee.g. the UGC-funded institutions and those schoolsreceiving recurrent funding under specific rules;
(iv) cases where Government funds represent not more than50% of their operating and staff costs e.g. the FamilyPlanning Association and uniform groups; and
(d) 15 bodies or groups of bodies (Annex E) that have receivedonly capital or other non-recurrent financial assistance, i.e.without any recurrent subvention from the Government e.g. theOcean Park Corporation Board and the Hong Kong Arts Centre.
5. The Steering Committee took account of the outcome of the Stage Iexercise and decided that the 20 subvented bodies at Annex F should besubject to detailed examination under the Stage II review. These 20 bodieshave:
(a) received and relied on Government recurrent funding as theirmain source of income, i.e. the Government’s recurrentprovisions amount to more than 50% of their operating and staffcosts; and
(b) employed their own executive staff and derived separateremuneration packages for their senior executives.
Stage II of Review
6. During Stage II of the review, for each of the 20 selected bodies, theresponsible Director of Bureau was required to:
(a) examine the remuneration packages of senior executives at the

top three tiers; and
(b) provide detailed information and assessment on theappropriateness of the remuneration policy and arrangementsfor its senior executives in present day circumstances.
The Bureaux’ returns provided the basis for the Steering Committee todetermine whether the number, ranking and remuneration packages of seniorexecutives in these bodies were appropriate, and whether actions should betaken to rectify irregularities so identified.
Review Findings
7. The 20 subvented bodies under the Stage II review were found to beemploying over 59,000 staff, including over 190 executives at the top threetiers of their respective organizational structure. Having considered thedetailed submissions from the relevant Directors of Bureaux, the SteeringCommittee agreed on the following broad findings for the 20 bodies:
Group I No change to the remuneration packages or seniormanagement establishment (13 bodies)
Group II Further separate reviews to be carried out (three bodies)
Group III Changes should be made to the remuneration packages orsenior management establishment (four bodies)
(a) Group Bodies – No Change
8. This group comprises 13 subvented bodies including: theOmbudsman, Duty Lawyer Service, Consumer Council, Guardianship Board,Privacy Commissioner for Personal Data, HK Academy for Performing Arts,HK Council on Smoking and Health, Society for the Aid and Rehabilitationof Drug Abusers, HK Applied Science & Technology Research Institute Co.Ltd., HK Jockey Club Institute of Chinese Medicine Ltd., HK ChineseOrchestra Ltd., HK Dance Company Ltd. and HK Repertory Ltd.
9. The Steering Committee accepted the recommendations of the

responsible Directors of Bureaux (and the Director of Administration in thecase of the Ombudsman and Duty Lawyer Service) that the establishment,ranking and remuneration packages of senior executives in the 13 bodiesshould be appropriate in present day circumstances. The SteeringCommittee concluded that no change to the current remunerationarrangements for these bodies should be necessary in the context of theinternal review.
(b) Group II organizations – Further Separate Reviews
10. Three subvented bodies fall under this group: the Vocational TrainingCouncil (VTC), Employees Retraining Board (ERB) and Equal OpportunitiesCommission (EOC).
11. The Steering Committee noted that the existing remunerationpackages of the senior staff in the Vocational Training Council andEmployees Retraining Board comply with the ‘no better than’ principle underthe existing subvention guideline. In anticipation of the proposedestablishment of a Manpower Development Committee (MDC), originallyscheduled for 2003, the Steering Committee accepted the Secretary forEducation and Manpower (SEM)’s recommendation that the organizationalset-up and the staff remuneration packages for these two bodies should bereviewed in tandem. With the recent establishment of the MDC in late 2002,the SEM would conduct the review accordingly, having regard to theprogress of the taking over of the functions of the two bodies by the MDC.

The Secretary for Home Affairs (SHA) has examined theremuneration of the top three-tier executives of the Equal OpportunitiesCommission (EOC) and confirmed that the arrangements for staff at thesecond and third tiers were in order. However, the SHA has decided toconsider the remuneration arrangement for the Chairperson of theCommission in the light of the outcome of the current proposal to legislateagainst racial discrimination, as such legislation may have a significantimpact on the work of the Chairperson.
(c) Group III Organizations – Changes to be Made

13. There are four subvented bodies in this group: the Hong KongPhilharmonic Society Ltd. (HKPSL), Hong Kong Arts Development Council(HKADC), Hong Kong Sports Development Board (SDB) and HospitalAuthority (HA). The Steering Committee accepted the recommendations ofthe relevant Directors of Bureaux as summarized below:
(i) HKPSL
14. The Steering Committee endorsed the SHA’s recommendation ofdowngrading three of its four Assistant General Manager posts (equivalentto MPS point 33-43) at the second tier to the third tier as Senior Managers(MPS point 27-32), leaving only one Assistant General Manager as deputyto the General Manager. This change would bring the managementstructure of the company more in line with three of the other performinggroups. The SHA would follow up the matter.
(ii) HKADC
15. Although the full cost of the remuneration package of the ChiefExecutive post was not higher than that of a D2 officer, the SteeringCommittee endorsed the SHA’s recommendation that the Council should beasked to split the salary component into base salary, cash allowance andgratuity in the next contract of the Chief Executive. Subsequently, theCouncil agreed and the salary component has been split into base salary,cash allowance and gratuity in the new contract of the Chief Executive.
(iii) SDB
16. The Steering Committee noted the SHA’s findings regarding theremuneration packages of four existing senior staff posts. The SHA wouldfollow up the matter and modify the remuneration packages for the seniorposts as appropriate.
(iv) HA
17. The Steering Committee noted the decision of the FinanceCommittee in 1991 regarding the remuneration of staff of the HA and therelevant provisions in the HA Ordinance. The Committee also noted thefindings of the Secretary for Health, Welfare and Food (SHWF) regardingthe existing remuneration packages of the HA and its proposal for changes.The Steering Committee endorsed the SHWF’s view that the new guidelines

which the Steering Committee has derived separately for the control andmonitoring of remunerations of senior staff of subvented bodies should notapply to the HA.
Conclusion
18. With the support of the relevant Directors of Bureaux, the SteeringCommittee completed the internal review of remunerations of seniorexecutives of government-funded bodies in end 2002. For the majority ofthe bodies reviewed, the number, ranking and remuneration packages oftheir senior executives were found to be in order. For those cases wherefurther reviews should be conducted or changes have been proposed, theresponsible Directors of Bureaux undertook to take follow-up actions in atimely manner.
