Introduction

Pursuant to section 40 of The Legislative Assembly Act, 2007, Mr. Tim McMillan vacated his seat in the constituency of Lloydminster effective September 30, 2014.

On October 16, 2014 pursuant to an Order of the Lieutenant Governor in Council, a writ of election was issued by the Chief Electoral Officer to Josephine Taylor, Returning Officer for the constituency of Lloydminster. The writ ordered that a by-election be held on Thursday, November 13, 2014.

At the time of the November 13 by-election, standing in the Legislative Assembly was: 48 Saskatchewan Party, 9 New Democratic Party and 1 vacant.

Constituency of Lloydminster Boundaries

The boundaries of the constituency of Lloydminster were enacted in 2002 under The Representation Act, 2002 on the recommendation of the Constituency Boundaries Commission, as established under The Constituency Boundaries Act, 1993. Polling divisions for purposes of the by-election included 40 regular polls and one mobile poll. The constituency of Lloydminster polling division map is included as Appendix I.

Lloydminster Candidate Nomination

Pursuant to Section 231 of The Election Act, 1996, Elections Saskatchewan recognized six political parties in the Register of Political Parties. Nomination of candidates concluded on October 28, 2014 at 2 p.m. Central Time (2 p.m. Mountain Time). At close of nomination, five of the province’s Registered Political Parties had nominated candidates:

Enumeration

From October 17 to October 25, 2014, enumeration was conducted for the constituency’s 40 polling divisions and one mobile poll. The enumeration was conducted according to regulations set out in The Enumeration Regulations – which required the enumeration to be conducted within the writ period and not before it. Pursuant to these regulations, the voters list remained open for revision until 10 p.m. on November 8, 2014. Following the revision period, 7,076 constituency of Lloydminster residents were on the Revised Voters List. Eligible electors not on the voters list were able to vote by completing a declaration form upon showing the proper identification.

Polling

Advance polls were held on November 6 to 10, 2014 at three locations: • Constituency of Lloydminster Returning Office, Lloydminster • Kinsmen Community Hall, Paradise Hill • Pierceland Community Centre, Pierceland

Pursuant to section 132 of The Election Act, 1996, advance polls held on a weekday (November 6, 7 and 10) were open from 3 p.m. to 10 p.m. Central Time (2 p.m. to 9 p.m. Mountain Time). The advance polls held on Saturday, November 8 and Sunday, November 9 were open from 12 noon to 7 p.m. Central Time (11 a.m. to 6 p.m. Mountain Time).

Regular polling stations were open from 9 a.m. to 8 p.m. Central Time (8 a.m. to 7 p.m. Mountain Time) on by-election day.

Eligible voters unable to attend an advance or regular poll were entitled to vote by absentee ballot.

Mobile polls were held at Jubilee Care Home in Lloydminster from 10 a.m. to 1 p.m. Central Time (9 a.m. to 12 noon Mountain Time) and Paradise Hill Care Home from 2:30 p.m. to 4:30 p.m. Central Time (1:30 p.m. to 3:30 p.m. Mountain Time) on by-election day. A hospital poll was established and operated at Lloydminster Hospital from 1 p.m. to 5 p.m. Central Time (12 noon to 4 p.m. Mountain Time) on by-election day.

Electoral Results

Unofficial electoral results were reported on the evening of November 13, 2014 resulting in Ms. Colleen Young of the Saskatchewan Party being declared Member-Elect.

On November 25 the constituency Returning Officer conducted the Final Count, which included votes cast by way of absentee ballot. Upon completion of the Final Count, the Returning Officer made a Return to the Writ of Election on December 6, 2014. The Chief Electoral Officer published notice of the receipt of the Return to the Writ and the name of the candidate elected in The Saskatchewan Gazette on December 12, 2014.

Registered Political Party and Candidate Financial Reporting

Pursuant to section 251 of The Election Act, 1996, audited Registered Political Party’s Return of Election Expenses, Form E-524, were required to be filed with the Chief Electoral Officer within six months after by-election day (May 14, 2015). Under Section 261 of The Election Act, 1996, candidates were required to file an audited Candidate’s Return of Election Expenses, Form E-412, with the constituency Returning Officer, subsequently to be forwarded to the Chief Electoral Officer within three months of polling day (February 13, 2015). Pursuant to Section 261 of The Election Act, 1996, the constituency Returning Officer published, in the prescribed form, a summary of all returns respecting candidate election expenses in the Lloydminster Booster on June 22, 2015.

i) Registered Political Parties The maximum amount of money that could be spent by a Registered Political Party in the constituency of Lloydminster by-election, as established in Section 243 of The Election Act, 1996, was (a) the sum of $46,419.00 or (b) the sum obtained by multiplying the number of voters on the voters list by $3.73, whichever sum was larger.

A Registered Political Party that endorsed a candidate who obtained 15 percent or more of all valid votes cast in the by-election and whose Chief Official Agent filed a Registered Political Party’s Return of Election Expenses pursuant to Section 264 of The Election Act, 1996, was entitled to a reimbursement of a portion of its eligible election expenses from the Province’s General Revenue Fund. The amount reimbursed to a qualifying party was one-half of its election expenses.

The duly audited Registered Political Party’s Return of Election Expenses for the constituency of Lloydminster by-election were received by the deadline. Contributions made to political parties are not listed in the Registered Political Party’s Return of Election Expenses but are set out in each party’s fiscal period return, filed in accordance with Section 250 of The Election Act, 1996. Appendix II

sets out a summary of election expenses incurred by the Registered Political Parties in the constituency of Lloydminster and the amounts paid in respect to each party who qualified for reimbursement.

ii) Candidates Candidates seeking election in the constituency of Lloydminster by-election were limited in the amount of money they could spend. A candidate seeking election was entitled to spend, pursuant to Section 252 of The Election Act, 1996, either (a) the sum of $55,780 or (b) the sum obtained by multiplying the number of voters on the voters list by $3.73, whichever sum was larger.

A candidate who obtained 15 percent or more of all valid votes cast in the by-election and whose business manager filed with the constituency Returning Officer a Candidate’s Return of Election Expenses, pursuant to Section 265 of The Election Act, 1996, was entitled to reimbursement of a portion of his or her eligible election expenses. The amount reimbursed to a qualifying candidate was an amount equal to 60 percent of the candidate’s election expenses, to a maximum of $34,468. The candidate election expenses are viewable on the Elections Saskatchewan website at www.elections.sk.ca. The returns may be viewed as they were filed and as reviewed.

Three of the five candidates filed their returns respecting contributions received and election expenses incurred in the course of the by-election, duly audited, on or before the respective deadlines. The Green Party candidate and the N.D.P. candidate asked for and received extensions from the Chief Electoral Officer to prepare and file their return. The Green Party candidate filed on May 8, 2015 and the N.D.P. candidate filed on March 5, 2015. On July 17, 2015, Elections Saskatchewan published in The Saskatchewan Gazette (Vol. 111, No. 29) a summary of candidate contributions received and expenditures incurred in the constituency of Lloydminster, as well as the amounts paid to each candidate who qualified for reimbursement. Such contributions, expenditures and reimbursements are reported in Appendix III.

iii) Auditors The reporting requirements and the responsibility assumed through consenting to appointment as auditor of a registered political party or candidate includes reporting in writing to the chief official agent or business manager on the respective election expenses return prepared on behalf of the party or individual candidate.

The auditor must employ generally accepted accounting principles and generally accepted auditing standards when reviewing the spending and financial records of a party or candidate. Auditor’s duties extend to thorough examination of the accounting records of a party or of a candidate, permitting him or her to reach an opinion as to whether the return examined presents fairly the transactions contained in the accounting records on which the return is based. It is compulsory that the party’s chief official agent or candidate’s business manager provide the information and explanations necessary to facilitate preparation of the auditor’s report. In instances where the auditor has reason to believe or is suspicious that proper

accounting standards were not kept by the party or candidate, the auditor must report same.

An auditor’s account of a registered political party or candidate is reimbursable regardless of whether the party/candidate qualifies for reimbursement. Pursuant to subsections 267(3) and 267(6) of The Election Act, 1996, the maximum reimbursement for auditing services in respect of preparations of a report pertaining to registered political party and candidate election expense returns was $2,853 and $926, respectively. See Appendix V for aggregate amounts paid for auditor reimbursement with respect to registered political parties and candidates.

Orders and Authorizations of the Chief Electoral Officer

The Chief Electoral Officer may make exceptions to The Election Act, 1996’s financial reporting provisions for election purposes for both registered political parties and candidates. In such instances, the legislation mandates the Chief Electoral Officer report on the situation and events surrounding the order or authorization granted.

Pursuant to subsection 262(7) of The Election Act, 1996, the Chief Electoral Officer granted two orders for the extension of time to prepare and file the required candidate’s return of election expenses, form E-412. These authorizations are included as Appendix IV.

Elections Saskatchewan Expenditures

The total cost of conducting the November 13, 2014 by-election in the constituency of Lloydminster was $384,093. See Appendix V for an itemization of expenditures.

Special Initiatives

The constituency of Lloydminster by-election was, by and large, administered in the same manner as the 27th General Election. That said, a small number of new initiatives were launched and tested throughout the election period.

The Chief Electoral Officer communicated with the province’s registered political parties in an open, transparent manner throughout the by-election. Beginning with the issue of the writ on October 16, the CEO communicated with the parties’ Chief Official Agents through the use of “Communiques.” These documents provided relevant, timely information to the political parties in a proactive manner. All of these communiques were posted to the constituency by-election website in the interests of keeping the electoral process open and transparent.

Elections Saskatchewan attempted a number of new advertising initiatives during the by-election. The vast majority of this advertising was focused on three goals – informing voters as to where and when to vote, ensuring voters brought acceptable I.D., and clarifying the potentially confusing time zones in use throughout the constituency (see below for more information). While traditional advertising media such as newspapers and radio were used, ads were also placed on electronic billboards in Lloydminster and every household in the constituency received information on voting through a Canada Post mail drop.

Challenges

Throughout the by-election period, the constituency of Lloydminster Returning Officer had difficulty in recruiting and retaining enumerators and poll officials. There are a variety of possible reasons for this. The Lloydminster area has experienced very low unemployment for a number of years, which means there are not many individuals looking for short term work. It also means that wages are generally higher in the area while the Schedule of Fees, which governs the amounts paid to all temporary election officials, has not been updated since before the 2011 General Election.

Many efforts were made to recruit election workers from within the constituency. The returning officer relied on an extensive network of personal contacts developed over the administration of several other electoral events. Advertisements were placed in local newspapers and online job sites. Despite these efforts, it was necessary to recruit six enumerators, three deputy returning officers, two poll clerks and one supervisory deputy returning officer from outside of the constituency of Lloydminster.

As required by subsection 7(3) of The Election Act, 1996 notice was given to all of the province’s registered political parties that out-of-constituency workers were used during the by-election. On January 9, 2015, the Chief Electoral Officer submitted a written report to the Speaker of the Legislative Assembly regarding these actions in accordance with subsection 7(6) of The Election Act, 1996. Since the administration of the constituency of Lloydminster by-election, legislative amendments have been proclaimed that allow the Chief Electoral Officer to permit the use of out-of-constituency election workers without resorting to the powers found in Section 7 of The Election Act, 1996.

Elections Saskatchewan encountered another challenge in the use of time zones in this area of the province. The constituency of Lloydminster is unique in that portions of it, specifically the city of Lloydminster, have legally adopted use of Mountain Time as their time standard. Other communities and individuals follow Mountain Time on an informal basis. The remainder of the constituency follows Central Time throughout the year (as the province of Saskatchewan does). On November 2, 2014 Daylight Saving Time ended and Mountain Time became one hour earlier than Central Time (before that date the two time zones had been the same).

Recognizing that there was ambiguity in different pieces of legislation and that it could cause confusion as to when voting or other activities could take place, the Chief Electoral Officer published an Information Circular on October 24, 2014 clarifying the approach Elections Saskatchewan would take in regard to time standards and time zones. For the remainder of the by-election period all times were reported in Central Time with the corresponding Mountain Time following in brackets. Elections Saskatchewan took a proactive approach to communicating this issue to voters through both the news media and advertisements. There were no formal complaints made during or after the by-election regarding confusion in this area. Throughout this report all times have been written in the same manner - Central Time with the corresponding Mountain Time in brackets.

Circumstances in which application was made:

Pursuant to section 261 of The Election Act, 1996 (the "Act"), the businessmanager for the Luke Bonsan campaign must file with the constituency returningofficer, no later than February 17, 2A15, the Candidate's Election ExpenseReturn (Form E-412) for the by-election held on November 13, 2014, in theconstituency of Lloydminster.

Due to logistical difficulties arising from all parties who are signing the returnresiding in different cities, in an e-mail received February 17, 2015, Luke Bonsanapplied pursuant to clause 263(1)(b) for an order of the Chief Electoral Officerexiending time for a period of 24 days in which to prepare and file the return.

ln my opinion, the circumstances make the following authorization necessary.
