1.1 DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND
Pursuant to section 73 of the Commonwealth Electoral Act 1918, the augmented Electoral Commission for Queensland hereby determines that the names and boundaries of the electoral divisions into which Queensland is to be distributed are as shown on the maps certified by the members of the augmented Electoral Commission for Queensland and lodged in file number 06/1458 at the National Office of the Australian Electoral Commission in Canberra. These maps are numbered in the following sequence

The augmented Electoral Commission for Queensland reached this determination on the basis that it determined the boundaries of the electoral divisions in Queensland, and the names of those divisions, should be as proposed by the Redistribution Committee for Queensland in its Report published on 23 June 2006, subject to the following changes:
(i) the name of the new division shall be Flynn; (ii) the boundaries of Flynn, Capricornia, Maranoa and Hinkler shall be
changed as indicated in paragraph 22 of the Report of the augmented Electoral Commission;
(iii) the further changes to boundaries shall be made that are set out in paragraph 24 of the Report of the augmented Electoral Commission.

1.2 REASONS FOR THE DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR QUEENSLAND
Representation of Queensland in the House of Representatives
1. On 17 November 2005 the Electoral Commissioner made a determination of State and Territory entitlements to representation under section 48(1) of the Commonwealth Electoral Act 1918 (the Act). By virtue of the determination, Queensland is entitled to 29 members of the House of Representatives, one more than its previous entitlement.
Direction for a redistribution of Queensland electoral divisions
2. Section 59(2) of the Act provides that a redistribution shall be directed whenever a determination under section 48(1) of the Act results in an alteration of the number of members of the House of Representatives to be chosen in a State. Consequently, on 2 December 2005, the Australian Electoral Commission (the Electoral Commission) directed by notice published in the Gazette (S226 Friday 2 December 2005) that a redistribution was to commence in Queensland.
3. At the end of 2 December 2005, the day determined by the Electoral Commission for the redistribution to begin, the number of electors enrolled for the State was 2 471 372.
4. Redistribution 2006 Statistics which show the electoral enrolment figures as at 2 December 2005 were made available on compact disc and on the Australian Electoral Commission website. In addition, copies were printed upon request at all Queensland offices of the Australian Electoral Commission. The statistics were given at the following levels:

Quota
5. Under Section 65(2) of the Act, the Electoral Commissioner determined that the quota of electors for Queensland was 85 220 (2 471 372 divided by 29 members). The permitted range of the margin of allowance of 10% below and above the quota would be 76 698 to 93 742. The Act does not permit any greater variation from the quota to be provided for in a redistribution.

Appointment of the Redistribution Committee for Queensland
6. The next step in the process leading to a redistribution in Queensland was the appointment under s.60 of the Act of a Redistribution Committee for the State.
On 14 March 2006, this committee was appointed, its members being:

7. All preconditions having been met, the Redistribution Committee (the Committee) made a proposed redistribution of Queensland under s.66 of the Act, stating its reasons in writing; caused the notice required by s.68(1)(c) of the Act to be published in the Gazette; and took the other steps required by s.68.
Objections and Comments
8. A total of 189 Objections (although a substantial proportion of these were in the same or a similar form) was received, and as well, 43 Comments on Objections were received.
Augmented Electoral Commission
9. By s.70(1) of the Act there is established for the purposes of any such redistribution an augmented Electoral Commission for the relevant State or Territory. By virtue of s.70(2) the members of the augmented Electoral Commission for Queensland (augmented Commission) are the Chairperson of the Electoral Commission (Hon James Burchett QC); the member of the Electoral Commission other than the Chairperson and the Electoral Commissioner (Mr Dennis Trewin); and the persons previously mentioned who constituted the Committee.
Public Inquiry
10. The augmented Commission held a public inquiry into the Objections in Longreach on 21 August 2006 and in Brisbane on 30 August 2006. Arguments were presented on these occasions by 13 persons (at Longreach), and a further 19 persons (at Brisbane), and have been carefully considered by the augmented Commission, together with all the objections and comments. For further details, see Appendices.

The Statutory Mandate of the augmented Electoral Commission
11. By s.73 of the Act, it is the augmented Electoral Commission for Queensland which must determine, by notice published in the Gazette, the names and boundaries of the electoral divisions into which the State is to be distributed. But that task must be performed in accordance with the requirements of s.73(4) and (4A), which provide:
“(4) In making the determination, the augmented Electoral Commission:
(a) shall, as far as practicable, endeavour to ensure that the number of electors enrolled in each Electoral Division in the State or Territory will not, at the projection time determined under section 63A, be less than 96.5% or more than 103.5% of the average divisional enrolment of that State or Territory at that time; and
(b) subject to paragraph (a), shall give due consideration, in relation to each Electoral Division, to:
(i) community of interests within the Electoral Division, including economic, social and regional interests;
(ii) means of communication and travel within the Electoral Division;
(iv) the physical features and area of the Electoral Division; and
(v) the boundaries of existing Divisions in the State or Territory;
and subject thereto the quota of electors for the State or Territory shall be the basis for the redistribution, and the augmented Electoral Commission may adopt a margin of allowance, to be used whenever necessary, but in no case shall the quota be departed from to a greater extent than one-tenth more or one-tenth less.
(4A) When applying subsection (4), the augmented Electoral Commission must treat the matter in subparagraph (4)(b)(v) as subordinate to the matters in subparagraphs (4)(b)(i), (ii) and (iv).”
12. These statutory requirements are expressed in an hierarchical order which puts, “as far as practicable”, the “endeavour to ensure” a division will fall within the projected enrolment range first; the considerations of “community of interests within [a division] including economic, social and regional interests”, “means of communication and travel within [a division]”, and “the physical features and area of [a division]” second; and “the boundaries of existing Divisions” third – while stating that, subject to these matters, “the quota of electors for the State … shall be the basis for the redistribution” and that “the augmented Electoral Commission may adopt a margin of allowance” not departing from the quota further than by one-tenth more or less.
13. The purpose of para (a) is suggested by the history of the paragraph, which has undergone some transformation by successive amendments. Initially, provision was made by the Commonwealth Electoral Legislation Amendment Act 1983 for what was later described (in section 1.6 of the Report of the Joint Standing Committee on

Electoral Matters on The Effectiveness and Appropriateness of the Redistribution Provisions of Parts III and IV of the Commonwealth Electoral Act 1918 – hereafter referred to as “the JSCEM Report”) as “a requirement [to] aim for equal numbers of electors in each of a State’s divisions (electorates) three-and-a-half years after a redistribution”. But, as the JSCEM Report noted (at section 4.3), by 1984 “it was observed that the three-and-a-half year rule had in some areas forced the adoption, on purely numerical grounds, of boundaries which took little account of perceived community of interest”, and the rule “was therefore relaxed [by an amendment of the Act in 1987 allowing a measure of tolerance] to plus or minus two percent from average enrolment” (emphasis added). The JSCEM Report goes on (at section 4.6) to state that the “most contentious issue” at its inquiry in 1995 “was whether the mid-point tolerance [at the date of the Report the required projection was to be made at what was considered a “mid-point” in the redistribution cycle] of two percent does, in fact, provide Redistribution Committees with the flexibility to give ‘due consideration’ to community of interest and the other qualitative criteria”. The JSCEM Report (at section 4.11) concluded, upon this issue, that “based on the evidence received the numerical criteria do not allow ‘due consideration’, in the words of the Act, to be given to the qualitative factors. Rather, the political parties and others attempting to frame electoral boundaries essentially find themselves engaged in a mathematical modelling exercise. In order to relax the enrolment requirements to that extent necessary to allow a realistic degree of flexibility the Committee recommends … that subsections 66(3)(a) and 73(4)(a) of the Electoral Act be amended, so as to extend the variation from average divisional enrolment allowed three-and-half years after a redistribution from two to 3.5 percent.” Later (in section 4.47), the JSCEM Report refers to its recommended amendment as one that “would maintain substantial restrictions on malapportionment [and] would allow other legitimate policy objectives to be more effectively met”.
14. It was pursuant to this recommendation that the amendment was made by which paragraph (a) came to take its present form. The terms of the recommendation, and the discussion which preceded it, make clear the purpose of paragraph (a), as it now stands, and how it was intended to interact with what the JSCEM report calls “other legitimate policy objectives” set out in the various sub-paragraphs of paragraph (b), to which also “due consideration” must be given. As the augmented Commission has so understood the Act, and has considered the objections, comments and arguments, and the proposed redistribution, on this basis, some contentions that were presented, particularly on behalf of the Liberal Party, suggesting the Committee had understood paragraph (a) in a different sense, need not be discussed here. The augmented Commission’s own examination of the proposed redistribution, and its conclusions, are based, so far as paragraph (a) is concerned, on the view of the provision that emerges from the discussion in the JSCEM Report.
Consideration of the Redistribution Committee’s Proposal, and of Objections, Comments and Arguments presented at the Inquiry in Longreach and Brisbane
15. Since the redistribution was particularly directed to the necessity to provide for an additional division in Queensland (giving the State 29 instead of 28 divisions, while New South Wales lost one, bringing it to 49 divisions), the core of the Committee’s proposal was its decision upon the location of the new division. That decision had its basis in an overview of the areas of present and projected population growth in Queensland. In contrast to the position at the time of the 2003

redistribution, which followed considerable growth in the south-east of the State, the Committee saw the position now as being that “significant future population growth (and the resulting increase in enrolment) is expected to occur in a number of regions north of Brisbane from the Sunshine Coast to Cairns including areas of Maryborough, Bundaberg, Mackay, Townsville and Cairns…..[M]ovement to major coastal areas [was] becoming increasingly evident.” This was not to deny, as the Committee recognised, that there was growth in other areas also, but the major area of the expansion it identified was generally that described, an area which includes both Hervey Bay and Gladstone.
16. Accordingly, the Committee considered the most appropriate location for a new division was in a region extending generally west from Gladstone, which would draw enrolment numbers from areas to the north, north-west and south-east of that city, embracing areas where projected enrolment numbers are generally high. Not only is projected enrolment high in a number of the localities to be included in the new division, but it is also high in most of the immediately and more remotely surrounding divisions (with the exception of Maranoa). In particular, the Committee noted high projected numbers for Capricornia, Hinkler, Kennedy, Dawson and Wide Bay.
17. In defining the boundaries of the new division, the Committee considered the factors set out in s.66 of the Act, being the same factors that are repeated for the purposes of augmented Electoral Commissions in s.73(4) and (4A) discussed in the previous section of these reasons. Generally, it found an appropriate community of interest in the mining and rural activities pursued in the region centred upon Gladstone as a significant port city. There was, however, a special problem in relation to eight western shires, to which it will be necessary to return.
18. Although none of the major political parties had suggested the creation of a new division so sited, and objections to it were lodged, it would be fair to say that, in oral argument in Brisbane and in Longreach, while objections of detail were pressed, and pressed vigorously, there was (apart from the question of the eight shires) a degree of broad acceptance of the Committee’s proposal to form the new division in a region based on Gladstone and the Capricorn Highway, which links up via Emerald with the Landsborough Highway to the west. The augmented Commission, for the reasons outlined, concluded that this was indeed the best solution.
19. The creation of a new division, wherever located, inevitably involves the severance of some existing ties between communities within and without its boundaries. Eight shires at the western end of the new division, as proposed, objected that they had little or no community of interest with a division based on Gladstone, whereas they had important communities of interest with areas belonging to the division of Maranoa, the division in which they are presently included. The eight were the shires of Winton, Aramac, Longreach, Barcaldine, Ilfracombe, Isisford, Blackall and Tambo. They were supported by some 74 objections (though not all related to every one of the eight shires) and by the Hon Bruce Scott MP the member for Maranoa. The augmented Commission gave careful consideration to these objections, which it recognised as weighty, in an endeavour to find a satisfactory alternative in this respect to the proposal. But, ultimately, its endeavours were in vain: the inexorable imperative of numbers stood in the way. Every compensatory adjustment that was suggested either failed the test of the numbers or would, had it been adopted, have caused even greater problems, affecting a number of other

divisions across the State, under the criteria set by the legislation. Moreover, the area of Maranoa (a statutory consideration) is already so large as to impair its viability; and the reinclusion of the eight shires would exacerbate the problem of size by multiplying the number of communities the member would have to service. Finally, while, other things being equal, community of interest considerations would certainly favour the retention of the eight shires in Maranoa, the augmented Commission saw some force in arguments that, with the development of Gladstone, further links to it will develop, and already there are links between the western end of the new division and Emerald, being one of the new division’s significant towns.
20. On balance, and especially because it could find no satisfactory way to remedy the excessive projected enrolment numbers in Maranoa which would result from the transfer back to it of the eight shires, nor could it see a satisfactory way to make up the corresponding loss of projected enrolment in the new division, the augmented Commission decided to confirm the Committee’s choice to include the eight shires within the new division.
21. A consequence of the position chosen for the new division, involving the transfer to it of a large share of the projected enrolment previously belonging to the division of Hinkler, was the need to replace the lost enrolment by moving the boundary of Hinkler to the south, with corresponding adjustments to the southern boundary of the neighbouring division of Wide Bay, picking up further growth areas on the Sunshine Coast. The changes to Hinkler required the splitting of Hervey Bay and Maryborough between the two divisions. A number of objections focussed on the considerable extent to which Hervey Bay and Maryborough share communities of interest. But, as has been pointed out, it is inevitable that the creation of a new division will involve some severance of existing ties. Indeed, the very growth in this part of Queensland which multiplies ties as larger communities impinge on each other would ultimately swell the numbers in a division such as Hinkler, so as indirectly to force a redrawing of boundaries in which a separation between Hervey Bay and Maryborough might be difficult to avoid. Having accepted the Committee’s conclusion on the location of the new division, the augmented Commission also accepts as a consequence, in broad terms, the changes proposed for Hinkler and Wide Bay.
22. Mr Paul Neville MP, member for Hinkler, proposed, as beneficial changes, some small adjustments to the boundaries of the new division, and of the divisions of Capricornia, Hinkler and Maranoa. Three of these changes could be made within the constraints as to numbers, and projected numbers, which bind the augmented Commission. First, he proposed that the local government area of Mt Morgan should be transferred from the new division, as it was proposed by the Committee, to Capricornia. Secondly, he proposed that the local government area of Biggenden be transferred from the new division, as it was proposed by the Committee, to Hinkler. Thirdly, he proposed (in order to compensate for the loss of enrolment in the new division caused by the first and second changes) that the local government area of Wondai be transferred from Maranoa to the new division. These proposals satisfy the tests of community of interest and communications and travel, and the augmented Commission considered their adoption would improve the underlying proposals of the Committee. Accordingly, they are adopted. A further objection contending for the transfer of Kolan local government area and part of the environs of Bundaberg (Burnett) to Hinkler could not be accommodated by reason of the numbers involved.

23. The suggestions made by Mr Neville MP found support, upon one aspect or another, in Objections and Comments lodged by 10 other persons or organisations. Section 72(4) of the Act expressly authorises the augmented Commission to hold “one inquiry into a number of … objections”, and the JSCEM Report earlier referred to stated (at section 6.33) that “where objections can be grouped together and responded to collectively, augmented Electoral Commissions should do so in their reports” as, it noted, they had in the past.
24. The augmented Commission considered these objections and other objections relating to other parts of the State, but in its opinion, having regard particularly to the impact of any substantial change on other boundaries, the statutory criteria were better met by the Committee’s proposal, subject to the matters referred to above and the following minor changes:
(i) an alteration of part of the boundary between Dickson and Longman to follow the boundaries of the localities of Kallangur and Petrie;
(ii) an alteration of the boundary between Fisher and Longman (in the Bellemere locality) to follow River Drive, Bellemere Road and Swan Road;
(iii) an alteration of the boundary between Fairfax and Wide Bay in the Eumundi area to follow the North Maroochy River.
Subject to the matters mentioned, the objectors failed to convince the augmented Commission that the Committee did not appropriately reflect in its proposal the statutory criteria relating to communities of interest, including economic, social and regional interests, means of communication and travel, physical features and area, and boundaries of existing divisions. As regards those objections not otherwise dealt with in its reasons, the augmented Commission adopts the Committee’s application of these criteria in the boundaries it drew.
Name of New Division
25. A substantial number of objections related to the name proposed by the Committee for the new division, “Wright”. The Committee made its proposal in order to honour the distinguished poet, Judith Wright, who made a further significant contribution to Australia through her dedication to social and environmental causes. But it was pointed out in the objections that the name “Wright” has prominence, in northern, western and central Queensland, as that of a disgraced former long term member of the Parliament who was convicted and sentenced to gaol terms aggregating nine years for rape and sexual abuse of children. Were it not for the very unfortunate resonance of the name “Wright” in a political context in this region at the present time, the augmented Commission would see no reason to change the Committee’s choice. However, in the circumstances, the augmented Commission has decided to change the name of the proposed new division to Flynn, in honour of the Reverend John Flynn, founder of the Royal Flying Doctor Service, who, in the early days of flying and also of radio (beginning in 1928) harnessed both to the relief of suffering and the saving of lives in the remote regions of Queensland and, ultimately, Australia. The flying doctor service for the provision of emergency medical care he pioneered was the world’s first, and is still the world’s most comprehensive service of that kind.

Whether the augmented Electoral Commission’s Proposal is “significantly different” from the Redistribution Committee’s Proposal
26. The augmented Commission’s decision to propose to determine the boundaries and names of the divisions into which the State of Queensland is to be distributed, by affirming the Committee’s proposal subject to the stated variations, leaves a further question outstanding under s.72(12) of the Commonwealth Electoral Act 1918. This question is whether, “in the opinion of the augmented Electoral Commission”, its proposal is “significantly different” from that of the Committee.
27. The augmented Commission has accepted the location of the new division as proposed by the Committee, with only small adjustments to its boundaries and those of adjacent divisions. Further small boundary changes have been made elsewhere. One divisional name out of 29 divisions has been changed, that of the new division of Flynn. These changes do not alter the substance of the Committee’s solution to the problem of finding the appropriate part of the State in which to create a new division and of redrawing the boundaries of divisions affected directly or indirectly thereby, or by shifts of population. In the opinion of the augmented Commission, it follows that the proposal now adopted is not significantly different within the meaning of s.72(12), and the augmented Commission has so determined.
Determination made by the augmented Electoral Commission for Queensland
28. For the foregoing reasons stated under s.74 of the Act, the augmented Commission, having considered all objections, comments and submissions, made the determination, the terms of which are set out above, by notice published in the Gazette on the 22nd day of November 2006. The augmented Commission had issued on 11 September 2006 a public announcement in compliance with section 72(10) and (12) of the Act. As a consequence of the opinion stated in paragraph 27, there was no occasion for the augmented Commission to issue the invitation or hold the further inquiry referred to in s.72(12)(d) and (13) of the Act. 1.4 DESCRIPTION OF THE METHOD USED TO CALCULATE THE AREA OF ELECTORAL DIVISIONS
1. The area of electoral divisions in Queensland has been calculated by
aggregating the area of: all land-based Census Collection Districts (CCDs); any parts of land based CCDs; and any ponds, creeks, wetlands or marshes not already included in land-based
CCDs, that are wholly contained within the divisional boundary of each electoral division.
2. Areas are spheroidal and are calculated on the Geocentric Datum of Australia
(GDA94) spheroid using the Electoral Boundary Mapping System (EBMS), which is based on MapInfo Professional desktop mapping software.
1.5 GENERAL DESCRIPTION OF EACH ELECTORAL DIVISION 3. The tables on the following pages set out how each Electoral Division is
constituted and are arranged under Statistical Local Areas (SLAs). Each SLA comprises a number of CCDs as used in the 2001 Population Census.
4. The SLA is the most widely used unit in the presentation of Census data and
collectively they cover the whole of Queensland without gaps or overlaps. In the majority of cases, SLAs correspond to Local Government Areas (LGAs). Where a particular LGA is substantially different from the general run of LGAs in terms of size and economic significance, it may be split into a number of SLAs.

APPENDIX F GUIDELINES FOR THE NAMING OF COMMONWEALTH ELECTORAL DIVISIONS
Several Commonwealth Parliamentary committees have considered guidelines for naming Electoral Divisions. The guidelines below were affirmed by the Joint Standing Committee on Electoral Matters in 1995. The Redistribution Committee for Queensland and the augmented Electoral Commission for Queensland took these guidelines into account when considering the names of Electoral Divisions. It should be noted that neither the Committee nor the augmented Commission are in any way bound by them. Naming after persons In the main, Divisions should be named after deceased Australians who have rendered outstanding service to their country. When new Divisions are created the names of former Prime Ministers should be considered.
Every effort should be made to retain the names of original Federation Divisions.
Locality or place names should generally be avoided, but in certain areas the use of geographical features may be appropriate.
Aboriginal names should be used where appropriate and as far as possible existing Aboriginal Divisional names should be retained. Other criteria The names of Commonwealth Divisions should not duplicate existing State
Districts. Qualifying names may be used where appropriate (e.g., Melbourne Ports, Port
Adelaide).
When two or more Divisions are partially combined, as far as possible the name of the new Division should be that of the old Division which had the greatest number of electors within the new boundaries. However, where the socio-demographic nature of the Division in question has changed significantly, this should override the numerical formula.
