Backqround and Summary

On September 11, 2007, the Planning and Land Use Management Committee ofthe City Council approved the report and recommendations prepared by the Departmentof Building and Safety regarding adopting the California Code of Regulations andamending Articles 2 and 7 of the Los Angeles Municipal Code relating to the Elevatorand Pressure Vessel Codes. If adopted, these final draft ordinances would update theLos Angeles Municipal Code to be consistent with state law.

CEQA Findinqs

Regarding a finding pursuant to the California Environmental Quality Act (CEQA),the Department of Building and Safety recommended adoption of the finding thatadoption of these ordinances is exempt from the provisions of CEQA under Article II,Section 2(m) of the City's CEQA Guidelines because the ordinances establish designstandards for the construction of buildings and structures for enforcement purposes onlyand it can be seen with certainty that adoption of the ordinances will not cause aphysical change that would constitute a significant effect on the environment. If the CityCouncil concurs, it should adopt this finding prior to or concurrent with its action on theordinances.

Copies of the final draft ordinances were sent, pursuant to Council Rule 38, tothe Department of Building and Safety. The Department's comments have beenincorporated into the draft ordinances.

An ordinance amending Article 2, Chapter IX of the Los Angeles Municipal Codeand incorporating by reference portions of the Elevator Safety Orders of Title 8 of theCalifornia Code of Regulations and the 2007 Edition of Part 7 of Title 24 of theCalifornia Code of Regulations.

THE PEOPLE OF THE CITY OF LOS ANGELESDO ORDAIN AS FOLLOWS:

Section 1. New Subsections (k) and (i) are added to Section 92.0207 of the LosAngeles Municipal Code to read:

(k) Elevator Controls/Machinery Spaces. Required workspace clearance forelevator control and/or machinery spaces shall be located entirely within the interior ofthe building.

(i) Elevator Earthquake Operation. An elevator, which has been shut down bythe activation of a seismic device, shall not return to normal operation until an inspectionof the hoistway and related equipment has been made and deemed safe and codecompliant by a Certified Journey-Level Elevator Mechanic. The owner of the buildingshall keep a record of the inspection and approval by the Certified Journey-LevelElevator Mechanic to allow the reactivation of the elevator.

Sec. 2. Section 92.0302 of the Los Angeles Municipal Code is amended to read:

SEC. 92.0302. PRIVATE RESIDENCE INCLINED ELEVATORS.

All inclined elevators in private residences shall comply with the provisions ofASME A 17.1 and this article. Part 5, Section 5.4 of ASME A17.1-2004 is adopted byreference, with the following exceptions and modifications: Sections 5.3.1.7.7,5.3.1.18.4, 5.3.1.18.5 and 5.4.8 are not adopted.

(a) Suspension Means. Suspension means shall comply with Part 5, Section5.3.1.120fASMEA 17.1-2004.

(b) Machine and Controls. Machine and controls shall be located as follows:

on cars, and shall be located outside of the hoistway in spaces dedicated to theelevator equipment.

2. The machine room shall have a head clearance of at least seven feet,and shall be provided with permanent electric lighting and a duplex receptaclerated at not less than 15A at 120V.

3. Required workspace clearance for elevator control and/or machineryspaces shall be located entirely within the interior of the building.

(c) Maintenance. The owner shall develop, implement, and maintain a writtenmaintenance program for Private Residence Inclined Elevators in accordance with themanufacturer's recommendations. The maintenance shall be performed by a registered

Journey-Level Elevator Mechanic as required by Section 92.0119, A log of all repairsand maintenance shall be kept at the location.

Sec. 3. Section 92.0304 of the Los Angeles Municipal Code is amended to read:

SEC. 92.0304. PRIVATE RESIDENCE ELEVATORS.

All elevators in private residences shall comply with the provisions of ASME A17.1-2004 and this article Part 5, Section 53 of ASME A 17.1-2004 is adopted byreference, with the following exceptions and modifications: Sections 5.3.1.7.7,5.3.1.8.1(a), 5.3.1.8.1(d), 5.3.1.18.4(a) and 5.3.1.18.5 are not adopted.

(a) Car Enclosure. Except at entrances, cars shall be enclosed on all sides andon the top. The enclosure shall be constructed of solid material, except openworkmaterial may be provided for ventilation. When openwork material for ventilation isprovided, it shall meet the requirement of ASME A 17.1-2004 Rule 204.2 c.

(b) Car Doors and Gates. A car door, when closed, shall guard the full openingof the entrance to the car. Car doors or gates shall be of solid construction. Scissorstype gates are prohibited.

(c) Machine and Controls. Machine and controls shall be located as follows:

1. Machines, controls and disconcerting means shall not be mounted oncars, and shall be located outside of the hoistway in spaces dedicated to theelevator equipment.

2. The machine room shall have a head clearance of at least seven feet,and shall be provided with permanent electric lighting and a duplex receptaclerated at not less than 15A at 120V.

4. Required car top and pit emergency stop switches shall conform toSection 5.3.1.18.7 of ASME A17.1-2004.

Sec. 4. Sections 92.0305, 92.0306, 92.0307, 92.0312 and 92.0313 of the LosAngeles Municipal Code are deleted.

JUSTIFICATION FOR PROJECT EXEMPTION

The ordinance adopts the Elevator Safety Orders of Title 8 of the California Code of Regulationsand 2007 edition of Part 7 of Tite 24 of the California Code of Regulations with necessaryamendments to the Municipal Code. This ordinance estabìishes design standards ïor theconstruction of buildings and structures for enforcement purposes only and it can be seen withcertainty that adoption of the ordinance wil not cause a physical change that would constitute asignificant effect on the physical environment.

THE PEOPLE OF THE CITY OF LOS ANGELESDO ORDAIN AS FOLLOWS:

Section 1. Subsection 6 of Section 97.0101 of the Los Angeles Municipal Codeis amended to read:

6. "Hot Water Boiler" means a boiler greater than 120 gallons or 400,000 BTUper hour input furnishing hot water at pressures not exceeding 160 pounds per squareinch or 210 degrees F.

Sec. 2. Subsection (a) of Section 97.0102 of the Los Angeles Municipal Code isamended to read:

(a) Authority and Jurisdiction. The Department shall have authority andjurisdiction over all boilers, pressure vessels and automotive hoists, any of which areoperated by or contain steam, air, gas, gasoline, electricity or diesel or semi-dieselengines, and steam engines or turbines or their multiple units, developing 50horsepower or more, and shall inspect and license the use and operation of theseapparatus, machinery or equipment, including those owned, operated or controlled bythe City, as provided in this article.

EXCEPTIONS:

1. Boilers, pressure vessels and automotive hoists in privateresidences.

2. Boilers, pressure vessels and automotive hoists owned andoperated by entities of the United States Government, County of LosAngeles, and the State of California.

Sec. 3. Section 97.0103 of the Los Angeles Municipal Code is amended to read:

SEC. 97.0103. DUTY TO EXAMINE APPLICANTS.

It shall be the duty of the Department to examine all applicants for steamengineer's license, steam engineer's turbine endorsement, boiler operator, gas andelectric hoist operator's license, and diesel engineer license as provided in this article.

Sec. 4. Subsection (c) of Section 97.0106 of the Los Angeles Municipal Code isamended to read:

(c) Operation of Condemned Equipment. No person shall use or operate anycondemned apparatus or equipment until it has been reconstructed and repaired. TheDepartment may reinstate a revoked Certificate of Inspection (Operating Permit) orissue a new Certificate of Inspection (Operating Permit) or approval.

Sec. 5. Subsection (a) of Section 97.0201 of the Los Angeles Municipal Code isamended to read:

(a) Scope. No person shall use or operate any boiler or steam generatingapparatus of over five horsepower, carrying over 15 pounds of steam, or any steamengine or turbine or their multiple unit, developing 50 horsepower or more, or any dieselor semi-diesel engine of over 50 horsepower, unless the person has a valid licenseissued by the Department for its use or operation. The license shall clearly list theparticular apparatus, machine or equipment for which it was issued.

A person having a valid unlimited horse power Steam Engineer's License issuedby the Department, shall be entitled, without further license, to operate steam enginesor their multiple units of any horsepower.

EXCEPTION: No license shall be required to operate any Diesel or semi-Diesel engine used for the purpose of providing standby power or emergencypower.

Sec. 6. Section 97.0202 of the Los Angeles Municipal Code is amended to read:

SEC. 97.0202. APPLICATION FOR THE LICENSE EXAMINATION.

Any person who meets the requirements set forth in Section 97.0204 may filewith the Department a written application upon forms furnished by the Department. Theapplicatiûn shall jnclüde the fûllû'vving infûímatiûn:

(1) The type of the machinery or equipment the applicant intends tooperate.

(2) The applicant's previous experience in the use or operation of similarmachinery or equipment, and its size, type and capacity.

(3) The names and addresses of previous employers and the length oftime of each engagement.

(4) The type of license requested.

Sec. 7. Subsections (d) and (e) of Section 97.0203 of the Los Angeles MunicipalCode are amended to read:

(d) Scope of License. The licensee is authorized to operate only the type ortypes of equipment specified on the license. The fee shall be no more than set forth inSubsection (a) of this section, regardless of the number of types of equipment shown onthe license.

(e) Existing Licenses. A license to operate any of the equipment specified inSubsection (a) of Section 97.0201 that is valid on the effective date of this ordinanceshall be renewable. The types of equipment covered shall be established by theDepartment, with consideration given to similarity between various types of equipment.

Sec. 8. The title of Subsection (f) of Section 97.0203 of the Los AngelesMunicipal Code is amended to read:

(f) Expiration and Renewal of Operator's or Deputy Inspector's License.

Sec. 9. Subsection 6 of Section 97.0204 of the Los Angeles Municipal Code isrenumbered as Subsection 4 and Subsection 5 is deleted.

Sec. 10. Section 97.0206 of the Los Angeles Municipal Code is amended toread:

SEC. 97.0206. POSTING OF LICENSE.

Every license issued pursuant to the provisions of this article shall be posted bythe owner at or near the apparatus, machinery or equipment, which the owner isoperating. Operators of portable apparatus, machinery or equipment may post theirvalid license cards in lieu of the license certificate required by this article, and no ownerof any license shall fail, refuse or neglect to keep his or her license or license cardposted at all times when operating any apparatus, machinery or equipment.

Sec. 12. Section 97.0304 of the Los Angeles Municipal Code is amended toread:

SEC. 97.0304. APPARATUS - OPERATION AT EXCESSIVE PRESSURE.

No person shall operate any equipment or apparatus listed in this Division at apressure greater than is shown by the Certificate of Inspection (Operating Permit), or ata pressure greater than is specified by the manufacturer of the equipment.

Sec. 13. Section 97.0308 of the Los Angeles Municipal Code is amended toread:

SEC. 97.0308. PREPARATION FOR INSPECTION.

The owner or user of any equipment or apparatus shall prepare the equipment orapparatus for a test or internal inspection as outlined by the Department, and shallfurnish all necessary labor. No equipment or apparatus shall be enclosed orreassembled until the test or internal inspection has been completed by the Department.

Sec. 14. Subsection (a) of Section 97.0310 of the Los Angeles Municipal Codeis amended to read:

(a) Equipment To Be Inspected. Any equipment listed in Sections 97.0301,97.0303 or 97.0314 shall be inspected once each year and a new Certificate ofInspection (Operating Permit) issued. This includes every steam boiler, high pressureboiler, low pressure boiler, hot water boiler, electric boiler, hot water storage tank orhydro-pneumatic tank of over 120 gallons, steam mangle, steam kette, steam cooker,vulcanizer, sprinkler tank, clothes press (regardless of where steam is obtained),rendering tank, retort or steam kettle, dryer, steam vacuum tank, automotive hoist, heatexchanger, and steam receiver. Air tanks shall be inspected once every 3 years.

Sec. 15 Exception number 3 of Subsection (a) of Section 97.0310 of the LosAngeles Municipal Code is amended to read:

(3) Oxygen, hydrogen and non flammable bulk industrial gas tanks.

Sec. 16. Subsections (a) and (b) of Section 97.0311 of the Los AngelesMunicipal Code are amended to read:

(a) Authorized Inspection. After the initial inspection and approval by theDepartmenÎ, any equipment listed in this article that is insured and inspected by aninsurance company or inspected by any other organization authorized by the State ofCalifornia to issue Operating Permits employing a Deputy Pressure Vessel Inspector,may be issued a Certificate of Inspection (Operating Permit). After the initial inspection,

the equipment may be relieved from further inspection by the Department if the requireddocumentation is received within 21 days as required in Section 97.0318.

(b) Certificates of Inspection (Operating Permit). Every Deputy PressureVessel Inspector for any insurance company, or other organization authorized by theState of California, shall issue to the owner or user of the equipment, upon a completedinspection, a Certificate of Inspection (Operating Permit) for equipment listed in thisarticle. A copy of the certificate and the inspection report shall be forwarded to theDepartment.

Sec. 17. Subsection (g) of the Table in Section 97.0314 of the Los AngelesMunicipal Code is amended to read:

(g) automotive hoists, including surge tanks.... $32.00 each

Sec. 18. The first unnumbered paragraph of Subsection (b) of Section 97.0314.1is amended to read:

(b) Minimum Inspection Fee. The owner shall pay a minimum inspection fee,as specified in Section 98.0412, to the Department to use any equipment, machinery orapparatus for which a certificate, license or permit is required by this Code. Where thecumulative fees set forth in Section 97.0314 are less than the minimum inspection fee,the minimum inspection fee shall be paid.

Sec. 19. Section 97.0317 of the Los Angeles Municipal Code is amended toread:

SEC. 97.0317. DEPUTY INSPECTORS - APPLICATIONS.

Every Deputy Inspector of any insurance company or other organization makingan application for a permit to be deputized as Deputy Inspector to inspect any of theequipment listed in this article, shall designate in the application for appointment thename of the insurance company or other organization, and the application shall becountersigned by that insurance company or other organization. No Deputy CityInspector shall be allowed to inspect any equipment for any organization other than thatfor which the application has been made and approved.

Sec. 20. Section 97.0318 of the Los Angeles Municipal Code is amended toread:

SEC. 97.0318. DEPUTY INSPECTOR.

Every Deputy Inspector shall, within 21days after inspecting any equipment orapparatus listed in this article, forward to the Department reports and copies of

operating permits on forms approved by the Department. These reports shall be inaddition to those furnished to the Division of Industrial Safety of the State of California.

Sec. 21. The provisions of this ordinance shall become operative on January 1,2008.

The ordinance adopts Title 8 of the California Code of Regulations with necessary amendments tothe Municipal Code.
