RELEASE OF LIABILITY, WAIVER OF CLAIMS ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

BY SIGNING THIS RELEASE AGREEMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE

PLEASE READ CAREFULLY! I have been given a copy of this Release Agreement and I have been advised to read

it carefully. Welcome to Highest Level, the cutting edge of terrain parks in North America. Highest

Level is the

Premier terrain park at Austin Hale’s backyard and contains most difficult features. Unlike

the Terrain

Garden, Habitat Park, Nintendo Park, Snow Cross track and the half pipes, access to

Highest Level

Will be controlled and is restricted to advanced and expert riders and skiers who

produce a valid, Highest Level pass at the entrance. Helmets are mandatory in Highest

Level—no exceptions.

In order to obtain a Highest Level pass, you must carefully read, complete and sign this

Release Agreement. The pass is free and is valid for the season, snow conditions

permitting. Please read carefully

ASSUMPTION OF RISKS I am aware that snowboarding and skiing involve the risk of injury. Terrain Park activities and airborne

maneuvers increase this risk.

Becoming inverted during an aerial maneuver, whether intentionally or accidentally substantially increases

the risk of serious injury.

I am also aware that there is a risk of negligence on the part of the ski area operator, including the

failure by the ski area operator an and its staff, to safeguard or protect me from or warn me of the risks,

dangers and hazards of skiing or snowboarding in the Terrain Park.

I freely accept and fully assume all risks, dangers and hazards associated with using the Terrain Park

and the possibility of loss, personal injury or death resulting therefrom.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT In consideration of the purchase of a Highest Level Terrain Park pass, and for other good and valuable consideration, the

receipt

and sufficiency of which is acknowledged, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES AND TO RELEASE THE

RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my

next-of-kin may suffer as a result of my use of the Terrain Park DUE TO ANY CAUSE WHATSOEVER, INCLUDING

NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE INCLUDING ANY DUTY

OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c. 337, ON THE PART OF THE RELEASEES, AND

FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM OR WARN ME OF

THE RISKS, DANGERS AND HAZARDS OF USING THE TERRAIN PARK.

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal

injury

to any third party resulting from my use of the Terrain Park;

3. This Release Agreement shall be effective and binding upon my heirs, next-of-kin, executors, administrators, assigns

and representatives,

in the event of my death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall

be governed

by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction; and

5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of British

Columbia

and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia.
