On October 21, 2010, Commission Staff issued its report on ISO/RTO Performance Metrics.

On December 6, 2010, the six ISOs/RTOs submitted the 2010 ISO/RTO Metrics Report, whichreflects the content outlined in the October 21, 2010 Commission Staff Report on ISO/RTOPerformance Metrics, as applicable and as information is available for each entity. TheISOs/RTOs combined their data and narratives into one report.

On October 1, 2010, FERC issued a Notice of Technical Conference to explore issuesassociated with reliability monitoring, enforcement and compliance, as announced in theCommission’s order issued September 16, 2010 that accepted the North American ElectricReliability Corporation’s initial assessment in Docket No. RR09-7-000 of its performance asthe nation’s Electric Reliability Organization (ERO), and performance by the Regional Entities,under their delegation agreements with the ERO.

The Technical Conference will be held on November 18, 2010, from 1 PM to 5 PM EST.

On November 2, 2010, FERC issued an agenda for the November 18, 2010 TechnicalConference.

On November 18, 2010, a Technical Conference was held to explore issues associated withreliability monitoring, enforcement and compliance, as announced in the Commission’s orderissued September 16, 2010 that accepted the North American Electric ReliabilityCorporation’s initial assessment in Docket No. RR09-7-000 of its performance as the nation’sElectric Reliability Organization ("ERO"), and performance by the Regional Entities, undertheir delegation agreements with the ERO.

On December 8, 2010, SPP submitted its annual operating budget and true-up. This issubmitted pursuant to the Commission's October 1, 2004 Order in Docket No. RT04-1, andcommitments made by SPP in Docket No. ER08-1338.

ER05-652 SPP Filing of Transmission Cost Allocation Tariff Revisions

On December 30, 2010, SPP filed an informational report. The report discusses: (1) SPP'sassessment of the average costs of all new network upgrades identified through SPP'sregional transmission cost allocation plan ("Cost Allocation Plan"), as well as SPP's efforts towork with its stakeholders and the Regional State Committee ("RSC") to evaluate theeffectiveness and accuracy of the $180,000/MW Safe Harbor threshold for Base PlanUpgrades; (2) the unintended consequence reports issued by its Regional Tariff WorkingGroup ("RTWG") to the Markets and Operations Committee ("MOPC") and the RSCconcerning the calculations of the cost allocation impacts of the Base Plan Upgrades to eachTransmission Customer within the SPP Region; and (3) information concerning SPP'sdisposition of all requests for waiver of the Base Plan criteria, to inform the Commission andothers regarding the reasonableness of SPP's application of the waivers and the treatment ofany facilities granted waivers that subsequently caused unintended consequences.

ER09-1050 SPP Order 719 Compliance Filing

On October 12, 2010, ISO New England, Inc. filed a Motion to Intervene Out-of-Time.

On October 15, 2010, ISO New England Inc. submitted a Motion for Clarification or, in theAlternative, Request for Rehearing of the September 16, 2010 Order. ISO New England statedit seeks clarification or rehearing regarding the following:

1) The Commission’s statements in paragraph 26 of the September 16 Order do not prohibit amarket monitor, at its discretion, from communicating or collaborating with the boardmembers, officers or other personnel of its ISO (or RTO), assuming that those persons are

bound by appropriate, Commission-accepted confidentiality requirements, in the investigationof a suspected market violation or the preparation of a referral, or prohibit the market monitorfrom making the board members or other ISO personnel aware that a referral has been made;and2) The Commission’s statements in paragraph 26 of the September 16 Order should beclarified as allowing a market monitor to collaborate or communicate with its ISO’s board ofdirectors and appropriate employees, and only as prohibiting the market monitor’s disclosureto state officials or other persons outside an ISO of a referral of a market violation toCommission enforcement staff.

On October 15, 2010, in FERC Docket No. ER11-121, SPP submitted its compliance filingpursuant to Order No. 719 and the September 16, 2010 Order issued in Docket No.ER09-1050.

An effective date of February 18, 2010 was requested.

On October 21, 2010, FERC issued an order accepting SPP's April 28, 2009 ComplianceFiling. The Commission found that SPP complied with the stakeholder responsiveness andRTO governance requirements of Order No. 719, including: (1) inclusiveness; (2) fairness inbalancing diverse interests; (3) representation of minority interests; and (4) ongoingresponsiveness.

On November 10, 2010, FERC issued an Order Granting Rehearing for Further Considerationof the September 16, 2010 Order.

On October 15, 2010, ISO New England filed a rehearing request in which it stated it seeksclarification or rehearing regarding the following:

ER09-1254 SPP Submission of Revisions to Open Access Transmission Tariff to Reform GenerationInterconnection Procedures ("Queue Reform Filing")

On November 18, 2010, FERC issued an order accepting SPP's January 19, 2010 compliancefiling effective June 2, 2009, subject to an additional compliance filing.

The Commission directed SPP to revise section 3.3.1 in order to clarify:1) an interconnection customer may make changes to its layout drawings in the preliminaryqueue stage (i.e. prior to entering the DISIS queue); and2) once an interconnection request enters the DISIS queue, any subsequent change to thedesign of the generating facility as depicted in the layout drawing will be evaluated todetermine whether the change constitutes a material modification under section 4.4.

ER10-794 Entergy Services, Inc. Submission of Revisions to its OATT to Implement SupplementalCurtailment Procedures ("SCP") and Local Area Procedures ("LAP")

On December 7, 2010, FERC issued an Order on Rehearing.

FERC granted SPP's rehearing request filed on May 24, 2010. FERC clarified that it does notcompel identical curtailment of non-interchange and interchange non-firm transactions atpresent, and that no further changes to the Supplemental Curtailment Procedures or theNERC TLR process beyond that specified in the April 23, 2010 Order are required.

FERC granted in part and denied in part Entergy's rehearing request filed on May 24, 2010. FERC denied Entergy's rehearing request concerning the ICT's suggested approach forimplementation of the Supplemental Curtailment Procedures ("SCPs") and exemption of QFputs from curtailment under the SCPs. FERC granted rehearing concerning implementation ofnon-discriminatory procedures for non-interchange transactions when NERC TLR Proceduresdo not sufficiently mitigate constraints. On December 8, 2010, SPP submitted revised pages to is OATT to implement rate changesfor ITC Great Plains, LLC, Nebraska Public Power District, Oklahoma Gas and ElectricCompany, Southwestern Public Service Company, and Westar Energy, Inc., which aretransmission owners within SPP. Specifically, this filing tracks the rate updates calculated bythe Transmission Owners based on their transmission cost of service formula rates.

On December 10, 2010, Westar Energy, Inc. filed a Motion to Intervene.

On December 22, 2010, SPP submitted an errata filing to correct the revenue requirement forNetwork Integration Transmission Service for Grand River Dam Authority, which is anothertransmission owner and pricing zone under the SPP Tariff.

An effective date of January 1, 2011 was requested.

On December 27, 2010, ICT Great Plains, LLC filed a Motion for Leave to Intervene.

ER11-2345 SPP Submission of Revisions to OATT to Implement Rate Changes for Kansas CityPower & Light Company ("KCPL") and KCP&L Greater Missouri Operations Company("KCPL-GMO")

On December 13, 2010, SPP submitted revised pages to is OATT to implement rate changesfor Kansas City Power & Light Company and KCP&L Greater Missouri Operations Company,which are transmission owners and pricing zones under the SPP Tariff. Specifically, this filingimplements the transmission formula rate included in the Offer of Settlement accepted by theCommission on December 3, 2010 in Docket No. ER10-230.

An effective date of January 6, 2010 was requested for the revisions incorporating the formularate template. An effective date of January 1, 2011 was requested for the updated rates for theKCP&L/GMO zones.

On December 23, 2010, SPP submitted an errata filing to correct the revenue requirement forNetwork Integration Transmission Service for Grand River Dam Authority, which is anothertransmission owner and pricing zone under the SPP Tariff.

An effective date of January 1, 2011 was requested for the updated rates for the KCP&L/GMOzones.

On December 17, 2010, SPP submitted a ministerial filing to reflect language accepted inER09-1254-002.

ER11-2415 SPP Compliance Filing in Accordance with November 18, 2010 Order Issued in DocketNo. ER09-1254-002 (Queue Reform Filing)

On December 20, 2010, SPP submitted its compliance filing, in Docket No. ER11-2415, inaccordance with the November 18, 2010 Order issued in Docket No. ER09-1254.

ER11-2425 SPP Submission of Tariff Revisions to Simplify the Election Process for LossCompensation in Attachments M and N

On December 21, 2010, SPP submitted revisions to its OATT in order to simplify the electionprocess for loss compensation in Attachments M and N. The changes will eliminate theannual election of loss compensation method required from each Transmission Customerunder the provisions of Attachment M.

An effective date of February 19, 2011 was requested.

ER11-2428 SPP Submission of Tariff Revisions to Clarify How Real Power Losses Caused byTransmission Service Customers are Determined and Recovered

On December 21, 2010, SPP submitted revisions to its OATT to clarify how the Real PowerLosses that must be replaced by transmission service customers are determined andrecovered.

An effective date of March 1, 2011 was requested.

On December 27, 2010, SPP submitted an errata filing to include a revision to the title forAppendix 1 to Attachment M of SPP's Tariff clarifying that the figures specified in Appendix 1are the Average Loss Factors for each of SPP’s pricing zones.

ER11-2528 SPP Filing of an Unexecuted Generator Interconnection Agreement ("GIA") betweenNorth Buffalo Wind, LLC ("North Buffalo") as Interconnection Customer and OklahomaGas and Electric Company ("OG&E") as Transmission Owner

On December 17, 2010, SPP submitted an unexecuted GIA between SPP as TransmissionProvider, North Buffalo Wind, LLC as Interconnection Customer, and Oklahoma Gas andElectric Company as Transmission Owner. SPP Service Agreement No. 2068.

SPP is filing the North Buffalo GIA because North Buffalo declined to execute it due to adispute concerning certain language North Buffalo proposed to include in Appendices B and Cof the North Buffalo GIA.

An effective date of December 10, 2010 was requested.

ES10-11 SPP Application Under Section 204 of the Federal Power Act for an Order Authorizingthe Issuance of Securities ($150 million)

On October 27, 2010, SPP submitted a request to modify the May 19, 2010 authorizationorder to specify that the Unsecured Notes will have maturities of 3 to 40 years.

On October 28, 2010, FERC issued an Errata to the May 19, 2010 Order. FERC changed theauthorization to allow for the Unsecured Notes having maturities of 3 to 40 years.

On November 19, 2010, SPP submitted a Report of Securities issued on October 28, 2010.

ES11-14 SPP Application Under Section 204 of the Federal Power Act for an Order Authorizingthe Issuance of Securities ($20 million Revolving Credit Facility)

On December 30, 2010, SPP submitted an application under Section 204 of the FederalPower Act for authorization of the issuance of up to $20,000,000 in non-secured PromissoryNotes. The Notes will be a revolving credit facility.

SPP requested that the Commission approve the application by February 28, 2011.

OA08-59 Entergy Services, Inc. Order No. 890 Attachment K Compliance Filing

On November 10, 2010, FERC issued an order accepting Entergy's June 1, 2010 ComplianceFiling.

OA09-5 SPP Tariff Revisions Pursuant to Order 890-B

On December 15, 2010, FERC issued a letter order accepting SPP's Order No. 890-Bcompliance filing, effective October 6, 2008 as requested.

This order constitutes final agency action.

PA11-2 FERC Audit of SPP's Responsibilities and Performance as a Regional Entity ("RE")

On November 2, 2010, FERC provided notice it is commencing an audit of SPP.

The audit will address SPP’s responsibilities and performance as a Regional Entity (RE). Theaudit will determine whether SPP is operating in compliance with:1) the SPP Bylaws;2) the Delegation Agreement between the North American Electric Reliability Corporation andSPP, Inc., and the conditions included in the Delegation Order;3) the SPP Membership Agreement; and4) other obligations and responsibilities as approved by the Commission.

Additionally, the audit will evaluate the RE’s independence from SPP’s function as a RegionalTransmission Organization. The audit will cover the period from January 1, 2009 through thepresent.

RM01-5 Electronic Tariff Filings

On December 22, 2010, FERC issued a Notice of Technical Conference, to be held on January21, 2011 from 9 AM to 12 PM EST, in order to discuss issues relating to the electronic filing oftariff and tariff related material pursuant to Order No. 714.

The technical conference will cover the following areas: (1) the addition to the Type of FilingCSV file of the FERC regulatory citation for each filing type as used by the Commission’seLibrary Description for eTariff filings; (2) an explanation and discussion of the eTariff Viewer’sExport file format and data elements which is being developed; (3) a change in the descriptionfor Type Of Filing Codes 1120 and 1150 from "Market-Based Rate Request and TriennialReview" to "Market-Based Rate Triennial Review", to become effective January 24, 2011, inorder to make clear that these filing codes should not be used for initial requests for marketbased rates; and (4) a discussion with FERC staff of lessons learn since the implementation ofeTariff.

RM06-16 Mandatory Reliability Standards for the Bulk-Power System to Process the ProposedReliability Standards Submitted by NERC on April 4, 2006

Numerous entities submitted post-Technical Conference comments regarding FrequencyResponse in the Wholesale Electric Grid.

On October 14, 2010, the ISO/RTO Council submitted post-technical conference comments.

On October 20, 2010, NERC submitted the 2010 Long-Term Reliability Assessment.

On October 25, 2010, NERC submitted its compliance filing in response to the May 13, 2010Order Granting Rehearing for Further Consideration and Scheduling Technical Conference.

On October 26, 2010, NERC submitted an information filing containing the 2010 SpecialReliability Assessment: Resource Adequacy Impacts of Potential U.S. EnvironmentalRegulations.

On November 30, 2010, NERC submitted its third quarter 2010 compliance filing in responseto Paragraph 629 of Order No. 693 and Request to Terminate Compliance Filing Obligation.

On December 1, 2010, NERC submitted an informational filing a report entitled "2009/2010

On December 16, 2010, FERC issued an Order accepting NERC's October 25, 2010compliance filing in response to the May 13, 2010 order directing that NERC submit aproposed schedule for developing a frequency response requirement.

RM06-22 Mandatory Reliability Standards for the Bulk-Power System to Process the ProposedReliability Standards Submitted by NERC on April 4, 2006

On October 15, 2010, NERC submitted its status report in response to Order No. 706-B,issued on March 19, 2009.

On December 16, 2010, FERC issued an Order denying the request for rehearing, filed on April19, 2010, of the Commission’s order addressing violation severity level assignments for criticalinfrastructure protection (CIP) reliability standards, issued March 18, 2010.

RM08-11 Notice of Proposed Rulemaking - Version Two Facilities Design, Connections andMaintenance Reliability Standards

On December 7, 2010, FERC issued a letter accepting NERC's May 29, 2009 and July 6,2009 compliance filings in Response to Order No. 722.

RM08-19 Notice of Proposed Rulemaking - Mandatory Reliability Standards for the Calculationof Available Transfer Capability, Capacity Benefit Margins, Transmission ReliabilityMargins, Total Transfer Capability, and Existing Transmission Commitments andMandatory Reliability Standards for the Bulk-Power System

On December 1, 2010, NERC submitted its compliance filing in response to Paragraph 274 ofOrder No. 729.

RM09-18 Revision to Electric Reliability Organization ("ERO") Definition of Bulk Electric System

On November 18, 2010, FERC issued Order No. 743, Final Rule regarding Revision to ElectricReliability Definition of Bulk Electric System.

FERC adopted, with modifications, the proposal outlined in its March 18, 2010 NOPR torequire the Electric Reliability Organization (ERO) to revise its definition of the term "bulkelectric system." The Commission directed the ERO, through the ERO’s Reliability StandardsDevelopment Process, to revise the definition to address the Commission’s technicalconcerns, as discussed in the Final Rule, and ensure that the definition encompasses allfacilities necessary for operating an interconnected electric transmission network.

This rule is effective January 25, 2011.

On December 16, 2010, Wisconsin Electric Power Company filed a Request for Clarification ofOrder No. 743, Final Rule on Revisions to Electric Reliability Organization Definition of BulkElectric System issued on November 18, 2010.

The issue raised by Wisconsin Electric is whether the Commission’s statements regarding theclassification of step-down transformers with sub-100kV equipment constitute a ruling on themerits, or whether the classification of such transformers remains to be developed in theexemption process at the North American Electric Reliability Corporation.

On December 20, 2010, numerous entities filed Requests for Clarification or Rehearing ofOrder No. 743, Final Rule issued on November 18, 2010.

RM09-25 System Personnel Training Reliability Standards

On November 18, 2010, FERC issued Order No. 742, final rule concerning System PersonnelTraining Reliability Standards. The Commission adopted the NOPR proposal and approvedReliability Standards PER-004-2 (Reliability Coordination - Staffing) and PER-005-1 (SystemPersonnel Training) .

This rule is effective January 25, 2011.

On December 17, 2010, Public Service Electric and Gas Company filed a Request forClarification of Order No. 742.

Specifically, PSE&G requested clarification that in Paragraph 90 of the November 18, 2010Order, FERC did not intend to place a reporting and records retention requirement uponTransmission Owners ("TO") rather than Transmission Operators ("TOP"). Thus, PSE&Grequests that the Commission clarify that these requirements only apply to registered TOPsrather than TOs.

On December 20, 2010, ISO New England, Inc. and National Grid USA filed a Motion toCorrect the Record.

Pursuant to the Transmission Operation Agreement ("TOA") with the New EnglandParticipating Transmission Owners, several of New England’s Participating TransmissionOwners operate LCCs that carry out the functions described in Section 3.06(a)(ii) of the TOA. Contrary to the language in Paragraph 62 of Order No. 742, each of these LCC operators is infact registered with NERC as a Transmission Operator. ISO-NE requested that theCommission to correct the record for this proceeding in accordance with those facts.

RM10-5 Interpretation of Protection System Reliability Standard

On December 16, 2010, FERC issued a Notice of Proposed Rulemaking in which FERCproposes to accept the NERC proposed interpretation of Requirement R1 of ReliabilityStandard PRC-005-1, and proposes to direct NERC to develop modifications to the PRC-005-1Reliability Standard, as discussed below, through its Reliability Standards developmentprocess to address gaps in the Protection System maintenance and testing standard,highlighted by the proposed interpretation.

Comments are due February 25, 2011.

RM10-8 Electric Reliability Organization Interpretations of Interconnection ReliabilityOperations and Coordination and Transmission Operations Reliability Standards

On December 16, 2010, FERC issued a Notice of Proposed Rulemaking in which theCommission proposes to approve the North American Electric Reliability Corporation’sproposed interpretation of certain specific requirements of the Commission-approved Reliability

Standards, TOP-005-1, Operational Reliability Information, and IRO-005-1, ReliabilityCoordination - Current-Day Operations. Specifically, the interpretation addresses whether aSpecial Protection System (or SPS) that is operating with only one communication channel inservice is "degraded" under these standards. The Commission proposes to approve theinterpretation, discussed in the NOPR, as being consistent with and not expanding orchanging the existing Reliability Standards. However, to address Commission concerns thatthe interpretation fails to specify that a Special Protection System that has lost acommunication channel be reported, the Commission also proposes to direct NERC pursuantto section 215 (d)(5) of the FPA to develop modifications to the TOP-005-1 and IRO-005-1Reliability Standards through its Reliability Standards development process.

Comments are due February 7, 2010.

RM10-11 Notice of Inquiry Regarding Integration of Variable Energy Resources ("VER")

On November 18, 2010, FERC issued a Notice of Proposed Rulemaking which proposes toreform the pro forma Open Access Transmission Tariff to remove unduly discriminatorypractices and to ensure just and reasonable rates for Commission-jurisdictional services.

Accordingly, the Proposed Rule would:1) require public utility transmission providers to offer intra-hourly transmission scheduling;2) incorporate provisions into the pro forma Large Generator Interconnection Agreementrequiring interconnection customers whose generating facilities are variable energy resourcesto provide meteorological and operational data to public utility transmission providers for thepurpose of power production forecasting; and3) add a generic ancillary service rate schedule through which public utility transmissionproviders will offer regulation service to transmission customers delivering energy from agenerator located within the transmission provider’s balancing authority area.

FERC believes the proposed reforms will remove barriers to the integration of variable energyresources.

On December 6, 2010, Edison Electric Institute submitted a Motion to Extend the Period forFiling Comments Until March 2, 2011.

On December 8, 2010, FERC issued a Notice Shortening Answer Period. Answers to EdisonElectric Institute's motion for an extension of time must be filed no later than December 13,2010.

On December 8, 2010, Bonneville Power Administration filed a Motion to Extend the Period forFiling Comments. Bonneville supports Edison Electric Institute's request for a 30-dayextension to file comments.

On December 16, 2010, FERC issued a Notice Extending Comment Period to March 2, 2011for parties to file comments in response to the November 18, 2010 NOPR.

RM10-13 Notice of Proposed Rulemaking: Credit Reforms in Organized Wholesale ElectricMarkets

On October 21, 2010, FERC issued Order No. 741, Final Rule regarding Credit Reforms inOrganized Wholesale Electric Markets. A Compliance Filing is due on June 30, 2011 and

must include the following tariff provisions to be effective October 1, 2011:

Each organized wholesale electric market must have tariff provisions that:(a) Limit the amount of unsecured credit extended by an organized wholesale electric marketto no more than:(i) $50 million for each market participant; and(ii) $100 million for all entities within a corporate family;(b) Adopt a billing period of no more than seven days and allow a settlement period of no morethan seven days;(c) Eliminate unsecured credit in financial transmission rights markets and equivalent markets;(d) Establish a single counterparty to all market participant transactions, or require eachmarket participant in an organized wholesale electric market to grant a security interest to theorganized wholesale electric market in the receivables of its transactions, or provide anothermethod of supporting netting that provides a similar level of protection to the market and isapproved by the Commission. In the alternative, the organized wholesale electric market shallnot net market participants’ transactions and must establish credit based on marketparticipants’ gross obligations;(e) Limit to no more than two days the time period provided to post additional collateral whenadditional collateral is requested by the organized wholesale electric market;(f) Require minimum participation criteria for market participants to be eligible to participate inthe organized wholesale electric market; and(g) Provide a list of examples of circumstances when a market administrator may invoke a"material adverse change" as a justification for requiring additional collateral; this list does notlimit a market administrator’s right to invoke such a clause in other circumstances.

This rule is effective November 26, 2010.

On November 19, 2010, the Cities of Anaheim, Azusa, Banning, Colton, Pasadena, andRiverside, California submitted a Request for Rehearing and Clarification of Order No. 741issued on October 21, 2010.

Several parties submitted Requests for Rehearing and Clarification of Order No. 741, the FinalRule issued on October 21, 2010.

On November 22, 2010, New York Independent System Operator, Inc. submitted a Request forClarification or, in the Alternative, for Rehearing and Request for Expedited Action.

NYISO seeks clarification that the Commission, when using the terms "net exposure" and"gross obligations," is referring to the net exposure or gross obligations across product orservice categories and is not referring to a customer’s positions within product or servicecategories.

On December 8, 2010, the New York Transmission Owners ("NYTOs") submitted an answer inresponse to New York ISO's November 22, 2010 clarification request. NYTOs agree withNYISO's request. In addition, the NYTOs state that Commission should clarify that Order No.741 requires market participants to provide a security interest in their transactions in order toestablish collateral requirements based on net exposure across products or markets

On December 20, 2010, FERC issued an Order Granting Rehearing for Further Considerationof Order No. 741, Final Rule issued on October 21, 2010.

RM10-15 Mandatory Reliability Standards for Interconnection Reliability Operating Limits

On November 18, 2010, FERC issued a Notice of Proposed Rulemaking in which theCommission proposes to approve three new Interconnection Reliability Operations andCoordination Reliability Standards and seven revised Reliability Standards related toEmergency Preparedness and Operations, Interconnection Reliability Operations andCoordination, and Transmission Operations.

The three new Reliability Standards proposed by NERC are designated asIRO-008-1 (Reliability Coordinator Operational Analyses and Real-time Assessments),IRO-009-1 (Reliability Coordinator Actions to Operate Within IROLs), and IRO-010-1a3(Reliability Coordinator Data Specification and Collection).

Comments are due January 24, 2011.

RM10-16 System Restoration Reliability Standards

On November 18, 2010, FERC issued a Notice of Proposed Rulemaking in which theCommission proposes to approve Reliability Standards EOP-001-1 (Emergency OperationsPlanning), EOP-005-2 (System Restoration from Blackstart Resources), and EOP-006-2(System Restoration Coordination) submitted to the Commission by the North AmericanElectric Reliability Corporation, the Electric Reliability Organization (ERO) certified by theCommission.

Comments are due January 24, 2011.

RM10-17 Demand Response Compensation in Organized Wholesale Energy Markets

On October 13, 2010, SPP submitted comments in response to the Supplemental NOPRissued on August 2, 2010.

SPP stated that the Commission should not require a net benefits test requirement either as astandard for all RTOs and ISOs or as a requirement tailored to the individual RTO or ISO. Also, SPP stated the Commission’s final rule from this proceeding should take into accountthat each RTO and ISO has very different markets, each with its own characteristics that havebeen debated and approved by the Commission.

Numerous entities submitted comments in response to the Supplemental NOPR issued onAugust 2, 2010.

Several entities submitted post-technical conference comments.

RM10-22 Promoting a Competitive Market for Capacity Reassignments

On October 20, 2010, Portland General Electric filed a request for an extension of time, untilDecember 23, 2010, to submit its compliance filing pursuant to Order No. 739 issued onSeptember 20, 2010.

On October 20, 2010, Portland General Electric Company ("PGE") filed a Request forClarification or, In the Alternative, Rehearing of Order No. 739 issued on September 20, 2010.

Specifically, PGE requests that the Commission clarify that stand-alone rate schedulespermitting capacity reassignments at negotiated rates on Bonneville Power Administration’s

transmission system remain operative.

On October 26, 2010, FERC issued an Order Granting Rehearing for Further Consideration ofOrder No. 739.

On November 4, 2010, Bonneville Power Administration filed an answer in response to theRequest for Clarification filed by Portland General Electric Company.

Bonneville requested that the Commission deny PGE’s request for clarification that itsmarket-based rate authority for capacity reassignments on Bonneville’s transmission systemapplies to the pricing of reassignments after October 1, 2010.

RM10-23 Transmission Planning and Cost Allocation by Transmission Owning and OperatingPublic Utilities

On November 12, 2010, the ISO/RTO Council submitted Reply Comments.

The IRC stated:1) the Commission should not expand the potentially eligible public policies to thosedeveloped by bodies other than State or Federal legislative and Executive authorities; and2) the Commission should not require insertion of a new "Independent Evaluator" into theISO/RTO transmission planning process.

Numerous entities submitted reply comments.

RM11-2 Smart Grid Interoperability Standards

On October 7, 2010, FERC issued a Notice of Docket Designation for Smart GridInteroperability Standards.

On October 22, 2010, FERC issued a Notice of Technical Conference, announcing that aconference will be held on November 14, 2010, from 10:30 am to 11:30 am Eastern time inconjunction with the NARUC/FERC Collaborative on Smart Response.

On November 5, 2010, FERC issued a Supplemental Notice of Technical Conference whichincludes an agenda for the meeting.

A technical conference was held on November 14, 2010, to discuss Smart Grid InteroperabilityStandards.

On December 21, 2010, FERC issued a Notice of Technical Conference to be held on January31, 2011.

The purpose of the technical conference is to obtain further information to aid theCommission’s determination of whether there is "sufficient consensus" that the five families ofstandards posted by the National Institute of Standards and Technology and included in thisproceeding are ready for Commission consideration in a rulemaking proceeding, as directed bysection 1305(d) of the Energy Independence and Security Act of 2007.

RR09-7 NERC Three-Year Electric Reliability Organization Performance Assessment Report

RR10-11 NERC Petition for Approval of Revised Pro Forma Delegation Agreement, RevisedDelegation Agreements with the Eight Regional Entities, Amendments to the NERCRules of Procedure, and Amendments to the Bylaws of Several of the Regional Entities

On October 21, 2010, FERC issue an order conditionally approving the revised pro formaDelegation Agreement, the revised Delegation Agreements with the Regional Entities, and theamendments to rules of procedure and certain Regional Entity Bylaws. An effective date ofJanuary 1, 2011 was granted.

NERC must submit a compliance filing by February 18, 2011 in order to address the followingissues:1) Clarify that the Commission and its staff will have full access to information madenon-public under proposed Sections 8(a)(iii), (c)(iv), and (d) of the revised Pro FormaDelegation Agreement (and the revised Delegation Agreements with the Regional Entities thatadopt the relevant portions of proposed Section 8);2) Revise Section 8 of Exhibit E of the Pro Forma Delegation Agreement (and the revisedagreements with the Regional Entities that adopt the relevant portions of proposed Section 8 ofExhibit E) to provide that NERC may review all financial records of the Regional Entities,including records not used to prepare financial statements;3) Submit a plan for timely auditing of the Regional Entities, explaining i) when it will completethe first round of audits; and ii) when it will perform the second round of audits;4) NERC and FRCC to revise Section 5.4 of Exhibit B to include language specifying FRCC’sauthority over the CMEP, as recommended in the FRCC audit report and consistent withFRCC’s concurrence;5) NERC and MRO to clarify Section 18.1 or replace "Member" with "Registered Entity";6) Provide in its compliance filing a further explanation and justification for eliminating theaudit validation requirement, including an explanation of what other tools NERC has that itbelieves are sufficient to monitor the effectiveness of the RegionalEntities’ Compliance Enforcement Programs;7) Revise its language to state, instead, the minimum amount of time the audited RegionalEntity is given to respond after it receives the preaudit questionnaire and informationrequest(s);8) Clarify the meaning of the proposed language in the section entitled "Reporting".

Specifically, it is unclear whether the term "exceptions" relates to problems with the scope ofthe NERC audit or, instead, to failures by the Regional Entity that are identified in the courseof the NERC audit;9) Revise its Spot Checking process so that Regional Entities are required to submit theirspot check reports to NERC in the same manner as they do Compliance Audit Reports.

FERC rejected NERC’s proposal to allow, at the request of the registered entity,representatives of other registered entities to attend the audit for educational purposes. Moreover, NERC and the Regional Entities have other, more appropriate tools at their disposalto educate registered entities without potentially introducing a disruptive element that may, infact, hinder the Regional Entities in the performance of their compliance duties.

On November 22, 2010, Nebraska Public Power District filed an Application for Rehearing ofthe October 21, 2010 Order.

NPPD listed the following issues:1) The Commission erred by failing to adopt standards for reviewing requests to transfer thatare consistent with Section 215 of the F.P.A. Burlington Truck Lines, Inc. v. United States,371 U.S. 156 (1962);2) The Commission erred by failing to provide a reasoned explanation for rejecting NPPD’sargument that the proposed standards are unreasonably biased towards consideration of thefinancial impact of the transfer on the Regional Entity budgets and assessments. NorAm GasTransmission Co. v. FERC, 148 F.3d 1158 (D.C. Cir. 1990); and3) The Commission erred by failing to direct NERC to amend its proposed Rules of Procedureto implement the Commission’s conclusion that registered entities have adequate due processto the extent that they have the right to appeal adverse decisions to the Commission. MotorVehicle Manufacturer’s Ass’n, et al v. State Farm Mutual Automobile Insurance Co., et al.,463 U.S. 29 (1983).

On December 15, 2010, SPP filed its Reply to the Response of Arkansas Electric CooperativeCorporation to Amended Motion for Protective Order. SPP stated that it determines access toconfidential information based on an individual's job functions and not based on the entity he orshe works for, or represents. SPP is in the process of revising its own internal procedures andnon-disclosure agreements to comply with this approach.

On December 16, 2010, the Consumer Utilities Rate Advocacy Division of the ArkansasAttorney General's Office submitted its response to EAI's Motion to Modify ProceduralSchedule, objecting to EAI's request to reduce Staff and Intervenor opportunities to presenttestimony from three rounds to one.

Anderson discussed he believes theCommission should consider if ETI should join an ISO/RTO, and to do that the Commissionmay want to consider authorizing one or more additional studies.

On November 9, 2010, Chairman Smitherman of the Public Utility Commission of Texasissued a memorandum concerning recent developments involving SPP and the selection andfunding of interstate electric transmission projects. Chairman Smitherman proposed the PUCTopen a project to receive comments from interested parties on how the PUCT or SPP rulesshould address his concerns in order to limit the burden on Texas ratepayers.

On November 19, 2010, the PUCT issued a Request for Comments on Transmission Projectsand Costs in the Southwest Power Pool.

Initial comments are due December 20, 2010. Reply comments are due December 28, 2010.

On December 20, 2010, American Electric Power Service Corporation, East TexasCooperatives, Southwestern Public Service Company, and Texas Industrial Energy Consumerssubmitted comments in response to the November 19, 2010 Request for Comments onTransmission Projects and Costs in the Southwest Power Pool.
