Section I Definitions
The following definitions shall apply in the
interpretation and enforcement of these regulations:

Agricultural Waste: Waste rnaterials produced from tho
raising of plants and animals, including animal manures,
bedding , plant star ks , hulls and vegetable matter - Ashes: Residue from burning of wood, coal, coke, or other
combustible materials.
Board of Commissioners: The Nash County Board of
Commissioners
Board of Health: The Nash County Board of Health.
County: The County of Nash.
Division: Solid Waste Management Division of the North
Carolina Department of Environment, Health and Natural
Resources I
Demolition Landfill: A sanitary landfill that is limited
to receiving stumps, concrete, brick, treated wood,
uncontaminated earth or other solid wastes as approved by
the county.
Disposal: The discharge, deposit, injection, dumping
spilling, leaking, or placing of any solid waste into or
on land so that such solid waste or any constituent
thereof may enter the environment or be emitted into the
air or discharged into any water, including ground waters.
Garbage: Al l putrescible solid wastes, including
vegetable matter, animal offal, carcasses of animals and
recognizable j-ndustr ial by-products but excluding human
body wastes and animal manure,
J. Hazardous Waste: A solid waste, or combination of solid
wastes, which because of it’s quantity, concentration,
physical I chemical , or infectious characteristics ( 1 ) may
cause or significantly contribute to an increase in
mortality or an increase serious irreversible or
incapacitating reversible illness or (2) pose a
substantial present or potential hazard to human health or
the environment when properly treated, stored,
transported, or disposed o f , or otherwise managed.
K . Health Director: The Health Director of Nash County or
his/her authorized agent.
L . Incineration: The process of burning solid, semi-solid,
liquid, or gaseous combustible waste to an inoffensive gas
and residue containing little or no combustible material.
M. Infect ious Waste: (1) Equipment, instruments, utensils,
and fomites of a disposable nature from the rooms of
patients who are suspected to have or have been diagnosed
as having communicable disease and must therefore, be
isolated as required b y public health agencies; (2)
laboratory waste, such as pathological specimen (eg., all
tissues , specimens of blood elements , excreta , and
secretions from patients or laboratory animals) and
disposable fomites (any substance that may harbor or
transmit pathogenic organisms) attendant thereto; (3)
surgical operating room pathologic specimens and
disposable fomites attendant thereto, and similar
disposable materials from outpatient areas an emergency
rooms
N. Institutional Solid Waste: Solid wastes generated by
educational, health care, correctional, and other
institutional facilities
0. Person: Any individual, firm, organization, association,
partnership, business , trust, corporation or company
P . Premises: Each single residential dwelling unit housed in
a building used for residential purposes, or mobile home,
or a structure used for residential purposes on any
property. Premise also means each unit contained in any
structure serving a separate owner, tenant, lessee, or
used for any purpose other than residential. Premises is
also property conveyed in a deed.
Q . Refuse: All non-putrescible solid waste. Refuse
consists of both combustible and non-combustible materials
such as paper , cardboard, tin cans, yard clippings, wood,
glass , bedding, crockery , metals, and similar materials
R . Sanitary Landfill: A facility for the disposal of solid
waste on land in a sanitary manner, in accordance with
Article 9 , Chapter 1 3 0 A , North Carolina Administrative
Code I
S. Solid Waste: Any hazardous or non-hazardous garbage,
refuse, or sludge from a waste treatment plant, water
supply treatment plants, or air pollution control
facility , domestic sewage and sludges generated by the
treatment thereof i n sanitary sewage collection, treatment
and d i s p o s a l s y s t e m s , and o t h e r m a t e r i a l t h a t is e i t h e r
d i s c a r d e d or is be ing accumula ted , s t o r e d or t r e a t e d p r i o r
t o be ing d i s c a r d e d , o r has s e r v e d i n i t ’s o r i g i n a l
i n t e n d e d u s e and is g e n e r a l l y d i s c a r d e d , i n c l u d i n g s o l i d ,
l i q u i d , s e m i s o l i d o r c o n t a i n e d gaseous material r e s u l t i n g
from i n d u s t r i a l , i n s t i t u t i o n a l , commercial and
a g r i c u l t u r a l o p e r a t i o n s , and from cornmunity a c t i v i t i e s .
T h e term does no t i n c l u d e : ( a ) f o w l and animal f e c a l waste
( b ) s o l i d o r d i s s o l v e d m a t e r i a l i n ( i ) domest ic sewage and
s l u d g e s g e n e r a t e d by t h e treatment t h e r e o f i n s a n i t a r y
sewage c o l l e c t i o n , t r e a t m e n t , and d i s p o s a l s y s t e m s w h i c h
are des igned t o d i s c h a r g e e f f l u e n t s t o t h e s u r f a c e
waters; ( i i ) i r r i g a t i o n r e t u r n f l o w s ; and ( i i i )
wastewater d i s c h a r g e s and t h e s l u d g e s i n c i d e n t a l t he re to
and g e n e r a t e d by t h e t r e a t m e n t t h e r e o f w h i c h p o i n t
s o u r c e s s u b j e c t t o permits g r a n t e d under S e c t i o n 402 o f
t h e F e d e r a l P o l l u t i o n Con t ro l A c t , a s amended ( P . L . 92-
S O O ) , and p e r m i t s g r a n t e d under G . S . 143-215.1 by t h e
Environmental Management Commission; except t h a t a n y
s l u d g e s t h a t meet t h e c r i t e r i a f o r hazardous waste under
t h e F e d e r a l Resource Conse rva t ion and Recovery A c t (P .L .
94-580) a s amended, s h a l l a l s o be a s o l i d was te f o r t h e
purpose of t h i s a r t i c l e ; or ( c ) o i l s and o t h e r l i q u i d
hydrocarbons c o n t r o l l e d under Art ic le 21A o f Chapter 143
of t h e North C a r o l i n a General S t a t u t e s g except t h a t any
s u c h o i l s o r t h e i r l i q u i d hydrocarbons t h a t meet t h e
c r i t e r i a f o r hazardous waste under t h e F e d e r a l Resource
Conse rva t ion and Recovery A c t ( P . L . 94-580) a s amended,
s h a l l a l s o be a s o l i d waste f o r t h e purpose of t h i s
a r t i c l e ; or ( d ) a n y r a d i o a c t i v e m a t e r i a l a s d e f i n e d by t h e
North C a r o l i n a R a d i a t i o n P r o t e c t i o n A c t , G . S . 104E-1
t h rough 104E-23; or ( e ) m i n i n g refuse covered by t h e North
C a r o l i n a M i n i n g A c t G . S . 74-76 through 74-68 and
r e g u l a t e d under t h e North C a r o l i n a M i n i n g Commission ( a s
d e f i n e d under G . S . 1438-290); e x c e p t t h a t a n y
s p e c i f i c m i n i n g was te t h a t meets t h e c r i t e r i a f o r
hazardous waste under t h e F e d e r a l Resource Conse rva t ion
a n d Recovery A c t ( P . L . 94-580) a s amended, s h a l l a l s o be a
s o l i d was te for t h e purpose o f t h i s a r t i c l e .
T . Radioactive Waste: Any was te w h i c h emits i o n i z i n g
r a d i a t i o n s p o n t a n e o u s l y .
U, Solid Waste Collector: A n y pe r son or f i rm , who c o l l e c t s ,
t r a n s p o r t s o r d i s p o s e s of s o l i d waste f o r p a y , and
t r a n s p o r t s s a i d s o l i d was te t o a n approved d i s p o s a l
f a c i l i t y .
V . Solid Waste Convenience Center: A permanent s t r u c t u r e
w i t h mechanical e q u i p m e n t used f o r t h e c o l l e c t i o n and/or
compaction o f s o l i d waste p r i o r t o t h e t r a n s p o r t i n g o f
s o l i d was te f o r f i n a l d i s p o s a l . I t is a l s o a n a r e a used
by t h e County for- t h e c o l l e c t i o n or r e c y c l a b l e m a t e r i a l s
from county r e s i d e n t s , a s approved by t h e Nash County
Board o f Commissioners , upon recommendation by t h e Nash
C o u n t y Board of W e a l t h .
W . White Goods: Households a p p l i a n c e s i n c l u d i n g , b u t n o t
l i m i t e d t o r e f r i g e r a t o r s , washing m a c h i n e s , water heaters
and c l o t h e s d r y e r s .
X . Yard Waste: Yard t r a s h and l a n d c l e a r i n g d e b r i s a s d e f i n e d
i n G.S. 130A-290, i n c l u d i n g s t u m p s , l e aves , g r a s s and
u n t r e a t e d wood (.
Section I1 Accumulation and Storage o f Solid Waste
A . No owner , o c c u p a n t , t e n a n t , o r lessee of any p u b l i c o r
p r i v a t e premises s h a l l permit t h e accumula t ion upon h i s
premises of any ga rbage r e f u s e , o r s o l i d waste t h a t h a s
been i n c o n t a c t w i t h o r s o i l e d by animal o r v e g e t a b l e
wastes, except upon s u c h p r o p e r t y t h a t is no t s t o r e d o r
d i sposed of i n t h e foll.owing manner.
1. A l l ga rbage s h a l l be s t o r e d i n a c o n t a i n e r t h a t is
d u r a b l e , r u s t r e s i s t a n t , nonabsorbent , w a t e r - t i g h t ,
r o d e n t p r o o f , and e a s i l y c l e a n a b l e w i t h a c l o s e -
f i t t i n g , f l y - t i g h t cover i n place w i t h adequa te
h a n d l e s t o f a c i l i t a t e t h e e a s y removal of ga rbage .
2 . I t s h a l l a l s o be unlawful f o r a n y person t o s t o r e
garbage of a p e r i s h a b l e o r o f f e n s i v e n a t u r e f o r more
t h a n one w e e k i n a n y t y p e of c o n t a i n e r .
B . S o l i d was te and garbage s h a l l no t be d e p o s i t e d , s t o r e d o r
p e r m i t t e d t o a c c u m u l a t e o n a n y p r o p e r t y f o r more t h a n 48
hour s i n s u c h a manner t h a t i t w i l l p rov ide food o r
harborage f o r insects or r o d e n t s , o r c o n s t i t u t e a f i r e OY’
s a f e t y hazard I
1. I t s h a l l be unlawful f o r any occupant of any dwe l l ing
or dwelling unit to place or leave outside of any
dwelling or dwelling unit or leave outside of any
such building any furniture, refrigerator , stoves or
other appliance, machinery, equipment, building
material, o r other item which is either in a wholly
or partially rusted, wrecked, junked, dismantled or
inoperative condition, and which is not completely
enclosed within a building, a privacy fence, or
other means of concealment as deemed satisfactory to
the Health Director. This section shall not apply to
a licensed junk dealer.
2. It shall be unlawful f o r any person to leave outside
of any building or dwelling, in a place accessible to
children, any abandoned, unattended or discarded
refrigerator or any other container of any kind which
has an airtight snap lock or other device thereon
without first removing said snap lock doors from said
refrigerator , or any other container o f any kind
which is crated, strapped, or locked to such an
extent that it is possible for a child to obtain
access to any airtight compartment thereof.
C. A person shall not throw, dump, deposit, or cause to be
thrown, dumped, or deposited solid waste on a street or
highway, upon public parks or recreation areas, or upon
any other public or private property.
0. It shall be unlawful for any person to dispose of garbage
or solid waste in any way other than in a manner approved
by law. Acceptable means of d i s p o s a l by person i n c l u d e
t h e f o l l o w i n g :

E. Where the re is more t h a n one d w e l l i n g l o c a t e d i n a
r e s i d e n t i a l b u i l d i n g o r mobile home p a r k , i t s h a l l be t h e
u l t i m a t e r e s p o n s i b i l i t y o f t h e owner of e a c h b u i l d i n g o r
mobile home p a r k t o ma in ta in proper s t o r a g e and d i s p o s a l
of a l l s o l i d w a s t e .
Section 111 Collection o f Solid Waste and Solid Waste
Permits
A . T h e owner , occupant , t e n a n t , o r lessee of any premises
upon which ga rbage is s t o r e d s h a l l remove, o r cause t o be
removed, a l l ga rbage from s a i d premises a t l e a s t once
I w e e k l y ( s e v e n days 1 .
B . S o l i d waste c o l l e c t o r s s h a l l remove a l l s o l i d waste from
t h e premises, w h e n t h e y receive compensat ion for t h e i r
s e r v i c e s , a t l ea s t once w e e k l y . T h e work s h a l l be done
i n a c l e a n and o r d e r l y m a n n e r , w i t h o u t c a u s i n g damage t o
t h e c o n t a i n e r . Any s o l i d waste t h a t is s p i l l e d s h a l l be
removed, a n d t h e premises l e f t i n a s a n i t a r y manner.
C . No person shall collect, transport, or dispose of
refuse, garbage, or solid waste for pay without a written
permit from the Health Director.
D . The Health Director shall issue such permit only when,
upon inspection, findings demonstrate that the
facilities, equipment and proposed operating methods o f
the applicant are in compliance with the requirements o f
these regulations.
E . The Health Director is authorized and directed to refuse
to issue any permit to collect, transport or dispose of
refuse, garbage or solid waste whenever he finds upon
inspection of the facilities, equipment and proposed
operating methods are not in compliance with the
requirements of these regulations.
F. Vehicles or containers used for the collection and
transporting of any solid waste shall be loaded and moved
in such a manner that the contents will not fall, leak or
spill therefrom, and shall be covered to prevent blowing
of material. If spillage should occur, the material
shall be picked up immediately by the occupant(s) o f the
vehicle and returned to the vehicle OT container and the
area properly cleaned.
G. Permitting o f collection and transporting of solid waste
by a solid waste collector will be on an annual basis.
kl. Permitting o f collection and transporting of solid waste
by a Governmental unit shall be valid as long as they
conform to this regulation I
I . W h e n e v e r , u p o n i n s p e c t i o n of t h e f a c i l i t i e s , e q u i p m e n t or
o p e r a t i n g m e t h o d s o f a n y p e r s o n c o l l e c t i n g , t r a n s p o r t i n g ,
o r d i s p o s i n g of garbage, r e f u s e or s o l i d waste, t h e
H e a l t h Director f i n d s t h a t c o n d i t i o n s or pract ices e x i s t
w h i c h a re i n v i o l a t i o n of t h e p r o v i s i o n s of t h e s e
r e g u l a t i o n s , t h e H e a l t h Director s h a l l g i v e n o t i c e i n
w r i t i n g t o s u c h p e r s o n t h a t u n l e s s s u c h c o n d i t i o n s or
practices are corrected w i t h i n t e n ( 1 0 ) d a y s t h e
o p e r a t i n g p e r m i t of s u c h p e r s o n s h a l l be s u s p e n d e d . A t
t h e e n d of s u c h t e n ( 1 0 ) day p e r i o d t h e H e a l t h Director
s h a l l make a r e i n s p e c t i o n , a n d i f h e f i n d s t h a t s u c h
c o n d i t i o n s or pract ices h a v e n o t b e e n corrected, h e s h a l l
g i v e n o t i c e i n w r i t i n g t o s u c h p e r s o n t h a t h i s p e r m i t h a s
b e e n s u s p e n d e d . Upon receipt of n o t i c e of s u s p e n s i o n ,
s u c h p e r s o n s h a l l immedia t e ly cease t o c o l l e c t ,
t r a n s p o r t , o r d i s p o s e of r e f u s e , garbage or s o l i d waste.
No s u c h p e r m i t s h a l l be r e i n s t a t e d by t h e H e a l t h Director
u n t i l h e f i n d s u p o n r e i n s p e c t i o n t h a t a l l p r o v i s i o n s of
t h e s e r e g u l a t i o n s h a v e b e e n compl ied w i t h , except t h a t
f o l l o w i n g a h e a r i n g a s h e r e i n a f t e r p r o v i d e d s u c h p e r m i t
may be r e i n s t a t e d by t h e C o u n t y B o a r d of H e a l t h .
J . Upon w r i t t e n p e t i t i o n from a p e r s o n w h o s e permit t o
c o l l e c t , t r a n s p o r t or d i s p o s e of r u b b i s h , garbage a n d
s o l i d waste h a s b e e n s u s p e n d e d , t h e C o u n t y B o a r d of
H e a l t h s h a l l h o l d a h e a r i n g a t w h i c h time s u c h p e r s o n
s h a l l be g i v e n a n o p p o r t u n i t y t o show t h a t h i s p e r m i t
s h o u l d n o t h a v e b e e n s u s p e n d e d . N o s u c h h e a r i n g s h a l l be
..
held unless written petition therefore shall have been
filed in the office o f the Health Director to communicate
the request to the Chairman o f the County Board of Health
as soon as practicable. Such hearing shall be held by
the County Board of Health within five (5) working days
following receipt o f such petition by the Chairman.
After such hearing, the County Board of Health may either
revoke or reinstate such permit, depending upon its
finding as to whether these regulations have been
complied with. If no such petition is filed on or before3
the tenth day following the day on which such a permit
was suspended, the permit shall be deemed to have been
automatically revoked.
K . When any person has made application for a permit to
collect, transport and dispose of refuse, garbage or
solid waste and the Health Director has refused to issue
a permit to the applicant, the applicant may file a
written petition for a hearing before the County Board o f
Health. Petition for hearing must be filed with the
Health Director within (10) days after the refusal o f the
Health Director to communicate the request to the
Chairman of the County Board of Health as soon as
practicable. The Board o f Health shall act upon the
petition within ten (10) days of its receipt to grant the
permit, depending upon compliance with these regulations.

Section I V . Disposal Sites
A . T h e d i s p o s a l of s o l i d waste s h a l l be l a w f u l o n l y by t h e
f o l l o w i n g methods as approved by t h e North C a r o l i n a
Department of Environment , H e a l t h and N a t u r a l Resources:
1 . S a n i t a r y L a n d f i l l
2. Demoli t ion L a n d f i l l
3 . I n c i n e r a t i o n
4 . Disposa l by any o t h e r s a n i t a r y method w h i c h may b e
developed a n d demonst ra ted t o be c a p a b l e of f u l f i l l i n g
t h e b a s i c r e q u i r e m e n t s of t h e North C a r o l i n a S o l i d Waste
Management R u l e s , a s amended, w h i c h h a v e been approved by
t h e North C a r o l i n a Department o f Environment , H e a l t h and
N a t u r a l Resources .
B . Any d i s p o s a l f a c i l i t y i n Nash County s h a l l be o p e r a t e d
a c c o r d i n g t o r u l e s and r e g u l a t i o n s f o r s o l i d waste
d i s p o s a l adopted by t h e D i v i s i o n . T h e o p e r a t i o n a l
r e q u i r e m e n t s f o r a d i s p o s a l f a c i l i t y a s adopted by t h e
D i v i s i o n on A p r i l 4, 1990 and r e c o d i f i e d on March 1 , 1991
or a s amended t h e r e t o , are made a p a r t of t h i s o r d i n a n c e
by r e f e r e n c e .
C . A l l p e r s o n s u s i n g a d i s p o s a l f a c i l i t y o p e r a t e d by Nash
County s h a l l a b i d e by t h e r u l e s and r e g u l a t i o n s g o v e r n i n g
i t ’s use and a v i o l a t i o n s f s u c h r u l e s and r e g u l a t i o n s
s h a l l c o n s t i t u t e a v i o l a t i o n o f t h i s o r d i n a n c e .
C). A person u s i n g or a l l o w i n g o thers t o u s e an open dump f o r
d i s p o s a l of s o l i d waste l o c a t e d on h i s / h e r p r o p e r t y is i n
v i o l a t i o n of t h i s o rd inance and must c l o s e t h e s i t e i n
accordance wi t . h 1 5 A NCAC 135 ( “ 0 5 0 2 ) .
E. I n accordance w i t h t h e S o l i d Waste Management Act of 1989
and a s amended, c e r t a i n s p e c i a l waste have been banned
from t h e l a n d f i l l . T h e s p e c i a l waste bans and e f f e c t i v e
d a t e s a r e a s f o l l o w s :
1. Whole T i r e s J u l y 1, 1990
2 , Used Motor O i l October 1 , 1990
3 . W h i t e Goods January 1 , 1991
4.. Lead Acid B a t t e r i e s January 1 , 1991

F. E f f e c t i v e March 26, 1992 i t s h a l l be unlawful t o d i s p o s e
of any load of s o l i d waste c o n t a i n i n g more than t e n ( 1 0 % )
p e r c e n t co r ruga ted cardboard by weight or volume i n t h e
Nash County S a n i t a r y L a n d f i l l .
T h i s ban does n o t apply t o co r ruga ted cardboard t h a t is
proven n o t t o be r e c y c l a b l e . Pe r sons i n v i o l a t i o n of
t h i s ban w i l l be f i n e d i n t h e fo l lowing manner:
1st o f f e n s e - w r i t t e n warning.
2nd o f f e n s e - 2 x t h e r e g u l a r t i p p i n g f e e of t h e e n t i r e
l o a d .
3 r d o f f e n s e - 4 x t h e r e g u l a r t i p p i n g f e e of t h e e n t i r e
l o a d .

G . I t s h a l l be unlawful t o d i s p o s e of i n f e c t i o u s waste a s
d e f i n e d i n t h i s o r d i n a c e a s of J u l y 1 , 1992. S o l i d Waste
Management Rules a s adopted by t h e D i v i s i o n a s amended,
s h a l l govern i n f e c t i o u s was te d i s p o s a l i n t h e county
u n t i l J u n e 30, 1992.
S e c t i o n V U s e o f County Sol id Waste C o n v e n i e n c e C e n t e r s
A . T h e u s e of t h e Nash County S o l i d Waste Convenience
C e n t e r s is r e s t r i c t e d t o household s o l i d waste g e n e r a t e d
i n u n i n c o r p o r a t e d areas of Nash County.
B . T h e t y p e s o f s o l i d waste not a c c e p t e d a t t h e s e c e n t e r s
are:

Section VI1 Use of County Solid Waste Containers
A , The use o f Nash County Solid Waste Containers a r e
restricted to non-commercial, Nash County residential
household solid waste. Only those establishments who
provide container site space may be exempted. Residents
using the county solid waste containers must comply with
the following rules for depositing household solid waste
in these containers.
1. Household solid wastes must be bagged before it is
placed into containers. Boxes and carton must be
flattened so as to occupy the least amount of space.
2. Burning, smoldering or highly flammable material
cannot be placed into containers.
3 . No building material bricks, lumber tree trimmings,
stumps , logs , animal carcasses , animal wastes,
appliances , furniture autos, auto parts , industrial
waste, business wastes, agricultural wastes, and the
like shall be placed in containers. This type
material shall be taken to the county landfill or
otherwise disposed of in accordance with this
Ordinance.
4 . Solid waste will not be dumped on top of containers
or on the ground. Solid waste spilled during dumping
will be immediately picked up and p r o p e r l y placed in
the container.
5 . Scavenging through these containers for recovera.ble
materials is strictly prohibited.
Section V I 1 1 Solid Waste User Fees

Tipping fees at the County Landfill shall be approved by
the Board of Commissioners upon recommendation by the
Board of Health.
Solid Waste Convenience Center user fees (solid
waste fee) shall be approved by the Board o f
Commissioners upon recommendation by the Board o f Health.
No resident of unincorporated areas of the county shall
be exempt from a portion or all of the Convenience Center
User Fee unless he/she pays for the services of a solid
waste collector, as o f January 1 o f each calendar year.
To be exempted from any or a portion of the convenience
center user fee, a county resident must first show
evidence satisfactory to the County that he/she uses the
services of a solid waste collector.
IX Appeals
A . Should any c o n t r o v e r s y a r i s e r e g a r d i n g the d e n i a l or
r e v o c a t i o n of a s o l i d waste pe rmi t r e q u i r e d by t h e s e
r e g u l a t i o n s o r shou ld a c t i o n p e r t a i n i n g t o t h e
enforcement of t h e s e r e g u l a t i o n s seem unwarranted , t h e
pe r son aggr i eved may appea l t o t h e H e a l t h D i r e c t o r of
N a s h County f o r a h e a r i n g . No s u c h h e a r i n g s h a l l be h e l d
u n l e s s a w r i t t e n p e t i t i o n has been f i l e d i n t h e o f f i c e of
t h e H e a l t h D i r e c t o r on or b e f o r e t h e f i f t h ( 5 t h ) day
f o l l o w i n g the a c t i o n o r lack of a c t i o n w h i c h caused t h e
p e t i t i o n e r t o be a g g r i e v e d . T h e w r i t t e n p e t i t i o n
r e q u e s t i n g t h e h e a r i n g m u s t se t o u t t h e g r i e v a n c e or
g r i e v a n c e s of t h e p e t i t i o n e r I W i t h i n f i v e ( 5 ) working

h e a r i n g t o t h e Chairman of t h e Board of Heal th a s soon a s
p r a c t i c a b l e . Such h e a r i n g s h a l l be he ld by t h e Board of
Hea l th w i t h i n s even ( 7 ) days f o l l o w i n g receipt o f s u c h

Ord inance , t h e North C a r o l i n a S o l i d Waste managemen t R u l e s ,
a s s e t f o r t h i n 1 5 A North C a r o l i n a A d m i n i s t r a t i v e Code,
Subchapter 138, a s amended from time t o t i m e , a re hereby
i n c o r p o r a t e d i n t o and made a p a r t of t h i s Ordinance by
r e f e r e n c e . A v i o l a t i o n of t h e s a i d North C a r o l l n a S o l i d
Waste Management R u l e s s h a l l a l s o be a v i o l a t i o n of t h i s
Ordinance .
Section XI Penalties and Remedies

misdemeanor and p u n i s h a b l e by a f i n e not t o exceed f i f t y
($50 ) d o l l a r s o r imprisonment not t o exceed t h i r t y ( 3 0 )

C a r o l i n a , i r r e spec t ive of a l l o t h e r remedies of
enforcement a s provided by law. Each days v i o l a t i o n

B. Not w i t h s t a n d i n g t h e p e n a l t i e s d e s c r i b e d i n S e c t i o n X , ( A )
