8.1 Informational Report on the City’s Draft Multi-Family Residential Objective Design Standards
The Planning Commission will receive a presentation on the City’s draft Multi-Family Residential (MFR) Objective Design Standards (ODS). Senate Bill (SB) 35 requires local jurisdictions to provide a streamlined ministerial approval process for eligible multi-family residential developments, subject to objective zoning and design review standards. In response to the legislation, the City is preparing MFR ODS and companion amendments to the Dublin Municipal Code, which are tentatively for consideration by the Planning Commission and City Council this summer. STAFF RECOMMENDATION: Receive the presentation on the City’s draft Multi-Family Residential Objective Design Standards and provide feedback. Staff Report

EXECUTIVE SUMMARY:
The Planning Commission will consider a Conditional Use Permit to allow a fortunetelling business at 6500 Dublin Boulevard, Suite 200E, within the Dublin Station Shopping Center. The Applicants, Janet Adams and Jennifer Miller of Love Psychic, would provide psychic, palm and tarot card readings.
STAFF RECOMMENDATION:
Conduct the public hearing, deliberate, and adopt the Resolution approving a Conditional Use Permit to allow a fortunetelling business located at 6500 Dublin Boulevard, Suite 200E.
DESCRIPTION:
BackgroundThe proposed fortunetelling business would be located at 6500 Dublin Boulevard on the second floor of a two-story commercial building within the Dublin Station Shopping Center, as shown on the vicinity map (Figure 1). The site has a General Plan land use designation of Retail/Office and Automotive and is located within General Commercial zoning district.
The Applicant is proposing to operate a fortunetelling business in an existing 150-square-foot tenant space. The tenant space, Suite 200E, is part of a larger office suite (Suite 200), that consists of a 1,620-square-foot shared lobby and other individual office suites (Suite 200 A through I). All suites are approximately the same size at 150-square-feet each.
Other uses occupying Suites 200 A through I include office uses such as financial, signage, and software services. The second floor of the building includes office uses such as financial, insurance, consulting, and health services. The first floor of the building and the other one-story building within the shopping center have a variety of commercial uses such as restaurants, a supermarket, a beauty salon, a commercial school, a children’s robotics facility, and retail stores.

Proposed ProjectThe Applicant is proposing to use an existing office space to provide psychic, palm and tarot card readings. The Zoning Ordinance classifies such services under the fortunetelling use type. Fortunetelling businesses and operations are conditionally permitted in the General Commercial zoning district. No interior or exterior modifications to the building are proposed. According to the Applicant, the business would require placement of a desk, two chairs, a shelf and a treatment bed in the tenant space.
AnalysisThe Conditional Use Permit process exists to ensure that the operation of the proposed use is compatible with the surrounding uses. The proposed project has been reviewed for issues related to operating characteristics, security, safety and parking. Conditions of approval have been included in the Planning Commission Resolution where appropriate to ensure compatibility with the surrounding commercial uses (Attachment 1).
Operating CharacteristicsThe proposed fortunetelling business would operate between the hours of 10:00 a.m. to 8:00 p.m. from Monday through Saturday as stated on the written statement (Attachment 2). The services provided would include psychic, palm and tarot card readings. All readings would be conducted in person on a one-on-one basis or over the telephone. As required by Condition of Approval No. 26, no group readings would be offered. Readings are by scheduled appointments or by walk-ins during business hours.
ParkingA fortunetelling business is required to provide one space per 250 square feet of floor area. At 150 square feet, the proposed location would require one parking space. Including Love Psychic, the

existing tenants of the shopping center require a combined total of 194 parking spaces, which includes the 10% reduction in the parking requirement for the shopping center. The 10% reduction was approved in coordination with the widening of Dublin Boulevard. This was also captured in an approved Minor Use Permit for Shared Parking for the Peacock Banquet Hall, an eating and drinking establishment at the shopping center (PLPA-2015-00052). With the 10% reduction, 194 (opposed to 215) parking spaces are required. A total of 211 parking spaces are available on-site, thus, with the addition of the proposed use, a surplus of 17 parking spaces would remain based on the current tenant mix. The site plan is included in Attachment 3.
Fortune Telling PermitIn addition to a Conditional Use Permit, fortunetelling also requires a permit from Dublin Police Services. Pursuant to Chapter 4.08 of the Dublin Municipal Code, an applicant for a fortunetelling permit must first obtain a Conditional Use Permit. As part of the review process for the Conditional Use Permit, the application was reviewed by the Dublin Police Services. Conditions of Approval Nos. 21-28 were provided by Dublin Police Services and have been included to ensure the safety of customers and employees.
Consistency with General Plan, Specific Plans and Zoning OrdinanceThe proposed project is consistent with the General Plan land use designation of Retail/Office and Automotive. The proposed project is located in the General Commercial zoning district, which allows for the operation of a fortunetelling business as a conditional use.
Review by Applicable Departments and AgenciesThe Building and Safety Division, Public Works Department, Fire Prevention Bureau, and Dublin Police Services reviewed the proposed project and conditions of approval are proposed to ensure that the project complies with all local ordinances and regulations.
ENVIRONMENTAL DETERMINATION:
The California Environmental Quality Act (CEQA), together with the State CEQA Guidelines and City of Dublin CEQA Guidelines and Procedures require that certain projects be reviewed for environmental impacts and when applicable, environmental documents be prepared. Staff recommends that the Planning Commission find the project is categorically exempt from the requirements of CEQA in accordance with CEQA Guidelines Section 15301 (Existing Facilities). The project involves no expansion of the existing commercial building and all proposed activities will be within the existing building.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
In accordance with State law, a Public Hearing Notice was mailed to all property owners and occupants within 300 feet of the proposed project. The Public Hearing Notice was also published in the East Bay Times and posted at several locations throughout the City. A copy of this Staff Report was provided to the Applicant and posted to the City’s website.

A RESOLUTION OF THE PLANNING COMMISSIONOF THE CITY OF DUBLIN
RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A FORTUNETELLING BUSINESS LOCATED AT 6500 DUBLIN BOULEVARD, SUITE 200E
WHEREAS, the Applicants, Janet Adams and Jennifer Miller of Love Psychic, are requesting a Conditional Use Permit to operate a fortunetelling business within the Dublin Station Shopping Center located at 6500 Dublin Boulevard, Suite 200E; and
WHEREAS, the project site has a General Plan land use designation of Retail/Office and Automotive and is within the General Commercial zoning district; and
WHEREAS, fortunetelling businesses are subject to the approval of a Conditional Use Permit by the Planning Commission in the General Commercial zoning district; and
WHEREAS, the California Environmental Quality Act (CEQA), together CEQA Guidelines and Dublin’s CEAQ Guidelines and Procedures, require that certain projects be reviewed for environmental impacts and that environmental documents be prepared when applicable; and
WHEREAS, pursuant to CEQA Guidelines, the Conditional Use Permit for fortunetelling iscategorically exempt under Section 15301 (“Existing Facilities”) because the project would occupy an office suite within an existing building; and
WHEREAS, the written statement, attached as Exhibit A and project plans, attached as Exhibit B, depict and illustrate the proposed use, site plan and floor plan; and
WHEREAS, a Staff Report, dated June 8, 2021, was submitted to the City of Dublin Planning Commission recommending approval of the Conditional Use Permit request; and
WHEREAS, the Planning Commission held a public hearing on June 8, 2021, to consider the proposed project at which time all interested parties had the opportunity to be hear; and
WHEREAS, proper notice of said public hearing was given in all respects as required by law; and
WHEREAS, the Planning Commission did hear and use independent judgement andconsidered all said reports, recommendations and testimony herein above set forth to evaluate the project.
NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and made a part of this resolution.
BE IT FURTHER RESOLVED that, pursuant to Dublin Municipal Code section 8.100.060, the Planning Commission of the City of Dublin hereby makes the following findings and determinations regarding the Conditional Use Permit for establishment and operation of a fortunetelling business, located at 6500 Dublin Boulevard, Suite 200E:

A. The proposed use and related structures are compatible with other land uses, transportation and service facilities in the vicinity in that: 1) the project will occupy an office space in an existing commercial building on a fully improved site; 2) the project will be located on a parcel that is developed with general commercial uses, and fortunetelling is permitted with approval of a Conditional Use Permit by the Planning Commission; 3) the existing transportation and services facilities are adequate to serve the proposed use; 4) the project site is accessible from Dublin Boulevard and Dublin Court providing vehicular access; and 5) the number of parking spaces on-site are sufficient to serve both the existing uses and the proposed use within the shopping center.
B. The proposed use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare in that:1) the proposed use will be conducted indoors and entirely within an office of an existing commercial building so as not to disturb surrounding businesses; 2) the project has been conditioned to require that prior to establishing the use, the Applicant shall obtain a Fortunetelling Permit from Dublin Police Services; 3) the project will comply with allapplicable regulations contained in the Dublin Municipal Code and Non-Residential Security Requirements; and 5) conditions of approval are include to ensure on-going compatibility with the site’s surroundings.
C. The proposed use will not be injurious to property or improvements in the neighborhood in that: 1) the project consists of a fortunetelling business within an existing commercial office building; and 2) the use will be conducted indoors and entirely within an office of an existing commercial building so as not to disturb surrounding businesses
D. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare in that: 1) the project will be located on a fully developed site that is served by existing utilities and services; 2) the project will not create a demand for additional utilities or services beyond that which already exists to serve the commercial building; and 3) pedestrian and vehicular access is provided to the site from existing sidewalks on Dublin Boulevard and Dublin Court.
E. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed in that: 1) the proposed use will be located within an existing commercial building with the General Commercial zoning district which permits a fortunetelling business with approval of a Conditional Use Permit; 2) the proposed number of staff, size of the office suite, and scope of services provided will naturally limit the intensity of the use; and 3) conditions of approval have been included to ensure compatibility with the site and surrounding uses.
F. The proposed use will not be contrary to the specific intent clauses, development regulations, or performance standards established for the zoning district in which it is located in that: 1) the project will occupy an office space in an existing commercial building on a fully improved site; 2) fortunetelling is permitted with approval of a Conditional Use Permit by the Planning Commission; and 3) the use will be conducted indoors and entirely within an office of an existing commercial building.
G. It is consistent with the Dublin General Plan and with any applicable Specific Plans in that: 1) the project is consistent with the General Plan land use designation of Retail/

Office and Automotive which allows a range of commercial uses including fortunetelling with approval of a Conditional Use Permit; and 2) the proposed use will be compatible with other commercial uses on the subject property and is allowed in the Retail/Office and Automotive designation such as offices and retail stores.
BE IT FURTHER RESOLVED that the Planning Commission of the City of Dublin hereby approves a Conditional Use Permit for the establishment and operation of a fortunetelling business, located at 6500 Dublin Boulevard, Suite 200E, as indicated and depicted on the written statement dated October 28, 2020, and included as Exhibit A and as shown on the project plans dated October 16, 2020, and included as Exhibit B, subject to the following conditions:

9. Required Permits. 10. Fees. 11. Indemnification. 12. Clarification of Conditions of Approval. In the event that there needs to be clarification to the Conditions of Approval, the Community Development Director and the Public Works Director have the authority to clarify the intent of these Conditions of Approval to the Applicant without going to a public hearing. The Community Development Director and the Public Works Director also have the authority to make minor modifications to these conditions without going to a public hearing in order for the Applicant to fulfill needed improvements or mitigations resulting from impacts to this project.

13. Minor Amendments. Modifications or changes to this Conditional Use Permit approval may be considered and approved by the Community Development Director, if the modifications or changes proposed comply with Section 8.100.080, of the Zoning Ordinance.

14. Property Maintenance. Per the City of Dublin Non-Residential Property Maintenance Ordinance DMC Section 5.64.050, the Applicant and/or Property Owner shall maintain the building, site and all signage in good condition at all times and shall keep the site clear of trash, debris and graffiti vandalism on a regular and continuous basis.

Each set of plans shall have attached an annotated copy of these Conditions of Approval. The notations shall clearly indicate how all Conditions of Approval will or have been complied with. Plans will not be accepted without the annotated resolutions attached to each set of plans. Applicant will be responsible for obtaining the approvals of all participation non-City agencies prior to the issuance of building permits.

EXECUTIVE SUMMARY:
Senate Bill (SB) 35 requires local jurisdictions to provide a streamlined ministerial approval process for eligible multi-family residential developments, subject to objective zoning and design review standards. In response to the legislation, the City is preparing Multi-Family ResidentialObjective Design Standards and companion amendments to the Dublin Municipal Code. The Planning Commission will receive a presentation on the City’s draft Objective Design Standards in preparation for Staff bringing them forward for consideration by the Planning Commission and City Council.
STAFF RECOMMENDATION:
Receive the presentation on the City’s draft Multi-Family Residential Objective Design Standardsand provide feedback.
DESCRIPTION:
Background
Senate Bill 35 (SB 35) provides a streamlined ministerial approval process for multi-family residential developments in cities and counties that have made insufficient progress towardmeeting their assigned Regional Housing Needs Allocation (RHNA). Under SB 35, eligible developments are subject to meeting objective zoning and design review standards. Eligible developments must include a specified level of affordability, be on an infill site, comply with existing residential and mixed-use general plan or zoning provisions, and comply with other requirements such as locational and demolition restrictions.
The legislation defines “objective standards” as standards that involve no personal or subjective judgement by a public official and are uniformly verifiable by reference to an external and uniform benchmark or criterion. For example, an objective standard for a building setback would provide a specific measurable distance that is required, whereas a subjective or discretionary guidelinemight use a term such as a “generous” setback is required.

The State Department of Housing and Community Development (HCD) is responsible for annually determining which cities and counties are subject to SB 35 and for publishing Streamlined Ministerial Approval Process Guidelines. The SB 35 streamlined ministerial process is in effect until January 1, 2026. It is unknown if the State legislature will extend or replace SB 35.
In accordance with HCD’s most recent SB 35 determination (last updated July 2020), the City has made insufficient progress toward meeting our lower-income RHNA (very-low and low-income) and is, therefore, subject to the streamlined ministerial approval process for proposed developments with at least 50% affordability. To date, no applicants have requested the SB 35 streamlined ministerial approval process in Dublin.
In response to the legislation, the City retained RRM Design Group to assist Staff with preparingobjective design standards for multi-family residential developments and companion amendments to the Dublin Municipal Code.
The City’s proposed Multi-Family Residential (MFR) Objective Design Standards (ODS) wouldapply to all new multi-family developments within Dublin. Projects that seek the SB 35 streamlined ministerial approval process would be required to comply with all the ODS. All other projects would be subject to the MFR ODS through the City’s discretionary Site Development Review (SDR) Permit process but could be allowed to deviate from the MFR ODS through the design review process.
Proposed Project
To prepare the City’s draft MFR ODS, Staff and the consultant completed the following steps:
Review Existing Policy Documents. Staff and the consultant reviewed the City’s existing policy documents, including the Bicycle and Pedestrian Master Plan, Downtown Dublin Specific Plan, Dublin Crossing Specific Plan, Dublin Village Historic Area Specific Plan, Eastern Dublin Specific Plan, Scarlett Court Design Guidelines, Site Development Review Guidelines, Streetscape Master Plan, Western Dublin BART Specific Plan, and the Zoning Ordinance.
Driving Tour. Staff and the consultant conducted a driving tour of multi-family residential developments in Dublin to identify successful and unsuccessful elements of projects.
Other Jurisdiction Analysis. Staff and the consultant reviewed example MFR ODS for other jurisdictions and identified topics and sample standards to be covered in the City’s MFR ODS.
Identify Subjective Language in Existing Policy Documents. Subjective design guidelines in existing policy documents were identified and where appropriate, these subjective standards were converted to objective standards that can be incorporated into the ODS.
The draft MFR ODS are proposed to address site planning and building design. The design standards for site planning will cover site layout and building placement; vehicular parking and access; bicycle parking; pedestrian circulation and access; private outdoor space; common usable outdoor space; site lighting; landscaping; and fences and walls. The design standards for building

design will cover building form and massing; roof forms; façade articulation; building and unit entries; fenestration; parking structure design; building lighting; building materials and colors; and accessory structures, equipment, and utilities. The document will also include a glossary of terms.
Staff and the consultant will provide a presentation to introduce the proposed project with examples of the ODS that have been prepared with sample images. Based on feedback from the Planning Commission, the consultant will complete the draft MFR ODS. Once the draft document is complete, the MFR ODS will formally be considered for adoption by the Planning Commission and the City Council.
ENVIRONMENTAL DETERMINATION:
This informational report on the MFR ODSs is not subject to the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378 as the report does not meet the definition of a project.
