Residents have complained about prostitution, drug dealing and otherillegal activity taking place in this area. Residents are concerned about safety of childrencrossing the street due to vehicles speeding excessively in this area. Please look into cleaning out the debris in the overflow brook located on Corbin Avenue betweenthe streets of 10 Acre Road and Elbridge Road. The Corbin Avenue residents have complainedabout the debris which includes broken glass and rusty nails. 2. To the appropriate department or state agency, please look into repairing the retaining wall of theoverflow brook located on Corbin Avenue between 10 Acre Road and Eldridge Road. Theresidents have complained numerous times over the years about the crumbling retaining walls andhave been told they were part of phase 3 for repair. The recent rain storms have caused additionaldamage to the remaining remnants of the rock wall causing dangerous conditions for the residentsand flooding onto their property. Petition

RE: ANTOINETTE CORBIN V. CITY OF NEW BRITAIN, ET AL.

RESOLVED, By the Common Council of the City of New Britain that the sum of THIRTEEN THOUSAND FIVE HUNDRED DOLLARS ($13,500.00) be paid to Antoinette Corbin and Murphy, Laudati, Kiel & Rattigan, LLC, her attorney, in full settlement of the lawsuit against the City of New Britain now pending in the Connecticut Superior Court under Docket No. HHB-CV17-6038486-S.

The Plaintiff alleges she was injured as a result of tripping and falling over an uneven/raised portion of sidewalk in front of the property at 291 Main Street. There was a confirmed problem with the condition of the sidewalk at this location. As a result of this incident, Plaintiff sustained injuries to her right knee consisting of contusions, spraining and patella bursitis which required medical treatment and physical therapy. Plaintiff’s medical bills after treatment total $15,340.27.

This recommendation is made after a pretrial conference with Judge John D. Moore and with the advice and approval of Corporation Counsel Gennaro Bizzarro, Esq.

This suit is to be withdrawn by the Plaintiff without costs to the City of New Britain and settlement was made without admission of any liability.

Open competitive examination No. 1320 for the position of City Attorney was announced once by the Department of Human Resources on October 9, 2017. Only two individuals applied for the position. Both individuals passed the examination and the employment list was certified by the Civil Service Commission on November 9, 2017.

Open competitive examination No. 1298 for the position of Human Resources

Director was announced once by the Department of Human Resources on October 14, 2016. Seven individuals applied for the position, 5 individuals tested for the position and three individuals passed the examination. The employment list was certified by the Civil Service Commission on December 5, 2016.

Open competitive examination No. 1263 for the position of Finance Director was announced twice by the Department of Human Resources on October 7, 2015 and again on or around December 1, 2016. Seven individuals applied for the position, 5 individuals tested for the position and three individuals passed the examination. The employment list was certified by the Civil Service Commission on January 4, 2016.

RE: Report about Trash Container Replacement

Petition 34420 asked for a report about the replacement of roll-out trash containers over a two year period including the number of containers paid for by property owners and paid for by the City’s trash hauler.

For further clarification on this report NBPW oversees the collection of trash and recycling from approximately 14,000 properties primarily ranging from 1 to 6 family residential dwellings, and is charged with the maintainance of over 40,000 trash and recycling containers used as part of the City’s curbside collection process.

The automated rubbish “trash” containers were first issued to residents in 2007, and the automated recycling containers were issued to residents in 2010. Prior to 2007 residents were required to purchase and supply their own trash container, and the automated trash and recycling containers issued to residents were first issued to residents no cost.

Dating back to July of 2016 495 trash containers have been purchased by property owners either due to being lost or damaged, and 45 trash containers have been paid for by the City’s trash and recycling contractor. Public Works does not maintain a database of the individual requests that are made for container replacements or if repeat requests are made.

NBPW does maintain an inventory of repairs that are performed on trash and recycling containers which typically involve wheel and lid replacements, and the majority of repairs are performed at no charge to residents.

Also included with this report are NBPW’s Waste & Recycling Disposal Services and Policies, our Trash Container Replacement form, and the City Ordinance Sec. 11-4 language on containers that states, “When a container is lost or damaged, the occupant of a dwelling unit shall replace the container with a like type of container which shall be purchased from the City’s Department of Public Works”.

Item # 34438-2 RE: PUBLIC PARKING SYSTEM – AUTHORIZATION TO ENTER INTO AN AGREEMENT FOR PARKING METER SERVICES

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, the City of New Britain has an extensive public parking system including the ownership of Parking garages containing approximately 1,920 spaces, 4 surface parking lots containing approximately 100 spaces, and 315 metered parking spaces on City streets; and

WHEREAS, the parking system revenues that the City has historically collected have not offset the operation and maintenance cost of the parking system facilities; and

WHEREAS, Municipal Parking Services, Inc. (MPS) has submitted a proposal to provide parking meter services for a term of five (5) years with an option to extend for an additional five (5) years subject to approval of the terms and conditions for the option period;and

WHEREAS, the agreement will include new parking meters provided, installed, and maintained by Municipal Parking Services, Inc. in return for revenue sharing that shall include 55% for the City and 45% for MPS; and

WHEREAS, the Parking Commission at its meeting on September 11, 2018 approved this agreement subject to approval by the Common Council; and

WHEREAS, Municipal Parking Services, Inc. is a sole source provider of these types of parking meters and is also a prequalified vendor under the National Cooperative Purchasing Alliance; and

NOW, THEREFORE, BE IT RESOLVED, that Erin E. Stewart, Mayor be and is hereby authorized on behalf of the City of New Britain to enter into a Parking Services Agreement with Municipal Parking Services, Inc. and to sign all documents related thereto.

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, the Bureau of Justice Assistance (BJA), has Violent Crime Prevention Grant funding available for police departments through the State Office of Policy and Management, and,

WHEREAS, these funds are to be used to reduce and prevent violent crime, gun violence and gang/group violence, provide support and expansion of community policing strategies, and improve police response to domestic violence, sexual assault crime and response to mentally ill offenders, and,

WHEREAS, this is a one-time grant requiring no cash match, and,

WHEREAS, these funds, in the amount of $21,111, will be used as set forth in the budget listed below, THEREFORE, BE IT

RESOLVED, that Mayor Erin Stewart be granted permission to apply for an OPM Violent Crime Prevention Grant in the sum of $21,111, as follows:

Item # RE: Amendment to Chapter 2 regarding duties of Clerk of Common Council

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

Resolution Summary: INTENT AND PURPOSE: To eliminate a requirement for the Council clerk to provide copies of certain Council proceedings to departments. All of these documents are readily available on-line making these additional duties redundant and unnecessary.

BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF NEW BRITAIN that SECTION 2-360 of CHAPTER 2 of the Code of Ordinances, City of New Britain be amended to read as follows (inserted text appears in underline; deleted text appears in strikethrough; new sections begin with the word [new]):

SEC. 2-360. – DUTIES OF THE CLERK OF THE COMMON COUNCIL.

(a) The town and city clerk, as clerk of the common council, shall take all minutes (proceedings) of the common council and submit such minutes at the next month's meeting for approval.

(b) The clerk shall record and attest by signature the common council doings by sending immediately after enactment and for approval in writing by the mayor, a copy of any ordinance, resolution, report or other order of the common council to each department or office affected thereby.

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, in accordance with City Code of Ordinances, Chapter 2, Article VIII, Division 1, Section 2-538 (a), a purchase order was requested for the following under the State of Massachusetts Cooperative Purchasing Plan for the New Britain Fire Department:

WHEREAS, The Fire Department hired eight (8) new probationary firefighters who will be required to wear the Personal Protective Coats and Pants during interior firefighting operations; and

WHEREAS, The Protective Coats and Pants meet the latest national standards aspromulgated by the National Fire Protection Association (NFPA) and the Occupational Safety and Health Administration (OSHA); and

WHEREAS, Funding of $5,851.00 is available for this purchase in the New Britain Fire Department’s account number 0041200114-57023, Capital Equipment, Fire Administration, Personal Protective Equipment and the remainder of the funding of $15,513.08 is available in the Fire Department’s account number 001212002-5659, Fire Operations, Operating Materials and Supplies; and

NOW, THEREFORE, BE IT RESOLVED that the Purchasing Agent is hereby authorized to issue a purchase order for the purchase of eight (8) Protective Coats and Pants for a total cost of $ 21,364.08 to C & S Specialty, Inc. of North Smithfield, RI utilizing the State of Massachusetts Contract award # FIR04.

Item # Re: Extended Easement onto Public Works Department, Utilities Division’s Property with O&G Industries, Inc.

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

WHEREAS, The extension of an easement that will allow O&G Industries, Inc. to access its property in exchange for a payment of $2,500.00 per year for a period of ten (10) years with two (2) five (5) year options; and

WHEREAS, The Original easement was first granted by the CITY in 1998 to allow O&G Industries, Inc. to remove sand and gravel from the New Britain Public Works Department, Utilities Division’s property as well as access their owned property located on Covey Road in Burlington, Connecticut; and

WHEREAS, O&G Industries, Inc. will be responsible of any road maintenance and construction needed for access to their property; and

WHEREAS, The New Britain Board of Water Commissioners at their October 17, 2018 meeting has approved the agreement to extend the existing easement granted to O&G Industries, Inc. to provide access to their owned sand and gravel pit for a period of ten (10) years with two (2) five (5) year options with payments of $2,500.00 per year being submitted to the Public Works Department, Utilities Division; and

NOW, THEREFORE, BE IT RESOLVED, That the Purchasing Agent be and is hereby authorized to enter into a ten (10) year agreement with the option for two (2) five (5) year additional periods at a price of $2,500.00 per year with O&G Industries, Inc. to allow them access onto the Public Works Department, Utilities Division’s property.

Item # RE: Engineering Assignment for Overlook Avenue Drainage Study

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

Whereas, the area of Overlook Avenue experienced flooding during a recent storm event in early October of 2018 and residents have complained that there has been a history of flooding at this same location; and

Whereas, a petition was received at the October 24, 2018 New Britain Common Council meeting requesting an investigation of the drainage issues on Overlook Avenue and to provide a report regarding the investigation; and

Whereas, the Department of Public Works is soliciting proposals from qualified Engineering Consultants, who specialize in drainage design, to submit pricing for a Drainage Study in the area of Overlook Avenue in order to determine if there are any deficiencies in the existing drainage system and to provide estimates for upgrading said deficiencies; and

Whereas, the Public Works Department Engineering Division will assist the selected consultant by providing existing mapping and data in order to reduce the cost of the Drainage Study; and

Whereas, the Public Works Department seeks to engage a qualified consultant to perform the Overlook Avenue Drainage Study as requested in the November 1, 2018 Engineering Assignment for a fee not to exceed $30,000; and

Whereas, funding for this work is available in the Public Works Department Storm Water Bond account number 0082748802-5453; and

Therefore, be it Resolved that the Common Council Authorizes the Public Works Department to retain the services of a qualified Engineering Consultant for the Overlook Avenue Drainage Study and the Purchasing Agent to issue a purchase order in an amount not to exceed $30,000 for the Overlook Avenue Drainage Study.

Item # RE: LEASING OF 150 PARKING SPACES – SZCZESNY PARKING GARAGE

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned begs leave to recommend the adoption of the following:

TO AUTHORIZE THE CITY OF NEW BRITAIN TO ENTER INTO A LEASEAGREEMENT WITH COMMUNITY MENTAL HEALTH AFFILIATES, INC. TO LEASEONE HUNDRED FIFTY (150) UNASSIGNED PARKING SPACES IN THE FIRST SERGEANT HENRY J. SZCZESNY PARKING GARAGE AT A MONTHLY RATE OF $40.00 PER VEHICLE.

WHEREAS, Community Mental Health Affiliates, Inc. has requested to lease one hundred fifty (150) unassigned parking spaces in the First Sergeant Henry J. Szczesny Parking Garage for a period of three( 3) years from December 15, 2018 to December 14, 2021 at a rate of Forty Dollars ($40.00) per vehicle per month payable in advancewith the understanding that Lessee will be responsible for payment for 100 vehicles per month starting on December 15, 2018 and 150 vehicles per month starting on May 15, 2019; and

WHEREAS, The Parking Commission met on October 23, 2018 and approved said terms regarding one hundred fifty vehicles at a rate of $40.00 per vehicle per month; now, therefore, be it

RESOLVED, that the City of New Britain is hereby authorized to enter into a Lease Agreement with COMMUNITY MENTAL HEALTH AFFILIATES, INC. to lease one hundred fifty (150) unassigned parking spaces in the First Sergeant Henry J. Szczesny Parking Garage for the rate of $40.00 per month per vehicle for a three (3) year termfrom December 15, 2018 through December 14, 2021 with the understanding that Lessee will be responsible for payment for 100 vehicles per month starting on December 15, 2018 and 150 vehicles per month starting on May 15, 2019; and

BE IT FURTHER RESOLVED THAT THE LEASE MAY BE RENEWED for an additional term of two years subject to mutual agreement of the terms and conditions by the parties; and

BE IT FURTHER RESOLVED THAT ERIN E. STEWART, MAYOR is authorized to sign said Lease Agreement and any documents related thereto.

Item # RE: Lease on roof of Badolato Parking Garage

To Her Honor, the Mayor, and the Common Council of the City of New Britain:the undersigned beg leave to recommend the adoption of the following:

Resolution Summary: INTENT AND PURPOSE: To renew the antenna/cell towerlease on the roof of the Badolato Parking Garage for a term of twenty (20) years.

WHEREAS, the City of New Britain and SNET Springwich, Inc. entered into a Lease Agreement for cellular panel space on the roof of the Badolato Parking Garage for the term March 1, 1995 through February 29, 2020 pursuant to Resolution No. 21891; and

WHEREAS, the lease was subsequently assigned by SNET Springwich, Inc. to New Cingular Wireless PCS, LLC; and

WHEREAS, New Cingular Wireless PCS, LLC has expressed an interest in entering into a new twenty (20) year lease subject to approval of the Common Counciland effective on February 1, 2019 instead of March 1, 2020; and

WHEREAS, the current yearly rent is $21,000.00 and the parties, subject to Common Council approval, have negotiated the following rental amounts for the twenty (20) year term:

$25,800.00 for the first five years;$28,380.00 for the second five years;$31,218.00 for the third five years; and$34,339.80 for the final five years; and

WHEREAS, the proposed lease is in the best economic interests of the City of New Britain; now therefore be it

RESOLVED, by the Common Council that Erin E. Stewart, Mayor, be and is authorized to enter into a Lease Agreement for a term of twenty (20) years from February 1, 2019 through January 31, 2039 with New Cingular Wireless PCS, LLC and to sign any documents related thereto.
