का. अ. 3724(ऄ).—केन्द्रीय सरकार को लोकजहत में यह अवश्यक प्रतीत होता ह ै दक ईत्तर प्रदेि राज्य में

टूण्डला टर्ममनल से कानपरु टर्ममनल तक पेरोजलयम ईत्पादों के पररवहन के जलय ेआंजडयन ऑयल कापोरेिन जलजमटेड द्वारा

पाआपलाआन जबछाइ जानी चाजहए।

और केन्द्रीय सरकार को ऐसी पाआपलाआन जबछाने के प्रयोजन के जलय ेयह अवश्यक प्रतीत होता ह ैदक ऐसी भूजम

में जो आससे ईपाबद्ध ऄनुसूची में वर्मणत ह,ै और जजसमें ईक्त पाआपलाआन जबछाइ जान ेका प्रस्ट्ताव ह,ै ईपयोग के ऄजधकार

का ऄजजन दकया जाए ।

ऄतः ऄब, केन्द्रीय सरकार, पेरोजलयम और खजनज पाआपलाआन (भूजम में ईपयोग के ऄजधकार का ऄजजन)

ऄजधजनयम, 1962 (1962 का 50) की धारा 3 की ईपधारा (1) द्वारा प्रदत्त िजक्तयों का प्रयोग करत ेहुए ईस भूजम में

ईपयोग के ऄजधकार का ऄजजन करने के ऄपने अिय की घोषणा करती ह ै।

कोइ व्यजक्त, जो ईक्त ऄनुसूची में वर्मणत भूजम में जहतबद्ध ह ै , ईस तारीख से, जजसको आस ऄजधसूचना में यकु्त

भारत के राजपत्र की प्रजतयााँ साधारण जनता को ईपलब्ध करा दी जाती हैं, आक्कीस ददन के भीतर, भूजम के नीचे पाआपलाआन

जबछाए जाने के जलए ईसमें ईपयोग के ऄजधकार के संबंध में सक्षम प्राजधकारी, आंजडयन ऑयल कापोरेिन जलजमटेड

पाआपलाआन्द्स प्रभाग, जनमाजण कायाजलय, ईत्तरी के्षत्र पाआपलाआन्द्स, टूण्डला - गौररया पाआपलाआन पररयोजना,इ-160, प्रथम

NOTIFICATION

New Delhi, the 20th October, 2020

S.O. 3724(E).—Whereas, it appears to the Central Government that it is necessary in the public interest that

for the transportation of petroleum products from Tundla Terminal to Kanpur Terminal should be laid by Indian Oil

Corporation Limited. And whereas, it appears to the Central Government that for the purpose of laying the said

pipeline, it is necessary to acquire the right of user in the land described in the Schedule annexed to this notification;

Now, therefore, in exercise of the powers conferred by Sub-section (1) of section 3 of the Petroleum and

Minerals Pipelines (Acquisition of Right of User in land ) Act, 1962 (50 of 1962), the Central Government hereby

declares its intention to acquire the right of user therein;

Any person interested in the land described in the said Schedule may, within twenty–one days from the date

on which the copies of this notification, as published in the Gazette of India, are made available to the General Public,

object in writing to the acquisition of the right of user therein or laying of the pipeline under the land to Competent

Authority, Indian Oil Corporation Limited ( Pipelines Division), Construction Office, Northern Region Pipelines,

Tundla-Gawria Pipeline Project, E-160,1st & 2nd floor, Kamlanagar, Agra (U.P.) – 282 004.

(1) के ऄधीन जारी की गयी भारत सरकार के पेरोजलयम और प्राकृजतक गैस मंत्रालय की ऄजधसूचना सं. का.अ. 17,

तारीख 28 ददसम्बर 2018, जो भारत के राजपत्र संख्या 01 भाग II, खण्ड 3, ईप-खण्ड (ii) तारीख 05 जनवरी 2019, में

प्रकाजित की गयी थी, ततपश्चात संिोधन ऄजधसूचना का.अ. 324(ऄ), तारीख 17 जनवरी 2020, जो भारत के राजपत्र

[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3

संख्या 308 भाग II, खण्ड 3, ईप-खण्ड (ii) तारीख 24 जनवरी 2020, में प्रकाजित की गयी थी, द्वारा ईस ऄजधसूचना से

संलग्न ऄनुसूची में जवजनर्ददष्ट भूजम में ईत्तर प्रदेि राज्य में टूण्डला टर्ममनल से कानपरु टर्ममनल तक पेरोजलयम ईत्पादों के

पररवहन के जलय ेआंजडयन ऑयल कापोरेिन जलजमटेड द्वारा पाआपलाआन जबछाने के प्रायोजन के जलये ईपयोग के ऄजधकार के

ऄजजन करने के जलए ऄपने अिय की घोषणा की थी।

और ईक्त राजपत्र ऄजधसूचना की प्रजतयां जनता को ईपलब्ध करा दी गयी थीं। और ईक्त ऄजधजनयम की धारा 6

की ईपधारा(1) के ऄनुसरण में सक्षम प्राजधकारी न ेकें न्द्रीय सरकार को ऄपनी ररपोटज दे दी ह।ै

और कें रीय सरकार न,े ईक्त ररपोटज पर जवचार करन े के पश्चात और यह समाधान हो जाने पर दक ईक्त भूजम

पाआपलाआन जबछाने के जलय ेऄपेजक्षत ह,ै ईसमें ईपयोग के ऄजधकार का ऄजजन करने का जवजनश्चय दकया ह।ै

ऄत: ऄब कें रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईपधारा (1) द्वारा प्रदत्त िजक्तयों का प्रयोग करत ेहुये

एतद् द्वारा घोषणा करती ह ैदक आस ऄजधसूचना से संलग्न ऄनुसचूी में जवजनर्ददष्ट भूजम में पाआपलाआन जबछाने के जलय ेईपयोग

के ऄजधकार का ऄजजन दकया जाये।

और कें रीय सरकार ईक्त ऄजधजनयम की धारा 6 की ईप-धारा (4) द्वारा प्रदत्त िजक्तयों का प्रयोग करत ेहुए, यह

जनदेि देती ह ैदक ईक्त भूजम में ईपयोग का ऄजधकार आस घोषणा के प्रकािन की तारीख से कें रीय सरकार में जनजहत होन ेके

बजाय, सभी जवल्लगंमों से मकु्त होकर आंजडयन ऑयल कापोरेिन जलजमटेड में जनजहत होगी।

पेरोजलयम और खजनज पाआपलाआन ऄजधजनयम, 1962 की धारा 10 के ऄधीन दकसी भी क्षजतपरू्मत के जलये आंजडयन

ऑयल कापोरेिन जलजमटेड पणूजतया ईत्तरदायी होगी और पाआपलाआन से सम्बंजधत दकसी भी मामले पर कें रीय सरकार के

जवरुद्ध कोइ वाद दावा या काननूी कायजवाही नहीं हो सकेगी ।

NOTIFICATION


S.O. 3725(E).—Whereas, by the notification of the Government of India in the Ministry of Petroleum and

Natural Gas, published in the Gazette of India No. 01 part II, Section 3, Sub-section(ii) dated the 05th January 2019,

vide S.O No. 17, dated the 28th December 2018, issued under sub-section (1) of section 3 of the Petroleum and

Minerals Pipelines (Acquisition of Right of User in Land ) Act, 1962 (50 of 1962) (hereinafter referred to as the said

Act), and subsequent amendment published in The Gazette of India No. 308 part II, Section 3, Sub section(ii) dated

the 24th January 2020, vide S.O No. 324(E), dated 17th January 2020. The Central Government declared its intention

to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying

pipeline from Tundla Terminal to Kanpur Terminal in the state of Uttar Pradesh by Indian Oil Corporation Limited for

the transportation of petroleum products.

And whereas copies of said Gazette notification were made available to the public; and whereas the

Competent Authority has under sub-section (1) of section 6 of the said act, has submitted report to the Central

Government.

And whereas the Central Government, after considering the said report and on being satisfied that the said

land is required for laying the pipeline, has decided to acquire right of user therein.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the

Central Government hereby declares that the right of user in the land specified in the Schedule appended to this

notification is hereby acquired for laying the pipeline.


And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central

Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the

Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation limited, free from all

encumbrances.

Indian Oil Corporation limited shall be exclusively liable for any compensation in terms of section 10 of the

P&MP Act, 1962 and no suit, claim or legal proceedings would lie against the Central Government on any matter

relating to the pipeline.
