Where is Reconstitution in statute?

Title 19 TAC §97.1064

(a)After a campus has been identified as Improvement Required for two consecutive school years, the commissioner shall order the reconstitution of the campus and the campus intervention team (CIT) will continue to be assigned.(1) Reconstitution is planned in the second year and with the assistance of the district and CIT the campus shall open the subsequent year as a reconstituted campus regardless of the state academic accountability rating.

(a-1) In reconstituting a campus, a campus intervention team (CIT) shall assist the campus in:

(1) developing an updated targeted improvement plan;(2) submitting the updated targeted improvement plan to the board of trustees of the school district for approval and presenting the plan in a public hearing as provided by Section 39.106(e-1);(3) obtaining approval of the updated plan from the commissioner; and(4) executing the plan on approval by the commissioner.

(b) The campus intervention team shall decide which educators may be retained at that campus.

•A principal who has been employed by the campus in that capacity during the full period described by Subsection (a) may not be retained at that campus unless the campus intervention team determines that retention of the principal would be more beneficial to the student achievement and campus stability than removal.

(b-1) A teacher of a subject assessed by an assessment instrument under Section 39.023 may be retained only if

• the campus intervention team determines that a pattern exists of significant academic improvement by students taught by the teacher. This should be documented with the use of student performance data.

•If an educator is not retained, he/she may be assigned to another position in the district.

What does this look like in practice?

2. Evaluate staff effectiveness and make determinations based on data

3. Follow district policies and timelines for reassignment

4. To the extent possible, make staffing determinations by the end of January

Frequently Asked Question:Is there a targeted improvement plan AND a Reconstitution Plan?YES, the targeted improvement plan addresses the areas of low performance identified in the state accountability reports, data analysis and needs assessment. The Reconstitution Plan focuses on permanent change in the design and structure of the campus.

Critical interventions may be addressed in both plans to maximize short and long term impact.

(c) A campus subject to Subsection (a) shall implement the updated targeted improvement plan as approved by the commissioner. If the commissioner determines the campus is not fully implementing the targeted improvement plan, the commissioner may order repurposing of the campus, alternative management, or closure of the campus. In addition, the commissioner may appoint a monitor, conservator, management team, or board of managers to the district to ensure and oversee district-level support to low-performing campuses and the implementation of the updated targeted improvement plan.

Reconstitution (A) The removal or reassignment of some or all campus administrative and/or instructional personnel …taking into consideration proactive measures the district or campus has taken regarding campus personnel; and

(B) the implementation of a campus redesign, approved by the commissioner of education, that:

(i) provides a rigorous and relevant academic program;(ii) provides personal attention and guidance;(iii) promotes high expectations for all students; and

(iv) addresses comprehensive school-wide improvements that cover all aspects of a school's operations, including, but not limited to, •curriculum and instruction changes, •structural and managerial innovations, •sustained professional development, •financial commitment, and •enhanced involvement of parents and the community.

What does this look like in practice?

1. Articulate in the Reconstitution plan the measures that are already in place or are planned

2. Indicate data to support what is working and what needs to be improved

Do all of the definitions and elements in statute for Reconstitutionneed to be addressed in the plan?

YES…but you can include measures already taken that are deemed effective based on data.

The Reconstitution Plan should result in improved systems and comprehensive school-wide improvements that cover all aspects of a school's operations.

What is the timeline for Reconstitution? 19

TAC§97.1064

(1) A campus ordered to reconstitute shall use the school year in which its second identification occurs to plan the reconstitution, with the assistance of the district and CIT, and shall open the subsequent school year as a reconstituted campus regardless of the state academic accountability rating assigned to the campus in that school year.

February 10 Submission: Updated Reconstitution Plan thatincludes staffing determinations and the Principal Retention Framework

July 10 Submission: Final board approved Reconstitution Plan submitted to TEA for agency approval

2015-2016- Implement the Reconstitution Plan and open as a Reconstituted campus when school begins

What is the role of the LEA? 19 TAC§97.1064 •b) The district is responsible for the successful reconstitution and subsequent performance of its campus. The CIT shall assist the reconstituting campus…

•(d) In combination with action under this section, the commissioner may impose on the district or campus any other sanction under TEC, Chapter 39, or this subchapter, singly or in combination, to the extent the commissioner determines is reasonably required to achieve the purposes specified in 19§97.1053 of this title.
